Minutes of the meeting of the Village Council Village of Apple Valley, Dakota County,
Minnesota held August 33, 1972.
PRESENT: Mayor Largen; Councilmen Branning, Hollenbeck Pearsall, Garrison; Clerk
Asleson
ABSENT: None
The Mayor called the meeting to order at 7:35 p.m. All residents attending took part
in the pledge of allegiance to the flag. Councilman Branning gave the invocation.
Minutes
MOTION: of Hollenbeck, seconded by Garrison, to approve the minutes of the meeting
of August 9, as corrected. Ayes - 3 - Nays - O (Branning & Pearsall abstaining)
MOTION: of Hollenbeck, seconded.by Garrison, to approve the minutes of the meeting
of August 16th, as written. Ayes - 5 - Nays - 0.
Gross payroll report for August llth received.
Police report for July 1972 received.
The Mayor presented the list of proposed condidates for tie Human Rights Commission.
Council requests candidates to be present at the Council meeting of September 6th,
and that the Mayor and Chairman of the Commission set the terms of the appointments.
MOTION: of Branning, seconded by Pearsall, to cancel the Council meeting of August
30, 1972. Ayes - 5 - Nays - O.
MOTION: of Hollenbeck, seconded by Pearsall, to authorize John Gretz to attend one
day, and Richard Asleson to attend the three-day seminar in Rochester on
Oct. 18 thru 20, 1972. Ayes - 5 - Nays - O.
Councilman Branning requested that the Police Department provide protection at the
County Road 42 crossings on Elm and Garden View during the opening days of school.
MOTION: of Hollenbeck, seconded by Pearsall, to rescind the motion made regarding
the rezoning of the Winkler property on July 19, 1972. Ayes , 5 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to pass Ordinance # 115, rezoning both the
apartment and townhouse areas to M-3 P.U.D., with the density of 6.5 town-
houses per acre, and up to 14 units per acre in the apartment area, with no
more than 2-story buildings~ Ayes - 5 - Nays - 0.
The Planning Consultant had a letter prepared to submit to the Metro Council, commenting
on the Comprehensive Guide Plan of the Village of Rosemount. Discussed by Council.
MOTION: of Pearsall, seconded by Branning, to pass Resoiution 1972-126, submitting to
the Metro Council Mr. Voss' letter. Ayes - 5 - Nays - O.
Public Hearing Water & Sewer Improvements, Well # 4 and S1/2 of Section 25. The Mayor
called the hearing to order at8:15 p.m. and read the affidavit of publication aloud.
The engineer located the area on the map and described the proposed improvements. There
being no further comments, the hearing was declared closed at 8:30 p.m.

Public Hearing reassessment of Palomino Hills 4th Addition. The Mayor called the
hearing to order at 8:30 p.m. and read the affidavit of publication aloud. The Admin-
istrator explained the reason for the hearing. Discussion. There being no further
discussion~ the hearing was declared closed at 8:45 p.m.
Planning Commission Recommendations
Model Stone Company Rezoning. The Planning Commission recommends denial of the
petition. The attorney read the resolution he had prepared at the request of
the Administrator. The petitioner was given a chance to comment on the motion
and recommendation of the Plsnning Commission.
MOTION: of Hollenbeck, seconded by Branning to approve the Planning Commission's
recommendation and pass Resolution 1972-127~ as read by the Village Attorney.
Discussion between Council and petitioner. Councilman Pearsall requested a copy of
Mr. Brauer's speech and stated he would need some more time to study the proposal.
Councilman Garrison also felt he needed more time.
The Mayor asked if either the motion or second would like to withdraw. Councilman
Branning withdrew his second. Councilman Hollenbeck said he would not withdraw the
motion.
No second to the motion.
MOTION: of Pearsall seconded by Garrison to table action on this item until Sept.
27, 1972. Ayes - 5 - Nays - O.
Valley Furniture Store - request for building permit. The building inspector
said he had the building plans and they Were in order but all plans had not
been submitted. Item held until complete.
3. Heritage Lutheran Church - all necessary plans on this not yet received either.
Held until complete.
4. Variance - Lot 20 Block 7, Greenleaf 4th Addition - request for garage setback to
be at 27.7 feet.
MOTION: of Hollenbeck, seconded by Pearsall to accept Planning Commission's recom-
mendation .and grant the variance. Ayes - 5 - Nays - Oo
5. Meadows proposal-
MOTION: of Pearsall seconded by Branning to approve the Planning Commission's rec-
ommendation to pass Ordiance # 117 , rezoning the property to M-l~ with 'the
density of 4.5 units per acre as recommended by the Planning Commission~ with
the exception to item # 2 changing it to a 30' public easement from Reflection
Road out with a walkway and other items which are to be handled in the Devel-
opment Contract. The drainage ways shall be compatible to the Lakeshore Addition.
Councilman Branning asked if it was possible to deed public roads back to homeowners
to become private roads. Staff answer - yes, through vacation proceedings.
Vote called - Ayes - 5 - NaYs ~ O.

