Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota County,
Minnesota held October 25, 1972.
PRESENT: Mayor Largen; Councilmen Garrison, Branning, Hollenbeck and Pearsall, (attended
at.7:37 p.m.); Clerk Asteson
ABSENT: None.
The Mayor called the meeting to order at 7:33 p.m. All residents attending took part in
the pledge of allegiance to the flag. Councilman Hollenbeck gave the invocation.
MINUTES
MOTION: of Garrison, seconded by Branning, to approve the minutes of the special
meeting of October 10th, as corrected. Ayes - 4 - Nays - O.
Wakota Mutal Fireman's Aid Agreement
MOTION: of Hollenbeck seconded by Garrison, to approve the agreement for the Wakota
Fireman's Aid subject to retyping and the prior signing by the association
officers. Ayes - 5 - Nays - O.
MOTION: of Hollenbeck, seconded by Pearsall to accept the Administrator's recommen-
dation and retain the firm of Ernst & Ernst for the 1972 audit. Ayes
Nays - O.
Refuse collection discussion - The Administrator read aloud his memo to the Council
regarding the problems. All Councilmen collectors and residents were given an
opportunity to speak.
Public Nearing - Greenleaf 5th Addition utilities. Affidavit of publication read and
hearing called to order at 8:15 p.m. Engineer discussed proposed improvements. There
being no further discussion, the hearing was declared closed at 8:20 p.m.
Public Hearing - Lakeside Meadows utilities - Mayor read the affidavit of publication and
called the hearing to order at 8:22 p.m. The Engineer discussed the proposed development.

MOTION: of Garrison, seconded by Hollenbeck, to pass Resolution 1972-166 requesting
the State to review the speed limit on Galaxie Avenue for a 35 mph. speed
limit. Ayes - 5 - Nays ~ O.
Disability insurance policy for Firemen. Discussion on cost and benefits.
MOTION: of Garrison, seconded by Hollenbeck, to purchase the disability insursmce for
the Fire Department from Continental Insurance Company, as recommended by the
Administrator. Ayes - 5 - Nays - O.
MOTION: of Pearsall, seconded by Branning, to accept the streets in Palomino Hills 4th
Addition subject to the list of items submitted by the Director of Public Works
and to release the performance bond when above list has been corrected. Ayes ~
5 - Nays - O.

MOTION: of Branning seconded by Pearsall to grant final acceptance for the streets in
Greed-leaf 1st and Greenleaf 2nd Addition as well as final acceptance for the
boulvard trees in Scott Highlands 3, Scott Highlands 4th, Greenleaf 1st and
Greenleaf 2nd Additions and that the $3,500. cash escrow presently on deposit
as security for the foregoing items continue to be held in escrow as security
for other Thompson projects in progress in the Village. Ayes - 5 - Nays - O.
MOTION: of Branning, seconded by Pearsall, to approve the issuance of a transient-merchant
license to Enlow Stamp Service. Ayes - 5 - Nays - O.
MOTION: of Garrison seconded by Hollenbeck to pass Resolution 1972-167 setting a
public bearing for Greenleaf 6th Addition for December 6, 1972. Ayes - 5 - Nays
O
MOTION: of Hollenbeck seconded by Branning to approve a conditional use permit for
the A & W Drive-In with periodic review pursuant to Ordinance # 22, as recommen-
ded by the Planning Commission. Ayes - 5 - Nays - O.
MOTION: of Pearsall seconded by Hollenbeck, to grant a variance to D. Schimek, for
a side yard setback to 9' 8 1/2 for the house located at 126 Sweetwater Drive.
Ayes - 5 - Nays - O.
Council reviewed the application for renewal of a conditional use permit from Eugene
Hesli. Councilman Garrison read a letter of opposition from Mr. & Mrs. William Prairie.
Mr. Hesli submitted a letter with signatures from six neighbors who have no opposition to
the permit.
MOTION: of Pearsall, seconded by Hollenbeck, to not renew the conditional use permit
for Eugene Hesli. Ayes - 5- Nays - O.
MOTION: of Garrison seconded by Branning, to pass Resolution 1972-168, setting a pub-
lic bearing for December 6, 1972 for the subdivision and building permit for
Lots 6 & 7, Farquar Lake Addition. Ayes - 5 Nsys - O.
Grace Lutheran Church - held until next Wednesday for more work on deficiencies.
Discussion on bike traffic on Garden View Drive South.
MOTION of Pearsall, seconded by Brauning, to authorize the purchase of infield equip-
ment for the fields at West View,in the amount of $2,880. Ayes - 5 - Nays - O.
MOTION: of Pearsall, sec0nded by Branning, to pay the claims and bills; check # 5104
· thru #5183, in the amount of $329,473.36. Ayes ~ 5 - Nays - O.
MOTION: of Garrison, ssconded by Hollenbeck to,adjourn. Uananimously carried.
