PRESENT• Mayor Largen; Councilmen Garrison, Branning, Pearsall and Hollenbeck; Administrator Curits E. Olsen and the Deputy Clerk ABSENT: None The Mayor called the meeting to order at 7 30 p. m. A11 residents attending took part in the pledge of allegiance to the flag. Pastor Charles Rehman of Berean Baptist Church gave the invocation for this meeting. MOTION of Pearsall, seconded by Branning, that the minutes of the meeting of September 10, 1969 be approved as amended and corrected. Those in favor Pearsall, Branning, Hollenbeck and Garrison - opposed - none. Motion carried. The Mayor did not vote on these minutes as he was not at this meeting. The Mayor called to order the public hearing for the Palomino Hills Lakeshore Addition on proposed curbs and gutters. The Engineer reviewed the proposed street improvements. There are two types of construction; one with curb and gutters and the other a shallow ditch, with culverts under each driveway. He mentioned that the benefitted property would be assessed the total cost of this. Jim Moser submitted a letter he received from Palomino Development Corporation, stating that they will assume the cost of the bituminous surfacing. Mr. McMenomy said we would have to get a definite agreement from Palomino. Bob Rosene then recomputed the figures and figured the additional cost for just the curbs and gutters would be approximately $3.65 per front foot. Jim Moser then presented the Council with a petition in favor of the rural type drainage of the ditch and culverts. A letter from Mr. W. Erickson in favor of the curbs and gutters was read by the Mayor. Mr. Sole and Mr. Turgeon spoke in favor of the urban type street. Mr. Pearsall spoke of the proposals for developing nearby areas for apartments or townhouses. The Mayor brought up the park site near Lake Alimagnet. He said they would pt~b~,bly have to slow down or stop ~iuilding in this area in the near future. Mr. Pearsall stated that if the cul-de-sac was punched through there would still be not too much more traffic flow than present because they would still use Garden View Drive. The public hearing was adjourned temporarily at 8:35 p.m. until the residents conferred some more among themselves about the matter. The representative from Northern Natural Gas said his firm objected to arty type of improvement. A letter was received from Ray Brown regarding the drainage problem on his land. The engineer said they were working on a soluti,~n now and they would have an answer soon. Mr. Rosene said there would have to be a ditch made to bring this over to the gravel pit where it drains. The mayor asked the engineer to have his recommendations ready for the next meeting. The Palomino Hills residents have requested a period of time to decide what they want to do. They will report again at the next Village meeting probably. Mayor's Report On Friday, September 5th Joe Milbauer from our Medical Committee and the Mayor were present at a luncheon at Fairview Southdale Hospital. They presented their intentions VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 2 • regarding the Burnsville-Apple Valley area. They are proposing to use the Lutheran Ridges Home as an emergency hospital-medical center. A clinic in liaison with this has also been proposed to be built in Apple Valley. There will be more meetings in the future and he will report on them at a later date. The Mayor and Mr. Pearsall attended a meeting of the Dakota County Officers along with other Mayors and councilmen from surrou~iding areas. Two items dis- cussed were: 1. The recommendation that there be a re-assessment and re-evaluation of the road policy. 2. Discussion regarding team of county assessors. Regarding the plat of Valley Commercial Park on the Northwest corner of ~~+2 and Cedar, the county highway traffic engineer recommends that no frontage roads be built on Cedar Avenue as it will probably be a six-lane highway eventually. He also made mention of the new Thompson plat near Lehmann and Galaxie, and communications he had received from Senators Mondale, McCarthy and Quie and Governor LeVander regarding his letter about the sewage plant and pollution. Bob Hollenbeck brought up the annexation petition which has been filed. A hearing has been scheduled for October 23rd at 9:30 a.m. in the Rosemount Town Hall. The Lakeville-Farmington petition will be heard also. Mr. McMenomy asked about the brochure being prepared regarding the annexation. It is to be discussed at the next meeting of the Rosemount Businessmen's Association. MOTION: of Pearsall, seconded by Hollenbeck, that we authorize the Attorney to represent us at the Farmington-Lakeville hearing. Those in favor Branning, Pearsall, Largen, Garrison and Hollenbeck - opposed - none. Motion carried, Administrator's Report He discussed the election and registration, and mentioned that the resolution for election judges and chairmen should be made by