PRESENT: Mayor Largen; Councilmen Pearsall, Branning and Hollenbeck; Clerk Asleson ABSENT: Councilman Garrison (Branning - part) The Mayor called the meeting to order at 7:35 p.m.. Proclamation re: Armfull of Love Christmas Effort - Community Action Council. Mayor read letter. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-169, declaring December 7 and 8 as sharing day. Ayes - 4 - Nays - 0. Mobil Oil - item held until Planning Commission arrival. MOTION: of Hollenbeck, seconded by Pearsall, to approve the inStallation of a street light at the intersection of Co. Rd. #38 and Belmont Ayes - 4 - Nays ~ O. Street assessment POlicy - Attorney and Engineer commentedl Changes discussed. Will be retyped and resubmitted to Council. Mobil Oil permit discussed with the Planning Commission. MOTION: of Branning, seconded by Pearsall, to amend a Wording of the motion of September 27, 1972, with regard to the issuance of a conditional use permit to Mobil Oil, as per,Exhibit A attaChed. Ayes - 3 - Nays - O.(Hollenbeck). Councilman Hollenbeck requested considering the prior actions, the Attorney to comment in the near future as to whether or not the previous motion was legal. Public Hearing - Planning Commission and Village Council - Poppler-Cardarelle - The Mayor read the affidavit of publication and called the hearing to order at 8:30 p.m. The Planning Consultant located the property on the map and Mr. Frank Cardarette discussed the proposal. Discussion on location of park, types of houses, price range, etc. Mr. Poppler said they would be custom built. There being no further discussion, the hearing was declared closed at 9:10 p.m. Branning left at 9: 15 p.m. · MOTION: of Hollenbeck, seconded by Pearsall, to pass Resolution 1972-170, ordering sale of $735,000. temporary improvement bonds, $306,000. park bonds, and $15,000. equipment certificates; said bids to be taken on November 29, 1972, at 7 O0 p.m. Ayes - 3 - Nays - 0. MOTION: of Hollenbeck, seconded by Pearsall, to approve the contract for Greenleaf 5th Addition with Orrin Thompson Construction, with the addition of sidewalk on 132nd Street. Ayes - 3 - Nays - O. MOTION: of Hollenbeck, seconded by Pearsall, to withdraw the motion of September 27, 1972 regarding the Wildwood Contract. Ayes - 3 - Nays - O. MOTION: of Hollenbeck, seconded.by Pearsall, to approve the Wildwood Contract for Planned Unit Development with Inland Construction. Ayes - 3 - Nays - 0. MOTION: of Hollenbeck, seconded by Pearsall to approve the Meadows Planned Unit Development Contract and Phase I of development, as amended with Palomino Development Corp. Ayes - 3 - Nays - 0. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-173, ordering the improvement and awarding the bid for Greenleaf 5th Addition water and sewer to Erickson Bros., the low bidder, in the amount of $134,917.85, as recommended by the Village Engineer. Ayes - 3 - Nays - 0. MOTION of Pearsall, seconded by Hollenbeck, to pass ReSolution 1972-174, ordering the Lakeside Meadows improvements, and to instruct the EngiDeer to negotiate a change- order to the Austin P. Keller Wildwood project for those improvements. Ayes - 3- Nays - 0.; MOTION: of Hollenbeck, seconded by Pearsall to approve issuance of a building permit to Mount Olivet.Assembly of God Church to build a gavage. Ayes - 3 - Nays - 0. MOTION: of Hollenbeck, seconded by Pearsall, to pass Resolution 1972-175, setting a public hearing for December 6, 1972 for the purpose of amending the public hearing pro- cedure in the zoning ordinance~ #22. Ayes - 3 - Nays - 0. Ed McMenomy commented on the bicycle problem on Garden View.Drive South. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-176, authorizing the Police Department to erect signs, restricting bicycles and pedestrians from Garden View Drive South, except for right angle crossing. Ayes - 3 - Nays - 0. Councilman Pearsall commented on the hearing scheduled for CATV for November 8th, which has been rescheduled for November 29th. He said it would be a one-hour presentation. MOTION: of Hollenbeck seconded by Pearsall to pay the claims and bills; check #5184 thru # 5255, in the amount of $135,172.73. Ayes - 3 - Nays - 0. MOTION: of Pearsall, seconded by Hollenbeck, to adjourn. Unanimously carried. Adjourned at 10:45 p.m. Mayor Clerk
