PLANNING COMMISSION MINUTES
JUNE 21, 2000
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Vice-Chair Frank
Blundetto at 7:00 PM.
Members Present: Frank Blundetto, John Bergman, Jim Hadley, Tom Melander, Jeannine Churchill
Members Absent: Karen Edgeton, Tim Burke.
Staff Present: Community Development Director Rick Kelley, City Planner Tom Lovelace, Assistant
Planner Kathy Bodmer, Consulting Engineer Pat Wrase, City Attorney Sharon Hills.
2. APPROVAL OF AGENDA
Vice-chair Blandetto asked if there were any changes to the draft agenda. There being none, he called
for its approval
MOTION: Melander moved, seconded by Churchill, to approve the agenda as amended. The motion
carried 5-0.
3. APPROVAL OF JUNE 7, 2000 MINUTES
Vice-chair Blundetto asked if there were any changes to the draft minutes as presented. There being
none, he called for their approval
MOTION: Churchill moved, seconded by Hadley, to approve the minutes as presented. The motion
carried 5-0.

5. PUBLIC HEARINGS
A. Amendment to Planned Development for Pharmacy Drive-Thrn & Site Plan/Building Permit
Authorization for Mulfi-Tenant Retail Building in Fischer Market Place by Centres Group and
Fischer Market Place LLP
Vice-chair Blundetto opened the public hearing at 7:05 p.m. with standard remarks.
City Planner Tom Lovelace introduced the item and reviewed the site plan and traffic circulation. The
three issues he has identified needing discussion and resolution are:
1) The parking spaces along the rear (north) side of the building are likely to conflict with deliveries
as well as traffic exiting the pharmacy drive-thrn adjacent.
2) The possibility of adding a driveway access to Forum Path on the west side of the lot to better
emphasize the front of the building to patrons.
3) Enhancement of the rear (north) building elevation to look more like the front of a building since it
faces a public street.

Commissioner Bergman asked if a new driveway access to Forum Path would have to line up with any
possible driveway that might be contemplated for the vacant lot located on the west side of Forum. Tom
Lovelace responded that it could either line up or be offset per code.
Tom Morse of KKE Architects introduced himself and explained the thought process they went
through as they designed the building and site plan. He noted the sidewallc connections for pedestrian
access and said they have used the same architectural "language" as the other multi-tenant building that has
been approved in this development.
Blundetto asked if there was any glass on the rear of the building. Morse said that on the rear the only
glass was on the corner towers. Blundetto said that this building was much longer than the previously
approved multi-tenant building and that the amount of glass on the reaz of this proposed building was not
proportional to the length of the reaz elevation.
Commissioner Melander noted that in the staff report it said that there was a possibility that the front
(south) elevation of the Snyder's drug store may be slid forward to be flush with the rest of the building and
that the foundation plantings in front of Snyder's would be relocated to the rear. The Commission asked
what staff's opinion was about this option. Tom Lovelace stated that his preference was to keep the
landscaping in front of Snyder's in order to enhance the appearance of the building. Melander then asked
the petitioner what he thought about staff's suggestion for an additional driveway access to Forum Path?
Paul Bilotta of Centres Group explained the status of the building lease-up. He said that if the lazger
tenants drop out, they may configure the west side of the building into smaller "back-to-back" tenant spaces
so that front entry doors will be necessary on two sides of the building (both north and south). If this
happens, they want to "force" all customer traffic past the north-facing business entrances and therefor do
not want a separate driveway access to Forum.
Bergman said that he would like to see an alternate building design, which incorporates such north-
facing stores. A general discussion ensued about possible enhancements to the reaz building elevation. Mr.
Bilotta said that when they return to the Commission they will show two revised reaz building elevations,
one of which will show entrances for the potential north-facing stores.
Blundetto asked if a design was possible to construct the building now with such north-facing stores?
Mr. Bilotta said that the building would be structurally designed to accommodate this, but that they didn't
want to construct north-facing entrances at this time if they end up not being used. If the entrances were
built but not used, their presence would confuse customers. Melander suggested the use of spandrel glass
along the reaz, which could be exchanged for real windows if occupancy be north-facing tenants becomes a
reality.
Commissioner Churchill asked if there would be any problems with pazking and traffic circulation
associated with north-facing tenant spaces? Tom Lovelace said he did not foresee any problems if the site
plan takes the possibility into account now. Churchill said she would like to see how both pazking and
truck dock would be accommodated on the reaz. Mr. Bilotta said that there would not be a formal truck
dock, just standazd doors (not overhead doors). He also said that Snyder's would have product delivery
through their front door eazly in the morning prior to business hours.
Blundetto then asked if t'rere were any comments from the public on this item. There being no
additional comments, he closed the public hearing.

