HomeMy WebLinkAbout08/10/2000CITY OF APPLE VALLEY Dakota County, Minnesota August 10, 2000 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held August 10th, 2000, at 8:00 o’clock p.m., at Apple Valley City Hall. PRESENT: Councilmembers Erickson, Goodwin, Grendahl, and Sterling. ABSENT: Mayor Hamann-Roland. City staff members present were: City Administrator Lawell, City Clerk Mueller, City Attorney Hills, City Engineer Gordon, Police Captain Anglin, Finance Director Ballenger, Police Chief Erickson, Assistant to the City Administrator Grawe, Acting Public Works Director Heuer, Parks & Recreation Director Johnson, Community Development Director Kelley, Police Captain Lohse, City Planner Lovelace, Human Resources Manager Margarit, Administrative Assistant Pederson, and Engineer Wrase. Acting Mayor Erickson called the meeting to order at 8:00 p.m. Everyone in attendance took part in the pledge of allegiance to the flag. APPROVAL OF AGENDA MOTION: of Grendahl, seconded by Sterling, appr oving the agenda for tonight’s meeting as amended. Ayes - 4 - Nays - 0. AUDIENCE Acting Mayor Erickson asked if anyone was present to address the Council, at this time, on any item not on this meeting’s agenda. There was no one was present to speak. Resolution No. 2000-197 MOTION: of Grendahl, seconded by Goodwin, adopting approving the final plat and subdivision agreement for Superior Storage Addition and authorizing the Mayor and Clerk to sign the same. Resolution No. 2000-198 MOTION: of Grendahl, seconded by Goodwin, adopting receiving the preliminary engineering report for Project 00-140, Superior Storage Addition Trunk Utilities, and setting a public hearing on it, at 8:00 p.m., on September 14, 2000. Resolution No. 2000-199 MOTION: of Grendahl, seconded by Goodwin, adopting approving a temporary waiver of platting to allow transfer of title to property, on a metes and bounds description basis, prior to platting the site for Evermoor Addition/Talcott Glen Townhomes. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving reduction of the subdivision financial guarantee for Regatta 2nd Addition, from $422,425.00 to $195,119.00. Ayes - 4 - Nays - 0. Resolution No. 2000-204 MOTION: of Grendahl, seconded by Goodwin, adopting awarding the contract for Project 99-130, Deep Well No. 17, to Keys Well Drilling Company, the low bidder, in the amount of $246,800.00. MOTION: of Grendahl, seconded by Goodwin, approving Change Order No. 1 to the contract with Southridge Construction for Liquor Store No. 2/PDQ Store Exterior Renovations in the amount of an additional $15,426.00 for block and sidewalk related work. MOTION: of Grendahl, seconded by Goodwin, approving Change Order No. 6 to the contract with Shaw-Lundquist, Inc., for Municipal Center Construction in the amount of an additional $5,038.00 for generator and drywell modifications. MOTION: of Grendahl, seconded by Goodwin, approving an Agreement with CNH Architects, Inc., for commissioning Municipal Center mechanical and electrical systems, at a cost not to exceed $39,500.00, as attached to the Assistant to the City Administrator’s memo dated August 10, 2000, and authorizing the Mayor and Clerk to sign the same. Resolution No. 2000-205 MOTION: of Grendahl, seconded by Goodwin, adopting awarding the contract for Municipal Center AMAG 450 Building Access System and CCTV Addition to General Security Services Corporation, the low bidder, in the amount of $82,404.85 including option number 3. MOTION: of Grendahl, seconded by Go odwin, approving a Building Maintenance Service Agreement with RPI Maintenance, Inc. for janitorial services at Apple Valley Community Center, as attached to the Recreation Superintendent’s memo dated August 7, 2000, and authorizing the Mayor and Clerk to sign the same. MOTION: of Grendahl, seconded by Goodwin, approving transfer of Jon Getting and Richard Glewwe from Park Maintenance to the Streets Division as listed in the Personnel Report dated August 10, 2000. END OF CONSENT AGENDA INTRODUCTION OF NEW POLICE OFFICERS Police Chief Erickson and Police Captain Anglin introduced the four newest officers hired by