MOTION: of Hollenbeck, seconded by Branning, to authorize the Engineer to study plans
for grades on 140th Street and the Meadows model townhouse area. Ayes - 5 -
Nays-O.
MOTION: of Garrison, seconded by Pearsall, to approve an excavation permit for pre-
liminary grading, subject to review of the final grade of the street. Ayes -
5 - Nays - O.
MOTION: of Hollenbeck, seconded by Pearsall, to pass Resolution 1972- 128, setting a
public hearing on proposed A & W for October 4, 1972 at 8:00 p.m. Ayes - 5 -
Nays- O.
MOTION: of Hollenbeck, seconded by Pearsall, to pass ReSolution 1972- 129, setting a
public hearing for rezoning and preliminary plat and plan for planned develop-
ment for Cottle-Herman developement. Said Hearing to be October 4, 1972 at
8 p.m. Ayes - 5 - Nays - O.
John Natwick requested comments on roller rink proposal.
Jerry Bell recommended acceptance of four Village Parks, subject to dead Sod and trees
being replaced by October 1, 1972, and other items on list.
MOTION: of Branning, seconded by Pearsall, to accept the four parks, as recommended
by the Park Director, subject to the attached list, and including the holding of
a 5% retainer until such items are taken care of. Ayes - 5 - Nays - 0.
Mr. Bell slso had additional HUD forms which were turned over to the Attorney for com-
pletion, to be submitted to the Council at their next meeting.
Proposal on recreation program for Valley Jr. High approved by Council and referred to
School District.
Work session set for 7:30 pom. September 21st, for road study by Barton Aschman.
The Metro Council has a meeting tomorrow at 2:00 p.m. to decide on the airport location.
Letter received regarding "No Pedestrian Crossings" signs on CR # 42, objecting to said
signs. It was noted that these were warning signs only and not regulatory.
MOTION: of Branning, Seconded by Garrison, to authorize purchase of truck for snow
plowing from Bill Boyer Ford at a price not to exceed $2,300. Ayes - 5, Nays-O.
Administrator discussed health insurance rates from present company and he has received
two quotations from other companies.
MOTION: of Hollenbeck, seconded by Pearsall, to approve the Administrator's signing
of the contract for another year with Blue Cross. Ayes - 5 - Nays - O.
Discussion on final paymnet to be made to Karl Dedolph for Well # 4. To be negotiated.
MOTION: of Hollenbeck, seconded by Garrison, to pass Resolution 1972 - 130, to the
Mstro Transit CommisSion regarding bus service to Apple Valley. Ayes - 5 -
Nays - 0.

MOTION: of Branning, seconded by Hollenbeck to approve the issuance of a transient
merchant's license to solicit from the local merchants for muscular distrophy.
Ayes - 5 - Nays - 0.
MOTION: of Hollenbeck, seconded by Garrison, to request the Attroney to review the
Dan Hogan variance violation and make a recommendation to the Council.
Ayes ~ 5 - Nays - O.
MOTION: of Hollenbeck seconded by Garrison , to waive the platting regulations in
regard to the Belzer Clinic, in that Council will allow the issuance of a
building permit to platting, but that the plat must be filed prior to the
occupancy of the building~ Ayes - 5 - Nays - O.
MOTION: of Pearsall, seconded by Hollenbeck, to amend the Council motion of a previous
meeting with regard to the. listed owner of the clinic. Ayes - 5 - Nays - O.
Discussion on Apple Valley bank.
MOTION: of Garrison, seconded by Branning, to pay the claims and bills check # 4688
thru # 4756 in the amount of $80,935.86. Ayes - 5 - Nays - O.
MOTION: of Pearsall, seconded by Branning, to adjourn. Unanimously carried.
