Christ Church Communications Tower — Consider a request for a conditional use permit amendment to allow for an 87 -foot tall cell tower. (PC16-40-C) LOCATION: Christ Church, 12925 Johnny Cake Ridge Road PETITIONER: Verizon Wireless and Christ Church Planner/Economic Development Specialist Alex Sharpe stated Verizon Wireless has applied to amend the Conditional Use Permit (CUP) at 12925 Johnny Cake Ridge Road (Christ Church) for an 87tall Wireless Communication Tower (cell tower). In 2010 Clearwire wireless applied for, and was approved for a 90' tower on the eastern portion of the lot. Staff is recommending that the City amend the prior approval, rather than rescind the CUP. Conditions from the prior resolution that apply have been brought forward. The property is zoned "P" Institutional, which conditionally permits cell towers. Conditional uses are permitted within a zone, with standard and site specific conditions. By state law these conditions must be reasonable to the site to mitigate any adverse impacts. If the applicant is able to address these conditions the use is permitted within the zone. Garrett Lysiak, P.E. of Owl Engineering, provide additional information. MOTION: Commissioner Burke moved, seconded by Commissioner Diekmann, recommending approval of a conditional use permit (CUP) amendment for an eighty-seven foot (87') tall wireless communication tower at Christ Church at 12925 Johnny Cake Ridge Road, subject to compliance with all City Codes and the following conditions: 1. The Conditional Use Permit shall apply to property located at 12925 Johnny Cake Ridge Road, legally described at Lot 1, Block 1, CHRIST CHURCH. 2. All conditions and findings approved in Resolution No. 2010-131 shall hereby be amended; the following conditions shall direct apply for the conditional use. 3. The wireless communication tower shall be constructed in accordance with the site plan (sheet A-1), and the elevation plant (sheet T-1) and Landscape plan (sheet A-1.2) dated October 11, 2016. 4. The antennas shall be flush mounted to the communication tower in accordance with the elevation plan (sheet T-1) dated October 11, 2016. 5. A building permit shall be obtained from the Building Inspections Department prior to any construction on the site. 6. The telecommunication service applicant shall provide verification of written final authorization/agreement with the landowner for the placement of the communication tower on the property prior to issuance of a building permit. A nursery bid list shall be submitted that confirms that the value of landscape plantings meets or exceeds 2.5% of the value of the construction of the communications tower per city ordinance. 8. The landscape plan dated October 11, 2016 (sheet A-1.2) shall be revised to replace the 8' Colorado Blue Spruce with 8' Black Hills Spruce. 9. Tower construction, maintenance, and operation shall comply with the communications tower requirements set forth in the City code, Section 155.3 85. 10. The cedar fencing and equipment platform shall be maintained to prevent visual deterioration. 11. Construction plans which are certified by a qualified and licensed professional engineer to be in conformance with: the latest structural standards: acceptable engineering methods and practices and the National Electrical code; designed in all aspects to accommodate both the operator's antenna and on additional user shall be provided prior to the issuance of a building permit. 12. The conditional use permit may be revoked upon any violation of City Code, the conditions set forth in this permit, or any applicable federal or state law or regulation. Ayes - 4 - Nays - 0. B. Mount Olivet Church Communications Tower — Consider a request for a conditional use permit amendment to construct an 84 -foot cell tower. (PC16-39-C) LOCATION: Mount Olivet Church, 14201 Cedar Avenue PETITIONER: Verizon Wireless and Mount Olivet Church Planner Kathy Bodmer reviewed the request of Verizon Wireless and Mount Olivet Assembly of God Church for consideration of a conditional use permit to construct an 84' tall wireless communications monopole west of the youth building at 14201 Cedar Avenue. The monopole is requested in order to improve network capacity and improve coverage along Cedar Avenue. The construction of the monopole will include construction of an equipment platform and a generator. The monopole and equipment will be located within a 21.5' x 25' area with an 8' tall cedar fence around the perimeter. The property is zoned "P" (Institutional) which allows a wireless communications cell tower by conditional use permit, subject to a number of performance standards. In order to obtain a conditional use permit, the petitioner must demonstrate that all of the performance standards of the zoning code are met. The City may place reasonable conditions on a conditional use to mitigate any adverse impacts associated with the use. MOTION: Commissioner Burke moved, seconded by Commissioner Diekmann, recommending approval of a conditional use permit (CUP) to construct an eighty-four foot (84') wireless communications monopole at 14201 Cedar Avenue subject to compliance with all City Codes and the following conditions: CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 4, 2017 Page 4 of 8 1. The monopole shall be constructed in accordance with the Site Plan (Sheet A- 1) dated October 24, 2016 and the Enlarged Site Plan (Sheet A-2) dated October 24, 2016. 