1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at
7:OO p.m. -
Members Present: Karen Edgeton, Frank Blundetto, Jim Hadley, John Bergman, 7eannine
Churchill, Tim Burke.
Members Absent: Tom Melander.
Staff Present: Assistant Planner Kathy Bodmer, Assistant Planner Tom Lovelace, Planning Intern
Mazgaret Milton, Community Development Duector Rick Kelley, Consulting Engineer Keitli Gordon,
City Attorney Shazon Hills, Community Development Secretary Nelda Werkmeister.
Others Present: See sign-in sheet.
2. APPROVAL OF AGENDA
MOTION: Burke moved, seconded by Churchill,- to approve the agenda. The motion rained
6-0.
3. APPROVAL OF MAY 5,1999 MINUTES.
MOTION: Churchill moved, seconded by Hadley, to approve the minutes as submitted. The
motion carved 5-0 (1 abstention-Burke).

5. PUBLIC HEARINGS
A. Conditional Use Permit for Building Height - Phase IIbf Haight Apartments ' ".'
Chair Edgeton opened the hearing with the standard, remarks. Assistant Planner Kathy Bodmer
introduced the item.
Consulting Engineer Keith Gordon stated that the sewer needs to be eight feet deeper than with the.
previous plan because of the addition of the underground. pazking.' Gordon went onto say the Regatta '
trunk is deep enough, but if that extension isn't complete when Phase 11 is constructed, a temporary lift
station would be needed until a sewer trunk is installed. A temporary pump would also -be needed to '
handle storm runoff on the drives to the underground garage.
Blundetto asked Gordon to address any road issues. Gordon said the City is collecting cash for
future construction of Foliage Avenue. ,There is now a permanenfconnection across Lots'1 and 2.;
Hadley asked about surface pazking, and Edgeton asked about the density in relation to the Livable .
Communities Act.
Douglas Dahms, representing the petitioner, explained that the changes to Phase II from market
rate to luxury are a result of the strong mazket projected for luxury apartments.: He said the addition of '
surface garages is to provide more parking for tenants for their storage items'and/or additional
vehicles.
Assistant Planner Tom Lovelace introduced the item. He reviewed the Conditional Use Permits
(CUPs) related to outdoor storage at other locations in the city. He also reviewed the definition of a
CUP and the standards imposed by City Code. Responses to the public hearing comments were shown
on an overhead. In addition, Lovelace reported the public hearing notice signs were stolen, and new
ones were placed on the site as soon as the Streets Department became aware of the situation.
Blundetto asked if any Wal-Mart violations had reached the attorney's office. Lovelace replied
they had not.
Churchill stated the diagram shows six storage containers, and eight are being requested.
Mike Switzer, legal counsel representing Wal-Mart, showed where the eight storage containers
would be located -- north to the wall, and pallets and cardboard bales would be shifted to the east.
Edgeton asked staff of perceived problems if there were eight containers with pallets next to them.
Lovelace answered there would need to be some cleaz space to open the container doors.
Churchill said she wants an accurate drawing of what the Commission is being asked to approve.
Switzer stated that Wal-Mart could live with only six containers as depicted on the drawing..
Mazk Ceminsky of 14625 Halhnazk Drive asked if current violations of a permit request would be
considered, and stated fire safety concerns in the Tire Lube Express. (TLE) area.
MOTION: Burke moved, seconded by Churchill,. to. recommend approval of a Conditional. Use
Permit to allow for the temporary storage of six (6) non-stacked storage containers in the loading azea
from September 15 through December 31, subject to the delineation of the 60 ft x 75 ft storage area by
means of striping of the paved surface and placement of informational signage listing the maximum
number of trailers and placement dates allowed. Motion carried 5-0.
MOTION: Burke moved, seconded by Churchill, to recommend approval of a Conditional Use
Permit to allow for storage of pallets and cardboard bales in the loading area as indicated on the site
plan, subject to the delineation of the 15 ft x 75 ft storage azea by means of striping of the paved
surface and placement of informational signage onthe wall, with a maximum stacked height of the
cazdboazd bales and pallets often (10) feet. Motion carved 5-0.
MOTION: Burke moved, seconded by Churchill, to recommend approval of a Conditional Use
Permit to allow for the temporary storage of pallets of bagged goods related to the garden store
operation in the TLE azea from April 15 to June 30 and August 15 to October 15 of each year and the
delineation of the storage area (10 ft x 32 ft along the west wall and 5 ft x 32 ft on the south) by means
of striping of the paved surface, and a maximum stacked height of six (6) feet.

