VILLAGE OF APPLE VALLEY Dakota County, Minnesota Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota County, Minnesota on October 8, 1969 at 7.30 p.m. PRESENT Councilmen Hollenbeck, Hranning, Pearsall, Mayor Largen and Administrator Curtis E. Olsen. ABSENT: Councilmen Garrison Mayor Largen called the meeting to order. All in attendance took part in the pledge of allegiance to the flag. The invocation for the meeting was presented by Pastor Drews of the Good Shepard Lutheran Church in Burnsville. MOTION• by Hollenbeck, seconded by Pearsall, to accept the minutes of the meeting of Sept. 2~+, 19691.after correcting the following items. 1. The first motion on page 5 to be approving of payment of the bills 2. Delete Mayor Largen's name from approving minutes of Sept. 10, 1969 - he was absent 3. Mayor's Report - Joe Milbauer is from our Medical Committee and not from Fairview Hospital Page - Tom Mohr made us aware of not enough pressure in the hydrants in Broback's Addition . Unanimously passed. Motion carried. Petitions, Requests and Communications iMOTION. by Pearsall, seconded by Branning to approve the Refuse Permit of D & M Hauling as they have met all the basic requirements. Unanimously approved. Motion carried. Mr. Olsen submitted materials received from the League of Minnesota Municipalities (Metro Section). He also stated that our total state aid allotment from the State Highway Department of $2+;305.00 has been re- allocated $5,180.00 for maintenance, and 19,125.00 for construction. A new license bond has been issued from B1lomington Sanitation. Ordinances and Resolutions None were presented. Re orts Mayor Largen stated that future meetings concerning a clinic should give him something to report on in the next two weeks. Mr. Olsen stated that he had talked to George Sauers and that Mr. Sauers was authorized to enter into a contract whereby Palomino Development Corporation would assume responsibility for the cost (estimated at 8800.00) for bitumin- ous surfacing of streets in the Palomino Lakeshore Addition. This would be accomplished by entering into a contract with the Village, requiring payment upon the letting of a contract• `Irhe matter of performance security would be VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 2 subject to further discussion. The Council requested Councilman Pearsall communicate these facts to the Lakeshore Addition residents so that a Council decision could be made on October 22, 1969. The Village engineer, Bob Rosene, stated that a portion of the black- top on the north side of County Road ~~+2 and Ctarden View Drive should be overlayed or patched in the near future. The cost would be approximately 600.00. MOTION• by Pearsall, seconded by Branning, to have McNamara overlay that portion of Garden View Drive and County Road ~+2. Unanimously passed. Motion carried. Mr. Rosene said that McCrossan is to repair the curbs and do the sodding in north Apple Valley next week and will level the blacktop ~,t the foot of Ridgeview, starting on Monday, Oct. 13th. He also said that the welding is completed on the large reservoir and the sand blasting will be done Thursday. They should be ready to paint on Friday. A report was made of a recent meeting with the Valley Park Community Organization relative to annexation to the pillage of Apple Valley. Mr. McMenomy said that he will be in attendance at the Rosemount Business Association's meeting next week at which time the proposed annex- ation would be discussed. • The water and sewer billings report is to be submitted at the next Village Council meeting. It was decided to move the "Meet Government Night" to the month of November instead of the scheduled date of Oct. 23, 1968. The date is to be set at the next meeting and a retraction of the statement in the news- paper for the Oct, date is necessary. New Business MOTION• By Hollenbeck, seconded by Pearsall, to have a joint meeting with the Planning Commission and to hold a Public Hearing on rezoning of the S 1~2 of NW 1~~+ off' Sec. 23; the SW 1~4 of Sec. 23; the SE 1~4 of Sec. 22 and the S 1~2 of NE 1~~+ of Sec. 22, the meeting and the Public Hearing to be held on Wednesday, Nov. 5, 1969 at 8:00 p.m. (Legal notice to be published.) Unanimously passed. Motion carried. The 1970 budget was discussed with the Council. Mr. Olsen said the Police Department budget was increased so as to provide for a man department and 2 squad cars. The park budget increase is for general improvements. also included in the fire budget is provision for the purchase of an emergency vehicle. MOTION: by Pearsall, seconded by Branning, to accept the 1970 Budget and also to adopt the Tax Levy Resolution which is to be forwarded to the County. Unanimously passed. Motion carried. Mr. Olsen was comarended for his hours spent on the budget. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 Mr. Olsen requested the Council review the proposed Personnel Policy and that it be placed on an early agenda. The Valley Athletic Association will provide the labor for the construct- tion of a hockey rink and warming house with the exception of one carpenter who will be paid. The warming house will have to be larger thatn the one origi- nally proposed, a rough cost estimate was given of $2+00.00, plus heating and lighting. MOTION: by Pearsall, seconded by Branning, to adopt the winter skating program with the purchasing of nexessary equipment included. Unanimously approved. Motion carried. The designation of judges for the Village election is to be done at the meeting of Oct. g, lg6g. The State wants each Village to present a 5 year park acquisition and development program (5 Year Lawcon Park Budget) which must be presented to the County by Oct. 15, lg6g. John Voss presented his proposed Park Develop- ment Program Study to the Council and he proceeded with its review. MOTION: by Branning, seconded by Hollenbeck, that we accept the proposed Park Development Program document and authorize that it be filed with the County. Unanimously approved. Motion carried. Excerpts from Mike Garrison's report concerning Village liquor policies • was read by Mayor Largen. MOTION• by Pearsall, seconded by Branning, to receive Mr. Garrison's report and that the report or a summary report be released to the press. Unanimously approved. Motion carried. MOTION: by Pearsall, seconded by Hollenbeck, to authorize the change order ~2 for the Sandstrom Haffaier Cedar Knolls contract. The Council is to be advised of any other changes. Unanimously approved Motion carried. Mr. Olsen said the cost of the postage meter and scale will be $25.00 for the installation and $22.00 per quarter rental. MOTION: by Hollenbeck, seconded by Pearsall, to authorize the rental of the meter and procurement of a scale. Unanimously approved. Motion carried. The J. F. LaBo bill is to be held up for payment. Bills to be added and paid are: Blue Cross payment $353•x+9 Bob Hollenbeck 32.50 (for attending seminar) MOTION: by Pearsall, seconded by branning, to pay the bills as corrected. Unanimously approved. Motion carried. At this time Colonel Robley asked to be heard. Colonel Robley protested the $25.00 fine for the first offense on ry a dog running loose. RESOLUTION APPROVING 1969 TAX LEVY, COLLECTIBLE IN 1970 BE IT RESOLVED by the Village Council of the Village of Apple Valley, County of Dakota, Minnesota, that the following sums of money be levied for the current year, collectible in 1970, upon the taxable property in said Village of Apple Valley, for the following purposes• General Fund $121,218.00 Debt Service Fund $ 15,875.00 Contribution to Firemen's Relief Association $ 416.00 Provision has been made by the Village for payment of the Village's contributory share of the Public Employees' Retirement Fund, as provided for in Minnesota Statutes Annotated, Sections 353.01 et seq No further levy is required for this purpose.
