PLANNING COMMISSION MINUTES
October 7,1998
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at
7:05 p.m.
Members Present: Diane Nagler, Karen Edgeton, Tim Burke, Tom Melander, Jce McNamara,
Lou Clark.
Members Absent: Frank Blunde[to:
Staff Present: Rick Kelley, Kathy Bodmer, Consulting Engineer Keith Gordon, City Attorney
Mike Dougherty, Nelda Werkmeister.

2. APPROVAL OF AGENDA
MOTION: Clazk moved, seconded by Burke, to approve the agenda. The motion carried 6 - 0.
3. APPROVAL OF SEPTEMBER 16,1998 MINUTES
MOTION: Burke moved, seconded by Nagler, to approve the minutes. The motion carried
5-0 (1 abstention -Clark).

6. LAND USE/ACTION ITEMS
A. Cedar Marketplace Addition -Preliminary Plat for 2 Commercial Lots; Rezoning to
Planned Development No. 290; & Site Plan/Building Permit Authorization for Applebee's
Restaurant and 2Multi-tenant Buildings
Assistant Plarmer Kathy Bodmer introduced the item.
Paul Tucci of Oppidan Development, the petitioner, addressed the issues brought forth at the public
hearing. He distributed photos of the Inver Grove Heights Applebee's, which is the same prototype as
proposed in Apple Valley. He stated the Apple Valley Applebee's would have signage only on the west
and south sides. He went on to say that all sides of the multi-tenant buildings would be composed of
brick, and that pilasters will be added to building #2. Tucci does not propose to add pilasters to building
# 1, however, because of the significant landscaping proposed on that north side which he felt would
negate any architectural enhancements. The site plan was also modified to include a low berm on the
northeast side to offset any headlights shining northward.
Edgeton stated she would like to see the pilaster look extend above the roof line on building #2, more
similar to what is on the front of the budding.
There was a brief discussion regarding the forester's landscaping recommendations, particularly to
convert some of the overpazking ur the northeast comer to greenspace. Tucci said they are hesitant to do

that, not knowing who the tenants will be. b`another restaurant went in, for example, those parking
spaces may be needed. Edgeton stated she would prefer to see overpazking as opposed to being short in
the future.
Nagler asked about the recommendation of a bumpout treatment on the east side of the Applebee's
building. Tucci responded that Applebee's have agreed to add a canopy above the door and a couple
gooseneck lights.
Discussion centered around the narrowing drive aisle behind budding #2 from south to north, and
whether there was adequate space if a bank did occupy the building.
Bodmer gave an overview of the traffic report prepazed by the firm of SEH.
MOTION: Clark moved, sewnded by Burke, to rewmmend approval of the request to rezone the
property from "LB" to "PD-290" to allow linuted business and wmmuniTy-scale retail uses. Motion
carried 6-0.
MOTION: Clark moved, seconded by Burke, to recommend approval of the preliminary plat of
Cedar Marketplace Addition to create 21ots, with the conditionthat anon-exclusive driveway easement
be recorded against Lot 2 to provide a public connection through the site between Cedar Avenue and
Glazier Avenue. Motion carried 6-0.
MOTION: Clark moved, seconded by Burke, to recommend approval of the site plan and give
building pentut authorization to construct a 5,000 sf Applebees Class I restaurant, and iwo multiple-
tenant limited business/retail buildings with the following conditions:
1. The service azea on the Applebees building shall be modified to ensure that there is no conflict with
traffic entering or exiting the site from 147th Street
2. Additional vertical elements shall be added to the reaz of buildings # 1 and #2 so that all sides of the
buildings are equally attractive.
3. Cross pazking/access easements shall be recorded with the property for both pazcels.
4. A "bumpout" treatment will be added to the east side ofthe Applebees building.
5. Cornices will be added to the rear vertical elements of the multi-tenant buildings.
Motion carved 6-0.
B. Cedar Brook Market -Conditional Use Permit for Motor Fuel Sales
Kathy Bodmer introduced the item. Clark said he would like to add a trash enclosure as a condition
of approval, to which Bodmer responded that can be accomplished by approving the site plan which
includes a trash enclosure.
Kevin McCormick of Zalil Equipment, the petitioner, stated the site bas been improved by the new
owners, and that they aze very receptive to completing the trash enclosure. He also said all safety
measures will betaken in installing the fuel pumps.
MOTION: Burke moved, seconded by Nagler, to recommend approval of the conditional use
pemut to allow the operation of motor fuel sales at the Cedar Brook Mazket at 12503 Germane Avenue
with the following conditions:
1. Perimeter curbing and catch basin skimmer shall be installed in accordance with the approved plans.
2. Drop curbing shall be installed where curbing intersects future sidewallc on Germane Avenue.
3. All canopy lights and site lights shall have flat-lens, shoe box fixtures to restrict lighting to the
property.

Motion carved 6-0.
MOTION: Burke moved, seconded by Nagler, to recommend approval of the site plan and building
pemrit authorization to install two gasoline pumps, underground storage tank and overhead canopy,
upon conditions that the Fire Mazshall shall review the plans and all Federal, State & City permits aze
obtained. Motion carried 6-0.
C. Appeal of Ruling -Limitation of Attached Garage Size in "R-3" Residential District
Community Development Director Rick Kelley gave an overview of the findings. He also submitted
a letter received today from a neighbor in support of the ruling.
Keith Klucas, the person appealing the ruling, said he based his proposal on a garage handout
provided by the city which says attached garages can be up to 3000 square feet. Klucas distributed
drawings of the existing and proposed layouts. He said he was willing to put in windows to make the
garage addition look residential.
MOTION: Clark moved, seconded by Melander, to affirm the mliug of the Zoning Administrator.
Motion carried 6-0.
7. OTHER BUSINESS
A. Receive Information on Development Moratorium on Certain Properties North of C.R #42
Rick Kelley reported that the City Council had received information from residents in the Palomino
Hills neighborhood and requested staff review of certain items. Staffpresented infomration, stating that
if City Council felt a different use of a property may be appropriate; that would best be evaluated in
conjunction with the comprehensive plan. review. The only mechanism deemed appropriate to allow that
study was to hrvoke a moratorium on development ofmulti-family north of County Road #42, and of
property exceeding a 12% slope.

MOTION: Burke moved, seconded by Clark, to adjourn the meeting at 8:34 p.m. Motion carried
6-0.
