Minutes of the special meeting of the Economic Development Authority of Apple
Valley, Dakota County, Minnesota, held March 11th, 1993, at 8 00 o'clock p m at
Apple Valley City Hall
PRESENT President Branning, Commissioners Erickson, Goodwin, Humphrey and
Sterling
ABSENT None
City staff members present were City Administrator Melena, Deputy City Clerk
Gackstetter, City Attorney Dougherty, City Engineer Gordon, Finance Director
Ballenger, Personnel Director Boland, Public Works Director Gretz, Parks &
Recreation Director Johnson, City Planner Kelley, Police Chief Rivers, Assistant
City Administrator Weldon, and Community Development Director Welsch
President Branning called the meeting to order at 10 55 p m
MOTION of Sterling, seconded by Goodwin, approving the minutes of FEB 25, 1993
the special meeting of February 25, 1993, as written MINUTES
Ayes - 5 - Nays - 0
The Board received a revised agreement dated March 11, 1993, concern- RYDELL/A V
ing transfer of rights under the Development Assistance Agreement FORD AGREEMENT
between it and The Rydell Company Commissioner Erickson asked if AMENDMENT
the requested name change, from The Rydell Company to Valley Apple
Ford, Inc would increase the City's financial exposure under the Agreement? Mr
Dougherty said it would not
President Branning asked Mr Gordon to present to the EDA the City's
recommendation for keeping 151st Street open Mr Gordon reviewed the plans
President Branning asked the representatives of the Rydell Group to commit to
working with the City in the future Mr Jon Hoganson, the attorney for The
Rydell Group, explained the reason Rydell is requesting the name change He
further stated that although Rydell will agree to work with the City towards such
a plan, they believe they already have an approved development
President Branning again stressed the importance of this issue and asked Rydell
to commit to work together to resolve this issue
Commissioner Erickson said he does not want this to turn into an adversarial
relationship and hoped both sides can work together with an open mind
Commissioner Sterling asked Rydell what percentage of total parking would be lost
if Mr Gordon's plan were used and 50 parking spaces were removed? Mr Jim Price
said it would be five percent, which is a significant amount and it is in the
most expensive area

MOTION of Erickson, seconded by Humphrey, approving the Agreement VALLEY APPLE
concerning transfer of rights involved in the Development FORD NAME
Assistance Agreement dated September 24, 1992, on Apple CHANGE
Valley Ford Addition from The Rydell Company to Valley Apple
Ford, Inc and authorizing the President and Secretary to
sign the same Ayes - 5 - Nays - 0
Mr Welsch presented the EDA with the draft application form for the BUSINESS ASST
Business Rental Assistance Program APPLICATION
MOTION of Erickson, seconded by Humphrey, approving the draft BUSINESS
application form for Business Rental Assistance as presented RENTAL ASSIST
to the Economic Development Authority Ayes - 5 - Nays - 0 PROGRAM APP.
Commissioner Sterling shared her concerns regarding the transfer of DISCUSSION OF
documents between the City Council and the Economic Development RESPONSIBILITY
Authority so that Apple Valley does not end up in the same situation
as the lawsuit making the City of Minneapolis responsible for certain actions Mr
Melena said the City is very careful about transferring documents and the city
attorneys are also constantly watching for this
MOTION of Sterling, seconded by Goodwin, to adjourn Ayes - 5 - Nays - 0
The meeting was adjourned at 11 25 o'clock p m