B. Site Plan/Buildiug Permit Authorization and Rear Setback Variance for 6-Story Office
Building w/340-Space Parking Ramp and Drive-Thru by Northwest Air Federal Credit Union
Lovelace introduced the item. He stated the drive-thru would now enter from 147th Street and exit
to Glazier Avenue, and that the sourthern drive entrance to Glazier would be reconfigured per staff
recommendations.
Cynthia Drake, traffic engineer with SEH, shared her analysis of the proposal, indicating about
2800 vehicle trips per day.
Bergman asked if there was any consideration for additional traffic controls for left turns from
Glazier onto 147th Street, and Drake indicated there were no plans for traffic signs there.
Brian Cazey of United Properties, representing the petitioner, said they are willing to make the
changes to comply with all staff suggestions, including eliminating the most easterly pazking row
intended for employee parking.
MOTION: Burke moved, seconded by Churchill, to recommend approval of a building setback
variance of 31 feet from the required 97 feet from the east property line to allow for construction of a
six-story office building 66 feet from said properly line, due to the hazdship created by the irtegulaz
east lot line. Motion carried 6-0.
MOTION: Burke moved, seconded by Churchill, to recommend approval of a site plan building
permit authorization to allow for the construction of a 120,,000 square foot six-story office building
with an attached five aisle bank drive-thru and 43 underground pazking spaces, 340 space pazking
ramp and 185 space surface parking lot on 7.13 acres subject to the following: (a) removal of all
surface parking spaces along the most easterly pazking row; (b) installation of a pedestrian connection
from the sidewalk along Glazier Avenue to the pazking ramp; (c) shifting the south drive approach to
within five feet of the east property line and extending the Glazier Avenue boulevard area eight feet to
the east; (d) submission of a revised landscape plan that indicates plant species location revisions to
pazking island species per the Natural Resources Coordinator. Motion carried 6-0.
C. Site Plan/Building Permit Authorization for Fendler Professional Building
Planning Intern Margaret Milton introduced the item.
Bergman asked why the applicant is proposing using guying for 2 1/2-inch trees and questioned
their selection of cedaz mulch next to the building. Bergman stated he was concerned about grass
being mowed along the street and median where clippings will go into the storm drain. Finally he
asked if there was discussion. with the townhome association about an appropriate barrier.
Milton noted that the bazk mulch is offered to absorb runoff since there is no gutter on the
proposed building. The applicant would be required to maintain the mulch as a condition of building
permit authorization.
Blundetto said he was reluctant to ask an applicant to remove any green space.
Collin Evanson, representing the petifloner, showed a color rendering of the buildmg. He noted
there is a solid fence about six-feet high which provides. a barrier to the townhomes to the north. As to
mulch versus rock, he responded that rock is lower maintenance but is also prone to incidents of
vandalism.

Burke asked about signage. Evanson said there would be a small monument sign on the street side
and potentially some building signage.
MOTION: Hadley moved, seconded by Burke, to recommend approval of the site plan and
authorization of a building permit with the following conditions: (a) a revised grading and drainage
plan that shows contour elevations based on sea level datum; (b) City Engineer approval of the grading
and drainage plan; (c) submission of a nursery bid list that confirms the landscape materials meet or
exceed t 2 1/2% of the value of the construction of the building based on Means Construction Data.
D. Site Plan/Building Permit Authorization for Kohl's Store in hlscher Market Place
Lovelace introduced the item. There was discussion of the east wall and the need for azchitectural
relief on the east and north walls.
Edgeton left the meeting and Blundetto assumed the duties of Chair.
MOTION: Burke moved, seconded by Bergman, to recommend approval of the site
plan building permit authorization to allow for the construction of a 86,594 squaze foot Kohl's -retail
building with 563 vehicle parking spaces on Lot 1, Block 1; Fischer Market Place 1st Addition,. subject
to the following conditions: (a) approval shall be contingent upon the approval and recording ofthe
fmal plat for Fischer Market Place 1st Addition; (b) the necessary cross parking, access and storm
water easements shall be attained prior to building permit;issuance; (c) elevation plans of screening .
wallsfor the trash enclosure area and loading azea shall be Submitted to the City forcompliance prior
to the issuance of a building permit; (d) a detailed planting iishshall besubmitted for verification :of the
City's 2 1/2% landscaping requirement at the time of building permit. application; (e) materials on the
front (south) side be extended to the east and north sides of the building.'.Motioncamed 5-0"
7. OTHER BU5INES5
A. Sketch Plan for Auto Repair Business at Co. Rd. 42 & Garden View by Kenneth Thomas
Bodmer introduced the item. In response to the Commission's inquiries; she described the .
grandfathering of Dick's Valley Service and the uses onthe other comers at the. intersechon'of Co. Rd.
42 and Garden View.
The appflcant Ken Thomas stated he would prefer to stay away from the convemence~business.
He continued by saying he would ufilize service entries at the back side of the building and add canopy
work.
Burke and Blundetto said they found the proposed use appropriate. Bergman agreed as Igng as
there was a convenience theme.,' Churchill stated. it was difficult to argue, against the proposal given the
uses on the other three corners.
Bergman asked about proposed hours of business. Thomas said 6 a.m. to 8 p.m. Monday through'
Friday, as well as Saturday hours.
Hadley asked to clazify that the only amendment needed would be to allowservice repair. `

MOTION: Churchill moved, seconded by Hadley, to adjourn. Motion carried 5-0. The meeting
