HomeMy WebLinkAbout08/24/2000CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held August 24th, 2000, at 8:00 o’clock p.m., at Apple Valley City Hall. PRESENT: Mayor Hamann-Ro land; Councilmembers Erickson, Goodwin, Grendahl, and Sterling. ABSENT: None. City staff members present were: City Administrator Lawell, City Clerk Mueller, City Attorney Dougherty, City Engineer Gordon, Assistant Planner Bodmer, Police Chief Erickson, Assistant to the City Administrator Grawe, Acting Public Works Director Heuer, Community Development Director Kelley, Police Captain Lohse, City Planner Lovelace, Assistant Planner Milton, and Administrative Assistant Pederson. Mayor Hamann-Roland called the meeting to order at 8:00 p.m. Everyone in attendance took part in the pledge of allegiance to the flag. APPROVAL OF AGENDA MOTION: of Erickson, seconded by Sterling, approving the agenda for tonight’s meeting as presented. Ayes - 5 - Nays - 0. AUDIENCE Mayor Hamann-Roland asked if anyone was present to address the Council, at this time, on any item not on this meeting’s agenda. Gary Shade, 15989 Garden View Drive, commented traffic and safety concerns being considered by the Garden View Drive Ad Hoc Committee. He said it made him aware of the restrictions placed on local control by MnDOT and legislators are being contacted to pursue changes. He said this committee process has been working well and asked the Council to consider establishing a standing committee for traffic issues to address ongoing traffic and safety concerns throughout the City. The Council received his letter dated August 24, 2000, describing the request. CONSENT AGENDA MOTION: of Sterling, seconded by Grendahl, approving al l items on the consent agenda with no exceptions. CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 2 Resolution No. 2000-212 MOTION: of Sterling, seconded by Grendahl, adopting approving issuance of a lawful gambling exempt permit, by the State Gambling Control Board, to Apple Valley Sons of American Legion, Squadron 1776, for an event on October 14, 2000, at 14521 Granada Drive, and waiving any waiting period for the permit to become effective. Ayes - 5 - Nays - 0. MOTION: of Sterling, seconded by Grendahl, approving a renewal Agreement with the Chamber of Commerce establishing the Apple Valley Convention and Visitors Bureau, including an annual remittance of $35,000 from lodging tax proceeds, as attached to the Assistant to the City Administrator’s memo dated August 24, 2000, and authorizing the Mayor and Clerk to sign the same. MOTION: of Sterling, seconded by Grendahl, authorizing the expenditure of $5,740.78 from lodging tax proceeds, for a promotional brochure by the Convention and Visitors Bureau, as described in the Assistant to the City Administrator’s memo dated August 24, 2000. MOTION: of Sterling, seconded by Grendahl, approving Change Order No. 7 to the contract with Shaw-Lundquist, Inc., for Municipal Center Construction in the amount of an additional $4,458.00 for maintenance area and structural modifications. END OF CONSENT AGENDA 140TH & 137TH STREETS INTERSECTION PEDESTRIAN CROSSINGS CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 4 Mayor Hamann-Roland commented on the importance of public safety in the community and action taken by the Council, at an emergency meeting on August 21, 2000, to install temporary stop signs at the intersection of 140th and 137th Streets. She thanked the Council, Staff, Police Officers, Fire Department, ALF Ambulance, and residents for their concern and response to the accident on August 18, 2000 that caused the death of Spencer Ingvalson. She said safety along the entire corridor of 140th Street, between Garden View Drive and Pennock Avenue, needs to be addressed and a traffic study has been ordered. Mr. Lawell reviewed the actions taken by the Council this week; ordering temporary placement of stop signs and ordering a traffic and pedestrian study of 140th Street between Garden View Drive and Pennock Avenue. The goal is to find a solution to safely accommodate pedestrians and cyclists. Glen Van Wormer, of Short Elliott Hendrickson, will be conducting the study as described in his letter of August 23, 2000. Following collection of data, a recommendation is expected from him the last week in September or first week in October. While the study is proceeding, options to fund recommended improvements are being reviewed. Sources being pursued include Municipal State Aid, the School District, and Minnesota Department of Children, Families and Learning. Mr. Lawell commented on the need to emphasize public safety for pedestrians and vehicles. The last issue of the City newsletter lead with an article on back to school safety and reminded cars to stop for pedestrians in crosswalks. The City is also looking at grant money that may be available for public safety education. Two weeks ago four new Police Officers were hired with the intent that two of them would concentrate on traffic enforcement. Gordon Henrikson, 13758 