2. The antennas shall be flush -mounted to the monopole in accordance with the South Elevation Plan (Sheet T-1) dated October 24, 2016. 3. A building permit and electrical permit shall be obtained from the Building Inspections Department prior to any construction on the site. 4. The telecommunication service applicant shall provide verification of written final authorizationlagreement with the landowner for the placement of the tower on the property prior to issuance of the building permit. 5. A nursery bid list shall be submitted that confirms that the value of the landscape plantings meets or exceeds 2 1/2% of the value of the construction of the monopole and antennas. 6. The site shall be constructed consistent with Landscape Plan (Sheet A-4) dated November 17, 2016, subject to replacing the 8' Colorado Blue Spruce with 8' Black Hills Spruce. The landscape plan is further subject to final review and approval by the Natural Resources Coordinator prior to issuance of the building permit. 7. Tower construction, maintenance, and operation shall comply with the communications tower requirements set forth in the City code, Section 155.385. 8. A qualified and licensed professional engineer shall submit certified construction plans which are in conformance with the following: the latest structural standards; acceptable engineering methods and practices and the National Electrical code. 9. A qualified and licensed professional engineer shall certify that the cell tower is designed in all aspects to accommodate both the operator's antenna and one additional user. 10. The co -location certification letter shall be revised to state the following: "... and there is no disruption to the service provided, except disruption as may be necessary for normal maintenance and employee safety." 11. The eight foot (8') cedar fence securing and screening the equipment platform shall be maintained in accordance with the requirements of § 155.351(C). Ayes - 4 - Nays - 0. C. 7525 147th Street Building — Consider a conditional use permit to allow for a drive-thru window in conjunction of with a proposed coffee shop and site plan/building permit authorization to allow for a 4,567 sq. ft. building. City Planner Tom Lovelace stated the applicant is requesting approval of two conditional use permits, site plan/building permit authorization and several building and parking setback variances to allow for construction of a 4,567 -sq. ft. building that will have a Class II restaurant and a Class III restaurant/coffee shop with a drive-through window. The site is located at 7525 147th Street West, the current location of a vacant motor fuel station/convenience store operation. There are currently four access driveways from public streets to the site, two each off Glenda Avenue and 147th Street West. The original plans showed the removal of the most -easterly driveway along 147th Street West and the southern driveway off Glenda Avenue. The City retained a traffic consultant to review the proposed plans and they have recommended that the remaining 147th Street West access be closed and a south driveway along Glenda Avenue be relocated a minimum of 60 feet north of 147th Street West. The applicant will be required to blend the curb, sidewalk, and install applicable streetscape amenities at the closed driveways. Discussion followed. Cobblestone Lake Medical Center — Consider the subdivision of an existing 1.97 -acre lot into two lots and site plan review/building permit authorization to allow for construction of a 10,000 -sq. ft. medical office building on a 1.45 -acre lot. (PC16-42-SB) LOCATION: 15875 Emperor Avenue PETITIONER: Stanley Lynn, LLC CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes January 4, 2017 Page 7 of 8 City Planner Tom Lovelace stated the applicant is proposing to subdivide an existing lot into two for the purpose of constructing a 10,236 -sq. ft. office building on the 1.45 -acre lot. Access to the two lots will be via Emperor Avenue, a private street located in easements, of which 35 feet of the easement area is located along the east property line of the two proposed lots. This easement provides direct access to 157th Street West and indirect access to Cobblestone Lake Parkway, two public streets. He reviewed the infiltration system, site plan, parking requirements, sidewalk connections and landscaping plan. Discussion followed. MOTION: Commissioner Diekmann moved, seconded by Commissioner Burke, recommending approval of the Cobblestone Lake Commercial 7th Addition preliminary plat. Ayes - 4 - Nays - O. MOTION: Commissioner Diekmann moved, seconded by Commissioner Burke, recommending approval of the site plan/building permit authorization approval to allow for construction of a 10,236 -sq. ft. single -story office building and 68 surface parking spaces on Lot 1, Block 1, Cobblestone Lake Commercial 7th Addition; subject to the following conditions: a. Approval and issuance of a building permit shall be subject to the recording of the Cobblestone Lake Commercial 7th Addition final plat. b. Construction shall occur in conformance with the site plan dated November 4, 2016; subject to the installation of a crosswalk and pedestrian ramps across Emperor Avenue, at the end of the proposed sidewalk along the west side of the street and an internal sidewalk connection from the two lots. c. The property owner shall execute a cross access and parking