PLANNING COMMISSION MINUTES
SEPTEMBER 2, 2009
1. CALL TO ORDER
The City of Apple Valley Planning Commission meeting was called to order by Chair Churchill at
7x00 p.m.
Members Present: Jeannine Churchill, Tom Melander, David Schindler, Ken Alwin, Keith
Diekmann, and Tim Burke
Members Absent: None
Staff Present: Community Development Director Bruce Nordquist, Associate City Planner Kathy
Bodmer, City Attorney Sharon Hills, Assistant City Engineer David Bennett and Department
Assistant Barbara Wolff
2. APPROVAL OF AGENDA
Chair Churchill asked if there were any changes to the agenda.
Community Development Director Bruce Nordquist stated that the petitioner for agenda item 7A,
Farrell Setback Variance Sketch Plan, has withdrawn her application. This item was removed from
the agenda.
Hearing no additional. changes, Chair Churchill asked for a motion for the amended agenda.
MOTION: Commissioner Diekmann moved, seconded by Commissioner Schindler, to approve the
amended agenda. The motion carved 6-0.
3. APPROVAL OF MINUTES OF AUGUST 19, 2009
Chair Churchill asked if there were any changes to the minutes. There being none, she called for
approval of the minutes.
MOTION: Commissioner Melander moved, seconded by Commissioner Schindler, to recommend
approval of the minutes of the August 19, 2009, meeting. The motion carried 5-0. Chair Churchill
abstained.

A. South Metro Jazzercise C.U.P. -Consideration of a conditional use permit to
allow for a commercial recreational business in a "BP" (Business Park) zoning
district.
Associate City Planner Kathy Bodmer stated that the petitioners are requesting a conditional use
permit (CUP) to operate a commercial recreational business in a "BP" (Business Park) zoning district.
The business is proposed to be located in the Pilot Flex Center, located at 14791 Energy Way.
The petitioners operate South Metro Jazzercise, a commercial recreational business. Jazzercise
classes are currently held in the Apple Valley Community Center. The petitioners wish to lease space
in the Pilot Flex Center in order to create a Jazzercise "Center" which would allow them to conduct
additional classes throughout the week.
The 3,000 sq. ft. space is located on the north side of the Pilot Flex Center building. The floor plans
indicate that the dance floor would be 2,000 sq. ft., leaving the balance of the space for personal
training, changing areas,. a reception area and a very small boutique.
One area of concern for the operation of commercial recreational facilities in an industrial zoning
district is that commercial recreational facilities generate more parking demand than a typical
office/manufacturing/warehousevse.
Bodmer stated that the property meets the parking requirements laid out in the code. However, she
said she was concerned that the parking calculation might not reflect the actual number of parking
spaces that might be needed by the Jazzercise facility.
She said a second parking calculation was done using one parking space per student which resulted in
a shortfall of 25 spaces on the site.
Bodmer stated that the Pilot Flex Center has aproof-of-parking agreement with the City. The
agreement states that the City may require that the 44 proof-of-parking spaces be constructed if
additional parking is needed. So, parking can be accommodated on the site.
Bodmer asked for questions or comments from the Planning Commission.
Commissioner Diekmann stated that Bodmer made a comment that the site was short 25 parking
spaces based on the 1:1 ratio. He asked if they were short based on a 1:3 ratio.
Bodmer replied no, using the code requirement of one space per three occupants, the site has
sufficient parking.
Hearing no further questions or comments from the Commission, Chair Churchill asked for the
petitioner to come forward.
Linda and Tom Isaacs, owners of South Metro Jazzercise stepped forward to address the Commission.
Mrs. Isaacs stated that with the new location, they would increase from the current seven morning
classes to 18 morning classes. This will help avoid class concentration. The national average of a
Jazzercise class is 20 students.

Commissioner Diekmann asked if there were afternoon and evening classes.
Mrs. Isaacs stated that there are a total of 39 classes that are held seven days a week. The classes
include mornings, evenings and weekends.
Comrissioner Alwin asked about the passing times between classes.
Mrs. Isaacs replied that there are 15 minutes between class times. The parking spaces would cleaz out
between classes so there would not be an overlap.
Commissioner Alwin asked if there aze shower facilities.
Mrs. Isaacs said no.
Chair Churchill asked if Mr. Whalen wanted to make any comments.
Mike Whalen with E.F.H. Company is the landlord at the Pilot Flex Center facility. He stated that
they have approximately 600,000 sq. ft. of space in the south metro azea. It is mostly
office/warehouse product with a variety of tenants. E.F.H. doesn't have any parking issues on any of
their locations. The two tenants currently at the Pilot Flex Center facility average 20 vehicles per
tenant. The offices that are left are smaller offices with wazehouse bays. The tenants that would
occupy this space typically use 25% office and the balance is warehouse. The bays aze not conducive
to a high office space user. He stated that he doesn't anticipate a problem for parking with the cross
parking easements that aze available.
Hearing no questions from the Commission Chair Churchill asked for comments from the public.
Hearing no comments from the public Chair Churchill closed the public hearing.
6. LAND USE/ACTION ITEMS

OTHER BUSINESS
A. Farrell Setback Variance Sketch Plan -Consideration of a setback variance
from the minimum required side yard building setback of 10 feet to allow for a
covered deck and storage area to encroach six feet into the ten-foot side yard
setback area in the "R-3" (Single Family Residentiall11,000 sq. ft. min. lot area)
zoning district.
The petitioner withdrew her application on September 2, 2009.
B. Review of the Upcoming Schedule and. other Updates

Community Development Director Bruce Nordquist stated that there is a vacant seat on the
Planning Commission. The City Clerk is still accepting applications until September 11, 2009.
8. ADJOURNMENT
Hearing no further comments from the Planning Staff or Planning Commission, Chair Churchill
asked for a motion to adjourn.
MOTION: Commissioner Burke moved, seconded by Commissioner Diekmann, to adjourn the
meeting at 7:21 p:m. The motion carried 6-0.
