HomeMy WebLinkAbout07/12/2001CITY OF APPLE VALLEY Dakota County, Minnesota July 12, 2001 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held July 12th, 2001, at 8:00 o’clock p.m., at Apple Valley City Hall. PRESENT: Mayor Hamann-Roland ; Councilmembers Erickson, Goodwin, Grendahl, and Sterling. ABSENT: None. City staff members present were: City Administrator Lawell, City Clerk Mueller, City Attorney Dougherty, City Engineer Gordon, Finance Director Ballenger, Assistant to the City Administrator Grawe, Public Works Director Heuer, Parks and Recreation Director Johnson, Police Chief Johnson, Community Development Director Kelley, Administrative Assistant Pederson, and Human Resources Manager Strauss. Mayor Hamann-Roland called the meeting to order at 8:00 p.m. Everyone took part in the pledge of allegiance to the flag. APPROVAL OF AGENDA MOTION: of Erickson, seconded by Grendahl, approving the agenda for tonight’s meeting as amended. Ayes - 5 - Nays - 0. AUDIENCE Mayor Hamann-Roland asked if anyone was present to address the Council, at this time, on any item not on this meeting’s agenda. No one was present to speak. CONSENT AGENDA MOTION: of Grendahl, seconded by Sterling, approving all items on the consent agenda with no exceptions. Ayes - 5 - Nays - 0. CONSENT AGENDA ITEMS MOTION: of Grendahl, seconded by Sterling, approving the minutes of the regular meeting of June 28th, 2001, as written. Ayes - 5 - Nays - 0. Resolution No. 2001-118 MOTION: of Grendahl, seconded by Sterling, adopting accepting, with thanks, the donation of a 1986 Mazda automobile, valued at $500.00, from William and Katherine Sommers for use by the Fire Department in training. Ayes - 5 - Nays - 0. Resolution No. 2001-119 MOTION: of Grendahl, seconded by Sterling, adopting approving issuance of a Lawful Gambling Exempt Permit, by the Minnesota Gambling CITY OF APPLE VALLEY Dakota County, Minnesota July 12, 2001 Page 2 Control Division, to Church of the Risen Savior, for a raffle on September 23, 2001, at Apple Valley Sports Arena, 14452 Hayes Road; and waiving any waiting period for State approval. Ayes - 5 - Nays - 0. Resolution No. 2001-120 MOTION: of Grendahl, seconded by Sterling, adopting approving issuance of a Lawful Gambling Exempt Permit, by the Minnesota Gambling Control Division, to St. Hubert Catholic Community, for a raffle on June 2, 2002, at Apple Valley Ford, 7200 West 147th Street; and waiving any waiting period for State approval. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, receiving the Apple Valley Firefighters’ Relief Association certification of its 2002 financial requirements for the special fund tax levy in 2002, in the amount of $138,127.00. MOTION: of Grendahl, seconded by Sterling, receiving the 2000 audited City Financial Statements and Management Letter of Kern, DeWenter, Viere, Ltd., as attached to the Finance Director’s memo dated July 9, 2001. MOTION: of Grendahl, seconded by Sterling, authorizing sending a letter of support for Dakota County Community Development Agency’s issuance of housing revenue bonds to assist in financing for Pennock Place Senior Housing as described in the Community Development Director’s memo dated July 9, 2001. Ayes - 5 Nays - 0. MOTION: of Grendahl, seconded by Sterling, approving reduction of t he subdivision financial guarantee for Orchard Pointe, from $384,100.00 to $225,712.00; and for Cortland Square, from $1,625.00 to 0. MOTION: of Grendahl, seconded by Sterling, approving Change Order No. 3 to the contract with Brown & Cris, Inc., for Project 96-512, East Trunk Storm Sewer, in the amount of an additional $15,665.00. MOTION: of Grendahl, seconded by Sterling, approving Change Order No. 26 to the contract with Shaw Lundquist for the Municipal Center Construction Project in the amount of an additional $14,406.00. MOTION: of Grendahl, seconded by Sterling, approving Change Order No. 1 to the contract with Facilities 2000, Inc., for the Municipal Center Carpet Contract in the amount of an additional $1,680.00. MOTION: of Grendahl, seconded by Sterling, accepting Project 00-132, Central Sanitary Sewer Trunk, as final and authorizing final payment on the contract with Municipal Contracting Services in the amount of $24,723.76. CITY OF APPLE VALLEY Dakota County, Minnesota July 12, 2001 Page 3 MOTION: of Grendahl, seconded by Sterling, accepting Tennis Court Resurfacing at Pennock and Delaney Parks as final and authorizing final payment on the contract with Court Surfaces & Repair in the amount of $10,945.00. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, approving an agreement with Short Elliott Hendrickson, Inc., for Second Phase of the Sign Inventory Project, at an estimated cost of $8,300.00, as attached to the Public Works Director’s memo dated July 12, 2001, and authorizing the Mayor and Clerk to sign the same. