The Committee is a forum to hear citizen concerns regarding traffic and parking on City streets, as well as pedestrian and bicycle safety issues. The Committee also evaluates proposals for traffic control devices, signage, and striping and considers citywide traffic education and communication programs. The Committee encourages residents to bring their concerns forward and appreciates your efforts to help make our City a safer community. Specific traffic solutions may also have unintended and potentially dangerous consequences as there are often engineering and liability issues involved with traffic controls and roadway designs to consider. When evaluating resident concerns, the Committee follows a process that looks broadly at multiple possible solutions and utilizes the City's engineering resources to help determine the most appropriate solution for identified problems: 1) The concern is received. 2) Options are identified to address the concern. 3) Additional analysis of the options to determine engineering, legal liability, and financial constraints or issues may be necessary. 4) A recommendation is made. Traffic Safety Advisory Committee City of Apple Valley July 12, 2017 7:00 p.m. Municipal Center Minutes 1. Call to Order The meeting was called to order at 7:00 p.m. by Chair Arthur Zimmerman. Members Present: Linda Dolan, Nick Francis, Charles Grawe, Fred Puente, Matt Saam, Joe Shaw, Arthur Zimmerman Members Absent: Consultants/Alternates Present: Brandon Anderson, City Engineer Others Present: 2. Approval of Agenda _ There were no changes to the agenda. MOTION: Mr. Grawe moved, second by Mr. Francis to approve the agenda as presented. Motion passed 7-0. 3. Audience Items There were no audience items. 4. Approval of May 10, 2017 Minutes A typo was noted on Mr. Kellas' title. MOTION: Mr. Grawe moved, second by Ms. Dolan, to approve the Minutes of May 10, 2017 with the typo correction. Motion passed 4-0. (Mr. Francis, Mr. Puente, and Mr. Saam Abstained) 5A. Cobblestone Lake Parkway Speed Limit Signs Mr. Anderson said residents have expressed concerns about speeding traffic on the Parkway and noted few posted speed limit signs. Mr. Anderson recommended allowing construction and its related traffic in the area to finish and continue to monitor traffic during that time. He expressed concerns about adding speed limit signs for one neighborhood while others with similar conditions don't have them. Mr. Francis said policy will increase their presence in the Parkway and will work with the homeowners' associations to increase awareness of the concern. 5B. Central Village Parking Lot— 152nd Street W Crosswalks Mr. Anderson said the City owns a parking lot on the south side of 152nd Street. Employees at businesses on the north side of 152nd have been crossing the street from the parking lot at mid-block locations. Some residents have suggested establishing a mid-block crossing. The mid-block locations do not meet the City's criteria for a crossing in the crosswalk policy. There are also visibility issues due to trees. Crosswalks are provided at the ends of 152nd Street that provide a safer crossing. Mr. Anderson did not recommend any crosswalk changes at this time. He recommended that staff communicate with the employers to encourage employees cross as the crosswalks. MOTION: Mr. Zimmerman moved, second by Mr. Shaw, that the Committee recommends communicating with the employers as described. Motion passed 7-0. 5C. Hamlet Avenue and Palomino Drive Crosswalks Mr. Anderson said there are right-of-way obstructions that block the view of the pathway users. The Public Works Department will work with the homeowners' association to correct the issue by trimming the trees and shrubs at the entrance monument area that are currently blocking sight lines at the intersection. 5D. Diamond Path and 1291i St W Turn Lane Requests Mr. Anderson said the City received a request to install a left turn lane off of southbound Diamond Path at the intersection with 1291i Street. The area has a very low crash history and the traffic volume hasn't changed much over the past decade. The County will be looking at modifications to Diamond Path when adding a round-about at the 1401i intersection and the turn lane could be considered during that project study. 5E. Crosswalk at Fit Academy School at 1471' Street Mr. Anderson said the crosswalk had been installed for the former Paideia Academy. It was removed when the school closed. Fit Academy would like to re-establish the crosswalk. City staff will work with Fit on the conditions for re-establishing the crosswalk. 5F. Update on Traffic and Speed Concerns and Parking Restrictions on Hayes Road South of 1451i Street Mr. Anderson said staff is working on studying the traffic volumes and speeds. 5G. Galaxie Avenue Corridor Study Update Mr. Anderson said the study is currently underway. 5H. Speed Advisory Siege on Pennock Avenue Update Mr. Anderson said the advisory signs have been placed on Pennock in response to a resident request. They will be rotated to other locations if other resident requests are received. A second set of advisory signs has been ordered. 5I. Garden View Speed Advisory Signage Update Mr. Anderson said the advisory signs are experiencing software and hardware issues. The traffic speeds and volumes have not changed significantly. 6A.Other Traffic Concerns Communicated to the City of Apple Valley Police Concerns Mr. Francis said the Commercial Vehicle Inspector has completed 83 of the 120 required annual inspections. Of the inspections done to date, 28 have resulted in vehicles or drivers taken out of service. Public Works Concerns Mr. Anderson said the City received a request for flashing yellow arrows at the signal at 1401' Street and Galaxie Avenue. These will be considered as part of a future intersection project. 