Hanover Way, read a petition circulated through the neighborhood last weekend and noted 533 signatures were collected. The petition asked for action to ensure safety at 137th and 140th Streets. It listed six actions to be taken including on-demand pedestrian crossing semaphores. The petition included a sketch illustrating the request. He also requested lowering the speed limit on 140th Street. Denise Louis, 15754 Hayes Trail, expressed sympathy for the Ingvalson family and commented that her son was nearly hit by a car on the way home from school. She understands the limit on the City’s ability to control traffic and contacted Representative Gerlach’s and Senator Knutson’s offices about changes in legislation to allow local control. She asked Council to pursue this. John Hessburg, representing the Wildwood Park neighborhood, read a statement expressing concern about pedestrian safety and drivers ignoring pedestrian crosswalks. He asked that a pedestrian activated flashing light be placed at the crosswalk on 140th Street, the School improve its education of young drivers, and traffic enforcement be upgraded. He thanked the Council and Police for taking action this week and asked everyone to become aware of pedestrian safety. Pamela Becker, 13720 Guild Avenue, said her son is a high school student and she drives through the area frequently. County Road 42 has been under study for some time with alternative parallel CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 5 routes being considered. 140th Street is such a route and commuter traffic is using it to get to Cedar Avenue. Some type of traffic control needs to be installed and the 45 mile per hour speed limit is too high. There are two signals on 140th Street at Eastview High School and none at Apple Valley High School. The traffic study should take that into consideration. David Lindroth, 8150 West 137th Street. said he walks along 140th Street frequently and has called the City to report problems. He commented on dangerous incidents where a bus from another school stopped on 140th Street and let students cross the street to get to the athletic fields. Other people using the fields often stop on the street to unload equipment and children. He expressed appreciation for the recent increased Police patrol and said the area of Greenleaf School on Galaxie Avenue is another potential problem area. John Raiche, 14638 Embry Path, spoke as President of the Optimist Club, and said they discussed what they could do to make streets safer at their meeting. They ask everyone in the community to be more responsible. They appreciate what the City is doing and are willing to help in any way that they can. Jamie Dop, 14080 Friday Lane, commented on seeing a child hit by a car last year at that intersection. As part of a school project, she wrote a letter to the City asking for a stop sign and did not receive a reply. Gordon Awsumb, 13690 Harmony Way, said he delivered a copy of the petition August 21, 2000, along with copies of letters he has written and received from the City over the years concerning the intersection. He talked with MnDOT about the stop sign and got a “no” answer. Something must have been missed along the line that could have been done. He asked the City to continue to pursue a solution and find alternatives. John Super, 7970 Gurney Court, said his son is the child who Ms. Dop saw hit at the intersection. Police Officer Soderholm investigated the accident and received a letter from the City Attorney stating nothing could be done because the bicyclist is treated like a vehicle. He read an excerpt from the report. Neighbors have told him they see this happen all the time and something needs to be done. There are now many more SUVs and vans on the streets which are taller and obstruct the vision of other drivers. Larry Haugesag, 8104 West 137th Street, said he has seen several accidents at the intersection. He noticed that the pedestrian crossing signs are installed in such a manner that pedestrians cannot be seen while standing at the side of the street. He has called the City about this over the years but no one listened. The new pedestrian crossing signs on Garden View Drive have been installed the same way. Lyle Bible, 8324 - 140th Street Court, said his daughter was hit, in September of 1989, while crossing the street on a bicycle and was injured. He thought the situation was unacceptable then CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 6 for a major traffic route to the high school. The neighborhood will not accept a solution that does not cure this problem. Pat Olson, 13595 Havelock Trail, asked that the study take into consideration pedestrians crossing during the summer sports season. Many parents will not allow their children to walk to school because it is too dangerous. She expressed concern that the study will count only cars. Jim Scavio, 8328 - 140th Street Court, said regardless of any signs installed, something needs to be done about the speed limit. He