PRESENT: Mayor Largen; Councilmen Garrison, Branning, and Hollenbeck (attended at 8:05 p.m.); J. Bell and Deputy Clerk Viveiros ABSENT: Councilman Pearsall The Mayor called the meeting to order at 7:40 p.m. All residents attending took part in the pledge of allegiance to the flag. Mayor Largen gave the invocation Minutes MOTION: of Garrison, seconded by Branning, to approve the minutes of the meeting of September 13, 1972 subject to checking with Councilman Hollenbeck as to the time he left. Ayes - 3 - Nays - 0. Planning Commission minutes of August 22, 1972 received. Water and Sewer report for August received. Gross payroll report for September 22, 1972 received. Housing Seminar- delayed for one week. ' Notice of Crystal Lake water level hearing of October 19, 1972 received. Nordic Square- study on itmes discussed at last hearing. The Planning Commission, Council and petitioner will get together in the near future to view the site and discuss a possible contract. Petitioner will draw up model contract. Mobil Oil Conditional Use Permit- The Mayor read the Planning Commission's recomm- endations. They recommend a 20-year permit and itemized their conditions. Mr. Tom Allen of Mobil Oil went over the conditions with the Council. Councilman Hollenbeck attended at 8:05 p.m. MOTION: of Hollenbeck, seconded by Largen, to deny the permit to Mobil Oil. Bay entrances was discussed, then Councilman Garrison suggested they review all of the additional items before any vote was taken. This was done. Vote was called for. Ayes = Hollenbeck and Largen; Nayes - Garrison and Branning. Not passed. MOTION: of Garrison, seconded by Branning, to accept the Planning Commission's rec- ommendations and approve the Conditional Use Permit, With the exception that Mobil pay for ½ of the cost of the service road, 5y contract for the amount. (See Planning Commission motion) Ayes - 4 - Nays - 0. MOTION: of Garrison, seconded by Branning, that we do not consider the vacation of the Cedar Avenue service road until a contract has been negotiated with Mobil Oil Company, as per above. Ayes - 4 - Nays - 0. Office building permit held. (Lifsonand Lieberman) VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 2 MOTION: of Branning, seconded by Hollenbeck, to pass Resolution 1972-150, ordering the improvements for the West Central Storm Sewer, and authorizing prepar- ation of plans and specs. Ayes - 4 - Nays - 0. MOTION: of Garrison, seconded by Hollenbeck, to approve the development contract with Inland Construction Company for Phase I of the Wildwood project, and authorize Mayor and Clerk to sign, subject to review of the Planning Consultant, and with the agreement made on the assessment for the paving of Garden View and also 140th Street, according to the Engineer's guide. (Garden View; a residential equivalent and 140th Street, a collector equivalent) The trailways will be restricted to pedestrians and non-motorized vehicles, other than Village maintenance vehicles, and that there be sidewalks on both sides of all public streets in this project. Ayes - 4 - Nays - O. Utilities contract- Wildwood Addition and Griswold-White. The bidder has agreed to extend the bids for improvements to these projects for an additional two weeks. MOTION: of Garrison, seconded by Branning, to approve the plans and specs for water and sewer extensions to Greenleaf 5th Addition, and to pass Resolution 1972-151, authorizing advertisement for bids on same, to be taken October 27, 1972 at 2:00 p.m. Ayes - 4 Nays;- 0. MOTION: of Garrison, seconded by Hollenbeck, to pass Resolution 1972-152,, setting a public hearing for October 25, 1972 at 8:00 p.m. for Greenleaf 5th Addition improvements. Ayes - 4 - Nays - 0. MOTION: of Garrison, Seconded by Hollenbeck, to pass Resolution 1972-153, to adver- tise the improvements for the Inland project to be taken as an alternate bid with the bids for Greenleaf 5th Addition on October 27th.' Ayes - 4 - Nays 0. MOTION: of Branning, seconded by Garrison, to pass Resolution 1972-154, ordering a preliminary report and setting a public hearing for October 25, 1972 for utilities to Palomino Meadows project. Ayes - 4 - Nays - O. MOTION: of Hollenbeck, seconded by Branning, to authorize a temporary permit to erect a trailer on the Grace Lutheran Church property for a 24-month period, or until December 31, 1974, subject to approval of the building inspector and fire marshal. They may request renewal of the permit after expiration. Ayes - 4 - Nays - 0 MOTION: of Garrison, seconded by Hollenbeck, to pass Resolution 1972-155, correcting the assement roll for Apple villa and the adjacent area. Ayes - 4 - Nays - O. MOTION: of Branning, seconded by Hollenbeck, to pass Resolution 1972-156, correcting the assessment on Parcel #24084C (near Ellice Trail). Ayes - 4 - Nays - 0. MOTION: of Branning, seconded by Garrison, to amend the Greenleaf 2nd Addition Contract, to add that Thompson Construction shall be responsible for 28.5% of 1/2 a street of the actual cost of the construction of 132nd Street. (Between Galaxie and a point near Flagstaff Avenue which will be described specifically in the contract) This must be signed by Orrin Thompson by Friday, September 29th. Ayes - 4 - Nays - O. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 Discussion on traffic signals and pedestrian crossings, and on fact sheet from fiscal agent regarding bond issue for same. MOTION: of Branning, seconded by Hollenbeck, to pass Resolution 1972-157, approving plans and spec for the Eastern Sewer Trunk extensions and interceptor sewer. Ayes - 4 - Nays - 0. MOTION: of Garrisdn, seconded by Hollenbeck, to pass Resolution 1972-158, ordering advertisement for bids for November 1, 1972 at 2:00 p.m. for the Eastern trunk. Ayes - 4 - Nays 0. The Housing and Redevelopment Authority of Dakota County sent a proposal to Apple Valley for buying seven houses in Apple Valley tn be re-sold to lower income families and subsidized by government funds. The Mayor read his letter of agreement to the County. It was suggested that he add a statement to the fact that this be contingent on the fact that his property will continue to be on the tax rolls. MOTION: of Hollenbeck, seconded by Branning, to approve the issuance of the transient merchants license to Mrs. Simon, with the stipulation that she cease to advertise on her property or commercially. Ayes - 4 - Nays - 0. Councilman Garrison noted that he had received a call from the assessor's office, stating that there would be an open-book hearing pertaining to the door-to- door re-assessment on October 2nd and 3rd at the Village Hall from 1:00 to 9:00 p.m. Council need not be present.