agreement. d. Minnesota Statutes Section 462.356, Subdivision 2, requires that the Planning Commission review any City action relating to the acquisition or disposal of City owned interest in property. The 0.18 -acre parcel, legally described as Outlot C, Valley Business Park is located along the south side of Energy Way, approximately 1/8 -mile west of Pilot Knob Road. The property is currently vacant and if sold to Miller Farms of Lakeville, LLC would be incorporated with a 3.45 -acre parcel currently owned by Miller for the purpose of developing the properties for business park uses. STAFF CONTACT: Thomas Lovelace, City Planner DEPARTMENT/DIVISION: Community Development Department APPLICANT: City of Apple Valley PROJECT NUMBER: PC17-01-M APPLICATION DATE: N/A 60 DAYS: N/A 120 DAYS: N/A Proposed Action Staff recommends that the Planning Commission approved the attached resolution finding that the disposaUsale of Outlot C, Valley Commercial Park to Miller Farms of Lakeville, LLC for consolidation with the property located at 5751 CSAH 42 is consistent with the Apple Valley Comprehensive Plan. Project Summary/Issues In 1994, the Apple Valley Economic Development Authority (EDA) acquired a 28 -acre site generally located northwest of the intersection of Pilot Knob and County Road 42 from L.G.S. Concord/Citizens Utility to facilitate the creation of an industrial business park. This 28 -acre parcel, now called Valley Business Park, was platted in 1999 and is zoned "BP" (Business Park). Immediately to the south of Valley Business Park is a 3.54 -acre unplatted parcel commonly referred to as the Melby farmstead property. When Valley Business Park was platted, a 0.18 -acre outlot, Outlot C, was created to provide the Melby property with access to Energy Way. The Melby property also has access to County Road 42, but will likely lose that access when the property is developed for another use. The Melby property is guided in the Comprehensive Plan for industrial uses and was rezoned from "A" (Agriculture) to "BP" Business Park) in 2015. In 2012, the Melby property was put up for sale, and the property owner requested the EDA work with them to acquire Outlot C so that their property would be more attractive to a potential user. The property owners did not present an offer for the acquisition of the property. The City Attorney has determined that no appraisal is needed and staff received approval from the EDA to begin negotiations with the Melbys for their acquisition of Outlot C. No sale of the outlot occurred as the result of the action taken by the EDA in 2012. Miller Farms of Lakeville, LLC, have purchased the Melby property and they are negotiating with City staff on the purchased of Outlot C. In order to complete the purchase the Planning Commission must determine that the sale is consistent with the Comprehensive Plan. The purchase of the outlot will help achieve the objectives of the EDA by attracting future development on the Melby property consistent with the Comprehensive Plan's and current zoning designations. Budget Impact The City's EDA would receive proceeds from the sale of the property and it would become a taxable parcel. Attachments Resolution Minnesota Statutes Section 462.356 Location Maps RESOLUTION OF THE APPLE VALLEY PLANING COMMISSION PURSUANT TO MINNESOTA STATUTES SECTION 462.356 SUBDIVISION 2 OUTLOT C, VALLEY BUSINESS PARK WHEREAS, Minnesota Statutes Section 462.356, Subdivision 2, charges the Planning Commission with the review of any City action relating to the acquisition or disposal of City owned interest in real property or the authorization of any capital improvement to determine such action's compliance with the local Comprehensive Plan; and WHEREAS, The City is considering an action related to said Statute, specifically the disposal/sale of the property legally described as Outlot C, Valley Business Park; and WHEREAS, Planning Commission review of such action finds that it is consistent with the goals, polices and implementation procedures of the Apple Valley Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Apple Valley that the Economic Development Authority of Apple Valley be advised that the disposal/sale of Outlot C, Valley Business Park is found to be in conformance with the Comprehensive Plan. Upon the recommendation by the planning agency of the comprehensive municipal plan or sections thereof, the planning agency shall study and propose to the governing body reasonable and practicable means for putting the plan or section of the plan into effect. Subject to the limitations of the following sections, such means include, but are not limited to, zoning regulations, regulations for the subdivision of land, an official map, a program for coordination of the normal public improvements and services of the municipality, urban renewal and a capital improvements program. Subd. 2. Compliance with plan. After a comprehensive municipal plan or section thereof has been recommended by the planning agency and a copy filed with the governing body, no publicly owned interest in real property within the municipality shall be acquired or disposed of, nor shall any capital improvement be authorized by the municipality or special district or agency thereof or any other political subdivision having jurisdiction within the municipality until after the planning agency has reviewed the proposed. acquisition, disposal, or capital improvement and reported