makes his children stand back from the curb while waiting for the bus because of traffic speeding around the curve on 140th Street. Dave Fudally, 8102 West 137th Street, said he has lived there since 1983 and seen and reported many accidents. He tried to get a parking lot on school property so people do not have to park in front of his house and cross the street. Athletic associations have been contacted to ask participants to park in the lot for safety reasons. He has contacted the City and School District and there has been no action. He has often helped people cross the street, but the situation has gotten worse with new crossing signs. People are not using common sense in crossing the street and watching for traffic. Larry Graham, 8312 - 140th Street Court, said no matter how many signs are installed, people still want to park close to the ball field. He suggested the ball field be moved closer to the school parking lot and asked citizens to help pay for the cost. Doug Cornelius, 13720 Hannibal Circle, said most parents in the neighborhood no longer allow their children to cross at that intersection. He and his son were nearly hit a month ago when the first car stopped and a second car did not stop until it was into the crosswalk. He expressed concern that the traffic study will not account for pedestrians in the neighborhood who are not present during that time. Stephanie Carlson, 8170 - 137th Court, asked what the Council’s answer will be if the study shows the numbers are too low for some type of control? Mayor Hamann-Roland said the whole 140th Street corridor is being reviewed and the best possible solution will be found. Ulysses Awsumb, 13690 Harmony Way, said he has seen numerous accidents at that intersection. The Council should do something instead of a study and take some action. Cindy, daughter of Nancy Tschohl, 8130 West 137th Street, said two days after the accident another bicyclist was nearly hit. Every time a solution has been suggested the City has not acted. The Council needs to act now. Neena Ingvalson, 13717 Parkwood Lane, said her son was killed and she will not thank anyone until the intersection is signalized. She will not agree to a push button signal, only a full semaphore. The is thankful for the increased Police presence, but went there today and the officer CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 7 sitting in the car was doing a puzzle and did not even see her. The Police need to address speeding and intersection violations. Pathways were built for pedestrians and cyclists, but they were not given a way to cross the street. This is a problem everywhere, not just here and everyone needs to be educated. The study should be started now and does not have to wait until the middle of September. The City has funding to install a signal and has more capability that it will admit; as an example, the Council held a meeting Monday and installed temporary signs. Bradley Hoyt, of Continental Property Group, spoke as a friend of Ms. Ingvalson and read a statement. He commented on his background in real estate development and said developers are generally responsible for improvements to serve their projects. The school is not held to the same standards in providing access. Crosswalks do not work, and give a false impression of safety, nor does a push button flashing light. The only solution is a full signal. A traffic study will only count cars and not show a high enough count for MnDOT to participate in a signal. The Council can act to install a signal without MnDOT financial participation. He asked the Council to make a motion and vote on it. He presented a check for $10,000 toward the signal and asked that it be named Spencer’s Crossing. John Carlson, 8170 - 137th Court, said over 500 people are asking the City to put in a light and want this problem resolved. They want it resolved now before school starts. Mayor Hamann-Roland said different options and solutions have been presented. The petition asked for a flashing light, now a full signal is requested. These and other options presented need to be considered. She has already asked the Association of Metropolitan Municipalities (AMM) to support a legislative policy for more local control of speed limits and establishment of an appeal process to allow consideration of unique situations in determining traffic controls. A traffic safety advisory committee is being proposed because the issue is important and residents throughout the City are concerned about it. Councilmember Erickson said one possibility of the study is that this may not be the location for a crossing. Citizens express concern about traffic every day, throughout the City, and the Council should proceed with establishing a committee. Councilmember Goodwin said he has seen athletic fields, at schools in other cities, entirely fenced with access at only one point. Another consideration is whether there should even be a crossing on 140th Street at 137th Street. Different options have been