the City; Mark Deming, Brenda Johnson, Barry Rogers, and Mark Shaw. The City Clerk administered oaths of office to the Police Officers and Council welcomed them to the City. FOLLOW-UP REPORT ON JULY 7-9, 2000, RAIN STORMS Mr. Heuer reviewed his memo dated August 10, 2000, summarizing damage to private and public property as a result of rainstorms over the weekend of July 7-9, 2000. The City has been contacted by 70 residents regarding storm damage. Of those, 62 indicated water from the storm entered their homes. After review of those situations, approximately 50 percent would not have had water entering their homes if they had drain tile systems and/or sump pumps. He also reviewed damage and repairs required to public property including some street repair and lift station pumps. Mr. Gordon reviewed his memo dated August 10, 2000, identifying seven areas where flooding was related to storm sewer issues. He described each of the areas along with proposed solutions for four of them. A meeting is proposed with residents of the Long Lake/Farquar Lake neighborhood to review problems in that area. It is scheduled for August 30, 2000, at 6:30 p.m., at City Hall. A report on recommendations for this area is not likely for several months. Acting Mayor Erickson asked if residents of homes where drain tile systems or sump pumps would have prevented damage have been advised of what improvements they can make? Mr. Heuer said that has not been done yet, but Public Works staff will be contacting them. Councilmember Goodwin compared the number of homes damaged to the total number of homes in the City and noted that most of the storm sewer system worked very well. He thanked staff for continuing to work on solutions to problem areas where improvements are needed. Councilmember Sterling asked if adding more drainage through Fischer Pond, as one of the solutions the Engineer identified, will cause future flooding problems there? Mr. Gordon said that pond’s capacity has been reviewed. The additional flow will not flood buildings. In times of very heavy rain there probably would be some street flooding, but it will drain quickly. CITY OF APPLE VALLEY Dakota County, Minnesota August 10, 2000 Page 5 MOTION: of Sterling, seconded by Grendahl, authorizing the e xpenditure of $30,500.00 for storm sewer system improvements involving Galaxie Park pond, Eveleth Path at County Road 38 pond, Everest Trail and County Road 38 pond, and Embry Path pond at 147th Street; as described in the City Engineer’s memo dated August 10, 2000. Ayes - 4 - Nays - 0. PROJECT 99-103, DAHLE PINES TOWNHOMES IMPROVEMENTS Acting Mayor Erickson called the public hearing to order, at 8:43 p.m., to consider Project 99- 103, Dahle Pines Townhomes Utility and Street Improvements, and noted receipt of the affidavit of publication of the hearing notice. Mr. Gordon reviewed the revised engineering report, dated August 3, 2000, describing the improvements. The subdivision consists of 35 townhouse units at the northwest corner of 132nd Street and Galaxie Avenue. The developer has requested that the City include all the street improvements in the project and the revised report reflects the additional cost. The Acting Mayor asked for questions or comments from the Council and the audience. There were none and the hearing was declared closed at 8:45 p.m. Resolution No. 2000-206 MOTION: of Goodwin, seconded by Grendahl, adopting ordering installation of Project 99-103, Dahle Pines Townhomes Utility and Street Improvements. Ayes - 4 - Nays - 0. Resolution No. 2000-207 MOTION: of Grendahl, seconded by Sterling, adopting approving plans and specifications for Project 99-103, Dahle Pines Townhomes Utility and Street Improvements, and authorizing advertising for receipt of bids, at 2:00 p.m. on September 7, 2000. Ayes - 4 - Nays - 0. ORCHARD POINTE REVISED BUILDING PLANS Mr. Lovelace reviewed the Planning Commission recommendation on revisions to the building permit previously authorized for Orchard Pointe Townhomes. The developer has proposed two- story, with basements, models for the units on the north side of 153rd Street. He reviewed