HomeMy WebLinkAbout11/13/2000CITY OF APPLE VALLEY Dakota County, Minnesota November 13, 2000 Minutes of the special meeting of the City Council of Apple Valley, Dakota County, Minnesota, held November 13th, 2000, at 4:30 o’clock p.m., at Apple Valley City Hall. PRESENT: Mayor Haman n-Roland; Councilmembers Erickson, Goodwin, and Grendahl. ABSENT: Councilmember Sterling. City staff members present were : City Administrator Lawell, City Clerk Mueller, City Attorney Dougherty, City Engineer Gordon, Finance Director Ballenger, Assistant to the City Administrator Grawe, Public Works Director Heuer, Community Development Director Kelley, Police Captain Lohse, Human Resources Manager Margarit, Administrative Assistant Pederson, and Fire Chief Wassmund. Mayor Hamann-Roland called the meeting to order at 4:30 p.m. Everyone in attendance took part in the pledge of allegiance to the flag. APPROVAL OF AGENDA MOTION: of Erickson, seconded by Grendahl, approving the agenda for today’s meeting as amended. Ayes - 4 - Nays - 0. CONSENT AGENDA MOTION: of Grendahl, seconded by Goodwin, adding a letter commenting on the Metropolitan Airport Commission’s noise mitigation update to the consent agenda and approving all items on the consent agenda. Ayes - 4 - Nays - 0. CONSENT AGENDA ITEMS MOTION: of Grendahl, seconded by Goodwin, approving the minutes of the regular meeting of October 26th, 2000, as written. Ayes - 4 - Nays - 0. Resolution No. 2000-279 MOTION: of Grendahl, seconded by Goodwin, adopting requesting a market value reassessment of homestead property damaged in storms on July 7th, 8th, and 9th, 2000, for the purposes of special tax credit as allowed by state law. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving participation in the Juvenile Accountability Incentive Block Grant (JAIBG) partnership with Dakota County for 2000 as attached to the Police Chief’s memo dated November 1, 2000, and authorizing execution of the necessary documents. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, appointi ng Kern, DeWenter, Viere, Ltd., as auditors for the year 2000, at a cost of $27,000.00, and authorizing execution of CITY OF APPLE VALLEY Dakota County, Minnesota November 13, 2000 Page 2 the letter of understanding as attached to the Finance Director’s memo dated November 3, 2000. MOTION: of Grendahl, seconded by Goodwin, approving the Black Dog Watershed Management Organization 2001 budget, with Apple Valley’s contribution at $7,340.20, as attached to the Natural Resources Coordinator’s memo dated November 8, 2000. Ayes - 4 - Nays - 0. MOTION: of Gre ndahl, seconded by Goodwin, approving reduction of the subdivision financial guarantee for Palomino Cliffs 2nd Addition, from $78,500.00 to $44,831.00. Ayes - 4 - Nays - 0. Resolution No. 2000-280 MOTION: of Grendahl, seconded by Goodwin, adopting approving distribution of the Alternative Urban Areawide Review (AUAR), dated November 8, 2000, for the proposed Cobblestone Lake Development and publication of the notice of its availability by the Minnesota Environmental Quality Board as required. Ayes - 4 - Nays - 0. Resolution No. 2000-281 MOTION: of Grendahl, seconded by Goodwin, adopting receiving the preliminary engineering report for Project 00-134, Hidden Ponds Apartments Utility Improvements, and setting a public hearing on it, at 8:00 p.m., on December 14, 2000. Ayes - 4 - Nays - 0. Resolution No. 2000-282 MOTION: of Grendahl, seconded by Goodwin, adopting directing the City Engineer to prepare plans and specifications for Project 00-134, Hidden Ponds Apartments Utility Improvements. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving Change Order No. 10 to the contract with Shaw Lundquist for the Municipal Center Construction Project in the amount of an additional $1,766.00. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving Change Order No. 4 to the contract with Southridge Construction for Liquor Store No. 2/PDQ Store Exterior Renovation in the amount of an additional $1,351.00. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, accepting the resignation of David Quarberg from the Cemetery Advisory Committee and soliciting applications for the two vacant positions on the Committee as described in the Administrative Assistant’s memo dated November 13, 2000. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving the Consultant Agreement with Brimeyer Group, Inc., for Police Chief executive search services, as attached to the CITY OF APPLE VALLEY Dakota County, Minnesota November 13, 2000 Page 3 Human Resources Manager’s memo dated November 13, 2000, and authorizing execution of the necessary documents. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving hiring James Gummert for the full- time position of Police Officer, as listed in the Personnel Report dated November 13, 2000. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving hiring the part-time and seasonal employees, as listed in the Personnel Report and Addendum dated November 13, 2000. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving hiring Rene Paulsen for the full- time position of Assistant Manager at Liquor Store No. 2, as listed in the Personnel Report Addendum dated November 13, 2000. Ayes - 4 - Nays - 0. MOTION: of Grendahl, seconded by Goodwin, approving submitting a letter to the Metropolitan Airports Commission commenting on the Airport Part 150 Update, related to mitigation of adverse noise impacts as a result of the new north/south Runway 17/35 construction, and particularly stating concerns about the concentration of arrival and departure aircraft over the Cedar Avenue corridor. Ayes - 4 - Nays - 0. END OF CONSENT AGENDA CANVASS OF ELECTION RETURNS Ms. Mueller reviewed returns of the November 7th, 2000, General Election. City-wide there were 1,621 absentee ballots and 23,164 voters at the polls for a total of 24,785 voters. There were 4,040 election day registrations making the total of registered voters 31,472. The result was a total voter turnout of 78.75 percent. Resolution No. 2000-283 MOTION: of Erickson, seconded by Hamann-Roland, adopting canvassing the returns of the November 7, 2000, City General Election and declaring that Thomas Goodwin and Ruth Grendahl were elected Councilmembers for four-year terms commencing January 2, 2001. Ayes - 4 - Nays - 0. COMMUNICATIONS & CALENDAR The Council received a memo dated November 9, 2000, with a calendar listing upcoming events. Mayor Hamann-Roland noted the Fire Department received a letter from the City of Burnsville thanking them for their mutual aid response to an apartment fire on October 24, 2000. The Council commended the Department for its work. CITY OF APPLE VALLEY Dakota County, Minnesota November 13, 2000 Page 4 CLAIMS AND BILLS MOTION: of Goodwin, seconded by Erickson, to pay the claims and bills, check registers dated November 1, 2000, in the amount of $2,448,196.57; and November 8, 2000, in the amount of $4,017,738.30. Ayes - 4 - Nays - 0. MOTION: of Goodwin, seconded by Grendahl, to adjourn. Ayes - 4 - Nays - 0. The meeting was adjourned at 4:37 o’clock p.m.
