Minutes of the special meeting of the Economic Development Authority of Apple
Valley, Dakota County, Minnesota, held May 13th, 1993, at 8 00 o'clock p m at
Apple Valley City Hall
PRESENT President Branning, Commissioners Erickson, Goodwin, Humphrey and
Sterling
ABSENT None
City staff members present were City Administrator Melena, City Clerk Mueller,
City Attorney Sheldon, Finance Director Ballenger, Personnel Director Boland,
Parks & Recreation Director Johnson, City Planner Kelley, Assistant Public Works
Director Miranowski, Police Chief Rivers, and Community Development Director
Welsch
President Branning called the meeting to order at 10 05 p m
MOTION of Erickson, seconded by Sterling, approving the minutes of APR 22, 1993
the special meeting of April 22nd, 1993, as written Ayes - MINUTES
5 - Nays - 0
MOTION of Erickson, seconded by Goodwin, adopting Resolution No RES EDA-93-3
EDA-93-3 establishing a policy for retention of and CABLECAST
duplicating procedures for meeting video tapes and MEETINGS
authorizing cablecasting of meetings beginning with the
meeting of May 13, 1993
MOTION of Humphrey, seconded by Branning, amending the foregoing AMEND MOTION
motion by beginning cablecast of meetings effective with the
next EDA meeting Ayes - 4 - Nays - 1 (Erickson)
Vote was taken on the motion as amended Ayes - 5 - Nays - 0
Commissioner Goodwin said he is concerned about the business reten- BUSINESS
tion portion of the Business Assistance Program He supports funding ASSISTANCE
the incubator portion and would like to shift funds to encourage a PROGRAMS
true business incubator program
Commissioner Erickson said he is concerned about some of the details of the
program, such as non-compete provisions
Commissioner Sterling said she believes the business retention program should not
be bringing in businesses from another community, but agrees with using it to
help an existing business already here and trying to expand
Commissioner Humphrey said he does not believe the competition issue is a
legitimate argument against the program

President Branning said he has worked hard to get businesses into the community
and does not want to see them leave Other communities have programs to attract
business and Apple Valley has to compete He suggested that applications for the
business retention portion be looked at on a case-by-case basis rather than
eliminating it
MOTION of Goodwin, seconded by Erickson, amending the allocation of BUS ASSIST
available funding in the policy for Business Assistance FUNDING
Programs to provide 50 percent for Business Incubators, 30 ALLOCATION
percent for Business Retention, that is expansion of busi-
nesses already in the City, and 20 percent for Discretionary

Mr Melena said Community Action Council has finalized all of the CAC AGREEMENT
documents, except one, to complete its agreement with the EDA It is & NEW APPS.

May 10, 1993 They are from Hitec Laboratories, Suburban Title and Sterling/
SunAmerica Securities
MOTION of Erickson, seconded by Humphrey, approving the Agreement CAC ASSISTANCE
with Community Action Council, Inc for business retention AGREEMENT
rental assistance totaling approximately $70,000, over three
years, for 10,000 square feet of space, and authorizing
execution of the necessary documents Ayes - 3 - Nays - 1

MOTION of Goodwin, seconded by Sterling, accepting the application, HITEC LAB
dated April 8, 1993, of Hitec Laboratories USA, Inc for APPLICATION
business incubator rental assistance totaling approximately
$13,920, over three years, for 800 square feet of space, and
directing the Attorney to prepare the necessary agreement

MOTION of Humphrey, seconded by Sterling, accepting the SUBURBAN TITLE
application, dated April 21, 1993, of Suburban Title, Inc APPLICATION
for business retention rental assistance totaling
approximately $17,500, over three years, for 1,000 square
feet of space, and directing the Attorney to prepare the
necessary agreement Ayes - 3 - Nays - 1 (Goodwin)
(Erickson Abstained)
MOTION of Humphrey, No Second, accepting the application, dated STERLING/
March 30, 1993, of Sterling/SunAmerica Securities, Inc for SUNAMERICA
discretionary business attraction rental assistance, with APPLICATION
the following change to the original application allowing
for a total of approximately $9,680, over two years, for
1,100 square feet of space, and directing the Attorney to
prepare the necessary agreement Motion failed for lack of
a second

The Board received a letter dated April 27, 1993, from James O'Meara, SOUTHPORT
concerning the Ryan/Target Southport Centre replatting for Best Buy TIF AGREEMENT
Store He indicates that no action is required of the EDA in connection
with tax increment financing agreements on the property
The Board received a letter dated April 27, 1993, from Metro East METRO EAST
Development Partnership concerning membership renewals for the years RELATIONSHIPS
1994-1996 Mr Welsch reviewed a chart showing the relationship of
Metro East, the Private Industry Council and Dakota County Economic Development
Partnership. He noted the EDA is a member of each and Metro East works as a
consultant with these groups
MOTION of Sterling, seconded by Erickson, setting a special meeting SET SPECIAL
on May 27th, 1993, at 8 00 p m at City Hall Ayes - S - MEETING
