Minutes of the Regular Meeting of the Village of Apple Valley Council held on
February 26, 1969 at 7:30 p.m.
PRESENT: Mayor Largen
Councilmen: Garrison, Branning, and Hollenbeck
Clerk C. Strunk
ABSENT: Pearsall
Mayor Largen called the meeting to order. All attending took part in the Pledge
of Allegiance to the Flag.
Pastor Charles Rehman of the Berean Baptist Church presented the invocation for
the meeting.
MOTION of Hollenbeck, seconded by Branning, to accept the minutes of the meetings
of February 13, 1969, held at 3:00 p.m. and 7:30 p.m., as revised and submitted to
the Council. Motion duly carried.
Mayor Largen called the Public Hearing pertaining to the revision of the prelim-
inary plan of Cedar Knolls Development to order. The hearing was turned over to the
Village Planner, John Voss.
Mr. Voss presented and clarified the map showing the change in the boundary lines
of the Cedar Knolls townhouse development area. It was noted the boundary revision
meets with the approval and recommendation of the Planning Commission.
Mayor Largen declared the hearing on the revision of the preliminary plan of
Cedar Knolls Development closed at 7:40 p.m.
PublichHearing on the Rezoning of the aforementioned area was called to order.
Engineer Bob Rosene noted the rezoning of the area from B 1-C to R 3-C covers
the rezoning of the properties within the boundary revision. Also the rezoning meets
with the unanimous approval of the Planning Commission.
Mayor Largen declared the Hearing on the Rezoning closed at 7:50 p.m.
Public Hearing on the Amendment to Ordinance ~k22 - Section 11.2 and 21.15, governing
townhouses for rent or sale by a Conditional Use Permit and placement of utilities
underground.
MOTION of Hollenbeck, seconded by Branning, to approve as submitted the Amendment
of Ordinance ~~22. Said Amendment to be known as Ordinance ~k56. Motion duly carried.
Public Hearing on ®rdffinance ~k56 was declared closed.
Public Hearing on the Proposed Conditional Use Peemit under the newly adopted
ordinance for the townhouse area of Cedar Knolls Development was called to order.
Discussion was held with the developer and village planner, covering plans and
requirements for townhouse developments.
It was the unanimous agreement of the Planning Commission and Council to continue
the hearing on the Conditional Use Permit to the March 26th meeting.

Public Hearing on the Scott Highlands 4th Addition rezoning change was called
to order. Said rezoning covering an area adjoining the Emma Scott residence to be
rezoned from R 1-C to R 3-C for multiple dwellings. Planning Commission approval of
said rezoning containing the stipulation of no access directly to the major thorough-
fare.
There being no further discussion, the hearing was declared closed at 8:10 p.m.
Discussion was held on the establishment of a policy concerning the assessing
of street improvements to adjoining property owners.
MOTION of Garrison, seconded by Hollenbeck, the street assessment policy be
referred to the Planning Commission, Planner and Engineer for further study at their
meeting of next week; requesting a recommendation be brought back to the Council for
the March 12th meeting. Motion duly carried.
Engineer Bob Rosene informed the Council the contractor of the North Apple Valley
sewer area is bringing in a blade this next week for street problems of that area.
MOTION OF Garrison, seconded by Branning, setting a maximum cost of $65,000 to
be bonded for without referendum and adquisition of the 38 acres in the previously
passed bill. Motion duly carried.
MOTION of Hollenbeck, seconded by Garrison, to grant a Conditional Use Permit
to LeRoy Visnovec to build a horse barn structure as requested, and accordffi~g to
conditions as set out by the Planning Commission. Motion duly carried.
Dick Edwards of the Urban Affairs Committee presented a draft of an ordinance
regulating licensing and conducting dances in the Village.
MOTION of Branning, seconded by Garrison, ordering a Public Hearing of the Dance
Ordinance to be held on March 26th at 7:30 p.m. at the Village Hall. Motion amended
by Branning to include a hearing on the proposed youth teen-dance center at Eaton's
Ranch. Motion duly carried.
Mr. Emmet Carroll, at the request of the Council, presented a report on the tax
situation on agricultural properties in the Village of Apple Valley, noting the
extensive rise in taxes this year.
Mr. Erwin Ulrich, Chairman of the Planning Commission submitted a proposal regarding
the tax problems which have developed for the rural or open-space ~~~d owners.
MOTION of Largen, seconded by Branning, to move that the Village Council go on
record as supporting the resolution as passed by the League of Municipalities of Dakota
County, and further that we submit this material with a statement from Emmet Carroll
and that these be mailed to the 8overnor, all Senators, and all Legislators; and that
the Council go on record as recognizing the confiscatory nature per that resolution;
and submit this for the consideration of the Legislature; and that these be mailed
individually to each legislator. The office staff be instructed to make copies of the
aforementioned reports for mailing. Motion duly carried.
Discussion was held on the completion of County Road 31.
MOTION of Hollenbeck, seconded by Garrison, to advise the County in the March 11th
meeting that the Council is now interested in the completion of County Road 40 and to
move County Road 31 down on the priority list; and that they use the money set aside for
County Road 31 for the rough grading of County Road 40 through the Greenleaf area.
Also that we exchange County 40 South for the area through the Greenleaf Addition.

MOTION of Branning, seconded by Hollenbeck, authorizing Engineer Gabiou to
use the Village Hall for the Public Meeting as required for County Road 31,
checking with the Clerk to set the date. Motion duly carried.
Discussion was held:
1. on the March 7th Public Informational Meeting
2. Bus Service for the areas of Burnsville, Eagan and Apple Valley
3. Appointment to the Park Commission
MOTION of Branning, seconded by Hollenbeck, appointing to the Park Commission:

MOTION of Hollenbeck, seconded by Garrison, to pay the bills - list hereto
attached. Motion duly carried.
MOTION of Garrison, seconded by Branning, whereas a Salary Ordinance has been
passed, and duly published and opportunity has been given for call for referendum;
be it therefore resolved that the salaries be established in accordance with the
attached resolution. Motion duly carried.
MOTION of Hollenbeck, seconded by Branning, to adjourn this meeting at 11:30 p.m.
VILLAGE OF APPLE VALLEY
Dakota County, Minnesota
Minutes of the Special Meeting held on March 12, 1969 at 3:00 p.m., to
receive sealed bids for the Modification of the Deep Well Pump and Pumphouse
for the Palomino Development Area.
PRESENT: Engineer Bob Frigaard of Bonestroo d Rosene, Village Engineers
Clerk Cecelia Strunk
Engineer Frigaard duly opened and read aloud the following bids as received:
Bergeson-Caswell, Inc. $37,972.00
Keys Well Drilling Co. $39,792.00
Layne-Minnesota Co. $38,976.00
E. H. Renner d. Sons, Inc. $40,140.00
The engineer informed all attend~mg contractors the bids would be awarded
~ upon calculation of the bids by the engineers at the Village meeting this
evening.
