CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Chair Karen Edgeton at 7:00 PM. Members Present: Karen Edgeton, Tim Burke, Tom Melander, John Bergman, Jim Hadley, and Frank Blundetto. Members Absent: Jeannine Churchill. Staff Present: Community Development Director Rick Kelley, City Planner Tom Lovelace, Assistant Planner Kathy Bodmer, Assistant Planner Margaret Milton, Consulting Engineer Pat Wrase and City Attorney Sharon Hills. 2. APPROVAL OF AGENDA Community Developmem Director Rick Kelley recommended that Kwik Trip item 6A be tabled. Bergman asked that "Manufactured Housing Ordinance" be added to Other Business. MOTION: Melander moved, seconded by Hadley, to approve the. agenda as amended. The motion carried 6-0. 3. APPROVAL OF FEBRUARY 2, 2000 MINUTES Commissioner Hadley pointed out on p.3, second paragraph of 6A, that the name Diedrich should be replaced with Kleckner. MOTION: Bergman moved, seconded by Hadley, to approve the minutes as amended. The motion carried 6-0. 4. CONSENT ITEMS -None - 5. PUBLIC HEARINGS A. Orchard Pointe -Planned Development Rezoning, Preliminary Plat & Site Plan/Building Permit Authorization for 278 Townhome/Condominium Dwellings at Foliage and 153`" Street Edgeton opened the public hearing at 7:03 p.m. with standard remarks. City Planner Tom Lovelace introduced the project. He noted that full dedication of Flagstaff Avenue is recommended because there are significant pipelines in the azea that would be too costly to move. The Commissioners asked about greenspace calculation, disposition of the utility easement upon which a building is shown placed, whether a culvert will direct the tributary under the roads, and how this plan fits with the Mixed Use Comprehensive Plan designation. Edgeton requested for the next meeting a map showing what is proposed in other Mixed Use areas. Scott Johnson, President of Arcon, stated the north half ofthe property is to be commercial and retail, so the 80-acre pazcel would then be Mixed Use. He went onto say Flagstaff Avenue is expected to be installed next year. As for pedestrian access, they would add sidewalks at all entrances. He said they could Planning Commission Minutes February 16,2000 Page 2 redistribute guest pazking spaces and supply a greater diversity of plantings. He concluded by saying the green azea east of future Flagstaff Avenue may become part of the Genstar properly, rather than Arcon owning a narrow strip on the other side of the road. Hadley asked again about the easement with a building on it. Lovelace noted that easement is for the tributary Swale, which can be manipulated or moved around. Bergman queried whether the townhomes will be offset. Johnson responded that the front elevations aze offset, and the garages are the same distance from the street. There being no public comments, Edgeton closed the hearing at 7:25 p.m. B. Planned Development Rezoning and Site PIanlBuilding Permit Authorization for Multi- Tenant Retail Building Chair Edgeton opened the hearing at 7:26 p.m. with the standard remarks. Assistant Planner Margaret Milton introduced the item. The Commissioners requested the following information: the distance from the south parking lot to the street; more information about why the Planned Development was set up with only Class I restaurants; number of sites zoned for Class I restaurants; number and location of sites zoned for Class II restaurants; a rough drawing of where the pylon signs aze located in the azea; schematic of the sign proposed. Burke asked about pedestrian access, and Edgeton said pazking needs to be looked at very closely, not knowing who the tenants will be. John Patterson, representing the petitioner, stated they could replace the shrubs on 151x` Street with trees, and also consider internal sidewalks even though there isn't a lot of room. He also commented that development of the site is restricted by the expanded right-of--way required for County Road #42. Tom Schuette with Azure Properties reiterated that they had a lazger building planned originally. He said tenant uses currently planned include: (1) art and frame store; (2) small take and bake pizza operation; (3) Panera Bread restaurant; and (4) a meat and seafood business. Edgeton expressed concern with the azchitecture of the rear of the building. Fdgeton invited public comment. Terry Bitsedorf of 14324 Flora Way asked if snow removal would block public access and additional parking. Rick Kelley responded there would be no impact on the street use or the ability