Minutes of the meeting of the Village Council, Village.of Apple Valley, Dakota County,
Minnesota held December 6,' 1972.
PRESENT: Mayor Largen; Councilmen Branning (part), Hollenbeck,and Garrison; J. Bell;
and Deputy Clerk
ABSENT: Councilman Pearsall
The Mayor called the meetimg to order at 7:40 p.m.
MOTION: of Garrison, seconded by Hollenbeck to pass Resolution 1972-187, awarding
the bid for $120,000. Municipal Revenue Bonds to Moore, Juran & Co. the
lowbidder, at the net interest rate of 5.933%, as recommended by the finan-
cial consultant; and to authorize Mayor and Clerk to'sign agreement. Ayes - 4
- Nays - 0.
MOTION: of Hollenbeck, seconded by Garrison, to approve the minutes of the meeting of
November 8, 1972, as corrected. Ayes - 4 - Nays - 0.
Commission minutes of October 18th, November 1 and November 15, 1972 received.
MOTION: of Branning seconded by Hollenbeck, to approve the tax abatements for Roger
Gilmore, Dennis Sanders, and the Village of Burnsville. Ayes 4 - Nays - 0.
MOTION: of Hollenbeck, seconded by Garrison, to accept the Recreation Director's
report and authorize the hiring of Don Ripple to study the report, at a fee
of $1,500., with payment to be made from the park escrow fund, and to give
the Council his recommendations , in writing, by December 22~ 1972. Ayes - 4 -
Nays - 0.
Public Hearing, Greenleaf 6th Addition rezoning and preliminary plat. The affidavit
of publication was read,and the Mayor called the hearing to order at 8:00 p.m. The
Planning Consultant expiained the proposed plat. More detailed discussion on hearing
attached to these minutes. There being no. further discussion, the hearing was declared
closed at 10:25~ p.m.
Councilman Branning left at this time.
Publis Hearing Hesli property replat. The Mayor called the hearing to order at 10:35
p.m. and read the affidavit of publication. The Planning Consultant expaliqed the
proposal for the replat. Mr. Hesli explained they wanted to move the lotl-line in
order to add a house on the other lot for his mother-in-law. There being no discussion,
the hearing was declared closed At 10:40 p.m.
Public hearing, Amendments to Ord.# 9 and #22. The Mayor called the hearing to order
at 10:40 p.m. and read the affidavit of publication. The Planning Consultant discussed
the proposed changes with the Council. There being no further discussion, the hearing
was declared closed at 11:00 p.m.
MOTION: of Garrison, seconded by Hollenback, to pass Resolution 1972-188, pertaining
to Traffic Signals at County Road #42 and Gardenview Drive, and a;pedestrian
overpass at Elm Drive across County Road #42. Ayes - 3 - Nays - 0.
Councilman Branning returned.
Attorney, Council and petitioners went over the Cottle-Herman contract,

MOTION: of Garrison, seconded by Hollenbeck, to pass Ordinance #120, rezoning the 80-acre
Cottle-Herman property to M-2 P.U.D. and to approve the developement contract
and authorize the Mayor and Clerk to sign name. Syes - 4 - Nays - 0.
Poppler-Cardelle rezoning and preliminary plat - Council went over details of the Planning
Commission recommendation with the petitioner. The request will be resubmitted to the
Coancil at a later date after additional staff review.
Cobblestone Rezoning and PUD plan. Discussion on drainage of storm water and park require-
ments.
MOTION: of Branning, seconded by. Hollenbeck to authorize the attorney to draft' an ordinance
rezoning the Cobblestone property and to have the contract prepared~ in accordance
with the items discussed, for final action at a later date. Ayes -. 4 - Nays - 0.
MOTION: of Hollenbeck,.seoonded by Garrison to pass Resolution 1972-189, setting a public
heariDg for January 3, 1972 at 8:00 p.m., regarding a proposed amendment to the
Multiple Dwelling Ordinance. Ayes - 4 - Nays - 0.
MOTION: of Branning seconded by Garrison to authorize the Park Director to hire Ron
Peterson to help with.flooding and maintenance of the rinks, at a salary of $2.75
per.hour. Ayes - 4 -~ Nays.- 0.
MOITON of Hollenbeck, seconded by Garrison to adjourn. Unanimously carried.

Discussion on Public Hearing, Greenleaf 6th Addition--
Discussion with Orrin Thompson on right-of-way if Pilot Knob were re-routed to the
West.
The Mayor questioned Mr. Thompson about the overall plan, with regard to the new concept
in P.U.D. single family dwellings, with varied setbacks, etc. He also asked about the
sidewalks.
Councilman Branning questioned the trailway system around the lakes, and said that he
would like to see more open space around them.
Councilman Garrison said he would like to see the shoreline preserved also. He also
questioned the possibility of the major N-S street being moved away from the trees.
Mr. Goodoien said he would like to see the specific locations of the streets where the
12-15% grades are; how many where, and alternate accesses, especially in regard to
the safety of the residents.
Mr. Thompson commented on the park dedication. .
Mr. Ulrich had a question about the final platting, and the possibility of not setting
the lot .lines in the beginning, .as with townhouses~ and then the houses could be placed
in a better location with regards to the neighboring houses, trees, style of house~
This might possibly even across lot lines.
The hearing was then opened to the public--
Mrs. Robert Goering questioned a discussion on a proposed municiapl park in that. area.
She would like Village to be able to purchase the green area around the lake for' a
municipal park. If Co. Rd. 31 would go the Westerly alternate, would Mr. Thompson be
still interested zn purchasing just the ares to the West of the new alignment and the
Village buy the Eastern portion.
Councilman Branning read the letter from the Dakota County Engineer, dated 10-31-72,
with regard to County Road #31.
Mr. Mendell Weiner attorney, retained by most of the residents present~ expressed the
view of those residents, stating their opposition to this plat, and their opposition
no County Road #31 as it now stands.
Mr. Goering asked to have Mr. Thompson erase all the green portion shown as trees on
the original map, to give them an idea what would be left of the trees if the develop-
ment should come in as it is proposed.
Mrl Lloyd Petry questioned'what part of the land was Mr. Doyles, and how many people
would be living in this area when fully developed. He was shown the area and told
that there would be about 1,600 people living there. Hec. then asked if the airport
would still be in operation. Yes, for the time being.
Mr. Glen Gilmore asked if anything was discussed with regard to widening or expanding
Ellice Trail for increased and higher speed traffic.
Councilman Garrison said they would preserve this street. It would be a residential
collector but the speed limit would not be more that 30.
Mr. Urban Schneider asked about the assessments for sewer and water and if his property
would be affected. He was told he would-not be assessed at this time .
Mr, Skinner asked about Apple Vallye's program regarding providing land for schools.
The school policy was discussed with him.
Mr, Henry Zelenka asked if there would be sewer in this development. Yes.
Dick Corrington asked if this proposal fell into the ideas outlined in the Comprehensive
Plan. Yes. Where will the Village Center be? NE of this plat.
Discussion on street plans for future.
Glen Gilmore questioned the drainage plan and how it affected his property.