in writing to the governing body or other special district or agency or political subdivision concerned, its findings as to compliance of the proposed acquisition, disposal or improvement with the comprehensive municipal plan. Failure of the planning agency to report on the proposal within 45 days after such a reference, or such other period as may be designated by the governing body shall be deemed to have satisfied the requirements of this subdivision. The governing body may, by resolution adopted by two-thirds vote dispense with the requirements of this subdivision when in its judgment it finds that the proposed acquisition or disposal of real property or capital improvement has no relationship to the comprehensive municipal plan. City of Appleii Valley Community Development Department 7100 - 147th Street West Apple Valley, MN 55124 952 / 953-2575 REQUEST FOR PROPOSAL PREPARATION OF COMMUNITY DEVELOPMENT SECTIONS OF THE 2040 COMPREHENSIVE PLAN UPDATE DOCUMENT December 8, 2016 REQUEST: The City of Apple Valley seeks professional consulting services to assist in preparation of the 2040 Comprehensive Plan update. The final draft plan document must be completed by June 1, 2018, presented to the City Council for acceptance, then submitted for Metropolitan Council and adjacent community review. Based on comments from Metropolitan Council and adjacent communities, final edits must be completed by December 1, 2018 for City Council approval and final submission by December 31, 2018. All service proposals are due no later than 4:30 p.m. on January 9, 2017. BACKGROUND: The City of Apple Valley is a thriving suburban community of 50,000 people with a compact, centrally located Downtown at the intersection of two major arterials that provide access to the Twin Cities region. The intersection of the two arterials, County Road 42 and Cedar Avenue, has one of the highest traffic volumes of any at -grade intersection in the State. Apple Valley is located 15 miles south of both Minneapolis and St. Paul. The City is the home of the Minnesota Zoo, a portion of the Lebanon Hills Regional Park, and Valleywood Golf Course. The City has a variety of housing choices, an active business community and nearly 800 acres of parks along with 60 miles of paved trails and nearly 125 miles of sidewalk. Cedar Avenue, the primary north/south arterial roadway in the City, is designated as a regional transitway in the Red Line which is the first bus rapid transit (BRT) corridor in Minnesota. The Apple Valley Transit Station, located at 155th Street on Cedar Avenue, provides transit connections to downtown Minneapolis, downtown St. Paul, the Minneapolis -St. Paul International Airport, the MN Zoo, the University of Minnesota, the regional transit hub at the Mall of America and adjacent cities. Multiple stations serve businesses and residents. The City is committed to sustainability, active living, great streets and accessibility as indicated in its 2030 Comprehensive Plan. The City believes that for 2040, it is well-positioned to demonstrate that it is a community for a lifetime and a model of a healthy, active and safe community. The City has adopted policies that help provide residents, businesses, employees and visitors with opportunities to thrive and integrate physical activity into their everyday lives. The City supports: • Mixed land uses that offer greater intensity of development termed "suburban intensive". • Local jobs and housing choices to improve opportunities for living and working within the City, reducing commute distances and vehicle miles, and making walking, bicycling and transit more desirable. • A complete transportation system that offers connection to the region. • Transit facilities, combined with the Red Line that are designed to be attractive and efficient, encourage ridership, and accommodate travel, circulation and access. • A compact downtown that, by land use design, has clustered compatible uses nearby. • Master planning of a privately owned active mining operation totaling 400 acres surrounded by a largely built out community. The area is called the Mixed Business Campus, which is being guided to integrate businesses, jobs, multi -modal transportation, housing, and retail uses. Priorities of the 2040 Comprehensive Plan will be to focus on the following details: • The Mixed Business Campus area master planning • Redevelopment, particularly in aging or opportunity areas • Suburban intensive transit oriented development near station areas • Defining livability, vibrancy, resiliency, and equity for the City • Programs that emphasize great residential neighborhoods; placing a high value on maintaining and retaining the existing housing stock in established neighborhoods and increasing private and public investment. • Business attraction, retention, expansion, job creation and a community culture of encouraging entrepreneurship The City of Apple Valley was awarded a $32,000 grant from the Metropolitan Council to aid in the creation of the Comprehensive Plan with emphasis in the following sections: • Community character, profile and vision • Development of the land use section in the 2040 priority areas • Project administration, coordination, community involvement, and the integrated "look and feel" of the final document for publishing. SCOPE OF SERVICES REQUIRED: The following is a general description of the tasks required of the consultant. In preparing a