Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held December 27th, 2001, at 8:00 o’clock p.m., at Apple Valley Municipal Center.
PRESENT: Mayo r Hamann-Roland; Councilmembers Erickson, Goodwin, Grendahl, and
Sterling.
ABSENT: None.
City staff members present were: City Clerk Mueller, City Attorney Hills, City Engineer Gordon,
Finance Director Ballenger, Golf Course Manager Dodge, Assistant to the Administrator Grawe,
Public Works Director Heuer, Parks and Recreation Director Johnson, Police Chief Johnson,
Community Development Director Kelley, and Human Resources Manager Strauss.
Mayor Hamann-Roland called the meeting to order at 8:00 p.m. Everyone took part in the pledge
of allegiance to the flag.

MOTION: of Sterling, seconded by Goodwin, approving revised City Attorney’s fees for
2002 legal services as attached to the Assistant to the City Administrator’s memo

Resolution No. 2001-249
MOTION: of Sterling, seconded by Goodwin, adopting setting the
reimbursement rate for mileage, under the travel policy, at $.365 per mile effective
January 1, 2002. Ayes - 5 - Nays - 0.
MOTION: of Sterling, seconded by Goodwin, approving the 2002-2003 Labor Agreement
with AFSCME Maintenance Union Employees, as attached to the Human
Resources Manager’s memo dated December 20, 2001, and authorizing its

Resolution No. 2001-250
MOTION: of Sterling, seconded by Goodwin, adopting approving
and implementing the 2002 Employee Pay and Benefit Plan. Ayes - 5 - Nays - 0.

employees as listed in the Personnel Report dated December 27, 2001. Ayes - 5 -

2002 VALLEYWOOD GOLF COURSE FEES
Mr. Johnson reviewed his memo dated December 21, 2001, recommending a change in the fee
structure at Valleywood Golf Course for 2002. The goal of Parks and Recreation Advisory
Committee’s recommendation is to maximize revenue for weekend play. The most significant change
is modifying the season pass policy to limit usage to Monday through Thursday at half the 2001 cost.
The reduced cost would allow season pass holders to use the difference and pay for approximately 17
rounds of weekend golf. Notice of the change was mailed to the 134 season pass holders and several
have asked to discuss the policy.
Tom Neumann, 5648 Upper 136th Street Court, submitted a letter dated December 21, 2001, and
asked for reconsideration of the season pass policy. He commented on benefits to the course of

maintaining season pass holders’ support and participation in promoting the course. He estimated he
plays about 50 times on weekends during the summer and a season pass limited to weekdays is not a
reasonable alternative.
Councilmember Goodwin said he was aware of the concern and asked Staff to look at whether adding
season pass weekend use after 5:00 or 5:30 p.m. was feasible. Mr. Johnson said they reviewed the
request and believe that could be accommodated with the fee increased ten percent over the 2002
recommendation. Mr. Neumann said they would also like to have some type of early morning
weekend hours.
Mr. Dodge said play slows considerably after 4:00 p.m. on weekends and adding that time would not
be a problem. They are planning to open the course at 6:00 a.m. next season and the time before 8:00
a.m. is generally not very busy and could be included. He stressed that season pass holders who want
to play between 8:00 a.m. and 4:00 p.m. on Friday, Saturday and Sunday would have to pay fees.
Ginny Becker, 4891 West 142nd Street, said she has purchased season passes for a number of years
and makes an extra effort to take care of the course. She would like the time after 3:00 p.m. added
for weekends if possible.
MOTION: of Goodwin, seconded by Erickson, approving the 2002 fee schedule for
Valleywood Golf Course as attached to the Parks and Recreation Director’s memo
dated December 21, 2001; except setting the season pass rates at ten percent over
the recommendation and allowing use any time Monday through Thursday and
from 6:00 to 7:52 a.m. and after 4:00 p.m. on Friday, Saturday, and Sunday.
Councilmember Erickson noted improvements to the clubhouse are being discussed and
revenue will need to be maximized to do so. He said the Council will be looking for
support for the project from those who use the golf course.
Vote was taken on the motion. Ayes - 5 - Nays - 0.
2002-2003 ICE ARENA FEES
MOTION: of Goodwin, seconded by Sterling, approving setting the 2002-2003 ice arena
hourly rental rates at $155.00 for regular prime and $110.00 for non-prime time as
attached to the Parks and Recreation Director’s memo dated December 21, 2001.