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, approving Traffic Signal Agreement No. 01-08 with Dakota County for upgrading signals at the intersection of County Road 38 and Galaxie Avenue, as attached to the Public Works Director’s memo dated July 12, 2001, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, appointing Captain Craig A nglin as the Police Department’s representative on the Traffic Safety Advisory Committee in place of Captain Merle Lohse as recommended in the Police Chief’s memo dated July 9, 2001. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, approvi ng hiring Christopher Walswick for the full-time position of Police Officer as listed in the Personnel Report dated July 12, 2001. Ayes - 5 - Nays - 0. MOTION: of Grendahl, seconded by Sterling, approving hiring the part-time and seasonal employees as listed in the Personnel Report and Addendum dated July 12, 2001. Ayes - 5 - Nays - 0. END OF CONSENT AGENDA INTRODUCTION OF NEW POLICE OFFICER WALSWICK Police Captain Anglin introduced Christopher Walswick appointed as a new Officer in the Department. He has served as a Community Service Officer for the past year. The City Clerk administered the oath of office to Officer Walswick and Police Chief Johnson presented him with his badge. The Council welcomed him and congratulated him on moving into his new position. PROJECT 01-153, DIAMOND VALLEY ESTATES IMPROVEMENTS Mayor Hamann-Roland called the public hearing to order, at 8:12 p.m., to consider Project 01- 153, Diamond Valley Estates Addition Utility and Street Improvements, and noted receipt of the affidavit of publication of the hearing notice. Mr. Gordon reviewed the preliminary engineering report, dated June 26, 2001, describing the project located west of Diamond Path at the 138th CITY OF APPLE VALLEY Dakota County, Minnesota July 12, 2001 Page 4 Street alignment. The developer will install the lateral and street improvements, by private contract, with the City doing design and engineering. Assessments will be levied for previously installed trunk utilities. Mayor Hamann-Roland asked who will be responsible for maintaining the rain garden being installed on the property? Mr. Gordon said it is being installed in a natural low area on the northern part of the property and will help water soak into the ground. The storm sewer system is designed with capacity to handle all drainage. The intent is for property owners to maintain vegetation and remove weeds in the rain garden. At some point, the City will need access to remove any silting that might affect function. The Mayor asked for questions or comments from the Council and the audience. There were none and the hearing was declared closed at 8:16 p.m. Resolution No. 2001-121 MOTION: of Goodwin, seconded by Sterling, adopting ordering installation of Project 01-153, Diamond Valley Estates Addition Utility and Street Improvements. Ayes - 5 - Nays - 0. NIGHT-TIME UTILITY/STREET PROJECT WORK Mr. Heuer gave the first reading of an ordinance amending City Code Section 14-81(1) by allowing work on utility and street projects as exceptions to activities prohibited between 10:00 p.m. and 6:00 a.m. The exception would only apply to commercial, high traffic volume, areas; not residentially zoned areas. It would allow construction and maintenance during non-peak traffic hours and cause less interference with vehicular traffic. The Council accepted the first reading. The second reading will be scheduled for July 26, 2001. COMMUNICATIONS & CALENDAR The Council received a memo dated July 9, 2001, with a calendar listing upcoming events. Mr. Heuer reminded everyone that due to dry weather and extremely high water usage, lawn watering restrictions have been placed in effect. Watering is prohibited between 3:00 and 10:00 p.m. every day until further notice. The only exceptions are for newly laid sod and trees planted this year. Mayor Hamann-Roland thanked the Freedom Days Committee and everyone who worked on and participated in the 4th of July activities and parade. The Council agreed and noted the fireworks display was spectacular also. CLAIMS AND BILLS CITY OF APPLE VALLEY Dakota County, Minnesota July 12, 2001 Page 5 MOTION: of Erickson, seconded by Sterling, to pay the claims an d bills, check registers dated July 3, 2001, in the amount of $4,725,500.59; and July 11, 2001, in the amount of $613,335.60. Ayes - 5 - Nays - 0. MOTION: of Goodwin, seconded by Grendahl, to adjourn. Ayes - 5 - Nays - 0. The meeting was adjourned at 8:30 o’clock p.m.
