CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Chav Edgeton at 7:00 p.m. Members Present: Karen Edgeton, Frank Blundetto (arrived at 7:03), Jim Hadley, John Bergman, Jeannine Churchill, Tim Burke. Members Absent: Tom Melander. Staff Present: Assistant Planner Kathy Bodmer, Assistant Planner Tom Lovelace, Plam~ing Intern Margaret Milton, Community Development Director Rick Kelley, Consulting Engineer Keith Gordon, City Attorney Bob Bauer, Community Development Secretary Nelda Werkmeister. Others Present: See sign-in sheet. 2. APPROVAL OF AGENDA Community Development Director noted that item 6C has been tabled at the request of the petifioner. MOTION: Burke moved, seconded by Bergman, to approve the agenda as amended. The motion tamed 6-0. 3. APPROVAL OF JUNE 16,1999 MINUTES MOTION: Churchill moved, seconded by Hadley, to approve the minutes as submitted. The motion carried 6-0. 4. CONSENT TTEMS -None - 5. PUBLIC HEARINGS A. Planned Development Zoning for Mixed Use Development of Barton Sand & Gravel Pit The public hearing was continued from June 2, 1999. Community Development Director Rick Kelley indicated an environmental analysis will be required, which is a minimum 120-day process. Staff recommends closing the public hearing and readvertising a new hearing a8er the environmental process is completed. Chair Edgeton closed the public hearing at 7:05 p.m. 6. LAND USE/ACTION TTEMS A. Fraser Independent Living -Conditional Use Permit for 17 Apartment Dwelling Units for People with Developmental Disabilities Assistant Planner Kathy Bodmer introduced the item. She reviewed the issues raised at the public hearing, including a history of city actions regarding the property. Planning Commission Minutes July 14,1999 Page 2 Edgeton asked Bodmer to review the legal obligation of the City in regazd to public hearing notification. Bergman asked if plantings can be placed over the drainage and utility easement on the north side of the building. Engineer Keith Gordon stated that plantings can occur within the easement, but not over the storm sewer lines. Tim Scott of Fraser Services stated how fortunate they feel to have found a site close to two bus routes, as well as shopping and service-oriented businesses. He went on to say that the residents of the facility are generally quite capable of maneuvering two blocks to a bus stop. He pointed out that alternative transportation is available for physically disabled persons. Bergman said he is still not comfortable with the traffic issue, but he supports the land use. He stated the stretch of sidewalk along County Road 42 in front of Bachmans is not well maintained in the winter. Don Curwick of KKE Architects, also representing the petitioner, said that they enlarged the turnaround drive in accordance with the Fire Marshall's recommendations, and were able to do so without impacting any trees. Curwick stated their opposition to a berm on the north side because they don't believe in screening residents from residents. He went on to say they did add lilac shrubbery to enhance the open area, and that the additional trees to be planted as a result of tree replacement requirements will occur on the north side as well. Mazk Ceminsky of 14625 Halhnazk Drive expressed concerns about the building being right up to the easement line should digging have to be done in the future. Gordon said the easement width requirements take that into account, and there would not be a problem. MOTION:. Burke moved, seconded by Bergman, to recommend approval of the conditional use permit to constmct an assisted living facility in an "LB" zoning district on the property on the northwest corner of County Road 42 and 147th Street West. Motion carried 6-lt. MOTION: Burke moved, seconded by Bergman, to recommend approval of the site plan and give building permit authorization for the construction of the 17-unit apartment building with the following conditions: (a) submission of a nursery bid list which confirms that the value of the landscape plantings meet or exceed 2 1/2% of the value of the construction of the building based on Means Construction Data; and (b) replacement of the loss of any significant trees in accordance with the NRMP requirements. Motion carried 6-ll. B. Chateau Estates 8th Addition -Preliminary Plat to Subdivide 1 Lot Into 3 Lots Assistant Planner Tom Lovelace introduced the item and reviewed the public hearing comments. Chaz Melecha asked if drainage of the property had been considered. Lovelace said staff anticipates drainage to the back of the property where z drainage easement and pond exist. Detailed grading plans are required when a building permit application is made. MOTION: Hadley moved, seconded by Blandetto, to recommend approval of the