PLANNING COMMISSION MINUTES
September 2,1998
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at
7:00 p.m.
Members Present: Diane Nagler, Karen Edgeton, Frank Blundetto, Tim Burke, Tom Melander,
Jce McNamara, Lou Clazk.
Members Absent: None.
Staff Present: Rick Kelley, Kathy Bodmer, Tom Lovelace, Consulting Engaieer Keith Gordon,
City Attorney Mike Dougherty, Nelda Werkmeister.
Others Present: See sign-in sheet.
2. APPROVAL OF AGENDA
Community Development Director Rick Kelley asked to add 7B, Information on Joint Plamilng
Commission Meeting for All Cities in Dakota County. Blundetto asked to add 7C, Annual Outing.
MOTION: Nagler moved, seconded by Clark, to approve the agenda as amended. The motion
carried 7 - 0.
3. APPROVAL OF AUGUST 19,1998 MINUTES
MOTION: Nagler moved, seconded by Blundetto, to approve the minutes. The motion carried 5-
0-2 abstentions (Clark, McNamara).

5. PUBLIC HEARINGS -None -
6. LAND USE/ACTION ITEMS
A. Palomino East Apartments -Preliminary Plat to Consolidate Outlots into 1 Lot; Site
Plan/Building Permit Authorization for 3-story 72-unit Apartment Building
Plamier Tom Lovelace reported that the site inspection done today revealed no additional wetland,
but other information has come to light, so staff is recommending this item be tabled until the next
meeting to allow time to evaluate the new information.
Blundetto requested area maps including more than just the site. Clark expressed frustration in
seeing so many people present interested in an issue that is now proposed to be tabled. He asked that
advance notice be given whenever possible.
MOTION: McNamara, moved, seconded by Burke, to table item this item for two weeks until
complete information is available. Motion carried 7-0.

B. Pinecrest 3rd -Rezoning to Planned Development No. 315 and Preliminary Plat for 4 Small
Lot Detached Single Family Dwellings
Assistant Planner Kathy Bodmer imroduced the item and reviewed the xernaining pr~rrrary issues:
drainage for the new lots, extension of Eveleth Path, and impacts of church activities on adjacent
properties. She reported that traffic studies done on Fairgreen Avenue revealed 300 cars per day, which
is well below road capacity and well below the level at which traffic engineers become concerned.
Bodmer went onto describe an incremental pazking/traffic solution which could include posting of signs
indicating no parking during peak church periods.
Kelley gave a brief history of the original main access to the church from Fairgreen. Nagler said she
thought staff should ask Pastor Harrington to continue to encourage his parishioners not to park on the
street.
Bev Hennes of 12617 Fairgreen objected to restricted pazking on Fairgreen. She said was not
complaining about the pazking as much as the danger posed by the traffic.
Edgeton stated she didn't think there was a decision to make about Fairgreen since it is a public
street and the neighborhood doesri t want restricted pazking. She suggested staff review the situation in a
yeaz after Johnny Cake is signalized at Co. Rd. 38 and the church access from Co. Rd. 38 is complete.
Kelley reviewed the reasons for staff recommending the extension of Eveleth Path. Nagler asked
about the soil boring requirement also recommended.
Dean Johnson, representing the petitioner, made himself available for questions.
Doug Skipper of 12685 Eveledm Path said he has had. sinkage in his front and reaz yazds. He went
on to say neighbors are hitting water when building decks.
Gordon said a high water table doesn't prohibit building but it may limit the type of house that could
be built, such as not having a basement. Johnson said financing institutions usually dictate building
types allowed in relation to the height above water tables.
MOTION: Burke moved, seconded by Blandetto, to recommend approval of rezoning the 1.2 acre
eastern comer of the church property from "P" to "PD-315". Motion tamed 6-1 (Clazk).
MOTION: Burke moved, seconded by Blundetto, to recommend approval of the preliumina.ry plat
subdividing the church property to create 41ots for residential development with the conditions
rewmmended in the staff report.
Clark stated he has a problem with Eveleth and asked why the city can't request an access variance
on behalf of the church. Nagler expressed concern for the impact ofthe road on the wetland and the
surrounding neighbors. McNamara said he looks at this project as a catalyst for future discussion of
issues like traffic and environmental impacts. Blundetto and Edgeton both expressed tmst in the advice
and expertise of staff. Motion carried 5-2 (Nagler, Clazk).
MOTION: Blundetto moved, sewnded by Burke, to recommend that staff draft a study of the
parking and traffic conditions around Fairgreen, 126th and possibly Eveleth to monitor traffic
performance and behavior and compare to what we have today. Motion carried 7-0.

7. OTHER BUSINESS
A. Consider Setting Work Session for Comprehensive Plan Update
Kelley suggested setting another work session to review draft documents relating to the
comprehensive plan update on September 23rd. A box lunch will be served at 5:30 p.m. Fdgeton
emphasized the unportance of members' attendance and input.
B. Information on Joint Planning Commission Meeting for All Cities in Dakota County
Kelley distributed a draft agenda for a joint planning commission meeting to review the county's
comprehensive plan on September 30 at Rosemount City Hall.
C. Annual Outing
Blundetto informed the group the outing is set for Friday, September 25, beginning at 8 a.m. He
would like a head count at the next Plamring Commission meeting.
8. ADJOURNMENT
MOTION: Blundetto moved, seconded by McNamara, to adjourn the meeting. Motion carried
7-0. The meeting was adjourned at 8:27 p.m.
