Minutes of the special meeting of the Economic Development Authority of Apple
Valley, Dakota County, Minnesota, held January 7th, 1992, at 8:00 o'clock p.m. at
Apple Valley City Hall.
PRESENT: President Holton; Commissioners Erickson, Goodwin, Humphrey and
Sterling.
ABSENT: None.
City staff members present were: City Administrator Melena, City Clerk Mueller,
City Attorney Hills, City Engineer Gordon, Finance Director Ballenger, Personnel
Director Boland, Police Captain Erickson, Public Works Director, Gretz, Associate
Planner Hickok, City Planner Kelley, Building Official Miranowski, Police Chief
Rivers, Assistant to Administrator Weldon and Community Development Director
Welsch.
President Holton called the meeting to order at 9:26 p.m.
MOTION: of Goodwin, seconded by Humphrey, adopting Resolution No. RES. EDA -92 -1

• ment Authority as: President - Holton, Vice President -
Humphrey, Secretary - Mueller, Treasurer - Sterling and
Assistant Treasurer - Mueller. Ayes - 5 - Nays - 0.
Mr. Melena distributed a copy of a quote from Falcon Fire Protection LIQUOR STORE
for installation of automatic sprinkler systems for the basement and SPRINKLER
first floor of the old Liquor Store building. This is one of the SYSTEM
requirements of the Purchase Agreement and indicates the work can be
done for $10,000 maximum. He reviewed the agreement returned by Mr. Neck with
some changes and said they are acceptable, but the City Attorney should revise
the documents and put all changes in one agreement.
MOTION: of Humphrey, seconded by Erickson, approving the Purchase LARRY NECK
Agreement and Addendum dated January 2, 1992, with Larry PURCHASE OF
Neck for the old Liquor Store Building, 14805 Granada, with LIQUOR BLDG.
an amendment to paragraph 8 of the Addendum allowing the
amount of $10,000.00 or actual cost, whichever is less, for
the sprinkler system and removing reference to a conditional
certificate of occupancy, subject to redraft and final
review by the City Attorney.
Ron Mielke, representing Mr. Neck, was present and said the language related to a
conditional certificate of occupancy was included so the water line can be done
when the frost goes out, but would still allow the business to open. Mr. Melena
said this is one of the police powers of the City and should not be limited by
contract. Mr. Gretz said the amount contained in the agreement is more than
• adequate to cover installation even with frost.

Vote was taken on the motion. Ayes - 5 - Nays - 0.
Mr. Melena advised Mr. Mielke that the agreement will be prepared by the end of
the week. He also asked Mr. Mielke to review the costs for sprinkler and water
line installation with him or Mr. Gretz.
MOTION: of Erickson, seconded by Humphrey, to adjourn. Ayes - 5 - Nays - 0.
The meeting was adjourned at 9 :40 o'clock p.m.