Chateau Estates 8th Addition preliminary plat, subject to the following: approval of the final plat shall be subject to the moving of the detached gazage, located on Lot 1, the proper distance as to bring it into conformance with "R-1" zoning district building setbacks. Motion carried 6-0. Planning Commission Minutes July 14,1999 Page 3 C. Subdivision Into 2 Parcels by Metes & Bounds Description by Pahl Farms This item was tabled at the request of the petitioner. D. Site Plan/Building Permit Authorization for Cedar Professional Building at the Northwest Corner of 142nd Street & Cedar Avenue Planning Intern Margaret Milton introduced the item. Edgeton noted the inclusion of a master signage plan in the packet. Milton confirmed that the plan does comply with the City's sign ordinance. Hadley asked about the trash enclosare. Milton showed its location on the site plan behind the building. Collin Evanson, architect for the project, stated he and the owner are available for any questions. MOTION: Churchill moved, seconded by Blundetto, to recommend approval of the site plan building permit authorization to allow for the construction of a 9500 s.f. one-story office building with a 64-space parking lot on an existing platted lot generally located on the northwest corner of Cedar Avenue and 142nd Street West, subject to staff approval of the landscape plan. Motion carried 6-0. 7. OTHER BUSINESS A. Sketch Plan for Mixed Residential Development (Large Lot Single Family & Low Density Townhomes) on the West Side of Diamond Path Between 129th & Upper 135th Streets by Contractor Property Developers Co. Lovelace introduced the item. Tim Erkkila of Westwood Development, representing the petitioner, reviewed the concept plan. He stated a regional trail would likely come through the site. Development may start at both ends of the project, in Apple Valley on the west and in the Rosemount on the east. He pointed out that it is a multi-year project, and that the Apple Valley portion is proposed to contain high-end single family and townhouse or villa units. He also stated that Birger Pond will probably be maintained at a lower level than it is now. Blundetto said he would like to see the environmental reports generated throughout the process and that his initial concerns are traffic density and wetland mitigation. Churchill asked about the proposed cul-de-sac on the Apple Valley side whose access is in Rosemount. Kelley responded a couple of options would be to enter into a contractual arrangement with Rosemount to maintain and service that road, or to annex a portion to the City of Rosemount. Hadley queried if Diamond Path would be a four-lane road some day. Lovelace answered that would be likely, and Erkkila added that a 60-foot halfright-of--way will be dedicated as part of the project. Edgeton shared her appreciation of the developer's sensitivity to the environment. Planning Commission Minutes July 14,1999 Page 4 Burke asked about the disposition of buildings in Birger Pond. Erkkila answered the buildings would all be removed. Bergman wondered about the Apple Valley Pazks Department's participation in the planning of the proposed trail system. Lovelace said he will bring that information to the Parks Department, who anticipates no need for additional park land. B. Sketch Plan to Retain Current Comp Plan & Zoning Designations for 120-unit Apartment Building at Germane Avenue & 128th Street by Domestic Development Mazgazet Milton introduced the item. The petitioner Frank Kleckner distributed photographs of the area and color renderings of his proposal. He gave a history of the site since purchasing the property. He pointed out that the site is adjacent to apartments and that the proposed building would not be visible from the closest single- family units. Blundetto asked the petitioner whether he is willing to reduce the number of units and size of the building. Discussion occurred about the process for land use applications regazding the scattered sites identified in the Comprehensive Plan evaluation, and the subsequent moratorium imposed on certain properties. Kleckner added that acquiring unused Department of Transportation right-of--way would increase the area of buildable land by an acre or so, which of course would impact the density calculations. He also talked about minimal visual impact to adjacent properties because of grade differences. Edgeton told the petitioner that if he wanted to return with a proposal that meets current zoning standards, the Commission would be willing to look at it. Kelley stated the petitioner can address the City Council about the proposed change to the Comprehensive Plan at the time they vote on it (following receipt of the Met CouncIl's recommendafion). 8.
