PLANNING COMMISSION MINUTES
November 19,1997
L CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order at 7:00 p.m..
Members Present: Karen Edgeton, Mazcia Gowling, Lou Clark ,Diane Nagler, Jce
McNamara, Frank Blundetto.
Members Absent: Paul Oberg.
Staff Present: Rick Kelley, Kathy Bodmer, Nelda Werkmeister, City Attorney Jim Sheldon.
Others Present: See sign-in sheet.
2. APPROVAL OF AGENDA
Chair Edgeton asked Staff and the Comnssion members if they were any changes or additions
to the proposed agenda. Community Development Director Rick Kelley suggested that Conditional Use
Permit Outdoor Storage Standards be added to Other Business.
MOTION: Cowling moved, seconded by Blandetto, to approve the agenda as amended. The
motion carried
6-0.
3. APPROVAL OF NOVEMBER 5, 1997 MINUTES
Chair Edgeton asked Staff and the Commissioners if they had any changes to the draft minutes
submitted in the packet. Edgeton noted that Blundetto had requested his reason for a nay vote on SB be
reflected in the minutes: that he did not oppose business, but that he did not warn to impose unnecessary
restrictions on business. She also said the second paragraph of that item should say "recommendations
do not relate to increasing the intensity of businesses." Kelley stated on p. 1 the name of the Holiday
Store manager should be Michele instead of Rochelle.
MOTION: Clark moved, seconded by Cowling, to approve the minutes as wrrected. The
motion carved 5-0 (1 abstention-Nagler).

B. Holiday Station Stores Conditional Use Permit for Outdoor Display
Assistant Planner Kathy Bodmer smmnarized the issues and addressed the concems raised at
the public hearing. Further review of the zoning code found that motor fuel sales stores may display
goods "generally required for the operation and rnaintenance of motor vehicles" as a pemutted use; thus
the windshield wiper fluid currently displayed is allowed. Exhibits A and B spell out the approval
criteria recommended by staff.
Edgeton asked about the width of the sidewalks in relationship to allowed display width.
Bodmer clarified that four feet must be allowed for pedestrian passage on sidewalks in all cases. Nagler
asked if there were any standards for storage or display of those auto-relayed items pemutted without a
wnditional use permit (CUP) Bodmer said there were not. However, the opportunity to address that
exists in amending the ordinance, which will be discussed further under Other Business. In response to
an inquiry by Clark, Bodmer said the Paul's 76 Outdoor Display CUP was included in the packet as a
jumping off point to start discussion to establish some standards. Clark said he would like to see staff
bring that before the Conunission.
The petitioner arrived at approximately 7:15 p.m.
In response to McNamara's request for clarification of Exhibit A and its prohibition of signage,
Bodmer stated Exhibit A is the proposed criteria for Holiday Store only. ff signage were part of a
special outdoor promotion, a pemut would be needed. Kelley noted that price cards could be included in
the amendment to the ordinance.
MOTION: Clazk moved, McNamara seconded, to recommend approval of the conditional use
pemut for outdoor display of merchandise at the Holiday Tmck Express with the conditions as listed in
staffs report. Motion carried 6-l).
OTHER BUSINESS
A. 1998 Meeting Schedule
Kelley said it was important to approve the 1998 meeting schedule because of pending
deadlines of which developers must be made awaze.
MOTION: Nagler moved, Blundetto seconded, to adopt the proposed schedule. Motion
tamed 6-0
B. Conditional Use Permit Amendment and Outdoor Storage Standards
Kelley said, in relation to previous discussion, an ordinance amendment could establish
standards for outdoor displays. The CUP standards for Paul's 76 is a jumping offpoint and could be
used for the purposes of setting a public hearing.
Edgeton asked if we're tallcing about standazds for a CUP or for items already pem~itted. Kelley
replied, "what is pemutted." Blundetto expressed his concerns about the seemingly excessive storage of
items at the back of the Coast to Coast store and how allowed temporary storage can become pemranent
if not monitored.

Bodmer stated that in addition to regulations for pemutted items, outdoor storage of propane
sales and ice freezers requires a CUP. She asked the Commission whether they would entertain revising
the motor fuel part to allow exemptions for propane sales and ice maclvues. ff exemptions were allowed
for those two items (pop machines aze aheady exempt), compliance with the ordinance could easily be
attained by the stores in town. Staff clarified that in that case location of these items would still be
reviewed. McNamara said he felt it was an appropriate time to address this issue.
MOTION: Growling moved, Blundetto seconded, to direct staff to put together documents and
set a public hearing at the next available Planning Commission meeting. Motion carried 6-0.
8. ADJOURNMENT
MOTION: Blundetto moved, seconded by Dowling, to adjourn the meeting. Motion tamed
6-0. Meeting adjourned at 7:30 p.in.
