PLANNING COMMISSION MINUTES
August 7, 1996
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called
to order at 7:04 p.m. by Chair Allen Felkner.
Members Present: Allen Felkner,- Karen Edgeton, Frank
Blundetto, Diane Nagler, and Marcia Gowling.
Members Absent: Paul Oberg.
Staff Present: Rick Kelley, Kathy Bodmer, and Keith Gordon.
Others Present: See the sign-in sheet.
2. APPROVAL OF AGENDA
Chair Felkner asked Staff and the Commission members if they
had any changes or revisions to the draft agenda. There, being .none,
he called for its approval.
MOTION: Member Gowling moved, seconded by Member Blundetto, to
approve the draft agenda. The motion carried 5 - 0.
3. APPROVAL OF NLY 17, 1996 MINUTES
Chair Felkner asked Staff and the Commission members if they
had any changes or revisions to the draft minutes submitted in the
packet. There being none, he called for their approval.
MOTION: Member Edgeton moved, seconded by Member Gowling, to
approve the minutes as submitted. The motion carried 4 - 0, with
one abstention (Felkner).

6. LAND USE/ACTION ITEMS
A. North Star Industrial Park 3rd Addition
Chair Felkner noted to members of the audience that in
accordance with the petitioner's wishes, and with information
contained in the staff memo, there would not be any action this
evening on the item.
Assistant Planner Kathy Bodmer introduced herself and noted
that she has the answers to some of the questions raised at the

hearing. She asked if the Commission wanted to have a full blown
presentation, or just the highlights of the information that had
been collected to date.
Chair Felkner stated that he would prefer to have a brief
synopsis at this time, since the information will need to be
repeated at the following meeting.
Ms. Bodmer identified the site on an overhead transparency of a
street map, and noted that the property is guided for Limited
Industrial uses and is zoned appropriately. There is not any change
being proposed in the land uses permitted at this time. She stated
that the proposed subdivision of the property with a preliminary
plat indicated 147th Street following along the north line of the
property, adjacent to the existing single family neighborhood for
about half the width of the plat. She said the most significant
question raised at the public hearing by the adjacent residents was
why this location for 147th Street was being proposed when they had
been under the impression that 147th Street would cross in the
center of the industrial property, approximately 300 feet to the
south.
Ms. Bodmer explained that 147th Street is a community collector
roadway that is intended to extend in a continuous alignment from
Pilot Knob Road, in a westerly direction to connect to the east side
of the City's downtown commercial area.
Ms. Bodmer noted that the initial alignment of 147th Street was
presented to North Star Companies and Williams Brothers Pipeline
since it would traverse their property. They raised objections
concerning the splitting of their property by this more central
roadway alignment because it would preclude their ability to easily
expand their current operations. Since these two corporate entities
owned the property from which the street right-of-way would have to
be acquired, the City was compelled to shift the alignment further
to the north.
Ms. Bodmer noted that in order for 147th Street to function
appropriately as a community collector roadway, it must have a four-
way intersection at Johnny Cake Ridge Road to allow for continuous
traffic movements without any offset, which would require traffic to
jog along Johnny Cake Ridge Road.
In addition, a four-way intersection is necessary in order for
appropriate traffic control to be established at Johnny Cake.
Without a four-way intersection, Johnny Cake would not be stopped at
either leg of 147th Street.
Ms. Bodmer went on to note that at the public hearing, North
Star had been asked to evaluate shifting the alignment of 147th
Street south and then placing the curve on their property on the
west side of Johnny Cake Ridge Road. North Star is still evaluating
the impact that this would have on their future development plans of
their concrete plant.

Ms. Bodmer stated that one of the other issues raised was for
the possible use of the triangular-shaped property in the northeast
corner of the proposed plat of North Star Industrial Park 3rd
Addition.
Ms. Bodmer displayed an overhead transparency showing potential
building sites on this lot. The site, although impacted by the
presence of the Williams Brothers Pipeline easement, could easily
accommodate a 6,000 square foot building on one side of the
easement, and a 8,000 square foot building on the other side.
Parking could occur in the central area on top of -the pipeline
easement, but could also extend up to 20 feet of the north and east
lines of the triangle.
Ms. Bodmer stated that the final significant issue raised at
the public hearing concerned the traffic on 147th Street. First
off, the speed limit on 147th Street would be established at 30
miles per hour. Ms. Bodmer noted that speed limits are established
in accordance with state law, which stipulate that based on
horizontal and vertical curves of the roadway, along with the number
and spacing of driveway intersections, create a 30 mile per hour
limit on roads such as 147th Street. Roads not meeting this
criteria would be designated as 55 miles per hour, unless a study
was performed by the Minnesota Department of Transportation
stipulating some speed in between 30 and 55 miles per hour.
The estimated amount of traffic on 147th Street would be
between two and four thousand trips per day. She compared this to
other roads in the immediate vicinity to help people visualize the
actual impact of the roadway. Johnny Cake Ridge Road currently
carries between 5,700 and 6,300 trips per day; 140th Street carries
between 8,500 and 9,500 trips per day; and County Road 42 is
currently carrying 19,000 trips per day. All of these trips are
based on 1995 traffic counts.
Finally she noted that there are indeed many gravel trucks
using Johnny Cake Ridge Road on their way northbound to access
either 35E or Cedar Avenue. She noted that these trucks typically
turn on 140th Street to access the more major roads and would not be
likely to use 147th Street since its alignment would require some
southerly back tracking toward the City's central business district.
Chair Felkner asked when North Star might be done evaluating
the potential alternative 147th Street alignment.
Dave Ericksmoen stated that they have begun their examination,
but have not made a conclusion as of yet. He noted that they have
been having ongoing discussions with City Staff concerning this
issue. Mr. Ericksmoen then asked if at what time they would have to
inform the City that a conclusion either had or had not been made in
order for the agenda of the next meeting to properly reflect either
action on the item, or an additional tabling of the item.
Rick Kelley noted that the next Planning Commission meeting is
on August 21st. The City would need to know by Friday morning,

August 16th, when the agenda is prepared for distribution, if in
fact North Star desires to have the item tabled again.
Chair Felkner asked if there was any additional audience
comments on this item. He stated that he would accept comments only
if it contained new information concerning the item.
One unidentified member of the audience stated that they would
wait until the next Planning Commission meeting to address the
Commission. No further action was taken on this item.

MOTION: Member Blundetto moved, seconded by Member Cowling, to
adjourn the meeting. The motion carried 5 - 0. The meeting
adjourned at 7:19 p.m.
