Minutes of the meeting of the Village Council, Village of Apple Valley
Dakota County, Minnesota held on November 26, 1969 at 2 00 p. m.
PRESENT Mayor Largen, Councilmen Garrison, Pearsall and Branning -
Councilman Hollenbeck attended at 3 30 p.m. - a.nd Administra-
tor Curtis E. Olsen
ABSENT None
The Mayor c~11ed the meeting to order at 2 10 p.m. All residents attending
took part in the pledge of allegiance to the flag. Pastor Leitze of Christus
Victor Lutheran gave the invocation for this meeting.
MOTION of Pearsall, seconded by Garrison, to approve the minutes of the
meetings of November 12th and November 21st, 1969, with the
corrections. Those in favor Pearsall, Garrison, Largen and
Branning - opposed - none. Motion carried.
MOTION of Garrison, seconded by Pearsall, that ordinance No. 67, an
ordinance raising the maximum penalty for misdemeanors under
Village ordinance, be adopted. Those in favor Garrison, Pearsall,
Largen and Branning - opposed - none. Motion carried.
Administrator's Report
The Treasurer's Report for the month of October was submitted.
In regard to the audit for the last year, the Administrator said he found
a lot to be desired. He would like to interview another firm prior to
recommending a firm to be retained for the 1969 audit.
MOTION of Pearsall, seconded by Branning to authorize the Administrator
to talk to Ernst and Ernst and another organization prior to the
Council retaining an audit firm for the 1969 audit. Those in
favor Pearsall, Branning, Largen and Garrison - opposed - hone.
Motion carried.
Valley Commercial Park
MOTION of Pearsall, seconded by Garrison, to accept the final plat of
Valley Commercial Park, subject to receipt of agreements from the
property owners as to restricted road access. Those in favor
Pearsall, Garrison, Branning, and Largen - opposed - none. Motion
carried.
MOTION of Pearsall, seconded by Branning to authorize the Engineer to
prepare a preliminary report on the plans and specs for the fron-
tage road along Cedar Avenue from 147th Street to the entrance
of Pennys. Those in favor Pearsall, Branning, Largen and
Garrison - opposed - none. Motion carried.
Dr. Vogen asked if he could start his building as his loan commitment
would expire in just a few days.

John Voss showed the Council the plans for a car wash.
MOTION of Pearsall, seconded by Garrison, that we accept the Planning
Commission's recommendation to approve the special use permit
for the car wash and gasoline pumps for Lot 3, Block 2 of Valley
Commercial Perk. Those in favor Pearsall, Garrison, Hollenbeck,
Lar en and Brannin - o osed - none. Motion carried.

meeting, were presented by Orrin Thompson. The Engineer said there would
be no necessity to change the Plat.
MOTION Pearsall, seconded by Garrison, to approve the preliminary plat of
Greenleaf First Addition. Those in favor Pearsall, Garrison,
Hollenbeck, Largen, and Branning - opposed - none. Motion carried.
Cedar Knolls Assessment
Mr. Thorson would like to pay $1~+3,~75. to the Village at this time and is
requesting that the balance of $373,878.x+8 be assessed over a three year
period at 6~o per annum.
MOTION of Pearsall, seconded by Hollenbeck, to adopt the resolution for
the assessment of the Cedar Knolls area. Those in favor Pearsall,
Hollenbeck, Largen, Garrison and Branning - opposed - none.
Motion carried.
Street Lights
MOTION of Branning, seconded by Garrison, that installation of street
lights at the following locations be authorized, 132nd Street
s (Lehman Rd) and Gala,xie, C.S.A. H. 38 at Cedar, Rimrock Drive a.nd
CardenVew, Pennock and County Road x+2, Galaxie and County Road
x+2. Those in favor Branning, Garrison, Pearsall, Largen and
Hollenbeck - opposed - none. Motion carried.
Bob Hollenbeck said he would look into some type of Christmas decoration
=y~ for the Village.

