HomeMy WebLinkAbout1969/03/26 VILLAGE OF APPLE VALLEY Dakota County, Minnesota Minutes of the meeting of the Village of Apple Valley Council held on March 26, 1969 at 7:30 p.m. PRESENT: Mayor Largen Councilmen: Pearsall, Garrison, Branning and Hollenbeck Clerk Cecelia Strunk Mayor Largen called the meeting to order. All attending participated in the Pledge of Allegiance to the Flag. Pastor Walter Lietze of the Christus Victor Lutheran Church presented the invocation of the meeting. MOTION of Hollenbeck, seconded by Pearsall, to approve the minutes of the meeting of March 12, 1969 held at 3:00 p.m. to received bids on the Modification of the Palomino Hills Water Pump and Pumphouse; as well as the minutes of the Regular Meeting of the Village Council held on March 12, at 7:30 p.m. Said minutes approved as presented. Motion duly carried. MOTION of Garrison, seconded by Hollenbeck, to continue further the Public Hearing on the Conditional Use Permit for townhouses in Cedar Knolls Development, to the meeting of April 9, 1969. Motion duly carried, PUBLIC hearing for the Dance Ordinance as advertised, was called to order by the Mayor. Mr. Don Adamson of the Urban Affairs Committee reviewed for the attending residents the Ordinance to Regulate the Licensing and Manner of Conducting Dances in the Village of Apple Valley. Noting permits covering the various types of dances are issued at the discretion of -the Council. Mayor Largen declared the hearing-closed at 7:55 p.m. MOTION of Pearsall, seconded by Hollenbeck, to enact the Ordinance No. 59 regulating and licensing dances as a law of the Village of Apple Valley. Motion duly carried. PUBLIC hearing on the Proposed Teen Center for Eaton's Ranch was called to order by Mayor Largen at 8:00 p.m. Noting this is not actually a hearing on the permit for the center - only the opportunity of the Council and committees to reflect with the citizens on this proposal. No action to be taken at this meeting. Mr. Gary Jorgensen, representative of Magoo's from Minneapolis and Art Eaton of Eaton's Ranch, presented material on the proposed teen center to be called "Snoopy's"; and some background on the dance operations Mr. Jorgensen now operates in Minneapolis. Mr. Bob Shoop of the Youth Committee presented a report on the Magoo Dance Center and their study as prepared by Bob, Leo Finley, and Paul Rice of the committee. Residents of Palomino Hills and adjoining areas presented their viewpoints on the proposed dance center. Mayor Largen noted the Eaton's Ranch is presently zoned Commercial. The hearing was declared closed at 9:20 p.m. Councilman Branning was temporarily absent from the meeting. VILLAGE OF APPLE VALLEY Minutes of the meting of March 26, 1969 Page 2 Engineer Bob Rosene presented material on the completion of the Street Improve- ments for Apple Valley North of County Road 42. MOTION of Hollenbeck, seconded by Garrison, approving the plans and specifications for the completion of the street construction; also authorizing the advertising for bids to be received at the Apple Valley Village Hall on April 16, 1969 at 3:00 p.m. Motion duly carried. Engineer Rosene submitted a letter to the Council pertaining to the Establishment of a Municipal State Aid Street System for the Village of Apple Valley and a map designating the various roads of the Village, noting the authorization funds needed for road traffic study and counters. MOTION of Garrison, seconded by Hollenbeck to establish the Municipal State Aid Street System for the Village of Apple Valley, in accordance with the Resolution hereto attached. Motion duly carried. Special Meeting to be held on April 14th at 8 p.m. with the Engineer and Council to further clarify the state aid road fund and requirements. Engineer Rosene presented material on House File 1177 - relating to Trunk Highways. No action was taken at this meeting. MOTION of Pearsall, seconded by Hollenbeck, to set a Public Hearing for the Preliminary Plan of Palomino Hills 4th Addition on April 9, 1969 at 7:30 p.m. Motion duly carried. Arleigh Thorberg of the Planning Commission presented material pertaining. to the establishing of an Open Space Acquisition Program. Noting a Comprehensive Park Plan for the Village is required. Estimated cost of the plan $1500 - Planner John Voss to submit said plan to authorities in Chicago for Fedexal Funds request. MOTION of Garrison, seconded by Hollenbeck, authorizing the preparation of the Open Space Application by Mr. Voss. Motion duly carried. Village Inspector Joel Osterhus presented material on buildings recommended by the Planning Commission, for final approval by the Council. MOTION of Pearsall, seconded by Garrison, to grant the following permits: C. Severson - dwelling on County Road 33 J. Greenly - dwelling in Akin's Addition W. Barrott - dwelling