CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Chair Edgeton at 7:00 p.m. Members Present: Karen Edgeton, Frank Blundetto, Tom Melander, Jolm Bergman, Tim Bwke, Jeannine Churchill, Jim Hadley. Members Absent: None. Staff Present; City Planner Tom Lovelace, Assistant Planner Margaret Milton, Community Developrnerrt Director Rick Kelley, Consulting Engineer Pat Wrase, City Attorney Sharon Hills. 2. APPROVAL OF AGENDA Community Development Director Rick Kelley asked that "Upcorning Groundbreaking and Dedications" be added as item 7A. Commissioners Edgeton and Blundetto asked that an update regarding painting brick buildings in the downtown, as well. as the Lamgerts window issue, be added as item 7B. MOTION: Burke moved, seconded by Melander, to approve the agenda as amended. The motion carried 7-0. 3. APPROVAL OF OCTOBER 6,1994 MINJTES MOTION: Churchill. moved, seconded by Hadley, to approve the minutes as submitted. The motion carved ?-0. 4. CONSENT ITEMS -None - 5. PUBLIC HEARINGS -None - 6. LAND USE/ACTION ITEMS A. Consideration of Preliminary Plat and CUP for Outdoor Storage of Rental Tnrcks and Site Plan/Building Permit Authorization for U-T3au1 Assistant Plannet Margaret Mi.~ton introduced. the item. Edgeton asked if the number of tmcks would be limited on the site. Milton replied that the number of overnight spaces limits trucks to 29. Randy Carlin, Director of Development and. Constmction for U-Haul International, said their organization does not want trucks parked on the street, and that previsions and instructions are made for customers to drop off vehicles on site 24 hours a day. Carlin also said they are not. opposed to additional plantings, but are opposed to landscaping the drive aisles because uhimately those plantings will be damaged by inexperienced drivers of rerrtal equipmerrt. He suggested a rolled curb with painted concrete and to work with staff to increase the landscaping elsewhere on the site. Milton noted there were two typographical errors in the report: the area for 1 S rerrtal storage spaces is on the west, and there are also 18 spaces on the north side. MOTION: Melander moved, seconded by Burke, to approve the U-Haul Apple Valley Addition preliminary plat. Motion carried 7-0. MOTION: Melander moved, seconded by Burke, to approve the conditional usepermit to allow outdoor storage of vehicles provided the following conditions are met: (a} the area for the 15 rental storage spaces for recreational vehicles be shifted to the west 10 feet, based upon recommendations bythe City's traffic engineer; (b) twenty-nine parking spaces are designated for storage of rental vehicles. Eleven vehicles no larger than 17 feet in length. maybe stored in spaces designated on the sits plan and shown. in the southwest comer of the parking lot. Eighteen spaces for trucks and trailers larger than 17 feet in length maybe stored in spaces. on the north side of the property. Motion carried 7-0. MOTION: Melander moved, seconded by l3adley, to approve the site planJbuilding permit authorization to construct three storage buildings totaling 40,625 square feet in a configuration as shown on the site plan with a minimum of 14 customer parking spaces located on the south side ofthe property abutting 151st Street West; with the. following conditions: (a) five to ten mere trees be added along the north side of the property abutting County Road #t42, and tuvelve shrubs be added to the landscaping along the south side ofthe property abutting 15ist Street,. based upon recommendations bytha City's Natural Resources Coordinatac; jb) petitioner will work with staff to define alternatives for additionah landscaping. Motion carried 7-fl. B. Site P[an/Building Permit Authorization for Automated. Teller Machine for Northwest Airlines Federal Credit Union City Pla:mer Tom Lovelace introduced the item. lie said stacking for six vehicles is typical of an ATM site. Bergman asked about diverting traffic through the parking ramp area, Lovelace responded that the ATM will be installed prior to the ramp being constmcted, and also that could create a potential conflict with the. ramp traffic. Mark Nelson of United Properties, representing the Northwest Air Federal Credit Union, stated they are very excited to create a presence in the City prior to the world headquarters being bunt. MOTION: Burke moved, seconded. by Bergman, to approve the site plan/building permit authorization to allow for the placement of an automated teller machine 13y Northwest Airlines Federal Credit Union ar the southwest comer of the Apple Valley Commons II building. parking lot, with the condition that staff7eviewtheturning radi to assure their adequacy. Motion carried 7-0. C. Sideyard Setback Variance for Storage Shed at 13825 Gladiola Way by Brian Wiegands Margaret Milton introduced the item. She stated the petitioner had not yet had the property surveyed to verify the property lines. Hadley asked about fire protection in the case of an accessory building being built so close to the house. Community Developmerrt Director Rick Kelley resppnded that if a fire wall is installed, the structure can be built neat to the house. MOTION: Bergman moved, seconded by Churchill, to table the item urrtil Use property line has been determined. Motion carried 7-0. 7. OTHER BUSINESS A. Upcoming Groundbreakings and Dedications Rick Kelley reminded the Commission of the following events: (a) Groundbreaking for Northwest .Airlines Federal Credit Union Heart Monday at 4:00 p.m. (b) Dedreation of Chasewood Townhomes (Dakota Coumy Housing & Redevelopment Authority project) neat Tuesday at 3:30 p.m. Metropolifarr Council Chair Ted Mondale will be presart. B. Update of Painting Brick Buildings irr the Downtown and Lamperts Window Issue. Rick Kelley stated there is not a prohibition ofpaintiug brick buildings. That standazd applies only to new Construction. He went on to say staffplans to address that issue by amending the ordinance. Blundetto said the eacpectations steed to be communicated to the businesses when the amendment occurs. MOTION: Churchill moved, seconded by Blundetto; to direct staffto prepare an amendment and schedule a public hearing. on this issue. Motion carried ?-0. Regarding. Lamperts, Tom Lovelace commupicated that the conunercial budding inspector is working with the Lamperts contractor to resolve this issue prior to issuance of the permanent Certificate of Occupancy (CO). Blundetto asked if the lack. of windows was enough of an issue to hold up issuing the CO. Attorney Sharon Hills replied their office can look irrto whether a criminal violation of the building code has occurred; or move the matter forward as a civil case. Lovelace will try to inform the Commission of resolution or referral to the attorney's office regarding this matter within two weeks. Bergman asked if there are any different requiremerrts for storage sheds in a side yard versus a back yard regarding materials. Milton answered drat sheds do not have to be of any particular material, whether in the side or rear yard. Planning Commission Minutes October 20, 1999 Page 4 8.