presented and the Council has to look at every possibility and solution. There is not an easy answer because whatever is done will anger someone else. Kevin Gagliardi, 13678 Harmony Way, said the intersection has always been a problem for traffic entering and leaving 137th Street. He asked the Council to approve a signal. CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 8 Ms. Ingvalson said Mr. Hoyt asked the Council to put the installation of a signal up for a vote. The study can proceed. Even if action is taken now, the signal will not be installed before the study is complete. MOTION: of Erickson, seconded by Sterling, accepting the neighbor hood petition dated August 21, 2000, containing approximately 533 signature, requesting pedestrian crossing improvements at the intersection of 140th and 137th Streets. Ayes - 5 - Nays - 0. Councilmember Goodwin said if any type of signal is installed, some type of median would also be needed. He commented on frustrations of cities in dealing with authority over speed limits and traffic control and endorsed working through the AMM to make some changes. Councilmember Grendahl said the Council is looking at long term and short term solutions to traffic problems. She has called Senator Knutson and asked for his support of, at a minimum, establishing an appeals board that cities can go to on MnDOT decisions. The Garden View Drive Ad Hoc Advisory Committee has been meeting since June and are coming up with some good solutions that will be presented shortly. Gary Shade, 15989 Garden View Drive, commented on the Committee’s work and noted that when a solution in one area was explored, it affected another area. He previously offered to donate $15,000 for an improvement in his neighborhood. The Council should not do something at one intersection that may be detrimental to other crossings. The Council needs time to look at solutions before acting. Councilmember Grendahl asked if it is correct that there will not be insurance coverage for actions taken that do not meet MnDOT’s criteria? Mr. Dougherty said that a defense would be provided, but whether a claim would be paid is different. If speed limits are set lower than warranted, they cannot be enforced. The reason for signage criteria is to maintain uniformity. If a city installs signs which deviate from the criteria, it might expose a city to greater liability. Police Chief Erickson reviewed accident statistics from 1985 to date. The records show six bicycle/pedestrian accidents with vehicles, he also noted others may not have been reported. In 2000 there were three reported accidents and in 1999 there were three. A resident on 140th Street Court noted this cul de sac is one area that does not have a sidewalk or pathway connection to any other street. He asked the study to include this information. Mayor Hamann-Roland said different options have been presented for the Council to consider. No matter what is done, everyone has to take responsibility to pay attention to traffic, drivers, pedestrians, and cyclists. The Council concurred and noted the study will proceed quickly and there will be action. CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 9 MOTION: of Sterling, seconded by Grendahl, supporti ng a policy statement by the Association of Metropolitan Municipalities to pursue legislation granting additional local control for setting speed limits and traffic control to cities and establishing a State Appeals Board to review unique conditions in cities where warrant criteria may not be met. Ayes - 5 - Nays - 0. MOTION: of Erickson, seconded by Goodwin, directing Staff to prepare guidelines and information on establishing a standing advisory committee on traffic safety issues in the City with criteria for providing best practices background information and education for those who will serve on it. Ayes - 5 - Nays - 0. ADDITIONAL STORM SEWER IMPROVEMENTS Mr. Gordon reviewed his memo dated August 21, 2000, identifying improvements for two additional areas where flooding on July 7-9, 2000, was related to storm sewer issues. He described the areas along with proposed solutions. The recommendation includes a berm at Delaney pond, on 144th Street, and an intercept pipe at the pond on 133rd Street Court. MOTION: of Grendahl, seconded by Goodwin, authorizing the expenditure of $33,000.00 for storm sewer system improvements involving Delaney pond and the pond at 133rd Street Court; as described in the City Engineer’s memo dated August 21, 2000. Ayes - 5 - Nays - 0. SPECIAL ASSESSMENT ROLL NO. 485 Mayor Hamann-Roland called the public hearing to order, at 10:50 p.m., to consider 2000 Special Assessment Roll No. 485, Water Connection at 84 County Road 42, and noted receipt of the affidavit of publication of the hearing notice. The property owner, as described in the City Clerk’s memo dated August 21, 2000; petitioned for assessment of the cost of the water connection, in the amount of $5,022.00. The Mayor asked for questions or comments from the Council and