MOTION. of Largen, seconded by Iollenbeck, to buy lights to decorate
one tree outside of the Village Hall. Those in favor Largen,
Hollenbeck, Garrison, Branning and Pearsall - opposed - none.
MOTION of Pearsall, seconded by Garrison, to have the Administrator re-
quest the gravel operators to submit a future use plan for their
area to the Village by January 1, 1970. Those in favor Pearsall,
Garrison, Branning, Hollenbeck and Largen - opposed - none.
Motion carried.
MOTION of Hollenbeck, seconded by Pearsall, to authorize a letter to
the Dakota County Auditor abating the tax levy for debt service
for bonds other than that prodded for in the annual tax levy
resolution. Those in favor Hollenbeck, Pearsall, Branning,
Largen and Garrison - opposed - none. Motion carried.
The hearing dates for the Planning Commission items were set for Decem-
ber 17, 1968.
The curfeTa ordinance was turned over to the Police Committee for the
recommendations.
MOTION of Hollenbeck, seconded by Branning, to pay the bills. Those in
favor Hollenbeck, Branning, Pearsall, Largen and Garrison -
opposed - none. Motion carried.
MOTION• of Hollenbeck, seconded by Pearsall, to raise the salary of
Lyle Knutsen to 675.00 per month, starting December 1, 1968.
Those in favor Hollenbeck, Pearsall, Garrison, Largen and
Branning - opposed - none. Motion carried.
MOTION• of Pearsall, seconded by Hollenbeck, to adjourn at 5 25 p.m.
Unanimously carried.

ORDINANCE N0. 67
AN ORDINANCE RAISING THE MAXIMUM PENALTY FOR MISDEMEANORS
UNAER VILLAGE ORDINANCE
The Village Council of the Village of Apple Valley, Dakota County,
Minnesota, ordains as follows.
pursuant to the Laws of Minnesota lg6g, Chapter 735, Section 7,
all ordinances of this Village which prescribe a maximum fine of
$100 00 or imprisonment fior g0 days for an ordinance violation, sha]1
now be deemed to prescribe a maximum fine of $300.00 or imprisonment
for g0 days or both.
This ordinance shall take effect immediately upon its enactment
and publication.

PROPOSED MODEL CURFEW ORDINANCE:

AN ORDINANCE ESTABLISi?ING A CURFEW FOR MINORS
AND PROVIDING PENALTIES FOR VIOLATION THEREOF
Sec. Z Restrictions nn T'}inors. It shall he unlawful for any minor
under the ale of sixteen (16) years to he in or upon any public street, highway,
road, alley, park, playground, or public places or public buildings, or in or
upon places of entertainment or amusement open to the public in the (name of
city or village) between the Hours of ten o'clock P.2~4. and five o'clock A.". It
shall be unlawful for any minor who is 16 or ].7 years of. age to be in or upon
any public street, highway, road, alley, park, playground, or public places
or public buildings, or in or upon places of entertainment or amusement open to
t}ie public in the (name of city or village) between the hours of twelve o'clock
midnight and five o'clocl: A.Pt. The provisions of this section shall not apply
to ^inor ~.,.~om~aniad by his or }.er parent, guardian, or other adult person
hav{.np the care and custody of the minor, or to a minor who is upon an emergency
errand or other legitimate business directed by his or her parent, guardian, or
other adult person having the care and custody of the minor, or where the presence
of said minor in said place or places is connected with and required by some ` '
legitimate business, Trade, profession or occupation in which said minor is permitted
by law to be engaged. ~ _
Sec. 2 Duties of Parents or Gulydians. It shall be unlawful for the
^~~Yent, guardian, or other adult person having charge of a minor under the age of
eighteen (18) years to permit such a minor to be in or upon any public street, highway,
• road, alley, park, playground or other public grounds, places, or public buildings,
or in or upon places of entertainment or amusement open to the public in the (name
of city or village) during the hours prohibited by this Ordinance, provided, however,
tnat the provisions of t}Iis section shall not apply w}ien the minor is accompanied by
his or her parent, guardian, or other adult person having the care and custody of
the minor, where the. minor is upon an emergency errand or legitimate business directed
by his or her parent, guardian, or other adult person having the care and custody
of the minor, or where the presence of said minor, in said place is connected with
and required by some legitimate business, trade, profession, or occupation in which
said minor is permitted by law to be engaged.
Sec. 3 r?inors in Amusement Places. ?~?o person, operating or in charge
of any place of amusement, entertainment or refreshment which is open to the public
shall permit any minor under the age of 18 years to remain in such place during the
hours prohibited by this Ordinance, provided, however, that the provisions of this
Section shall not apply when such minor is accompanied by his or her parent, guardian
or other adult person having the care and custody of such minor.
See. 4 Penalty. Any person violating any provision of this Ordinance shall
be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine
not to exceed $300.00 or by imprisonment not to exceed ninety (90) days.
Sec. S Effective Date. This Ordinance shall be in force and effect from
and after its publication according to Iaw.

