HomeMy WebLinkAbout08/20/1997CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES August 20,1997 1. CALL TO ORDER The City of Apple Valley Planning Cormmission rneeting was called to order at 7:00 p.m.. Members Present: Diane Nagler, Jce McNamara, Karen Edgeton, Marcia Dowling, Lou Clark and Paul Oberg, Frank Blundetto. Members Absent: None. Staff Present: Rick Kelley, Tom Lovelace, Kathy Bodmer, Engineering Consultant Keith Gordon, City Attorney Mike Dougherty and Nelda Werkmeister. Others Present: Jim Dimond, Dennis Griswold, Randy Hedlund. 2. APPROVAL OF AGENDA Chair Edgeton asked Staff and the Commission members if they were any changes or additions to the proposed agenda. There being no other changes; Chair Edgeton called for approval of the agenda. MOTION: Dowling moved, seconded by Blundetto, to approve the agenda. The motion carried 7 - 0. 3. APPROVAL OF AUGUST 6,1997 MINiI"1'ES Chair Edgeton asked Staff and the Commissioners if they had any changes to the draft minutes submitted in the packet. There being none, she called for their approval. MOTION: Clark moved, seconded by McNamara, to approve the minutes. The motion carried 6-0 with 1 abstention (Blundetto). 4. CONSENT ITEMS -None - 5. PUBLICHF'ARJNGS -None- 6. LAND USE/ACTION ITEMS A. Conditional Use Permit for Class II Restaurant Big Apple Bagel Bakery in Autostop Assistant Planner Kathy Bodmer introduced the item, proposed to be located in leased space at Conoco's mixed retail center on 145th Street and Cedar Avenue, and then deferred to the petitioner. Jim Dimond, representing Big Apple Bagel Bakery operators Larry and Trish Bell, stated all issues addressed at the public hearing had been satisfied and the petitioner is agreeable to the staff recommendations outlined in the project report. Chair Edgeton asked for clarification of the awnings. Dimond said that any future awnings installed by other tenarrts at the Autostop would maTCh those of the Big Apple Bagel Bakery. Dimond replied that baking time starts between 4:30 & 5:00 a.m.; the closest home is 310-350 feet away, and no problems have been encountered at other locations. In response to a delivery track inquiry by Blundetto, Dimond said a rear service door would be installed to accept deliveries via the double lane in the rear alley. McNamara asked when granting a conditional use permit for a Class II restaurant in this situation, how does the city avoid opening up the door to other fast-food type places. Bodmer responded that is handled by placing specific conditions on the pernrit approval. MOTION: Clark moved, seconded by Gowling, to recommend approval of the conditional use pemut to operate a Class II restaurant in conjunction with a bagel bakery in an "RB" zoning district with the conditions outlined by staff. Motion carried 7-0. DISCUSSION ITEMS A. Receive Dakota County Rental Survey Community Development Director Rick Kelley said this is strictly an informational item, comparing vacancy and current rental rates throughout the county. He noted there was a 35% increase in one-bedroom rental rates. Chair Edgeton asked what vacancy rate is desirable. Kelley responded anything below 5%is considered quite tight. The city's vacancy rate is currently 1.21%. Clark asked staff if they knew the reason for the significant one-bedroom rate increase. Kelley answered that the large increase in one- bedroom rental rates is unknown. Oberg asked what percentage of the total housing units are rental. Kelley answered that 12-13% right now, which should increase to about 20% in response to the Livable Communities Act. 8. OTHER BUSINESS A. Receive Environmental Assessment Worksheet Regarding Regatta Development Assistant Planner Tom Lovelace introduced the item, noting that an environmental assessment worksheet (EAW) is required for any development exceeding 325 attached dwelling units, and it must be discussed at a public form. The comment period begazi August 11 and ends September 10. Dennis Griswold of Pulte Homes said he and engineer Randy Hedlund are available to address concerns or questions. Clark requested of staff a wpy of the calculations used to estimate population changes based on housing types. He also asked about site runoff addressed in question 18. Hedlund stated the response was based on the Wallcer model, and that the 70% removal rate is a NURP (National Urban Runoff Program) standard. McNamara. asked how the recommendations of the EAW aze implemented, or if they are. Kelley replied an EAW generates additional data and comments. The final plat approval conditions will Planning Commission Minutes August 20,1997 Page 3 incorporate appropriate recommendations. A brief discussion followed regarding any impacts of sand and gravel operations surrounding the site. 9. ADJOiJI2NMENT MOTION: Nagler moved, seconded by Clark, to adjourn the meeting. Motion carried 7-0. Meeting adjourned at 7:30 p.m.