October 8th. The Treasurer's report for August was submitted. Skating areas are being reviewed by the Park Committee and they hope to have a recommendation in a week to 10 days. Bob Hollenbeck suggested three people to be appointed to the Urban Affairs Committee. The meeting with prospective members of the Committee is now re-scheduled for October 8th at 6.30 p, m. Budget work sessions are scheduled for September 2'Sth and 26th. More will probably be needed. Some research has been done on uniforms for employees. They will have a recommendation for the Council on October 8th. Paving of the street has been done in front of the Village Hall. We will have to negotiate with Orrin Thompson to decide who pays for the half of the street on the Village Hall side. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 Mr. Pearsall asked about traffic counters. He wondered if we had purchased any. We need traffic counts to send in for State Aid Funds, The Planning Commission has now recommended to the Council that the building permit be issued to Central Telephone. MOTION: of Garrison, seconded by Pearsall to approve the building permit for Central Telephone Compar~y, subject to the approval of the engineer and the building inspector. Those in favor Hollenbeck, Garrison, Largen, Pearsall and Branning - opposed - none. Motion carried. The assessment rolls for improvements in North Apple Valley and Palomino Hills have been completed. The attorney has drawn the necessary resolutions. MOTION: of Hollenbeck, seconded by Branning to pass the resolution for the assessment hearing on North Apple Valley and the Palomino Hills area. The hearing to be held on October 9, 1969 at 7:30 p,m. Those in favor Branning, Pearsall, Largen, Garrison and Hollenbeck - opposed - none. Motion carried. The attorney reported on the Attleson condemnation - the award has been made in the amount of 200.00. He has 40 days to file a court appeal if he wants to do so. Engineer's Report • The engineer presented his report on the sanitary sewer and water to the proposed new school building on the Thor property. He suggested that Apple Valley and Rosemount have an agreement to have the school hook up with the Rosemount Township sanitary sewer which is nearby. MOTION: of Pearsall, seconded by Branning, that we accept the recommendations of the Engineer and that we send a copy of this report to Mr. Hanson, Super- intendent of the Rosemount School District. The engineer reported that he has checked the streets in The Woods 2nd Addition and has written a letter accepting the streets and he now recommends that the bond being held for this be released. MOTION: of Garrison, seconded by Hollenbeck, to accept the streets in Frisbee's The Woods 2nd Addition. Those in favor Hollenbeck, Garrison, Largen, Pearsall and Branning - opposed - none. Motion carried. The North Apple Valley area has been gone over with the contractor. All items on his list were examined and the contractor will take care of the problems soon. Sodding is to be done as soon as it can be. The weather has been dry and it has been impossible to cut the sod, but he will do so as soon as he can. The park adjacent to the Dennistoun property has been checked. There has been much dumping there. MOTION: of Hollenbeck, seconded by Branning, that we authorize the Administrator and Engineer to contact the interested parties which have been using this park area for dumping, find out how much of this material is his and divide the cost between the Village and him and have him clear the area. Those in favor Ho~,lenbeck, Garrison, Largen, Pearsall and Branning - opposed - none. Motion carried. The Mayor asked when the new water reservoir was going to be painted. Bob Rosene said it would be painted in October. The Mayor then asked if the old one was going to be painted thin, also. The engineer said that he had it on his list for things to do next spring. They can then drain the water and paint the tower. Will Branning mentioned the ponding area by the Country Club. He said it should be cleaned out now or it will be a problem next Spring. He also mentioned that three residents of North Apple Valley reviewed all the streets and sodding and submitted the list of things to be done to the Engineer. These men were Jim Geving, Don Bennett, and Duane Amdahl. MOTION: of Pearsall, seconded by Hollenbeck, to approve the burying of the cable on 1~+3rd Street. Those in favor Hollenbeck, Garrison, Largen, Pearsall and Branning - opposed - none. Motion carried. Urban Affairs Committee { The Committee asked that we issue a no burning order for the present time as the weather has been very dry and it could be quite dangerous. Other Villages who have done so were mentioned. f MOTION• of Garrison, seconded by Hollenbeck that we issue a ban on burning until further notice. Those in favor Branning, Pearsall, Largen, Barz•3,soh and Hollenbeck - opposed - none. Motion carried. 