PLANNING COMMISSION MINUTES
September 15,1999
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at 7:00
p.m.
Members Present: Karen Edgeton, Frank Blundetto, Tom Melander, John Bergman, Tim Burke.
Members Absent: Jeannine Churchill, Jim Hadley.
Stab Present: City Planner Tom Lovelace, Assistant Planners Kathy Bodmer and Mazgazet Milton,
Conmmnity Development Director Rick Kelley, Consulting Engineer Keith Gordon, City Attorney Sharon
Hills, Community Development Secretary Nelda Werkmeister.
2. APPROVAL OF AGENDA
MOTION: Burke moved, seconded by Bergman, to approve the agenda. The motion carried 5-0.
3. APPROVAL OF SEPTEMBER 1,1999 MINiJ'PES
MOTION: Burke moved, seconded by Bergman, to approve the minutes as submitted. The motion
carried 3-0 (2 abstentions-Blundetto, Melander).

A. Preliminary Plat and Conditional Use Permit for Outdoor Storage of Rental Truck and Site
Plan/Building Permit Authorization by U-Haul
Chair Edgeton opened the public hearing. Assistant Planner Margazet Milton introduced the item.
Several questions were raised by Commissioners. Milton responded accordingly: the freestanding sign
would be located in the northeast comer; the 2-story building appears to be below the slope along Co. Rd.
42; the outdoor storage area of tracks would also be below the grade. Some screening would probably be
required on the west which basically consists of garages.
John Mikel of U-Haul Corporation distributed revised plans. He stated the proposed facility is the first
ofthis type in Minnesota.
Edgeton asked Mikel to review the changes. Mikel noted the parking on the north was cut to about half,
and some was added to the south. He went on to say the plan was changed to reduce the building coverage
from 33%to 29%.
MOTION: Blundetto moved, seconded by Bergman, to table consideration ofthis item and leave open
the public hearing in order for a thorough review of the revised plans to occur. Motion carried 5-0.
Edgeton announced that public commerrts will be taken at the next meeting.

B. Planned Development Rezoning and Preliminary PIatlSubdivision for Mixed Residential for
Regatta III by Pulte Homes
Chair Edgeton opened the public hearing with the standard remazks. City Planner Tom Lovelace
introduced the item. He stated the overall density of the proposed project was 12 units per acre; the
individual type calculations included courthomes at 10 units per acre, manor homes at 7 units per acre,
village homes at 14 units per acre, and apartmexrts at 20 units per acre.
Edgeton asked how each product alone stacks up to the zoning needed. Lovelace replied that the manor
homes, which aze similar to the clubhome product, would fit in Subzone 4. The village homes are new and
would require a new subzone, as would the apartment complex.
Bergman asked for the city's overall view of the south cerxhal plam~iug district as it relates to the
pending comprehensive plan for the next meeting. Edgeton asked staffto include where any sand and
gravel, now or in the fixture, may occur in relation to the project, and whether an EAW will be required.
Lovelace noted that an EAW will be required, and that building coverage is 31%. Edgeton asked for
greenspace calculations for each product. Melander asked about a traffic analysis and sidewalks. Edgeton
also requested what product types aze adjacent to each other in Phases II and III.
Dennis Griswold of Puke Homes stated that 81% of Phases I and II have been sold in two years. The
unit mix in those two phases approximates the third phase being proposed. Griswold distributed an
information packet to Planning Commissioners. He described the product types and their placement in
relation to the adjacent Phase II. Griswold stated the transition is fairly soft, and that Flagstaff Avenue
serves as a major barrier. He concluded by stating Pule can accommodate all the staff commexrts, and that
they will provide sidewalks and paths according to city policy, including concrete sidewalk on each side of
1570i Street. He agreed it was a good idea to have sidewalk on one side ofthe other streets.
There was extensive discussion about past sand and gravel mining proposals in relation to Phase I of
Regatta and Puhe's past and fixture efforts to inform prospective buyers of existing and potential rminiug.
Bergman asked about the possibility of amending the park azea to include active recreation areas like.
tennis courts and playgrounds. Griswold responded that there will be association common space. In the
courthome area they are offering a tot lot with potential expansion. The bulls of the greenspace in the manor
home area is mainly visibility to the ponds. He also said Pulte is hying to create more intimate spaces for
mini-neighborhoods in the village home area. The path system will connect to the park system. Cniswold
also pointed out that the Park Committee preferred a cash park dedication for Phase III rather than park land
dedication. The aparhnent site would be directed out to open space on the pond side. Lovelace noted there
is a 10-acre park within Regatta classified as a neighborhood pazk which has not yet been graded.
Lovelace closed by stating a third pedestrian connection would probably be along 1580i Street. He said
he would also like to see a connection through the apartment development from 1580i to 1570` Streets. He
noted there is availability of on-street parking in the cul-de-sacs and local streets.
Edgeton stated associations sometimes decide they don4 want to allow on-street parking, so she has
concern using those spots in any pazking calculations.
Mark Ceminsky of 14625 I Iallmaxic Drive said he thought there was a good chance to mine the Luella
Fischer property because of the difference in elevations; that developers do fail to give home buyers
information; and that he has a concern about the on-street pazking.

C. Preliminary P-at to Split 1 Lot hrto 2 Lots by Fraser Services
Chair Edgeton opened the public hearing with the standard remarks. Assistant Planner Kathy Bodmer
introduced the item.
Bergman asked if there would ever be another driveway off 147s` Street. Bodmer said staff is
recommending the petitioner dedicate a restricted access easement for one drive only on 147's Street.
Barb Bang, consultant to Fraser Services, stated the petitioner would appreciate approval tonight to
keep the process moving in a timely manner.
Doug Palmer of 14847 Haven Drive asked if there would be a berm on the north side. Bodmer stated
additional plantings will be put on the north side, but no berm.
Don Swenson of Bachmann stated he thinks the proposal is a good use ofthe site and feels it meets all
the requirements.
Edgeton closed the public hearing at 8:37 p.m.
MOTION: Melander moved, seconded by Blundetto, to recommend approval of the preliminary plat
of Fraser First Addition with the following conditions: (1) review and approval of the plat by the Dakota
County Plat Commission; (2) dedication of a restricted access easement on 147` Street West to limit the
number of driveways to one. Motion carried 5-0.
6. LAND USE/ACTION ITEMS
A. Review Natural Resources Management Permit (NRMP) for Eastwood Ridge
Bodmer introduced the item. She produced an overhead showing the proposal of trees to be saved, trees
to be removed, and trees which may be saved by the builder.
MOTION: Blundetto moved, sceonded by Bergman, to recommend approval of the NRMP, which
includes specific lot plans establishing specific grading limits and housepad locations for Lots 10, 11, 16 and
22. Motion carried 5-0.
8. ADJOiJRNMENT
MOTION: Burke moved, seconded by Blundetto, to adjourn. Motion carved 5-0. The meeting was
adjourned at 8:52 p.m.