Gentlemen
As per your request, the County Board petitioned the State Traffic
Engineer to re-study the speed zoning on County Road 38 between
County Road 11 and County Road 23. I reviewed this area with a
representative of the District Traffic Engineer's office and concur
• with their findings that there has been very little new construction
abutting this road during the last ten months. Therefore, I must
support their position of retaining the present speed zoning at this
time.
I will continue to make periodic studies of this road and will
recommend a lower speed limit as soon as traffic conditions permit.

WHEREAS, the State of Minnesota, Department of Highways, have completed
an engineering and traffic investigation on County Road #38 and have
determined the reasonable and safe speed as follows:
60 miles per hour daytime - - 50 miles per hour nighttime
from County Road #11 to a point approximately 200 feet West
of Cimarron Road.
40 miles per hour from a point approximately 200 feet West
of Cimarron Road to C.S.A.H.#23.
NOW THEREFORE BE IT RESOLVED, that the existing speed limits on County
Road #3$ be retained as approved by the Department of Highways, State
of Minnesota.
AND BE IT FURTHER RESOLVED, that a certified copy of this resolution be
forwarded to the Village of Apple Valley, Dakota County, Minnesota.

I am enclosing herewith a certified copy of the County Board resolution
adopting the standard section for construction of CSAH # 23.
I have also enclosed a typical cross-section and plan illustrating first
. stage construction for a divided four lane highway with "open ditch"
drainage and typical section for a divi ded six lane street using urban
street section .
Please note the plan view provides for one additional left lane at inter-
sections with storage for approximately six passenger cars.
Also, please note the area colored red wi I I be an encroachment beyond
the 75 foot Right of Way in order to get drainage from abutting property
over the boulevard, through the gutter, at such time as it becomes
necessary to fi11 in the road ditches in order to provide six lane capacity.

Dear i~1r. Olson:
We are proposing to the Village of Apple Valley and to Orrin
Thompson Homes that our fixrn plant the following trees as boule-
vard trees in Apple Valley for newly completed homes the Fall of
ly6y and early Spring of 1970.

These trees will be planted bare root and in sizes between 12"
and 2" in diameter.
We have suggested these trees with. the plan of picking varieties
which will adopt to the light soil conditions existing in most of
Apple Valley, and still using quality trees.
Of the 30U trees anticipated to be needed we plan to plant 3 dif-
ferent varieties but to develop uniformity and symetry in appearance
when planted and growing we plan to plant only one type of tree in
any given block. To riix varieties within the block would give a
hodge-podge appearance and would be undesirable.
We believe this plan will give tre most desirable res~~:].ts.

SUBJECT: STREET LIGHT INSTALLATION
We have had under study for sometime the matter of specific additional
street light needs and a Village policy for future street light installations.
Additional light installations at the following locations have been
recommended
1. 132nd Street (Lehman Road) at Galaxie
2. CSAH 38 at Cedar
3. Galaxie at CSAH/#2
4. Rimrock Dr. and Garden View

The Planning Commission has recommended the adoption of a policy whereby
only street Lights along major thoroughfares and at hazardous intersections
would be installed and maintained by the Village, with all others to be
installed by neighborhood petitions and assessed.
• Without acting on the proposed policy at this time, it is recommended that
installation of the above lights be authorized, inasmuch as they are not in-
consistent therewith. The consideration of the proposed policy should be a
matter of further consideration between the Council and Planning Commission,
along with provision of sidewalks and other subdivision requirements.

Re: Preparation of- concept plans
•L-or Village Parks.
Dear Air. Olsen:
As outlined in the "Paxk Development Program - October 1969" the next step in the
development of the parks in the Village would be the preparation of concept plans
for each park. This would consist of a scaled pencil drawing indicating the proposed
use for every area of the park. This plan should also be accompianed by corresponding
cost estimates.
After the plan is adopted a rendering for display purposes and working drawings
i~Tould be prepared.
The estimated cost of preparing the concept plans and corresponding cost estimates

Redwood Park South 250.00
I recommend that we start with these parks. The above are only estimates and the
~~rork would again be done on an hourly basis.
I also estimated that we could have the plans for Greening and Duchess parks ready
for review by the Park Commission within 2-3 weeks.
