HomeMy WebLinkAbout02/02/2000CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES FEBRUARY 2, 2000 L CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Chair Kazen Edgeton at 7:00 PM. Members Present: Karen Edgeton, Tim Burke, Tom Melander, John Bergman, Jim Hadley, Jeannine Churchill and Frank Blundetto. Members Absent: None. Staff Present: Community Development Director Rick Kelley, City Planner Tom Lovelace, Assistant Planner Kathy Bodmer, Assistant Planner Margaret Milton, Consulting Engineer Pat Wmse and City Attorney Sharon Hills. Blundetto introduced Boy Scout Troop #290, present to observe the proceedings to receive Merit Badge credit. 2. APPROVAL OF AGENDA MOTION: Burke moved, seconded by Blundetto, to approve the agenda as submitted. The motion carried 7-0. 3. APPROVAL OF JANUARY 5, 2000 MINUTES MOTION: Churchill moved, seconded by Hadley, to approve the minutes as submitted. The motion carried 6-0 (Edgeton abstained). 4. CONSENT ITEMS -None - 5. PUBLIC HEARINGS A. Motor Fuel Sales & Car Wash Conditional Use Permit and Site P1an/Building Permit Authorization for Kwik Trip Gas/Convenience Store at C.R. #42 & Foliage Avenue Edgeton opened the public hearing at 7:02 p.m. with standard remazks. City Planner Tom Lovelace introduced the project. Edgeton asked about any restrictions at the intersection of C.R. #42 and Foliage and expressed her concern about cars stacking, citing Van Wormer's recommendation not to allow full access onto Foliage. Lovelace noted the intersection is athree-quarter, non-signalized intersection, and that one alternative is to allow full access initially with the possibility of closing it when build-out of Fischer Mazketplace occurs. Bergman said he'd like to see improved landscaping along C.R. #42. Burke suggested an additional driveway to the north when build-out occurs. Edgeton requested an overhead of the entire Fischer Mazketplace to accompany presentation ofthese projects. Scott Teigen, Director of Real Estate for Kwik Trip, introduced himself and stated he agreed with staffs concerns. He went onto say Kwik Trip would agree to aright-in only off Foliage and would also Planning Commission Minutes February 2, 2000 Page 2 agree to parameters to close it some day. Lovelace showed an overhead demonstrating options for right- tum only off Foliage. Teigen said they prefer the option with the continuous right-turn lane along Foliage. Blundetto asked about internal traffic circulation of trucks. Teigen responded there would be diesel on each end of the pumps for small diesel vehicles. Melander said he agreed with the Chair that access off Foliage not be allowed now and then taken away later. Teigen noted they could tum the site around without access to C.R. #42, in which case they would detach the car wash. Kwik Trip, however, would prefer not to have their "back" to C. R. #42. Edgeton noted that the City requires a "back" to be equally attractive as a "front". The chair opened up the hearing to public comments. Ron (no identification given) said he doesn4 see a problem with traffic except for tunung left off Foliage going south, which is not allowed with the current three-quarter intersection. There being no additional public comments, Edgeton closed the hearing at 7:30 p.m. B. Rezoning to "M-3", Preliminary Plat & Site Plan/Building Permit Authorization for 21 Townhomes by Diedrich Builders at Galaxie Avenue and 132"d Street Chair Edgeton opened the hearing at 7:31 p.m. with the standard remarks. Lovelace introduced the item. He noted a house and outbuildings are currently situated on the lot. Bergman asked about adjacent sites, and Burke wondered if any of those homes were still on septic systems. Hadley inquired about greenspace. Lovelace responded it is calculated at 62%. That calculation will change somewhat because the street azea needs to become dedicated right-of--way. Bill Diedrich of Diedrich Builders said guest parking could be added on the north side of the private street. He stated a tree inventory will be completed next week, and that most of their customers are retired so traffic is not a problem. The 50% brick requirement will be met; the driveway slope on Lot 17 will be reduced below 10%; and the roof lines will be staggered. Edgeton invited public comment. Tom Kukowski of 7290 132"d Street stated he was concerned about the number of homes on the site because of the increasing difficulty getting onto Galaxie Avenue from 132°d Street. Hunt Gildner of 13186 Garnet Avenue said he shared the concern about traffic. He went onto say he thought natural siding is needed to conform with the neighborhood; that the neighborhood is short on parks; he's concerned about greenspace. He questioned the size of the units and the notification process for hearing. Doug Carlson said he was opposed to rezoning mainly because of the density. Lovelace clarified that natural siding is not required. Planning Commission Minutes February 2, 2000 Page 3 Phyllis Cazlson said she was curious about the distance from the corner to the east driveway, and whether the knob on Galaxie Avenue would be modified. Lovelace answered the distance is 180 feet, and that the entrance location would be the same as the existing driveway. There being no other comments from the public, Edgeton closed the hearing at 8:07 p.m. 6. LAND USE/ACTION ITEMS A. Hidden Ponds Apartment Site -Consideration of Comp Plan Amendment & Rezoning at Germane and 128th Street by Domestic Development Assistant Planner Margaret Milton presented the project. Community Development Director Rick Kelley clarified that MnDOT could convey their parcel to Diedrich without the requirement of replatting. Melander shazed his concern about a potential site plan because of the pond easement. Edgeton said she thought there were too many unlmowns to vote for rezoning. Hadley agreed with Melander's concern. The petitioner Frank Kleckner read from a letter to the Planning Department, dated August 20, which included a revised plan and application. Because there was a moratorium on development of the site at that time, the application was returned to the petitioner. Kleckner stated he had no intention of building within the easement, that he wanted