PRESENT: Mayor Largen; Councilmen Pearsall and Branning; Clerk Asleson attended at 9:15 ABSENT: Councilmen Hollenbeck and Garrison The Mayor called the meeting to order at 8:10 p.m. Public Hearings 1. Whitney Drive Improvements- Affidavit of publication was read aloud and the hearing opened at 8:10 p.m. The Engineer explained the proposed improvements. There being no further discussion the hearing was declared closed at 8:20 p.m. 2. Proposed rezoning Outlot E, Greenleaf 4th Addition- Affidavit of publication read and hearing declared open at 8:25 p.m. The Planning Consultant discussed the proposal. Pastor Teigen was present to answer any questions. There being no further discussion~ the hearing was declared closed at 8:28 p.m. 3. Continuation of assessment hearing Eaton's Trailer Park- declared open at 8:29 p.m. Mr. Bergen was present and discussed his meeting this afternoon with the Clerk and the reduction of $348.01 in the proposed assessment. He also had some question about the fill taken out and replaced which the Engineer will check on. There being no further discussion the hearing was declared closed at 8:44 p.m. 4. Continuation of Lapaz Addition hearing declared open at 8:44 pom. Mr. Voss discussed the questions raised at the last meeting. Mr. Gilmore asked for a clarification of the park dedication. He will discuss this further with Mr. Voss later. There being no further discussion the hearing was declared closed at 9:04 p.mo Municipal Building Expansion- the building inspector discussed the bids received and rec- ommended the Council award the bid to the low bidder. MOTION: of Pearsall, seconded by Branning, to pass the resolution awarding the bid to Leibfried Construction, Inc. the low bidder in the amount of $47,750.00. Those in favor Pearsall, Branning and Largen - opposed - none. Motion carried. Petitions Requests & Communications 1. Thompson request for $3,500 escrow release- Council tabled request because of situation of boulevard trees and also the grading in the parks has been reviewed. 2. Fire Prevention Code Summary- Jim Reemts, the Fire Marshall was present and discussed this with the Council. This would be a summary in writing for apartment and other commercial builders; to be used as a guide when discussing ordinance requirements. The Mayor invited the Fire Department and Village employees to participate in the Donkey sofball game to be held on September 19th. This was a challenge from the Jaycees. 3. Notice of regional meeting of municipal league to be held Thursday, September 23, Received. 4. Criminal Action Briefs- noted received. 1971. Ordinances & Resolutions 1. Resolution requesting snowmobile regulations from Dakota County. MOTION: of Pearsall, seconded by Branning, to pass the resolution requesting the County adoption of a model snowmobile regulation. Those in favor Pearsall, Branning an.d Largen - opposed - none. Motion carried. 2. Lakeville Fire Service Agreement- MOTION: of Branning seconded by Pearsall, to pass the resolution reinstating the fire service agreement with Lakeville retroactive to May 1, 1971, and request immediate negotiations with the County for a new fire contract. Those in favor Branning Pearsall and Largen - opposed - none. Motion carried. 3. Resolution approving assessments- Clerk submitted the resolution which had been prepared by the attorney. Note: Regarding Mr. Hogan's situation- It was discussed at this meeting, prior to the motion~ and, should it have been necessary for him to break into the street at the time of his hookup to the city sewer, he would have received a credit on his street assessment. His assessment will stand. MOTION: of Pearsall seconded by Branning to pass the resolution, certifying to the County the assessments.on Apple Valley 4th Addition Sewer and Street Improvements, Galaxie Avenue Street Improvements from 132nd Street to 146th Street, Valley Park Frontage Road, Eatons Trailer Park and Eatons Ranch. Those in favor Pearsall, Branning and Largen - opposed - none. Motion carried. Mr. Pagel of the Dakota County Commissioners has requested a meeting with the Village Council on Monday, September 13th at 7:30 p.m. regarding the Burnsville Crosstown. Mr. Bonestroo is to be at the meeting. Mayor Largen read a letter of thanks to the rescue and emergency unit of the Fire Department and to the Police Officer on duty at the time his daughter broke her wrist at the Apple Valley Coun- try Club. Noted received. July Treasurer's Report - received. The Building Inspector has asked a week's delay on the Donnay sign problem. Orrin Thompson's request for permission to put up three or four signs on Galaxie to reroute the truck deliveries to their new field shack location near Fairgreen was explained by the inspector. Mr. McNamara's request for permission to operate four or five nights a month, for special pro- jects was explained by the inspector. Old Business Clerk-Typist job status- held until next week. Clerk has requested one councilman to sit in on interviews. Permit to Northwestern Gravel is in order for issuance. MOTION: of Pearsall, seconded by Branning to authorize issuance of said gravel permit to Northwestern Sand & Gravel. Those in favor Pearsall~ Branning and Largen - opposed - none. Motion carried. Maintenance Building- Councilman Pearsall discussed letter he received from the Engineer. Eng- ineering fees were discussed. MOTION: of Pearsall seconded by Branning to pass the resolution authorizing the Engineer to prepare plans and specs, and advertise for bids for a new utilities maintenance building Those in favor Pearsall, Branning and Largen - opposed - none. Motion carried. Engineer's Report He had a meeting with the Metro Sewer Board staff and Metro Council staff, regarding plans Apple Valley and the surrounding areas. The Metro Sewer Board has approved our construction requests, but it still has to be approved by the Metro Council. The referral committee will be meeting Thursday, September 2nd. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 Communication received from County requesting our plans for improving any County roads in Apple Valley during 1972. New Business 1. Authorize purchase of paint sprayer- Mr. Kohls has three bids which he submitted to the Council. He recommended the push-type model and the quote from Hayden-Murphy Company. Council was in favor of the self-propelled model~ because of the need for using this on the football fields. MOTION: of Pearsall, seconded by Branning, to authorize purchase of the HaydenoMurphy self- propelled paint sprayer in the amount of $1,020.00. Those in favor Pearsall,. Branning and Largen- opposed - none. Motion carried. 2. Street lighting installation at County Road #31 and #9. MOTION: of Branning~ seconded by Pearsall, to authorize installation of same. Those in favor Branning, Pearsall and Largen- opposed - none. Motion carried. 3. Seeding project- MOTION: of Branning, seconded by Pearsall, to authorize the seeding of Baldwin Park, based on the school's proposal, at Village cost of $780. Those in favor Branning~ Pearsall and Largen - opposed - none. Motion carried. 4. Purchase contract for water meters- Clerk explained. MOTION: of Pearsall, seconded by Branning to authorize signing of contract. Those in favor Pearsall, Branning and Largen - opposed - none. Motion carried.
