VILLAGE OF APPLE VALLEY Dakota County, Minnesota Pursuant to due call and notice thereof a re ~zlar meeting of the Village Council of the Village of Apple Valley, Dakota County, Minnesota was held at the Village Hall in said municipality on the 9th day of October, 1969 at 7.30 o'clock p. m, The following members were present• Mayor Largen; Councilmen Pearsall and Hollenbeck. Councilman Garrison attended at 8:15 p.m. and the following were absent: Councilman Branning The Clerk presented an Affidavit showing publication of the Notice of Hearing on proposed assessment rolls for the following: Sanitary sewer interceptor, trunks, laterals, house services, street replacement and sewage treatment plant in Apple Valley Additions North of County Road ~+2; and water trunks, laterals, supply and storage, sanitary sewer interceptor, trunks, laterals, house services, street replacement and sewage treatment plant in Palomino Hills. In the official newspaper in accordance with a resolution heretofore adopted by the Village Council which affidavit was examined, found satisfactory, and ordered placed on file. • The Mayor announced that the meeting was open for consideration of objections, if any, to said proposed assessments. Clark and Carroll R. Mitchell, outlined verbally the objection in behalf of some 20 property owners. Mr. Johnson stated that the residents were promised 6°~o interest rate by the Town Board. The now proposed 8f rate would cast doubt now as to the feasability of the project to the property owners. Mr. John Natwick, former chairman of the Town Board and a resident of the area being assessed, explained his rational as a member of the Town Board for promising a 6°fo rate for the Palomino Hills special assessment. He suggested that the promise of 6/o must be kept by the Village Council. Considerable discussion ensued as to the proposed financing plan for all pro- jects in the ~1,13~,000. 3-year temporary improvement bonds issue and the prospective interest rates which may be experienced upon refinancing. Mr. Louis Clark and others objected to the interest rate spread between the current bond issue rate of 4.226 and the proposed 8% assessment rates. The Council recessed the hearing at 10 15 p. m. Council reconvened the hearing at 10 30 p. m. Mayor Largen summarized the problems as he saw them which included the communications difficulties inherent in the change of governing bodies with the Village incorporation, the possible difference in philosophy between governing bodies, all of which contributed to the honest differences which became apparent during the hearing. He suggested that the hearing be adjourned until Thursday, October 23rd at 8 00 p.m. Between now and then he suggested that a committee re- presenting the homeowners be formed to meet with the Council and staff to review the details of the project financing and to bring back to the reconvened hearing • recommendations. MOTION of Largen, seconded by Pearsall, that the hearing be adjourned until Thursday, October 23rd at 8.00 p.m. Those in favor Largen, Pearsall, Hollenbeck, and Garrison - opposed - none. Motion carried. A citizen's committee, consisting of Mr. John Natwick, Carroll Mitchell, and Charles Johnson was designated. The Council designated October 13 at 7 30 as a work session with the above group. Councilman Hollenbeck then introduced the following resolution and moved its adoption (See Section I of attached resolution). The motion for the adoption of the foregoing resolution was duly seconded by member Pearsall, and upon vote being taken thereon, the following voted in favor Largen, Pearsall, Hollenbeck and Garrison and the following voted against same None Whereupon said resolution was declared duly passed and adopted. Councilman Pearsall introduced the Resolution providing for the annual Village Election and appointed the Judges of election. Resolution hereto attached. The motion was seconded by Hollenbeck. Those in favor Largen, Pearsall, Hollenbeck and Garrison - opposed - none. Motion carried. BE fT RESOLVED by the Village Council of the Village of Apple Valley, Dakota County, Minnesota, as follows: (1) The Clerk has calculated the amount proper and necessary to be specifically assessed for sanitary sewer, interceptor, trunks, laterals, house services, street replacement and sewage treatment plant facilities against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statutes Annotated, Section 429, and notice has been duly pufilished and mailed, as required by law, that this Council would meet to hear and pass upon all objections, if any, and to amend said proposed assessments as might 6e necessary, and said proposed assessment roll has at all times since its filing been open for public inspection, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments. (2) This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds each of the lots, pieces and parcels of land enumerated in the proposed assessment roll was and is specifically benefitted by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby .levied against each of the respective lots, pieces and parcels of land therein described. {3) The proposed assessment roll is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with the interest at the rate of 6o per annum accruing on the full amount thereof from time to time unpaid shalt be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual installments extending over a period of 19 years, the first of said installments, together with interest on the ent-ire assessment from the date hereof to December 31, 1y69, to ~e payable with the general taxes collectable during the year 1970, and one of each of the remaining installments, together with one year's interest on that and all other unpaid instailments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid.
