PLANNING COMMISSION MINUTES
May 5,1999
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at 7:00
p.m.
Members Present: Karen Edgeton, Torn Melander, Frank Blundetto, Jim Hadley, Jolm Bergman,
Jeannine Churchill.
Members Absent: Tim Burke.
Staff Present: Assistant Plamier Kathy Bodmer, Assistant Planner Tam Lovelace, Community
Development Director Rick Kelley, Consulting Engineer Keith Gordon, City Attorney Sharon IIiILs.
Others Present: See sign-in sheet.
2. APPROVAL OF AGENDA

MOTION: Melander moved, seconded by Bergman, to approve the agenda. The motion carried

MOTION: Hadley moved, seconded by Churchill, to approve the minutes as submitted. The motion
carried 6-0.

5. PUBLIC FIEARINGS
A. Conditional Use Permit for Additional Outdoor Storage. at Wal-Mart
Chair Edgeton opened the hearing with the standard remarks. Bergman removed himself due to his
previous involvemerrt in the issues.
Assistant Planner Tom Lovelace introduced the item, a conditional use permit request for three items:
(a) eight seasonal storage containers at the rear of the building; (b) pallets and cardboard bales at the rear of
the building; and (c) seasonal storage of pallets and bagged goods in the Tire and Lube Express (I'LE).
Edgeton asked about the south seasonal area previously proposed. Lovelace stated that is not part of
the current request.
Churchill wondered how the proposal compared to other operations in Apple Valley. Lovelace noted
that Kmazt, Cub Foods and Frank's Nursery historically Lave had some spillover during seasonal
operations. He was not aware of any seasonal storage trailers requested, and will bring to the next meeting
information regarding pallets and bales.
Hadley asked about the sidewalk sales discussed previously. Lovelace responded that Wal-Mart
decided not to include that in their request.

Melander asked about any time period CAnch-a;nte included in conditional use permits for other
locations. Lovelace will reseazch that issue.
Mike Switzer, attorney for Wal-Mart, emphasized the adequacy of screening walls: 12-14 foot wall in
the reaz, as well as a wall along Pemrock Avenue. He clarified the request for the TLE area is for storage
from April 15 to September 4; for bales and pallets, all year.
Rita Morgan, Wal-Mazt store manager, interjected the bales and pallets would be stacked flush to the
reaz wall, not visible to passersby. Bales would be stacked about 5 feet high, and pallets to a height of 10-
12feet
Gwen Torgerson of 14860 Haven Drive, noted six currerrt violations of City Code by Wal-Mart. She
went on to say she thinks the bales and pallets can be seen from the stoplight at Pennock and 147th Street.
She thinks Wal-Mart ignores City regnirements, and asked about the procedure for enforcement of penalties
for code violations.
Mazk Ceminsky of 14625 Halhm~ark Drive said he thinks pallets (with product) aze visible all day long,
and that Wal-Mart should reschedule deliveries relative to their capacity to unload. He continued by saying
trailers shouldn't be at the loading docks without tractors. He also stated pazking stalls are being removed
by their use as storage, and wanted to know why outgoing semi-trailers can't take the empty pallets. He said
the public notice signs were removed early; then replaced after he called the City to comphmin; why were they
removed?
Lovelace noted that Ann Larson submitted a letter for the record

There being no other commerrts, Edgeton closed the public hearing at 7:28 p.m.
Bergman returned to the dais.
6. LAND USE/ACTION ITEMS
A. Site Plan/Building Permit Authorization for a Truck Center at Apple Valley Ford
Assistant Pkmner Kathy Bodmer introduced the item. She described the revisions from the previous

Darwin Lindahl, architect on the project, explained the use of various pazking areas. He stated the
windows on the south side would be real (versus false)
Bodmer stated staff's position that the inventory area does not need to be striped since vehicles can be
parked very close together. However, staff is looking for striping in designated customer pazking, service
and employee pazking areas.

MOTION: Blundetto moved, seconded by Melander, to recommend approval of the site plan and
give building permit authorization fora 15,440 sf truck facility on the ford site with conditions
recommended by staff. Motion carried 6-0.

MOTION: Blundetto moved, seconded by Churchill, to adjourn. Motion carried 6-0. The
meeting adjourned at 7:39 p.m.