ORDINANCE REGULATING FEES FOR MUNICIPAL PLANNING APPLICATIONS
Ms. Hills gave the first reading of a proposed ordinance providing for the City to prescribe fees to
defray costs incurred in reviewing, investigating, and administering zoning, subdivision, or
applications for other official control approvals. At its meeting of October 25, 2001, the Council

approved the form of a deposit agreement and the rates that will be used to establish the required
escrows. State law requires that imposition of such fees be by ordinance. For that reason, it is
recommended the Council waive a second reading and act on the ordinance.
MOTION: of Erickson, seconded by Grendahl, waiving a se cond reading and passing
Ordinance No. 705
amending the City Code by adding Section 1-25 providing for
collection of fees sufficient to defray the costs of reviewing, investigating, and
administering applications for amendment of an official control or for a permit or
other approval required under an official control. Ayes - 5 - Nays - 0.
ORDINANCE AMENDING CERTAIN CITY FEES
Ms. Mueller gave the first reading of a proposed ordinance amending certain fees as attached to
her memo dated December 21, 2001. The adjustments include cemetery fees, utility trunk rate
charges and sewer and water availability charges. Cemetery fee revisions were recommend by the
Cemetery Advisory Committee at its meeting of October 16, 2001, and reviewed at the Council’s
informal meeting on November 8, 2001. Utility trunk charges are imposed on undeveloped
property and will be used in engineering reports to determine development costs. Water supply
and storage and Metropolitan sewer availability charges are collected with building permits.
Because these fees have been discussed previously, it is recommended the Council waive a second
reading and act on the ordinance.
MOTION: of Sterling, seconded by Erickson, waiving a second reading and passing
Ordinance No. 706
amending City Code Section 1-23 by adjusting fees and
charges for lot sales and associated services in Lebanon Cemetery, adjusting per
acre rates for trunk utilities, setting the water supply and storage charge at
$560.00, and the Metropolitan sewer availability charge at $1,200.00 per unit.
Councilmember Goodwin said he would support increasing the differential between
resident and non-resident cemetery rates beyond the $150.00 recommended. He asked
that the Committee review the fees again during the year. He suggested the differential
could reach a point where non-resident rates are double that for residents.
Councilmember Grendahl concurred.
Vote was taken on the motion. Ayes - 5 - Nays - 0.
COMMUNICATIONS & CALENDAR
The Council received a memo dated December 21, 2001, with a calendar listing upcoming events.
Mayor Hamann-Roland congratulated Patty Mraz, a resident, for receiving a National Community
Service Award from the United States Tennis Association, for her work in recreational tennis
programs.

Councilmember Grendahl commented on property tax estimates provided by the City in August
that were incorrect and did not show the homestead credit for 2001. She expressed concern that
this information resulted in a distorted comparison with the proposed 2002 tax. She said, in the
future, the City should not get involved in presenting information on other jurisdictions’ tax
estimates. The Council discussed confusion in information presented earlier in the year on
proposed property taxes due to legislative tax reform enacted for 2002. They noted that the
amount of taxes Apple Valley homeowners pay was ranked 72 out of 109 cities listed in a report
by the Taxpayers League.
Mayor Hamann-Roland thanked City Staff for their work during the year and the Councilmembers
for their leadership.
CLAIMS AND BILLS
MOTION: of Erickson, seconded by Goodwin, to pay the claims and bills, check registers
dated December 19, 2001, in the amount of $6,296,466.21; and December 27,
2001, in the amount of $5,794,448.46. Ayes - 5 - Nays - 0.
MOTION: of Grendahl, seconded by Sterling, to adjourn. Ayes - 5 - Nays - 0.