6 The proposed rubbish ordinance was gone over in detail with the Council. MOTION• of Hollenbeck, seconded by Garrison, to accept the proposal of the Urban Affairs Committee and turn it over to the Administrator and the Attorney for their recommendations at the next meeting. Those in favor Hollenbeck, Garrison, Largen and Pearsall - Branning abstained. Tom Mohr made us aware of not enough pressure in the hydrants in Broback's Addition. Payment of Bi11s MOTION• of Garrison, seconded by Branning, to raise the salary of James Heidemann to $575.00 per month, retroactive to September 1, 1969. Those in favor Branning, Pearsall, Largen, Garrison and Hollenbeck - opposed - none. Motion carried. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 5 MOTION: of Pearsall, seconded by Branning to pay the bills, as amended, with two items added to the list: 1. The statement from Urban Planning & Design in the amount of $390.00 2. Payment to the Village of Burnsville in the amount of $3,680.00 for charges in the amount of $160.00 each for 23 connections to the sewer. Those in favor Pearsall, Branning, Largen, Garrison and Hollenbeck - opposed none. Motion carried. Paul Dow of the League of Minnesota Municipalities appeared to discuss with the Council League services and services offered by the Metropolitan Section of the League. Council took the matter under advisement. MOTION of Pearsall, seconded by Hollenbeck, to authorize mailing of information regarding the annexation petition at an estimated cost of $130.00 Those in favor Hollenbeck, Pearsall, Largen, Garrison and Branning - opposed - none. Motion carried. MOTION• of Pearsall, seconded by Hollenbeck, that the meeting be continued to Thursday afternoon, September 25th at 3.00 p. m. Adjourned 12.00 p. m. Continued meeting • 3 15 p. m. 9-15-69 The Village Administrator discussed with the Council existing dog ordinance enforcement policy and suggested that summonses be issued when there was a violation detected, for example, the impoundment of a dog would be a violation of the ordinance. Councilman Garrison advised the Council that this matter had been reviewed by the Police Committee and that they concur with this change. in policy. He further advised that the Police Committee recommends that the Council request the J.P.'s establish a schedule of penalties providing for a 25.00 fine for the lst offence and a $50.00 fine for each subsequent violation. MOTION• of Garrison, seconded by Branning that the Council request the J.P.'s to establish a schedule of penalty providing for a $25.00 fine for an initial violation of the dog ordinance and for a $50.00 fine for subsequent violations. Those in favor Hollenbeck, Garrison, Largen and Branning - opposed - none. Motion carried. MOTION of Hollenbeck, seconded by Garrison, that the dog ordinance be amended so as to provide, in cases of dog bite, a mandatory quarantine of 14 days at a facility designated by the Village at the dog-owner's expense. Those in favor Branning, Largen, Garrison and Hollenbeck - opposed - none. Motion carried. MOTION: of Branning, seconded by Garrison, to engage George W. Anderson to review and revise the Village accounting system forms and procedures. Those in favor Branning, Garrison, Largen and Hollenbeck - opposed - none. Motion carried. MOTION. of Pearsall, seconded by Branning, to authorize the Village Administrator to employ such additional personnel as is necessary to effectively enforce the gun discharge ordinance during the shotgun-deer season. MOTION: of Pearsall, seconded by Branning to schedule a "Meet Your Government Night" for the evening of Thursday, October 23rd at 8 00 p.m. at Southview School if that facility is available. Those in favor Pearsall, Branning, Largen, Garrison and Hollenbeck - opposed - none. Motion carried. MOTION of Branning, seconded by Garrison to authorize the hiring of a drag line to improve the storm water ponding area on Village owned property at Redwood Park. Mayor d Village Council Village Administrator Salary Adjustment Mr. James Heidemann, water and sewer maintenance man was hired March 1, 1969 at $525.00 per month with an agreement to increase to $550.00 of ter three months. In June, additional personnel was added at $550.00 under a 6 month probationary period arrangement. It was gener~.ly understood that an adjustment would be made in Mr. Heidemann~s salary at the end of a six month period also. Having favorable service reports, it is recommended that the salary of Mr. Heidemann be adjusted upward to $575.00 per month, retroactive to Sept- ember 1, 1969. • • , September 23~ 1969 TO: Apple Valley Pillage Council FROM: Park Commission The Park Commission recommends that an ordinance be passed by the Council prohibiting the discharge of firearms or boe and arrow in the area bounded by the Burnsville line on the north and west Cedar Avanue on the east and the Lakeville line on the south.