in Akin's Addition W. Thortsen - dwelling on County Road 40 Motion duly carried, with W. Branning abstaining due to his absence from the hall. MOTION of Hollenbeck, seconded by Pearsall, to grant the variances in accordance with the recommendation of the Planning Commission on Lots 10, Block 2, and Lot 14, Block 2 Scott Highlands 2nd Addition. Motion duly carried. MOTION of Garrison, seconded by Branning, the building permit for the Chandler T.V. Building be granted with the conditions as listed by the Planning Commission in their recommendations. Motion duly carried. Discussion was held by the Council and Engineer on the meeting with the Metro Council staff relative to the interchanges on Highway I-35E. VILLAGE OF APPLE VALLEY Minutes of the meeting of March 26, 1969 Page 3 .3- Discussion was held on the meeting pertaining to the Metro Sewer Plan. MOTION of Largen, seconded by Hollenbeck, the attached Resolution limiting the Metro Council powers be presented to the surrounding communities for their concurrence. Said resolution prepared with the assistance and advisement of our attorney McMenomy. Motion duly carried. MOTION of Largen, seconded by Pearsall, tabling taking any action on the ordinance licensing electricians and plumbers for our Village until the next Council meeting of April 9th. Motion duly carried. MOTION of Largen, seconded by Garrisons to reappoint: (to the Planning Com.) Mr. William Person of Palomino Hills Mr. James Nelson of Dominica Way - Farquar Lake Addn. To appoint Mr. Arleigh Thorberg to fill the facancy of Fred Largen to the Planning Commission. Arleigh Thorberg was duly sworn in by the Clerk at this meeting; Nelson and Person absent. Motion duly carried. Richard Tuthill, the new Apple Valley Fire Department Chief was duly sworn in by the Clerk. E~. Mr. Leo Finley gave a report on the new Day Recreation Program being set up under the auspices of the Apple Valley Athletic Association. S~ [ MOTION of Branning, seconded by Garrison, to extend a welcome to the Apple Valley =f Athletic Association as we develop our programs for the youth of the area. Motion duly carried. Jerry Goodoien noted their meeting to be held Monday, March 31, at the Hall with the Commercial and Industrial Committees and the business men of the area. Gene Corrigan, Police Chief noted the radar unit has arrived, and will be put officially into use when the certification of the unit is received. e': ~:9 Mayor Largen noted a meeting will be held at the Hall on Wednesday, April 2nd with the Engineer, Village Planner, and gravel operators of the area at 9:00 a.m. y~ @, ,N MOTION of Pearsall, seconded by Branning, to pay all bills as submitted.. Aid ~~.ts ~i13~t~ d ~i~ 1~~tlie~~ ~ 1la~~ / ~s ~#~~i~~ it~~~ Aid i~~~~~~ ill i~h~~ nom: ~ f C _ ~l~rk ~ i~rree~?g ~t~ met e ~ is ~ ~ ~ +~f a s+~i~t~ian a~ ~~yy/ g~e~v~d b~ ~h~ ViI C¢nas~2 ~ Sint ~it~:a~ ~.il I~~~~ MiYI\II I I~YYY YY~MiiY?~ ' iii ~i~ RESOLUTION TO LIMIT THE POWERS OF THE METROPOLITAN COUNCIL WHEREAS, the Council of the Village of Apple Valley, Dakota County, Minnesota has had opportunity to have direct dealings with the Metro- politan Council, and WHEREAS, in relation to Highway Planning, especially that related to interchanges on Interstate 35E at County Road 11 and County Road 42, recommendations were made by staff members of the Metropolitan Council to eliminate said interchanges without prior consultation with the communities involved, and WHEREAS, the Villages of Apple Valley and Burnsville and Eagan Township, Dakota County, have built roadways to fit the state highway plan which contained these interchanges, and WHEREAS, much time and energy has been expended by all concerned to demonstrate to the Metropolitan Council the importance of these interchanges, and WHEREAS, there have been further dealings with the Metropolitan Council in regard to Sewer Planning in which in our own area their own basic guide- lines were not followed, and WHEREAS, after repeated demonstration that the Metropolitan Council's Sewer Plan for our area is unreasonable, arbitrary and uneconomical, there continues to be a lack of sensitivity to the planning and needs of the local community, and WHEREAS, there has been a lack of positive constructive help for the local communities on the part of the Metropolitan Council, and WHEREAS, the Metropolitan Council is a creature of the legislature and the Governor of the State of Minnesota, ' BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF APPLE VALLEY, that the Village Council requests that the powers of the Metropolitan Council be severly limited to an advisory and coordinating level, and that it BE FURTHER RESOLVED THAT THE VILLAGE COUNCIL OF THE VILLAGE OF APPLE VALLEY opposes any and all attempts to expand the powers of the Metropolitan Council now or in the future.