6B.Educational Issues Grant Opportunities Ms. Dolan reported on the Car Fit clinic for nurses to train people to adjust their seating position in cars to reduce injuries. Ms. Dolan reported that the school resource officers met with the Toward Zero Death representatives to learn how to improve outreach in schools. Ms. Dolan reported the Eastview mock crash was cancelled due to poor weather. Ms. Dolan reported the Toward Zero Death Conference will be held in St. Paul October 261i and 271'. Ms. Dolan reported that the County is willing to work with the City on a blue light pilot project. The City is not interested in pursuing a blue light project at this time because the lights are not supported in the manual on uniform traffic control devices and local judges have not supported tickets based on this system. Mr. Shaw reported that the Arts Foundation has approved a booth for TSAC at a Kelley Park concert. 7. Adjourn MOTION: Ms. Dolan moved, second by Mr. Saam, to adjourn. Motion passed 7 - 0. In England,where I come from, motorcycle noise laws have always been fairly strict. My father told me that when he was about 20,he owned a 1948 Vincent Black Shadow. He told me that in those days the British police were hot on motorbike noise so if a cop suspected that your exhaust was modified, he would stick his nightstick(police in the UK didn't, and most still don't, carry guns) up the exhaust pipe to see if you'd removed the baffles. If you had,he'd write you a ticket. There was a federal regulation set by the Environmental Protection Agency in 198o which mandated a maximum 83 decibel limit for bikes manufactured from 1983 onwards but, of course, each state has it's own take.According to the AAA a number of states (Alabama,Alaska,Arkansas, Georgia, Iowa, Kansas, Kentucky, Louisiana, Missouri,North Carolina, Oklahoma,Tennessee,Utah, and West Virginia) have no limits while most of the rest have vague limits defined by original equipment specifications. Only a handful of the remainder,which includes California,have specific noise level limits defined. But he says the idea that loud pipes save lives is a myth. Hahn,who writes books and articles on motorcycle safety.says there's a problem with the safety theory because the pipes direct the sound backwards. "Seventy-seven percent of all motorcycle accident hazards come from the ii to i:oo direction,from in front of the motorcycle rider.And people that are 500 feet in front of you that may tum in front of you that will violate your right of way;they can't hear it because it's pointed the other way,"says Hahn. Hahn says there are better ways for riders to be seen:wearing bright colored clothes and helmets plus riding brightly-colored bikes.He says a New Zealand study found wearing bright colors lowered the chance of a motorcycle-vehicle crash by 37%. There is no surefire way to gauge whether there is more motorcycle noise over the past decade.The State Patrol didn't have numbers on how often troopers cite motorcyclists for noise; city police departments like Minneapolis, St.Paul and Duluth did not have them readily available.Typically,citing a motorcyclist for noise is at the officer's discretion.But there is one constant and that's more people are riding motorcycles in Minnesota than ever before at about 115,000. Curt Sandell,who is in charge of the St.Paul traffic enforcement unit,says with so many motorcycles on the road,there will be more noise because police can't keep up. On this day, Sandell is supervising a training course for motorcycle cops who are practicing breaking maneuvers.Sandell says any motorcyclist can make loud pipes sound no louder than a car; and can make even stock pipes sound loud. He says it's all in the right wrist and how they throttle. "I actually had one where I stopped at an intersection behind somebody and the light turned green and he didn't know I was a police officer and boy he took off like crazy really loud.Well he forced me to stop him and when I stopped him I said,'what are you doing?I'm right behind you..''I didn't know you were a cop; I was showing off to you.'So I said, 'guess what,here,now you can remember what date you were showing off,"'Sandell says. Motorcyclist Tom Gallagher agrees there are motorcyclists who make noise just to show off. But he says there are many others who use it solely for safety.He does everything he can to increase his safety;he wears a helmet and bright protective clothing. In the United States, motorcycles are built to federally mandated noise control standards. The reason why some motorcycles are loud is because riders modify the exhaust system or install an aftermarket exhaust system that is not street legal. A roaring exhaust system can be heard and felt over a wide distance, rattle windows and travel through walls. Millions of people are adversely affected by motorcycle noise. Riders who choose to ride with illegal exhaust systems ruin the image of the lifestyle and sport of motorcycling for others. Responsible riders and motorcycle clubs should advocate the use of legal exhaust systems. Motorcycle riders with loud aftermarket exhaust systems often claim that"loud pipes save lives" - that they are more likely to notice the attention of distracted motorists when they are on the road. There is no study on record that demonstrates a correlation between the noise level of a motorcycle exhaust system and its ability to reduce accidents. Motorcycles are also equipped with horns,just like passenger vehicles. Loud motorcycle exhaust systems produces low frequency sound that is non-directional and coming from the rear of the motorcycle where the exhaust is located. Since most two-vehicle accidents come from the front of the vehicle, the use of a loud exhaust system does nothing to alert other motorists of an oncoming motorcycle. In nearly three-fourths of the two-vehicle motorcycle crashes involving passenger vehicles,the role of the motorcycle was recorded, as the striking vehicle.Additionally,factors including alcohol impairment, invalid license, and speeding were more attributed to motorcycle riders. H-D had attempted to