to remove snow by granting placement of the building along 151x` Street as proposed. There being no other comments from the public, Edgeton closed the hearing at 7:56 p.m. C. Comprehensive Plan Amendment & Rezoning to "SG" for 25 Acres; Conditional Use Permit for Sand & Gravel Mining of 25 Acres; Amendment to Current Conditional Use Permit for 320 Acres at the Northeast Corner of Pilot Know and 160u' Street by Aggregate Industries (formerly CAMAS) and Nordic Square Ltd. Edgeton opened the public hearing at 7:57 p.m. with standazd remarks. Planning Commission Minutes February 16, 2000 Page 3 Lovelace introduced the item. He noted the plan includes a mining completion date of 2004. Edgeton asked about the closing of 160s` Street. Lovelace stated the roadbed would be mined to lower the road. He added that engineering plans for the 40-acre pond have already begun, and that construction of the pond will start this spring. Hadley expressed concern about the impact of closing both Dodd and 160' in 2000. Lovelace replied the City will not allow the closing of Dodd Boulevazd until construction of Pilot Knob at County Road #42 has been completed. Hadley also asked about fire protection if the two roads aze closed. Bergman wondered if there is concern about traffic turning south if trucks wfll be hauling boulders greater than six inches. Bob Bieragel of Aggregate Industries stated there is currently no crushing on the site. Since they are moving away from the residential azea, they would like a primary crusher on site, which would eliminate truck traffic. Tracks would operate internally on the site, not on city streets. He added there aze not many boulders on this site. Bieragel went on to say Dodd Boulevard could be closed as long as three years. Mining and reconstroction of 160x' Street could be finished by Fall of 2001. The Reclamation Phase I could be released for development by the end of this yeaz. There was some discussion of the parcel east of the 25-acre site. Kelley noted mining of that parcel by Fischer Sand & Aggregate will likely occur sometime after 2003. Discussion about the crusher also occurred. Lovelace said the crusher would be located at the pit face and would move with the product. Kelley noted primary crushers aze permissible., and that Fischer currently uses one north of this project site. Blundetto requested more information on crushers. Melander stated the faster residential development occurs, the more problems he thinks the petitioner will have. Bieragel responded by the time all the houses aze sold, mining would be completed. Hadley asked. about the location of the conveyer and screen when Phase I reclamation begins. Bieragel answered that they would be moved by the end of this year. In the fixture the conveyer may go along 160s' and Pilot Knob. Bergman suggested mining the northwest azea quicker to allow Dodd Boulevard to reopen sooner. Mazk Ceminsky of 14625 Hallmark Drive asked why the ponding was reduced to 40 acres from the 75 acres originally planned. Dave Tomlinson of 15450 Dodd Boulevard posed several questions: Does the Vermillion waterway work its way over this far? He said he lives in the house closest to the operation and is very concerned about the noise. How close is underwater mining to the existing wells? He expressed disappointment that the lake size seems to be diminishing. What will the grading of the site be. Will there be a notification process before Dodd Boulevazd is closed? He also said 12 units/acre seems too dense to meet the Comprehensive Plan. Kelley stated the decision to realign Dodd Boulevazd was made a long time ago, but that its closing date had not been determined. Planning Commission Minutes February 16, 2000 Page 4 There being no other comments from the public, Edgeton closed the public hearing at 8:45 p.m Blundetto left the room at this time. 6. LAND USE/ACTION ITEMS A. Motor Fuel Sales & Car Wash Conditional Use Permit and Site Plan/Building Permit Authorization for Kwik Trip Gas/Convenience Store at C.R #42 & Foliage Avenue Lovelace pointed out the petitioner now wants to propose anorth-south building orientation. Staff and the petitioner recommend tabling the itemwrtil all detailed plans can be completed. 