HomeMy WebLinkAbout09/27/2018 CITY OF APPLE VALLEY Dakota County, Minnesota September 27, 2018 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held September 27, 2018, at 7:00 o'clock p.m., at Apple Valley Municipal Center. PRESENT: Mayor Hamann-Roland; Councilmembers Bergman, Goodwin, Grendahl, and Hooppaw. ABSENT: None. City staff inembers present were: City Administratar Lawell, City Clerk Gackstetter, City Attorney Dougherty, City Engineer Anderson, Police Captain Bermel, Parks and Recreation Director Bernstein, Planner Bodmer, Police Captain Francis, Assistant City Administrator Grawe, Human Resources Manager Haas, Finance Director Hedberg, Community Development Director Nordquist, Police Chief Rechtzigel, Acting Fire Chief Russell, Public VVorks Director Saam, and Planner/Econ. Dev. Specialist Sharpe. Mayor Hamann-Roland called the meeting to order at 7:00 p.m. Everyone took part in the Pledge of Allegiance to the flag. APPROVAL OF AGENDA MOTION: of Hooppaw, seconded by Grendahl, adding item S.B - Proclaim October 1 - 7, 2018, as"Minnesota Manufacturing Week" in Apple Valley to the regular agenda, and approving the agenda for tonight's meeting, as amended. Ayes - 5 - Nays - 0. AUDIENCE Mayor Hamann-Roland asked if anyone was present to address the Council, at this time, on any item not on this meeting's agenda. Mr. Gene Rechtzigel commented about his fence, his request for a variance, and referenced State Statutes and the Minnesota Building Code. Mayor Hamann-Roland suggested Mr. Rechtzigel meet with the City Attorney to further discuss this matter. CONSENT AGENDA Mayor Hamann-Roland asked if the Council or anyone in the audience wished to pull any item from the consent agenda. There were no requests. MOTION: of Bergman, seconded by Goodwin, approving a11 items on the consent agenda with no exceptions. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, adopting Resolution No.2018-143 accepting, with thanks,the donation of$8.00 from Anthony Iverson of Community Alliance and 4Kids Fundraising for Use by Parks and Recreation Department. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving issuance of a 2018 Christmas Tree Sales Lot license to William E. Brabec, d/b/a Silver Bell Christmas Tree Farm, for use on Lot 2, Block 1, East Valley Plaza 3rd Addition(between Upper 141st and 140th Streets), as described in the City Clerk's memo. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2018-144 setting a public hearing, at 7:00 p.m., on October 25, 2018, on the application for On-Sale Wine and 3.2 Percent Malt Liquor Licenses by T & D Choice, LLC, d/b/a Phovalley Cuisine. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, declaring certain City vehicles as surplus; � authorizing the disposal of City vehicles and unclaimed property by a public sale from October 18, 2018,through November 1, 2018; and approvmg the agreement with Assets 2 Cash, LLC, for an online auction conducted through K-Bid, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin adopting Resolution No. 2018-145 appointing individuals listed in the resolution to serve as judges for the General Election to be held on November 6, 2018, in the City. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving a preferred catering list for the Senior Center, as described in the Parks and Recreation Director's memo. Ayes- 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving a change in operating hours of Redwood Community Center teen drop-in site, as described in the Parks and Recreation Department Director's memo. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2018-146 in support of Dakota County's Principal Arterial Study. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving wetland delineation for the Apple Valley Golf Course property, at 8661 140th Street W., as summarized in the complete delineation report of July 25, 2018. Ayes - 5 -Nays - 0. • CITY OF APPLE VALLEY Dakota County, Minnesota September 27, 2018 Page 3 MOTION: of Bergman, seconded by Goodwin, adopting Resolution No.2018-147 reauthorizing the final plat for Village at Founders Circle 2nd Addition, and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, adopting Resolution No.2018-148 approving plans for Wings Financial Building signs, with conditions as recommended by the Planning Commission. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving the Agreement for City of Apple Valley Residential Fall Clean-Up Day(furniture and remodeling debris collection)with Waste Management of MN, Inc., and authorizing the Mayor and City Clerk to sign the same. Ayes - 5 -Nays- 0. MOTION: of Bergman, seconded by Goodwin, accepting Project 2018-135, Well 5 Air Conditioner Installation, as complete and authorizing final payment on the agreement with Nordic Services, Inc., in the amount of$15,525.00. Ayes - 5 - Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving an amendment to the Personnel Policy Manual, as described in the Human Resources Manager's memo. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving the personnel actions as listed in the Personnel Report dated September 27, 2018. Ayes - 5 -Nays - 0. MOTION: of Bergman, seconded by Goodwin, approving the claims and bills, check registers dated September 5, 2018, in the amount of$194,218.19; and September 12, 2018, in the amount of$1,343,730.91. Ayes - 5 -Nays - 0. END OF CONSENT AGENDA PROCLAIM"FIRE PREVENTION WEEK" Acting Fire Chief Russell commented on Fire Prevention Week. The theme for 2018 is "Look. Listen. Learn. Be Aware. Fire can happen anywhere." Public open houses will be held, from 6:00 to 9:00 p.m., at Fire Station No. 1 on October 9, at Fire Station No. 2 on October 10, and at Fire Station No. 3 on October 11, and everyone is invited. He then reviewed activities planned at the fire stations and read the proclamation. MOTION: of Bergman, seconded by Grendahl, proclaiming October 7 - 13, 2018, as "Fire Prevention Week" in support of the Fire Department's public safety efforts and urging all citizens to install smoke alartns and to plan and practice fire drills; and authorizing activities planned at the fire stations. Ayes - 5 -Nays - 0. CITY OF APPLE VALLEY Dakota County, Minnesota September 27, 2018 Page 4 � PROCLAIM"MINNESOTA MANUFACTURING WEEK" Mr.Nordquist commented on the vital role manufacturing plays in Apple Valley's economy. In honor and recognition of those manufacturers located in Apple Valley, staff recommends the Council proclaim October 1 - 7, 2018, as"Minnesota Manufacturing Week". He then read the proclamation. MOTION: of Grendahl, seconded by Hooppaw,proclaiming October 1 - 7, 2018, as "Minnesota Manufacturing Week" in Apple Va11ey. Ayes - 5 -Nays - 0. CALENDAR OF UPCOMING EVENTS MOTION: of Grendahl, seconded by Bergman, approving the calendar of upcoming events as included in the Deputy City Clerk's memo, and noting that each event listed is hereby deemed a Special Meeting of the City Council. Ayes - 5 -Nays - 0. COMMUNICATIONS Mr. Lawell invited the public to Oktoberfest on September 28, 2018, from 4:00 p.m. to 9:00 p.m. in Kelley Park and to the Jack-O-Lantern Spectacular at the Minnesota Zoo from October 4 through 31, 2018. • Mr. Grawe reminded everyone Fall Clean-up Day will be September 29, 2018, from 8:00 a.m. to 1:00 p.m. at the Aquatic Center parking lot. Police Chief Rechtzigel with Police Captain Francis congratulated Police Captain John Bermel on his retirement. The Council thanked Captain Bermel for his service. Captain Bermel said he will miss the culture of excellence at the City of Apple Valley. ADJOURN MOTION: of Grendahl, seconded Goodwin,to adjourn. Ayes - 5 -Nays - 0.
