CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Vice Chair Blundetto at 7:00 p.m. Members Present: Frank Blundetto, Tom Melander, Jim Hadley, John Bergman, Tim Burke (arrived at 7:02 p.m.). Members Absent: Karen F.dgeton, Jeannine Churchill. Staff Present: Assistant Planner Kathy Bodmer, Planning Intern Margaret Milton, Community Development Director Rick Kelley, Consulting Engineer Keith Gordon, City Attorney Sharon Hills, Community Development Secretary Nelda Werkmeister. Others Present: See sign-in sheet. 2. APPROVAL OF AGENDA MOTION: Hadley moved, seconded by Melander, to approve the agenda. The motion carved 4-0. 3. APPROVAL OF AUGUST 4,1999 MINUTES MOTION: Melander moved, seconded by Hadley, to approve the minutes as submitted. The motion carried 4-0 (1 absterrtion-Blundetto). 4. CONSENT ITEMS A. Setback Variance for Parking Lotto Street at 12650 Johnny Cake Ridge Road, Shepherd of the Valley Lutheran Church MOTION: Melander moved, seconded by Bergman, to approve the setback variance as recommended by staff. The motion carried 5-0. 5. PUBLIC HEARINGS -None - 6. LAND USE/ACTION ITEMS A. Eastwood Ridge -Preliminary Plat to Create 22 Lots for Detached Single Family Homes Assistant Planner Kathy Bodmer introduced the item. She reviewed the public hearing comments and showed a comparison of proposed lot sizes to the nearby Cherry Oaks development. Blundetto asked ifthere were any issues relating to exit and entry to lots from 132"d Street. Bergman asked staff to explain its recommendation to eliminate a lot. Bodmer responded there were no issues relating to access from 132i° Street. She went onto say it is difficult to save trees within 20 feet of a house. Bodmer showed an overhead which eliminated a lot and realigned the remainder, which according to her recalculations, results in saving additional trees. Planning Commission Minutes August 18, 1999 Page 2 The petitioner Bill Diedrich responded to the alternative proposed by staff, showing that it would save only three additional trees, in his calculation. He offered a compromise of requiring the planting of two trees per lot instead of one tree per lot as required by ordinance. Melander asked the petitioner's reaction to the forester's memo which references "taking extraordinary measures". Diedrich stated no objections. He said he will move things azound to save trees, which add value to the lots. Blundetto asked. the petitioner to give an example of where he has done that, to which Diedrich referenced Saddle Ridge Development. Discussion continued regarding saving trees and tree replacement. Blundetto asked how the City can. hold the developer to do what he says regarding the cemmitment to save and replace trees. Community Development Director Rick Kelley responded that the City can apply standards to individual lots in addition to the Natural Resources Management Pemut (NRMP) required for mass grading. The Engineering and Natural Resources Departments would be reviewing individual site plans. MOTION: Burke moved, seconded by Bergman, to approve the preliminary plat with the requirement that protective fencing be installed for each lot. Motion carried 5-0. Blundetto asked that the Commission review the NRMP prior to issuance. MOTION: Burke moved, seconded by Bergman, to approve the front Yazd setback variances of up to 10 feet for Lots 5; 6, 1Q 11,13, I4 and 22 in cases where the reduced setback will help preserve the natural elevation and/or trees on the site. Motion carved 5-0. B. Subdivision Into 2 Parcels by Metes & Bounds Description by Pahl Farms This item remains tabled at the request of the petitioner. 7. OTHER BUSINESS A. Sketch Plan for 7-8 Lot Single Family Residential Subdivision at 13472 Pilot Knob Road (Southeast Corner of Pilot Knob & Embry Way) y Robert Shackelford Bodmer introduced the item: The property owner Bob Shackelford noted that Pilot Knob Road is now being widened. The proposed project combines three lots: 12, 13 and 14. City utilities are being installed 150 feet along Embry Way. He continued by saying Pilot Knob is changing dramatically, and that he thought most of the oak trees on site could be saved. Iladley asked about fire protection on this private street. Kelley answered that in this situation adead- end street was provided, which maybe extended at some point in the future. Bergman inquired whether all the lots were currently zoned "R-1 ", and whether any of those could also be subdivided later. Bodmer replied that to be subdivided the lots would need city water and sewer along Embry Way. Shackelford stated this proposal would contribute to greater safety because of alleviating driveways onto Pilot Knob, which is currently a heavily traveled road. Planning Commission Minutes August 18,1999 Page 3 Blundetto cited two obstacles to this proposal in his opinion: (1) spot zoning; and (2) a dead~nd road for an indefinite period of time. Melander stated he has no problem preserving some large lots, especially for history's sake. Shackelford said his residence has city sewer and water, and that he hasn't received too much negative feedback from the neighbors he has talked to. He also pointed out that a person cannot see -his rental property from his house. The is a hedge row on the east side, and he cannot see any of his neighbors in the summer months when the trees are full. Lastly, the proposal is for low density, consistent with the Comprehensive Plan. Bergman asked about the possibility of eliminating a lot to minimize tree loss. Bodmer replied that a tree inventory has not been done yet, so no analysis has been made. Bodmer did note that a nearby property owner had submitted a letter to the Planning Commission with some concerns with the project. 8. ADJOiJRNMENT MOTION: Burke moved, seconded by Bergman, to adjourn. Motion carried 5-0. The meeting was adjourned at 8:07 p.m.