no more delays, and that he wants the two parcels treated together. Milton displayed the second site plan which Kleckner referred to, but which plan still did not address the concerns that were raised. Kelley noted that consolidating Lot 2 would help the applicant with density, but a driveway going across Lot 2 without replat or rezoning would not be prohibited. Hadley asked about the density without Lot 2. Milton replied that at least 10 units would need to be dropped to conform to the proposed zoning. MOTION: Churchill moved, seconded by Blundetto, to deny the petition for a comprehensive plan amendment because of too many unknown's. The motion carried 7-0. MOTION: Churchill moved, seconded by Blundetto, to deny the rezoning because of its inconsistency with the comprehensive plan. The motion carried 7-0. The Chair called atwo-minute recess at 8:45 p.m. The meeting was reconvened at 8:52 p.m. Churchill stepped down for discussion of the next item. Planning Commission Minutes February 2, 2000 Page 4 B. Fairview Cedar Ridge Clinic -Site PIan/Building Permit Authorization for Addition at 15650 Cedar Avenue Lovelace introduced the item. He stated the plan is in conformance with all regulations, and staffs only recommendation is to modify the landscape plan. John Harris of Harass Architects introduced himself and said he was available for any questions. MOTION: Burke moved, seconded by Bergman, to approve the site plan/building permit authorization with staff recommendations. The motion carried 6-0. Churchill returned to the dais. C. Prairie Crossing Commercial -Public hearing for Comp Plan Amendment from "SF" to "NS" and Rezoning from "R-3" to "PD-629", Zoning Amendment to "PD-629" to allow banks as a permitted use and drive-thru tellers as a conditional use, Preliminary Plat to create 3 lots in Prairie Crossing Commercial Development. Assistant Planner Kathy Bodmer introduced the item. She noted that site plan building permit authorization is not requested at this time. There was discussion about the number and placement of fuel pumping stations. Bodmer presented information on the number and configuration of pumping stations throughout the City. Mike Falk of CWB introduced Mike Belz of Dodd Valley Development, who will take over development of the commercial section of Prairie Crossing. Falls pointed out the changes from previous plans as indicated in the staff report. He suggested the Commission may want to consider limiting the total number of pumping stations rather than to specify configuration of the pump islands. MOTION: Burke moved, seconded by Melander, to recommend approval of the Comprehensive Plan Amendment ofthe expansion area from "LD" to "NS". Motion carried 7-0. MOTION: Burke moved, seconded by Melander, to recommend approval of the Rezoning of the expansion azea from "R-3" to "PD-629, Zone 4". Motion carried 7-0. MOTION: Burke moved, seconded by Melander, to recommend approval of Amendment to PD-629, Zone 4, to allow banks as a permitted use and drive-thru tellers as a conditional use. Motion carried 7-0. MOTION: Burke moved, seconded by Melander, to recommend Amendment to PD-629, Zone 4 to limit the number of gasoline pumping stations to 12. Motion carried 7-0. MOTION: Burke moved, seconded by Melander, to recommend approval of the Preliminary Plat to create 3 lots and a public street with a 40-foot right-of--way through the development. Motion carried 7-0. Kelley Trust - AUAR Environmental Review for Mixed Residenfial Development west of Diamond Path and north of 135"' Street Lovelace irriroduced the item, which is mainly located in the City of Rosemount. He stated from Apple Valley's perspective, the greatest concern is traffic at Diamond Path and Pilot Knob. Possible cut- through traffic on Diamond Path is also a concern. Rick Person of the City of Rosemount gave an overview of the project. He introduced Shem Buss of Bonestroo, Rosene, Anderlik & Associates, the prepazer of the document. Buss stated they have tried to work with all decision makers up front in developing the azea. The main issues identified include: (1) storm water management, erosion and sedimentation; (2) high quality wetlands; (3) traffic on Diamond Path. Buss went on to say the developer has committed to some innovative measures to deal with storm water and wetlands. Blundetto asked when the Commission would get more details on the traffic issue. Shelley Johnson of Bonestroo said the development will add approximately 400 vehiclesJday at full development. One possible measure is to time the signals at Pilot Knob and Diamond Path, which would require agreement by Dakota County. Kelley informed the Commission the City has been monitoring traffic on Diamond Path. The daily traffic counts have decreased by 500 cars since the signal at Pilot Knob and Diamond Path became operational. B. Sketch Plan for Townhomes at Galaxie Avenue & 132nd Street by Dahle Brothers Lovelace introduced the item. He stated there aze currently two dwelling units on two pazcels. Chuck Ryan, representing Dahle Brothers, clarified the current sketch plan is for 35 units, not 37. He stated they want to have a meeting with Williamsburg residents to discuss the possibility of acquiring their remainder pazcel. They would also like to eliminate the need for four off-street "guest" parking stalls for the eight units fronting the public street where on-street pazking is available. Kelley gave a brief history of Gamma Drive right-of--way associated with the Williamsburg project. There was discussion regarding differences in greenspace and density if the remainder Williamsburg parcel were incorporated into the Dahle Brothers project. Melander asked about the proposed alignment of the units. Ryan responded the garages will be staggered, but the backs would be straight. Lovelace noted they would probably have the ability to stagger units based on setbacks. Ryan added they intend to keep the exterior low maintenance, and that they like to use more mature trees and significant landscaping to enhance their projects. Edgeton said she is concerned with how the backs of the units look, particularly where they back up to existing single family homes or to a public street.