6. LAND USE/ACTION ITEMS
A. Comprehensive Plan Amendment; Rezoning; Preliminary Plat to Create 2 Lots; Site
Plan/Building Permit Authorization for Church at the Southeast Corner of Cedar Avenue and 145's
Street by Christian Science Society
Assistant Planner Kathy Bodmer introduced the item. From the staff report, she reviewed the
comments and issues raised at the public hearing, with the three main issues being:
1) "Flipping" the chwch and office locations.
2) Location of the church in the center of the lot; building expansion.
3) List of all uses allowed on the north lot under the proposed "LB" zoning.
Bergman asked "what if' a daycare operation occurs in the chwch? Also, is the petitioner amenable to
replacing the proposed red splendor crabs with another species not susceptible to a leaf tissue fungus?
Raleigh Foss, representing the petitioner, stated that it is not part of the chwch's tradition or mission to
provide daycaze services. He said they selected the locations of the chwch building to minimize traffic
down Glazier, as they do not need the high visibility of the north lot at the intersection of Cedar Avenue
/145°i Street. Since they don't pay property taxes, they wanted to try and give back to the community
through design by placing the chwch building in a location that would save the lazgest trees on the site. He
said they also want the parking lot close to the front door to accommodate their parishioners with physical
handicaps. He stated the consensus of his group is that a new group would be formed somewhere else if
they got too large and not expand the building.
MOTION: Melander moved, seconded by Bergman, to recommend approval of a comprehensive
plan amendment to the northern portion of the property from "INS" (Institutional) to "C" (Commercial).
Motion carried 5-0.
MOTION: Melander moved, seconded by Chwchill, to recommend approval of a rezoning to the
northem portion of the property from "P" (Institutional) to "LB" (Limited Business). Motion carried 5-0.
MOTION: Melander moved, seconded by Chwchill, to recommend approval of a rezoning of the
former homestead from "R-3" (Single family residential) to "P" (Institutional). Motion carried 5-0.
MOTION: Melander moved, seconded by Churchill, to recommend approval of the preliminary plat
of Christian Science Society with the following condition: a) installation of a six foot (6') wide concrete
sidewalk along Glazier Avenue? 145°i Street. Motion carved 5-0.
MOTION: Churchill moved, seconded by Bergman, to recommend approval of the site plan building
permit authorization for the Christian Science Society Chwch with the following conditions: a) No work
including tree removal shall begin on the site until a natural resowces management permit (NRMP) has
been obtained from the Engineering Department; b) The developer shall submit a nwsery bid list that
confirms the value of the landscape planting meets or exceeds 2 ''/z% of the value of the construction of the
building. Motion carried 7-0.

B. Timberland Apartments Site Plan/Building Permit Authorization for 208 Units at future
Foliage Avenue and 157th Street by Timberland Partners
Lovelace introduced the item and noted the project name will be "Regatta Apartments" as it is located
within the plat and development of Regatta 3'a Addition; this azea is zoned under a planned development
that provides for site specific performance standards.
Mr. Lovelace noted that the proposed private street connection to 15Th Street lines up with the existing
private road access on the north side of the street; while this is less than a perfect 90 degree intersection, it
is acceptable given the curvature of the road and the need to line up the centerlines of the intersecting
private roads. He also noted that the revised site plan has created emergency vehicle hammerhead turn-
azounds on the east side of the site by reconfiguring the parking and free-standing gazages there. This
approach maintains a contiguous greenspace connection to the pond which satisfying the accessibility
concerns of the Fire Marshal.
Churchill said that she was concerned about ease of access to the rear parking courts by any guests
who were anfamiliaz with the layout of the complex and were visiting for the first time. Other
Commissioners felt that on-site directional signage could address this issue without altering the layout.
MOTION: Melander moved, seconded by Bergman, to recommend approval of site plan/building
permit authorization to allow for the construction of 208 apartment dwelling units on Outlot C, Regatta
Third Addition, subject to the replatting and final replat of said Outlot C. Motion carved 5-0.
C. Rezoning from "RB" to "GB" to Allow for aSelf-Storage Facility at Garrett Avenue & 155"'
Street by Superior Storage
This item has been tabled at the request of the petitioner.
D. Dahle Pines -Rezoning for Townhome Development
This item has been tabled at the request of the petitioner.
7. OTHER BUSINESS
A. Sketch Plan for Dental Office on the Southeast Corner of Cedar Avenue and 145"' Street by
Stephen Dalseth, DDS
Bodmer introduced the project, which is proposed to be located on the north lot of the Christian
Science Society plat considered as item 6.A. previously on tonight's agenda. The consensus of the
Commission was that they preferred the orientation of the building and anorth-south pazking lot as
depicted in Layout B. There was some discussion about sight distances around the curve of Glazier/145h
Street with the location of the driveway access.
Stephen Dalseth, DDS, said that he is working with a national architect who specializes in floor plans
for dental offices. When these plans are done, there will be an association with a local architect to prepare
the building elevations and fmal site plan. Dr. Dalseth said that he preferred Layout B because most of the
treatment rooms would be facing north, in order to avoid a west exposure that allows too much solaz gain
through the treatment room windows and higher operating costs for cooling. Blundetto asked if it were
possible to combine elements of both Layout A & B; he likes the parking on the east side.

Melander asked about the stairway illustrated on the floor plan. Dr. Dalseth explained that there is fill
on the site which will require soil correction; this condition means it makes economic sense to excavate and
create a basement. The excavation spoils will be spread elsewhere on the site.
There was some discussion of the landscape plan requirements and reforestation of the site after tree
removal and development. Some of the existing trees are not of a desirable species and would be replaced
with more desirable ones.
B. Set July Work Session
Kelley referred to several significant developments expected to occur in the south central and
southeast portions of the city and stated that a work session is needed in order for everyone to be aware of
the competing interests at work and the need to coordinate them carefully. He has suggested a work
session to be held just prior to the July 27, 2000, City Council meeting, which would allow
Councilmembers to attend the meeting. Commissioners Blundetto, Churchill, and Hadley all said that they
would be out of town and unable to attend a meeting on that date. Kelley suggested that this topic be
brought up at the next Commission meeting to try an arrive at a different date.

Vice-chair Blundetto adjourned the meeting at 8:39 p.m.
