PLANNING COMMISSION MINUTES
September 16,1998
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at
7:00 p.m.
Members Present: Diane Nagler, Kazen Edgeton, Frank Blundetto, Tim Burke, Tom Melander,
Jce McNamaza.
Members Absent: Lou Clark.
Staff Present: Rick Kelley, Kathy Bodmer, Tom Lovelace, Consulting Engineer Keith Croydon,
City Attorney Mike Dougherty, Nelda Werkmeister.
Others Present: See sign-in sheet.
2. APPROVAL OF AGENDA
Blundetto asked to add 7B, Annual Outing.
MOTION: Burke moved, seconded by Blundetto, to approve the agenda as amended. The motion
carried 6 - 0.
3. APPROVAL OF SEPTEMBER 2, 1998 MINUTES

MOTION: McNamara. moved, seconded by Burke, to approve the minutes. The motion carried

5. PUBLIC HEARINGS
A. Cedar Marketplace Addition -Preliminary Plat for 2 Commercial Lots; Rezoning to
Planned Development No. 290; & Site PIan/Building Permit Authorization for Applebee's
Restaurant and 2 Multi-tenant Buildings
Chair Edgeton opened the public hearing with the standazd remarks. Assistant Planner Kathy
Bodmer introduced the item. She noted that setback variances would be needed for the parking lots and
proposed signage adjacent to Cedar Avenue. She went on to say that the majority of properties on Cedaz
Avenue dedicated a 75 foot rightof--way for Cedar Avenue; however, the County now requires a 100
foot dedication. A similar variance was requested and granted for the Old Chicago parking lot.
Paul Tucci, representing the petitioner Oppidan Inc., said he used the Old Chicago as a benchmazk
for the parking and rightof--way layout for the Cedar Mazketplace site plaza. Tucci showed elevations
and described building materials and sign placement. He went on to say a possible additional user in the
rear would be a day care of about 6500 feet with a play area.
Burke asked about architectural treatment of the long expanse of the back of the buildings. Nagler
asked about the landscape plan. McNamara queried about traffic exiting the site off 147th Street.
Bodmer noted that the access does meet standard criteria.

Blundetto asked about tenants. Tucci listed Applebee's, Caribou Coffee and Kinko's as tenants he
could disclose.
McNamara wondered about the solar access for the townhomes, and Nagler asked ifthey could
effect landscaping. Community Development Director Rick Kelley said the requirements preclude
plant<ng trces that get too tall.
Edgeton asked for any comments from the public. Tom Eagan of 7367 Upper 146th Street said he
didn't expect something this big so close to his house. He is most wncemed about two accesses to
Glazier because of traffic and noise. He went on to say a lot of kids play in that azea, and he is
concerned about the resale value of his home.
Edgeton requested current and projected traffic counts.
Melander asked if a berm on the north side is possible. Tucei responded he did not think there was
enough room to create a berm behind the building.
Discussion followed about the Applebee's site, including building elevations and product deliveries
on the east side of the building adjacent to the development's entruice on 147th Street. Tucci said he
could talk to Applebee's about possibly adding a canopy over one door and a light fixtaze on the east side
of the building.
There being no other comments from the public, Chair Edgeton closed the public hearing at 7:50
p.m.
Bodmer said she received a phone call from a representative of Garrett Square Condominiums.
Their association is meeting this evening. If arty comments aze received, they will be included in the next
Plarmiug Commission packet.
B. Cedar Brook Market -Conditional Use Permit for Motor Fuel Sales
Bodmer introduced the item.
McNamara asked what procedure is followed with regard to fire protection and public safety when a
petitioner requests a new use involving a flarrnYiable substance. Bodmer responded that the fire marshall
is apprised of all applications and has no concerns with this plan.
Kevin McComuck, representing the designer and petitioner, said the installation would meet
requirements of the state and local fire nkvshall. He also said the wncrete pad in the fireling area would
be tapered so any gas would drain into the skimmer before going into the city's storm sewer.
There being no comments from the public, Chair Edgeton closed the public hearing at 8:05 p.m.
Edgeton said she appreciated having the petition of so many in favor ofthe project.

6. LAND USE/ACTION ITEMS
A. Apple Valley Square -Site Plan/Building Permit Authorizafion for 8,100 Square Foot
Multi-tenant Building
Kelley introduced the item He pointed out the azea of the existing multi tenant building to be
demolished and explained how that impacts the pazking requirements, even though there has always been
more than enough parking for that area.
Blundetto expressed concern about the Cedar Avenue entrance to the Square and wondered about
snow removal. Kelley said the Streets Department can look at the entrance issue.
Nagler said she hated to see green space used for a trash enclosure, given no landscaping
requirements. Kelley said the city might ask for planters on the north side. He noted the budding does
meet the design guidelines.
Craig Minea, the applicant, introduced himself. He said snow is not a problem, and that there is
always more parking thaz~ is used. He agreed that the entrance is a problem, but that he had no control
over that when it was constnrcted. He pointed out. that greenspace wasn't part of pazkiag lots back when
this pazcel was developed, but that planter boxes were added this year. An outdoor plaza for outside
seating is also an option.
MOTION: Burke moved, sewnded by McNarara, to rewmmend approval of site plan building
permit authorization for the Apple Valley Square Retail Building, subject to staff conditions. Motion
carried 6-0.
B. Variance for Off-site Housing Development Signs
Assistant Planner Tom Lovelace introduced the item. He gave the background of the signage for
Cedar Isle Estates, Cedar Isle Village Homes and Cedar Isle Countryhomes.
Larry Frank of Aram Development, the petitioner, stated the single family area (Cedar Isle Estates)
is all sold. He went on to say Ryland, the developer for Cedar Isle Village, is really concerned in getting
traffic exposure. He said the model sign on 145th will betaken down, as well as the sign put up by
Countryhomes at Flagstone and Galaxie.
David Bocek of 14059 Flintwood Way stated his concern that their association is paying to maintain
an azea being overtaken by signs.
MOTION: McNamara moved, seconded by Burke, to recommend approval of the variance
request Motion failed 0-6.
7. OTHER BUSINESS
A. Schlofzky's Restaurant -Sketch Plan & Consideration of Restaurant Classification: I
(cafeteria) or II {fast food), on Northwest Corner of C.R #42 and Pennock Avenue
Bodmer introduced the item. She pointed out the current differences in the Class I and Class II
restaurant classifications.

Tom Hart, legal counsel for Schlotzky°s, said delis occupy a unique place. He stated their
willingness to eliminate adrive-through and to provide an outdoor dining aspect. Though unique, he said
he felt the Schlotzky's operation was much closer to a cafeteria than fast food.
Chair Edgeton stated her desire that the restaurant classifications be acted on right away so the
Commission does not have to wrestle with every proposed use that does not fit into the Class I and II
"boxes". Her only cocrunent on the sketch plan was that every side ofthe budduig needs to be treated as
a front.
Tom Hanson, owner of the Burnsville store, introduced himself, and stated that the proposed design
is a fiuther upgrade from. his store design.
B. Annual Oufing
Blandetto provided an update and asked who would be able to attend.
