HomeMy WebLinkAbout07/17/2002CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES JULY 17, 2002 CALL TO ORDER The City of Apple Valley Planning Commission meeting was called to Order by Chair Karen Edgeton at 7:00 p.m. Members Present: Karen Edgeton, John Bergman, David Schindler, James Hadley, and Tim Burke Members Absent: Jeannine Churchill and Tom Melander Staff Present: Community Development Director Rick Kelley, City Planner Tom Lovelace, City Attorney Sharon Hills, and City Engineer Jacob Fick 2. APPROVAL OF AGENDA Edgeton asked if there were any changes to the Agenda. Community Development Director Rick Kelley informed the Chair that Shepherd of the Valley Lutheran Church has postponed their request for an interim use permit (Item 6A). MOTION: Hadley moved, seconded by Burke, to approve the Agenda as amended. The motion carried 5-0. 3. APPROVAL OF MINUTES OF JUNE 19, 2002 Chair Edgeton asked if there were any changes to the minutes. There being none, she called for its approval. MOTION: Hadley moved, seconded by Bergman, to approve the minutes as presented. The motion carried 4-0, with Burke abstaining. 4. CONSENT ITEMS Norse. 5. PUBLIC HEARINGS None. 6. LAND USE/ACTION ITEMS A. Interim Use Permit for Church Use - Shepherd of the Valley Lutheran Church, 12637 Fairgreen Avenue Postponed at request of petitioner. B. Site Plan/Building Permit Authorization for Pickled Parrot Restaurant City Planner Tom Lovelace presented the request from the Pickled Parrot Restaurant for site plan review/buildingperrnit authorization to allow for the construction of a 7,345 sq. ft. restaurant and 1,870 sq. ft. patio with a "Tiki Baz" gazebo. Lovelace reported the restaurant and patio bar are within the Fischer Market Place development on approximately 1.4 acres of a 5.65 acre site that will be part of amulti-building restaurant development. Access to the overall site will be via driveways off Gadwell Street and Florence Trail. Lovelace stated the proposed building's exterior finish would consist of a combination of face brick and EIFS, a synthetic stucco material. Lovelace discussed some of the issues with the project. He stated that no exterior egress openings are indicated in the fence that surrounds the patio. There is also no connection from the patio area to the plaza via a decorative walkways identified on theplaza plan submitted by Fischer Market Place, and sidewalks are abutting the parking lot curbing where head on pazking is proposed. The materials used for paving of the sidewalk are not indicated. In addition, the plans identify a 26 ft. by 8 ft. beer cooler located at the southwest comer of the building to be partially screened by an 8 ft. high vinyl fence. A wood storage, trash, and recycling areas located along the southeast elevation are proposed to be screened by a 6 ft. vinyl screen and no screening for the mechanical equipment area. Chair Edgeton suggested that the wood, trash, and recycling storage areas be screened.. Commissioner Hadley recommended moving the wood, trash, and recycling storage azea to just south of the beer cooler, in addition to screening it. Lovelace reported that he is recommending the sidewalk directly adjacent to *1:e pazl~:ng spa: es be redesigned to assn:*e tha± a mininmum width of five ~Sj feet exist. Edgeton asked Lovelace if he was comfortable with the parking proposed and he indicated that Glen Van Wormer, the City's traffic engineer, has reviewed it and he is comfortable with the recommendations proposed. In regards to natural resources, construction of a berm will require the removal of several existing maple trees currently planted along County Road 42. Lodelace is recommending that these trees be transplanted on the site. MOTION: Commissioner Hadley moved, seconded by Bergman, to recommend approval of the site plan building permit authorization to allow for construction of a 7,345 sq. ft. restaurant and 1,870 sq. ft. patio with a gazebo on Lot 1, Block 1, Fischer Market Place 7a` Addition, subject to the following conditions: • The necessary egress gates shall be installed in the patio area and that one gate shall be aligned with the proposed Fischer Market Place plaza walkway connection. • The beer cooler shall be completely screened. • The ground mechanical area located along the southeast side of the building shall be properly screened. • Any trees removed as part of the berm construction in the southeast corner of the lot shall be replanted on site. • The wood, trash, and recycling storage areas shall be relocated from directly behind the building to just south of the beer cooler and shall be properly screened. • A decorative sidewalk shall be constructed from the outdoor patio area to the rear parking area located south of the building. • All sidewalks directly adjacent to any parking spaces shall be redesigned to assure that a minimum width of five (5) feet will exist at all times. The motion passed unanimously 5-0. 7. OTHER BUSINESS Cornmunity Development Director Rick Kelley reminded the Commission of the Grand Opening of Cobblestone Lake scheduled for July 19-20. 8. ADJOURNMENT Commissioner Burke moved, seconded by Hadley, to adjourn the meeting at 7:43 p.m. 3
