PLANNING COMMISSION MINUTES
OCTOBER 4, 2000
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Karen Edgeton at
7:01 p.m.
Members Present: Karen Edgeton, Jeannine Churchill, Tom Melander, Jim Hadley, John Bergman
Members Absent: Tim Burke, Frank Blundetto
Staff Present: Community Development Director Rick Kelley, Consulting Engineer Pat Wrase, City
Attorney Shazon Hills, Assistarrt Planner Kathy Bodmer, City Planner Tom Lovelace
2. APPROVAL OF AGENDA
MOTION: Churchill moved, seconded by Bergman, to approve the agenda as proposed. The motion
carried 5-0.
3. APPROVAL OF SEPTEMBER 20, 2000 MINUTES
MOTION: Melander moved, seconded by Bergman, to approve the minutes as submitted. The motion
carved 5-0.
4. CONSENT ITEMS -None -
5. PUBLIC HEARINGS
A. Preliminary Plat to Subdivide Unplatted Parcel into 2 Lots; Conditional Use Permit for Class II
Restaurant at the Northwest Corner of Galaxie Avenue and 153'" Street by New Century, Inc.
Chair Edgeton opened the public hearing at 7:02 with the standazd remarks.
City Planner Tom Lovelace introduced the item, which consists of a subdivision of land, conditional use
permit and site plan building permit to allow for construction of a Class II Culver's Restaurant.
Lovelace explained that any tirrted building materials would have to be integrally colored rather than
painted, and that sidewalk connections would be required to Galaxie Avenue and 152°d Street.
Bergman asked about pazking on the west side of the Culver's building. Lovelace responded there would
be no pazking on that side.
Edgeton noted at the Elk River store stacking occurs on the end where orders aze picked up. Lovelace
stated there is room for stacking of about three vehicles in addition to one at the window.
Gene Pederson of New Cemury, the petitioner, said they would own the second building proposed for the
plat also. He stated they have no problems with the suggested landscape changes or moving the building a little,
and that they could dress up the reaz elevation. Pederson noted that Vanguazd Construction would be the
builder.
Edgeton asked if there would be any room for Culuer's to expand. Pederson said the proposed building is
their lazgest footprint, and there aze no provisions for future expansion.
Bergman queried whether an additional turn lane would be constructed on Galaxie. Lovelace said that is
not anticipated, but a traffic study is being done. The petitioner confirmed that the north-south drive over the
two lots would be completed when Culvers is constructed.

Edgeton stated she would like to see the traffic pattern revised to eliminate two-way traffic on the west
side.
There being no commems from the public, Edgeton closed the public hearing at 7:33 p.m.
6. LAND USE/ACTION ITEMS
A. Interim Use Permit for Outdoor Storage of Staging Trailer by GoodwilllEaster Seals
Assistant Planner Kathy Bodmer described the request for an interim use permit to allow overnight storage
of asemi-trailer during peak donation periods.
Kimberly Ziesemer, representing the petitioner, stated they would like to keep the trailer as close as
possible to the donation azea so a forklift or pallet jack can be used to transport items from the donation area
directly onto the trailer. She specified there would be only one trailer on site for that purpose.
Bergman said he was stuck in traffic there for 45 minutes on a Saturday and was concerned about that time
being extended if cars had to wait for loading to occur. Ziesemer said in that situation they would wait until the
busy time had passed.
Bergman stated he is not comfortable with the trailer there, that they could use the loading docks. He
wondered if they could eliminate the problem by conveying material to the loading dock. Ziesemer said they
aze looking at different options, but that anon-profit needs at least a year to plan for its facilities.
Bodmer said the City has restricted delivery times at some businesses, but that traffic is moving so slowly
in this situation staff does not see a problem with conflicts.
Fdgeton stated she looks at this as an opportunity for the petitioner to look for along-term solution.
MOTION: Mekmder moved, seconded by Churchill, to recommend approval of an interim use perrnit to
allow the overnight storage of asemi-trailer on the Goodwill/Easter Seals site with the following conditions: (a)
the interim use permit will be valid for a period of two years; (b) a maximum of one trailer shall be allowed to
be stored on the site at any one time; (c) the trailer shall be located on the site only during the peak collection
periods of May-June September-October and the last week of December; (d) the trailer shall be located on the
site in accordance with the approved site plan. Motion carried 4-1 (Bergman).
B. Zoning Amendment to Regulate Convertible Vestibule Sales Area Under Performance Standards
in NCC Zones
Bodmer introduced an amendment to the NCC Zoning District to allow constmction of a vestibule with
movable walls for product display and sales.
Edgeton said the proposed amendment takes care of her concern of stacking items like potting soil
MOTION: Churchill moved, seconded by Bergman, to recommend adoption of the amendment to the
"NCC" zoning district, regulating the constmction of vestibule merchandise display areas. Motion carried 5-0.

8. ADJOURNMENT
Churchill moved, seconded by Bergman, to adjourn the meeting. Motion carried 5-0. The meeting was
adjourned at 7:57 p.m.