the proposed plans and exterior elevations. Mark Sonstegard, of Ryland Homes, was present to explain the request. The subdivision has a total of 278 units and the revised plans are proposed for 88 units. Depending on the options selected, the cost of these homes will increase by $10,000 to $15,000. Resolution No. 2000-208 MOTION: of Goodwin, seconded by Grendahl, adopting approving the site plan and authorizing issuance of building permits for revised townhome plans on Lots 1 through 7, Block 1, and Outlot C, Orchard Pointe, with conditions as recommended by the Planning Commission. Ayes - 4 - Nays - 0. GENSTAR/SEED DEVELOPMENT AUAR CITY OF APPLE VALLEY Dakota County, Minnesota August 10, 2000 Page 6 Mr. Lovelace reviewed his memo dated August 7, 2000, submitting the final draft of the Alternative Urban Areawide Review (AUAR) and Mitigation Plan on the Genstar/Seed Trust Property Development for distribution. The 237-acre site is located between County Road 42 and 153rd Street, east of Flagstaff and extending east of future Johnny Cake Ridge Road. The AUAR process is similar to an Environmental Assessment Worksheet process, but provides an opportunity to review different development scenarios on a site. It allows evaluation of how much development can be accommodated on a site without significant environmental impacts and helps to anticipate and correct potential problems. The site is currently a gravel mining operation. Pam Maki, of Short Elliot Hendrickson, the traffic consultant; and Peter Gualtieri, of Astra Genstar Partnership, the developer; were present to answer questions. Additional traffic analysis was provided and mitigation measures identified for collector and arterial road systems. Mr. Gualtieri noted that traffic mitigation is involved no matter what type of development is proposed due to growth in Dakota County. Mr. Kelley commented on road improvements anticipated to be completed by 2007 that impact the report. He also noted that background traffic continues to grow in the County. Even if nothing else is built in the City, traffic will increase due to growth in surrounding areas. Resolution No. 2000-209 MOTION: of Grendahl, seconded by Goodwin, adopting accepting the final draft of the Alternative Urban Areawide Review and Mitigation Plan, dated August 10, 2000, for the “Seed Trust Property” proposed Astra Genstar development and authorizing its distribution in accordance with Minnesota Rules. Ayes - 4 - Nays - 0. GRANITE FALLS DISASTER RELIEF ASSISTANCE Mr. Pederson reviewed his memo dated August 7, 2000, describing a community effort to collect donations for the City of Granite Falls that sustained damage from a tornado on July 25, 2000. Lonnie Titus, who serves as Chaplain for the Minnesota House of Representatives and the Police Department, was present and reported on his visits to provide assistance to Granite Falls residents. Mr. Pederson said Apple Valley can participate by helping publicize the needs. Cash donations can be sent to Granite Falls Bank. Donated items will be collected at City Hall and the Teen Center through September 9, 2000. Volunteers interested in staffing the Teen Center site should contact Mr. Pederson. The details are itemized in a press release attached to his memo. Councilmember Goodwin noted that, at the request of Granite Falls, only new clothing and bedding items will be accepted. Councilmember Sterling asked whether food items are needed? Mr. Titus said, at this time their food pantry is full, but there will probably be an ongoing need for non-perishable food once residents are settled in temporary housing. CITY OF APPLE VALLEY Dakota County, Minnesota August 10, 2000 Page 7 COMMUNICATIONS & CALENDAR The Council received a memo dated August 7, 2000, with a calendar listing upcoming events. Councilmember Sterling thanked everyone who organized and participated in the “National Night Out” events last week. CLAIMS AND BILLS MOTION: of Goodwin, seconded by Sterling, to pay the claims and bills, check registers dated August 4, 2000, in the amount of $756,991.19; and August 10, 2000, in the amount of $5,701,921.92.