5-0 MOTION: Hadley moved, Burke seconded, to table this item until the next meeting. Motion carried B. Rezoning to "M-3", Preliminary Plat & Site Plan/Building Permit Authorization for 21 Townhomes by Diedrich Builders at Galaxie Avenue and 132°" Street Lovelace distributed a memo from the city attorney and explained the notification procedure for public hearings. Because the abstractor's list was incomplete, staff recommends tabling the item until adjacent residents have been individually notified of the proposal. MOTION: Burke moved, seconded by Melander, to table this item until the next meeting. The motion carried 5-0. 7. OTHER BUSINESS A. Sketch Plan for Rezoning, Preliminary Plat & Site PlanBuilding Permit Authorization at the Northeast Corner of McAndrews Road & Everest Trail by Centex Homes and Mike Mickelson. Milton introduced the item. She pointed out that the townhome proposal would require a rezoning and comprehensive plan change because the proposed density at 4.6 units/acre is too low. Burke asked about a density bonus. Milton explained additional density is allowed if certain criteria are met. One example is private recreational amenities. Erlgeton requested a complete list of criteria if a formal application comes in. Burke asked about proposed elevations in relation to the park. Milton said the elevation would be about the same as the park. Fdgeton stated with so much single family in this area, jumping into a 3-story apartment seems like a stretch. On the other hand, townhomes seem to be a better fit but need a rezoning, while apartments aze less intrusive to the existing vegetation. She asked what the City's vision was in determining the current zoning. Kelley said multi-family would cause the least disturbance, given the contours of the site. Melander and Bergman indicated their preference for the townhome proposal. Burke noted there have been several accidents at Diamond Path and McAndrews, and this proposal may further impact that. Planning Commission Minutes February 16, 2000 Page 5 Kathy Strelnieks of Centex Homes introduced Ed Haesek of Westwood Professional Services. Haesek stated they proposed the apartments to test the density. He pointed out the benefits to the townhome proposal versus the apartment plan and stated his confidence in getting County approval for an access to McAndrews. He also noted they didn't connect the cul-de-sacs because of grade changes. Blundetto returned at 9:22 p.m. Melander said he would be happy to decrease the density. Bergman asked if the cul-de-sacs could be connected. Edgeton stated concern about affordable housing and different housing stocks. She requested a housing stock inventory in that azea of the city. Burke thought the townhome proposal was better given the topography. B. Sketch Plan for Child Care in "I-1" Zoning District at the Northeast Corner of Johnny Cake Ridge Road and C.R. #42 by United Properties and Children's World Learning Center Assistant Planner Kathy Bodmer introduced the item. Blundetto asked why childcare isnt currently allowed. Kelley said two factors were preserving industrial land and the allowance for childcare in many other zoning districts. Edgeton stated her opposition to making a change to allow childcare. Ned Rukavina of United Properties stated they like the site because it is close to businesses that will use it. He also questioned whether a 1 %z acre site is viable for industrial development. He said a daycare would have hours compatible with industrial uses. Blundetto stated he did not like the proposed site for daycare. Hadley mentioned noise and fumes from neazby tracks. He also referred to the new industrial pazk (Valley Business Pazk) and wondered if any market surveys had been done for that area. Burke said he was not thrilled with the daycare idea there, but was concerned about the ability to utilize a 1 '/: acre site for industrial development. Melander echoed a 1 % acre site is tough to build on. He referenced other industrial sites with service uses within them. Bergman indicated he was not crazy about the proposal. He did note, however, that the school district has a facility in the industrial pazk. Victor Sacco, Manager of Real Estate for Holiday Companies, said that convenience and daycare work well together for folks. Planning Commission Minutes February 16, 2000 Page 6 C. Manufactured Housing Ordinance Bergman stated the task force had met and asked Mr. Kelley to provide an update. Kelley said an agreement among the parties was reached at the last meeting. The city attorney is putting together the final language. The item may be brought to the Planning Commission as early as the next meeting. 8. ADJOURNMENT MOTION: Blundetto moved, seconded by Bergman, to adjourn. The motion carved 6-0. The meeting was adjourned at 9:52 PM.
