CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to order by Vice-Chair Jeannine Churchill at 7:06 p.m. Members Present Jim Hadley, Tom Melander, Jeannine Churchill, John Bergman, and David Schindler Members Absent Tim Burke and Kazen Edgeton. Staff Present: City Engineer Jacob Fick, City Attorney Sharon Hills, Assistant Planner Kathy Bodmer, Assistant Planner Margaret Dykes, Community Development Director Rick Kelley 2. APPROVAL OF AGENDA Vice-Chair Churchill asked if there were any changes to the agenda. There being none, she called for its approval 0. MOTION: Melander moved, seconded by Hadley, to approve the agenda. The motion carried 5- 3. APPROVAL OF MARCH 6, 2002 MINUTES Vice-Chair Churchill asked if there were any changes to the minutes. Commissioner Bergman asked that the misspelling of his name be corrected in the motion for item number 7A MOTION: Melander moved, seconded by Bergman, to approve the minutes as amended. The motion carried 40 (Hadley abstained). 4. CONSENT TTEMS -None - 5. PUBLIC HEARINGS -None - 6. LAND USE/ACTION ITEMS A. Dalseth Dental -Consideration of a sign variance for monument signs. Assistant Planner Mazgazet Dykes presented the variance request as outlined in the staff report. Because of the additional right-of--way dedication required for Cedaz Avenue, staff believes there is justification for a setback variance for the one sign, but that an addifional ground sign along Glazier Avenue is not warranted. She noted that the sign variance criteria is very explicit about what types of variances are allowed and the conditions which must exist in order for them to be granted. An extra ground sign along Glazier Avenue does not meet any of the criteria, and even if it did there is no reason for any reduction of required setback along Glazier since it has a standard right-of--way width. Planning Commission Minutes 1 March 20, 2002 There was a general discussion about the varying right-of--way width for Cedaz Avenue and the relative locations of other ground signs to both its curbline and pathway. There was further discussion about the intent of the provisions in the sign regulations for the substitution of a ground sign for, a building sign on double frontage lots. It was noted that while no building sign has been proposed for the Dalseth building, the sign regulations would allow one. Dr. Dalseth presented the Commission with his rationale for seeking a second ground sign along the Glazier Avenue side of his lot. He expressed concern for the ability of emergency responders to fmd his building if another ground sign was not approved. Commissioner Schindler suggested that the ground sign substitution criteria be reevaluated the next time that the sign regulations are looked at. MOTION: Hadley moved, seconded by Bergman, to recommend approval of a setback variance from 13' to 1' for the ground sign located along Cedaz Avenue at 14505 Glazier Avenue for the Dalseth Dental Clinic due to the hardship created by the additional right-of--way dedication. 7. OTHER BUSINESS A. Review Legacy of Apple Valley EAW for a mixed retail, office, townhome & apartment complex. Assistant Planner Margaret Dykes introduced this item. Because of the magnitude of the proposed Legacy development, a mandatory environmental worksheet (EAW) had to be prepared to analyze and evaluate potential adverse environmental impacts arising from its construction. 8.