the audience. There were none and the hearing was declared closed at 10:51 p.m. Resolution No. 2000-215 MOTION: of Erickson, seconded by Grendahl, adopting levying 2000 Special Assessment Roll No. 485, Paulseth Residence Water Connection, in the amount of $5,022.00. Ayes - 5 - Nays - 0. EVERMOOR ADDITION PLANNED DEVELOPMENT Mr. Lovelace reviewed his memo, dated August 21, 2000, describing the planned development zoning and agreement for Evermoor Addition located east of Diamond Path between 130th and 135th Streets. The planned development will allow for townhouse and open space uses. CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 10 Ordinance No. 681 MOTION: of Grendahl, seconded by Goodwin, passing adding Article A26 to Appendix A of the City Code establishing Planned Development Designation No. 681 zoning district for Evermoor Apple Valley, as recommended by the Planning Commission; approving the Agreement, as attached to the City Planner’s memo dated August 21, 2000; and authorizing the Mayor and Clerk to sign the same. Ayes - 5 - Nays - 0. Resolution No. 2000-216 MOTION: of Sterling, seconded by Erickson, adopting approving the final plat and subdivision agreement for Evermoor Apple Valley and authorizing the Mayor and Clerk to sign the same. Ayes - 5 - Nays - 0. STERLING STATE BANK Ms. Bodmer reviewed the Planning Commission recommendation on a building permit for Sterling State Bank in Prairie Crossing Commercial. A sidewalk will be added along the south property line to provide a pedestrian link to the west. She reviewed the exterior elevations of the proposed building. The report incorrectly requested a variance for two additional signs. The signs shown on the site plan were directional signs and no variance is needed. Rob Middlestad, President of Sterling State Bank of Lakeville, was present to answer questions. Resolution No. 2000-217 MOTION: of Goodwin, seconded by Sterling, adopting approving the site plan and authorizing issuance of a building permit for Sterling State Bank on Lot 1, Block 2, Prairie Crossing Commercial, with conditions as recommended by the Planning Commission. Ayes - 5 - Nays - 0. BAKKEN SUBDIVISION & DENTAL CLINIC Ms. Milton reviewed the Planning Commission recommendation on a building permit for Bakken Dental Clinic and a minor subdivision west of Pennock Avenue and north of 147th Street. A height variance to allow a 29-foot high building in the planned development is also requested. Michael Bakken was present to answer questions. Resolution No. 2000-218 MOTION: of Erickson, seconded by Grendahl, adopting approving the final plat and waiving the requirement for a subdivision agreement for Bakken First Addition (replat of part of Outlot B, Carrollton Estates 3rd Addition), as recommended by the Planning Commission. Ayes - 5 - Nays - 0. Resolution No. 2000-219 MOTION: of Sterli ng, seconded by Grendahl, adopting approving the site plan and authorizing issuance of a building permit for Bakken Dental Clinic on Lot 1, Block 1, Bakken First Addition, and granting a variance to allow the building to be constructed to a height of 29 feet, as recommended by the Planning Commission. Ayes - 5 - Nays - 0. CITY OF APPLE VALLEY Dakota County, Minnesota August 24, 2000 Page 11 HOLIDAY CAR WASH CONDITIONAL USE PERMIT Ms. Bodmer reviewed the Planning Commission recommendation on a car wash addition proposed for the Holiday Truck Express at the northeast corner of County Road 42 and Johnny Cake Ridge Road. She distributed a copy of a letter from Glen Van Wormer, the City’s traffic consultant, commenting on the site layout and recommending directional signage for vehicles exiting the site. The car was is being constructed as an addition to an existing building. Resolution No. 2000-220 MOTION: of Goodwin, seconded by Erickson, adopting approving a Conditional Use Permit for a car was for Holiday Stationstores on Lot 1, Block 1, Holiday Johnny Cake Additions, with conditions as recommended by the Planning Commission and the Traffic Consultant. Ayes - 5 - Nays - 0. SET INFORMAL MEETING MOTION: of Sterling, seconded by Grendahl, setting an informal meeting, at 7:00 p.m., on August 31, 2000, for review of the 2001 City Budget. Ayes - 5 - Nays - 0. SCHOOL ZONE SPEED LIMIT ON WHITNEY DRIVE Mr. Lawell reviewed the recommendation, forwarded from the Garden View Drive Ad Hoc Committee’s August 21, 2000, meeting; to establish a school speed zone on Whitney Drive. Copies of the Public Works Director’s memo describing the recommendation were distributed. GRANITE FALLS DISASTER RELIEF ASSISTANCE Chaplain Lonnie Titus was present and gave an update on the community effort to collect donations for the City of Granite Falls that sustained damage from a tornado on July 25, 2000. A banner has been made to inform citizens about the drop off center for donations at the Teen Center. Donations will be delivered the week of September 10th. Volunteers interested in staffing the Teen Center site should contact Andy Pederson at City Hall.