trademark the noise from its V-twin motorcycle engines. Ken Schmidt, a former H-D executive once described the sound of his product in three words: "Voice of God." He went on during a speech at a business conference, "Noise is good. Noise is the foundation of your business." Some riders join motorcycle rights,organizations (MROs)that lobby against motorcycle noise legislation. These organizations include the Motorcycle Riders Foundation, and American Motorcyclist Association (AMA). In many cities and states, there are groups that call itself ABATE. Depending on the chapter,the acronym may stand for'American Brotherhood Aimed Towards Education' or'American Brotherhood Against Totalitarian Enactments,' Motorcycle Exhaust Noise In Boston When a motorcycle comes from the factory,the exhaust system is EPA approved, but not for long. "We usually see 60 to 70:percent of riders change the pipes out," according to the general manager at a Boston Harley-Davidson dealership. All motorcycles are required to display an EPA stamp on the chassis and exhaust system.The EPA recognized that the intricacies of accurate field-testing are beyond the scope of law enforcement agencies.The EPA label match-up is designed as a regulatory measure for states and municipalities to control motorcycle noise. Riders can legally buy and: install aftermarket exhaust systems, however it is required to meet EPA noise emissions. Most aftermarket exhaust systems are not street-legal and intended for off-road or professional track use only. The California Air Resources Board estimates that a motorcycle whose catalytic converter has been removed emits up to ten times the amount of smog forming pollutants. This is just one of many common modifications to emissions equipment, often intended to make the bike louder, that reduces air quality and increases noise pollution. Affected residents dealing with; the problem of motorcycle noise are actively lobbying their elected officials for better legislation and enforcement.Additionally,there is increasing motorcycle restrictions on public lands, private roads and gated communities. Traditional rider destinations in cities such as Daytona, Myrtle Beach, Laconia have held public hearings aimed at banning annual motorcycle events. Some affected residents abandon their own homes during motorcycle rallies because of the deafening noise and traffic. The AMA compromises over 300,000 members and more than 1,200 chartered clubs,with corporate representation from the motorcycle industry. Through sponsored events and organized campaigns,they mobilize their membership to lobby to defeat motorcycle noise legislation. In 2002, after intense lobbying from the AMA and other MROs,the City of Albuquerque abandoned EPA stamp enforcement. In 2007, in spite of vocal opposition, the City of Denver passed EPA stamp enforcement. In 2008 and 2009,the New York City Council proposed legislation that would allow police officers to visually inspect parked motorcycles for the required EPA stamp. In 2008, the City of Myrtle Beach passed EPA stamp enforcement and banned most motorcycle rallies.Affected residents claimed the noise,traffic congestion and unruly behavior was a serious problem.According to the Mayor of Myrtle Beach,John Rhodes, motorcycle rallies also drove away visitors. In 2010, California passed SB 435 that aims to increase enforcement of current anti-tampering and noise-level statutes for motorcycles. It would require that motorcycles maintain their federally required emissions equipment(on both original, and aftermarket exhaust systems), including a readily visible EPA stamp certifying compliance. These regulations gives law enforcement the ability to cite violations, under the CA Vehicle Code, using a readily visible and unalterable stamp, already required by Federal regulation.The law applies to 2013 and newer model-year vehicles and is not retroactive to older motorcycles. In response to increasing legislation in support of EPA stamp enforcement around the country, the AMA"Motorcycle Sound Working Group'was created. They organized a 'Natioinal Summit on Motorcycle Sound' comprised of representatives from motorcycle manufacturers, the aftermarket industry, and racing promoters to create alternative model legislation. In 2009,the Society of Automotive Engineers (SAE)developed a new street motorcycle measurement procedure, called J2825, "Measurement of Exhaust Sound Pressure Levels of Stationary On-Highway Motorcycles." The SAE J2825 standard, prepared by the SAE 'Motorcycle Technical Steering Committee', recommends a decibel limit of 92 to 100 dB(a)for motorcycles. As decibel levels are measured logarithmically, a motorcycle would pass a vehicle inspection at over ten-times the current federal limits for noise emissions. It requires police officers to use a sound meter at an angle from a discreet distance of the exhaust pipe while the motorcycle operator slowly increases the RPM at idle. In communities where police officers are mandated to use sound meters to determine motorcycle noise,the result is no meaningful enforcement.The meters are expensive, it must be maintained and calibrated,the officer must be trained in its use and follow exact protocols. Adverse field conditions(such as vehicle traffic on roadways) make it difficult to get an accurate measurement. The summons is often challenged in court and dismissed. The automotive and motorcycle industry is neither qualified nor acting in the best interest on the issue of public health in relation to vehicle noise emissions and enforcement. The advocacy of SAE J2825 is designed to game the system with legislation that is unenforceable. Another enforcement measure is called 'pilainily audible standard"that allows an officer to determine excessive noise levels. In New York City, offenders can be cited if the motorcycle exhaust noise is plainly audible at 200 feet. Since passed in 2007 as,part of a revised noise code, it has proven to be ineffective.
