The hearing was closed at ,8;05 p,:m. MOTION: of Garrison, seconded by Pearsall, that. this access will be granted, with the concurrence of the Planning Commission. Those in favor Hollenbeck, Garrison, Pearsall and Branning - opposed - none. Motion carried. Our Attorney, Ed McMenomy,, explained the present contract we have with Thorson & Cornwell and also the sentence which the F.H.A. did-not approve of. Mr. McMenomy recommended that we delete the phrase about children between the ages of 3 and 13 not being allowed in, the mobile home park. (,Paragraph 5) MOTION: of Pearsall, seconded by Branning, that we delete from this resolution, in paragraph 5, the phrase which was mentioned- above, at the recommendation of our attorney and that this be attached to the minutes as- ap exhibit, Those in favor Hollenbeck, Garrison, Pearsall axed Branning - opposed - none. Motion carried. MOTION: of Hollenbeck, seconded by Branning, that we grand. a building permit to James. Heidemann for a garage, such garage is to be built in an agricultural area. Those in favor Hollenbeck, Garrison, Pearsall and Branning - opposed -'none. Motion carried. With reference to the proposed addition to the telephone company, John Voss explained that the company would, need a variance.ta l8 ft. from the property line along Garden View Drive, and read the ordinance stating that a public hearing could be held. Mr. Cox of the telephone company explained the necessity of the addition to the prgsent-building. MOTIQAT: of Pearsall, seconded by Garrison to set a public hearing on the variax~c~ for the telephone company on Jude 4, 1969 at 7:30 p, m. Those in favor Hollenbeck, Garrison, Pearsall-and Branning - opposed - none. Motion carried. The application for the permit to build a garage by C. Wollse]~1:ager was continued until the petitioner had contacted the utility compax~ys and engineer, and if the various utilities companies approve the Planning Commission could then set a public hearing. MOTION: of Garrison, seconded by Hollenbeck,--that the Council refer the application of James Wheelock for a 2 car garage back to, the Planning.. Com- mission and that the neighbors be notified for thier opin:i.on prior to an3r approval. Those in favor Garrison, Hollenbeck, Pearsall and Braening - opposed - none. Motion carried. Mr. Frisbee presented the blueprint of his final plat. He did not have the hard she11, but wanted the approval of the Council. first. Mr. Frisbee was instructed to submit to the Village the deeds to Outlots B & C, whig}i are proposed streets. The Mayor spoke of a meeting. he, Mr. Olsen and Mr, Gabi~u had with the Dakota County Commissioners, proposing a trade between the Village and. the County of County Road 1~0 for CaalaxieAVenue. VILLAGE OF APPLE VALLEY - Minutes of the meeting of May 1~+, 1969 page_ 3 Diseussion-wa.s held on County Road 38 through~Cedar Knolls. The County does not want to accept this road without a ~+5°~~-55°0 split of the cost of paving between.-the Village and the County. The Council decided not to accept this split, instructing the Deputy Clerk to check the minute book for dis- cussion on this road between the County anal the old Town Board. Mr. Bonestroo,presented the report onlthe Sewage Treatment Plant Expansion. They would like us to apply for a Federal grant to aid with the costs, and then proceed with the construction. MOTION: ~of-Garrison,~seeonded by Hollenbeck, that the resolution be 4" passed anal forwarded to the P:C.A. fox Federal aid in the construction of the sewage treatment plant expansion. Motion Carried. • ~ - - Don Adamson of the tTrban Ai'fars-Committee reported they are working on Air Pollution Control, garabage control, on which they wi71 have recommendations in a week or two, and also on street lighting for County Road 38 at Cedar Avenue, and County Road ~+0 at County Road ~+2. - - - - Leo Finley of the Youth Committee said things axe progessi ng well. The summer hel has been lined p v~ and equipment ordered. - _ _ Mike .Garrison said the Police Committee felt that the-crosswalk-lines should be painted in the streets at Garden View Drive and County Road ~+2, and also "stop sign ahead" warnings of County Road ~+2. =MOTIOPT: off' Garrison, seconded ~by Braslning,: that the Administrator be authorized to write a letter to Mr. Ga'biou requesting that the cross walks across County Road ~+2 be painted and that warning signs be painted on the strc~~s of County -Road ~F2. Those in favor Hollenbeck, Garrison, Pearsall and Brannirig ~ oppasecl -none. =Motion caxried. Leo Finley requested the help of the Village in buying sod for •various slopes at the Westview park. The Council said they would help with the cost. Harry Corning reported- =ori a tour o~ the parks -last weekend. Dumgi.ng 3s being done in all parks and burning baxrels being kept out there. Chains and-locks should be placed at the entrance-to the pump houses and people should be kept from driving ~.n park areas:-They believe the parks should be maintained by the Vi11agA~and be of no concern to the Park Committee. Mr. Corning presented a list of items needed to be purchased for Aiewell . Pennock Parks. The Council decided to get a plan of proposed equipment and locations for equipment for ~ac~h park. John Voss, Hairy Corrim.n,g and the ~ Administrator wexe asked to get together and =study this. The-recommendation of the Park -Committee for the purchase of equipment has been tabled. The Council Committee then recsm?~ended that we hire 1 full dine and 3 temporary summer employees for +eampletirig the work necessary ins the- parks. fir. -01seri was = instructed to consider this. They felt that people should get only one warnings and the second time get an automatic citation. It was sugested that we work out a system of fines with the Justice of the Peace and issue s. citation with: each pickup. We should also bray new tags with larger numbers so they may be seen and noted from the police cax atld they should be sent to all those who have been. issued 1968 dog licenses. The motion. on dogs is to be continued until the next mn_eting to clarify all of the details. MOTION: of Pearsall, seconded by Branning~ that we accept the ordinance changing the date of the Village elec-~~~,ons. Those in favor Hollenbeck~ Garrison. Pearsall and Branning -opposed ngne. Motion carried. MOTION: of Pearsall seconded by Hgllenbeek~ that Mr. Bob hers be given the` use of the Village Fa.11 on July 7, 1gC~ for the equalization hearing of the Board of Review. Motion carried, Discussion was held on rho letter from Tombs Insurance Agency on the cost of bonding of the Clerk-Treasurer and also of other employees. MOTION:_ of Branning~ seconded by Garrison, that we bond the Clerk-Treas- urer in the amount of ~10=000 for 1 year premiums. Those in favor Hol7.enbeck: Cxarrison~ Pearsall and Braxlning -opposed -zone. Motion carried. The blanket bond will be looked into by the administrator. Mr. Olsen presented two estimates on the cost of moving his household furnishings to Apple Valley) and suggested the Council send a Letter to Allied Van Lines the-lower estimated instructing them to do the moving. MO'T'ION:; by Hollenbeek~ seconded by Pearsall, to authorize the Mayor to send a letter of authorization for moving to A,17.ied Van Lines. Mayor Largen stated that an ordinance was passed last year restricting the boats on Alimagnet Lake to under 3 H.P. motors, The Mayor also stated that cads should be off the streets now as the sweeping has begun and also the ri?ad construction. The police have been instructed to go around and. use their loud speakers, i~fi'orming the residents of this, MOTION: of Garrisons seconded by Pearsall, that-we grant a permit to Phillips Petroleum Company to operate a gas service station? making sure that they have read the ordinance and tai].]. abide by it.