proposal, the consultant is free to modify, revise, or otherwise amend the list of tasks to best satisfy the requirements. • Prepare Analytics: a. Prepare community profile on demographics • Changes in age, gender, race, etc. since 2010 and trends to 2040 2 of 5 Income levels, house sale prices, average age of home etc. b. Create graphic materials for presenting the story of the community through the data c. Monthly staff meetings February 2017 -December 2018 d. Meetings with staff via telephone or in person as needed • Update Community Development Sections of 2030 Comprehensive Plan: a. Assess key missing elements in current plan based on analytics and required policies b. Work closely with City staff to update and create the following elements (see the 2030 Comprehensive plan as a template online) • Vision • Keys • Context • Housing • Land Use • Economic Development • "Community for a Lifetime" • Mapping and photography • CIP • Mixed Business Campus: • Coordination with staff, Planning Commission, and City Council to affirm area goals and desired outcomes for development of 400 acre sand & gravel mining operation • Community Engagement: a. Assist City staff in creation of a community engagement plan b. Coordinate with City staff and participation in 2-3 community engagement events • Facilitation by Consultant and City staff • Creation of electronic feedback mechanisms and other supporting materials to test and secure feedback on the draft chapters as completed • Coordination with Consultants Selected for Other Chapters and Final Publishing: a. Consultants are to be selected to complete sections such as parks and recreation, transportation and engineering. The consultant will facilitate the work of Community Development with these other consultants to provide one finished product which carries the same style and "voice". • Final assembly, formatting, and publishing of document. b. Coordinate finishing of final product: • Edit existing plan (adobe Indesign format) to include updated materials, new text, i▪ mages, vision etc. • Creation of new images and content which relates to updated information. • Update design of existing 2030 Comprehensive Plan to offer print, digital, and mobile formats. • Assist City staff in obtaining responses to adjacent communities/agencies and the Metropolitan Council. • Professionally designed end product with visual content that emphasizes best in class presentation, connection, and communication. 3 of 5 PRODUCT DELIVERABLES The 2040 Comprehensive Plan shall be presented in a narrative 8-1/2" x 11" text format (Microsoft Word), with maps (ArcView), digital format (Adobe Reader and InDesign) that are user-friendly and easily comprehended by the general public. The consultant shall make every effort to minimize the use of technical planning and engineering jargon. The consultant shall deliver the collaborative draft and final documents in both hard copy and electronic formats that allow easy reproduction, direct web readiness which includes mobile access and the ability for staff to edit. The consultant shall deliver: I. Thirty (30) printed, bound, color copies; 2. An unbound reproducible high definition camera ready original copy; and 3. Stick drive or CD-ROM of the text, all computer graphics, and ArcView shapefiles, compatible with the programs used by the City. STUDY TIMEFRAME: The Consultant is asked to submit a calendar that allows all objectives to be met by December 2018. A statement of qualifications, relevant experience and key personnel who will be responsible for the execution of this project, including qualifications of any sub- contractors named in the proposal. 2. A proposed work program based upon the scope of work in this request. The consultant is encouraged to incorporate his or her own ideas beyond those outlined in the RFP. 3. A detailed theoretical timeline for achieving each of the preceding scope of services. Consideration should be given for the orderly development of the sections; a list of tasks to be undertaken in each section, including meetings with the staff, public meetings; and the deliverables at each stage of development. 4 of 5 4. Ability to complete the requested project tasks in a timely manner and evidence that the firm's workload would permit the prompt commencement and completion of the project. 5. A list of three professional references from other local governments with contact names, mailing addresses, email addresses and phone numbers. 6. Commentary on the familiarity with the City of Apple Valley, Dakota County and the region. 7. A copy of work completed by you for a City of similar size and attributes. 8. A detailed cost breakdown of the project; section by section preferred. COMPENSATION: Following the selection of a firm, a contract which details the scope of work, costs attributed to the project elements, and an agreement for services will be executed. Reimbursement shall be made in accordance with the agreed upon schedule, specified within the contract. CONSULTANT SELECTION CRITERIA: Selection of the consultant will be based on the following criteria: 1. Completeness of the proposal. 2. Qualifications, specialized experience and professional competence. 3. Experience and availability of project manager and project personnel. 4. Completeness of project work plan identifying deliverables, timelines, and ability to meet project deadline. 5. Proposed cost of professional services. 6.
