CALL TO ORDER The October 2, 1991 meeting of the Apple Valley Planning Commission was called to order at 7:34 p.m. by Chairperson Alan Felkner. Members Present: Karen Edgeton, Alan Felkner, Marcia Gowling, Eugene Kitzman, Jeannine Churchill, Joe Nordlund, and James Norris. Staff Present: Scott Hickok, Rick Kelley, Lon Anne, and Dennis Welsch. Others Present: See the sign -in sheet. 2. APPROVAL OF THE AGENDA The agenda was approved as submitted. 3. APPROVAL OF THE MINUTES OF SEPTEMBER 18, 1991 The minutes of the September 18, 1991 meeting were approved as submitted, 5 - 0 - 1, Norris abstaining. 4. CONSENT AGENDA (One motion sends items needing no discussion on to the City Council with the staff recommendations.) None 5. PUBLIC HEARING A. Valley Meadows Replat - Townhouse Units LOCATION: East Side of Garden View Drive at Heywood Path PETITIONER: Diedrich Builders, Inc. (PC91- 049 -S) STAFF REPORT: Richard Kelley, October 2, 1991 City Planner Richard Kelley provided a background report in which he described the existing zoning of M -3C and a density of up to six units per acre for a site previously used for common wall townhouse projects. He also explained the existing uses surrounding the site and noted that the current proposal would have less total units than the previous project. As currently configured, the Diedrich proposal would have up to 26 units. Kelley also described the site plan and the elevations for the building and requested that improvements be made to the rear side of the buildings. He noted that the density on the site, as currently configured, would be 5 -1/2 units per acre. Planning Commission Minutes October 2, 1991 Page 2 Member Gowling asked for clarification regarding the landscape plan and the inclusion of a 3 to 3 -1/2 foot berm along the south edge of the project. Kelley responded that this would be included in the final plan. Member Edgeton asked for clarification regarding the ownership of the units. Each unit would be individually owned by the occupant of the unit. Member Felkner asked for clarification regarding the need for additional parking space for guests and overflow. Kelley responded that 1/2 stall per dwelling unit will be required in addition to the 2 spaces for each dwelling unit for the purposes of overflow parking. He noted that Williams Brothers Oil Company will have to approve parking on the pipeline easement which runs through the site. Member Felkner asked if a hammerhead- turn - around would be needed as per other townhouse projects. Kelley responded that only in cases where a private road exceeds 150' in length is a hammerhead driveway turn around required. In this case, there is no such distance in any of the private roads. Bill Diedrich, proponent for the site, stated that lots 25 and 26 would require a setback variance to allow a building to be set at 30' from the right away line adjacent to Garden View Drive. This would allow for a duplex unit to be constructed on the site. The Staff is recommending against placement of a unit at this location. Member Nordlund asked for clarification regarding the previous project and expressed support for the new design which Diedrich has done in other areas. Diedrich stated he has no problem with completing the landscape plan as had been previously approved for the Valley Meadows project. Wayne Lambert, 14032 Heywood Path, told the Planning Commission that the concept for this project has not been presented to the Homeowner's Association and that the Homeowner's Association would have to approve the use of Lot 15 for construction of dwelling units. Currently Lot 15 is used as open space within the Palamino Hills Townhouse Project. He expressed concern with the aesthetics on this outlot area. Chairman Felkner noted that the Palamino Hills Townhouse Homeowner's Association would have to approve the sale of Lot 15 for the purposes of constructing more townhouse units. The City has no role in the sale of the parcel. Bob Dawson, 14034 Heywood Path, noted that the owner of Lot 15 is Stan Stans, who is out of town and was supportive of selling the parcel. Roberta Brinkman, 13963 Harold Court, asked the Planning Commission to review the traffic impact of adding up to 26 townhouse units in this area and on 140th Street. Layton Bennett, 13984 Harold Way, stated he was opposed to the sale of the property by the Palamino Townhouse Association to the project. Council Member Virginia Sterling asked the Planning Commission to consider turning units around with access off the private drives on Lots 25 and 26. She asked if it was possible Planning Commission Agenda October 2, 1991 Page 3 to meet the setback requirements with such a configuration. City Planner Kelley responded that a 40' setback would still be required from Garden View Drive right -a -way. Chairman Alan Felkner closed the public hearing. He noted that the Homeowner's Association will meet on November 6th to consider the use of Lot 15 for townhouse construction. City Planner Kelley asked the Planning Commission to consider approval of the Diedrich proposal without Lot 15 as part of the project. The Planning Staff will review the project and submit recommendations to the Planning Commission without Lot 15 being considered as part of the project at a future meeting. 6. LAND USE /ACTION ITEMS A. Setback Variance for Mobile Home Addition LOCATION: 13001 Pennock Avenue South PETITIONER: Jerry Steinert (PC91- 050 -V) STAFF REPORT: Scott Hickok, October 2, 1991 Associate Planner Scott Hickok provided background reporting in which he described the requirements for 20' setback between mobile home units. The proposed entry addition onto the Steinert mobile home (Lot 88) would reduce the setback to 11' between units. The Staff had recommended denial of the setback variance because there appeared to be no physical hardship creating the need for the variance. Jerry Steinert and son, Nate Steinert, 13001 Pennock Avenue, presented background information regarding the case. Mr. Steinert is a handicapped person who has limited mobility, especially on steps. The steps at the entrance to the mobile home unit are not covered, and become slippery and dangerous in the winter. Mr. Steinert explained that a covered entry and overhang above the stairs would provide a safer entrance to the mobile home for winter months. A general discussion ensued regarding the nature of the variance request and passed variance cases where a handicapped variance had been granted. Member Kitzman asked the applicants whether a smaller entry could also be created on the site. Nate Steinert stated that if allowed, the porch or entry cover would be constructed to meet or exceed City Building Codes. MOTION: Member Norris moved, seconded by Member Gowling, to recommend and direct the Staff to research methods of improving access to the mobile home unit. Should the Staff determine that a permit could be issued, the Staff was instructed to proceed to the City Council for final approval at the next available meeting. If no immediate approval was available, the Staff was to return to the Planning Commission for further discussion at the next meeting. The motion carried unanimously. Sketch Plan Review for Good Value Homes City Planner Richard Kelley provided a background report regarding a proposed 4 -plex townhouse development to be located on 8 acres on the south side of 138th Street, adjacent to Cedar Avenue. He noted that the proposal is to develop 13 to 14, 4 -plex townhouse units rather than using the current comprehensive plan and zoning designation for mixed uses. The developer has also proposed to move the road alignment within the site, and provide some type of buffer along the west boundary of the project, adjacent to the single family and duplex lots. Kelley noted that the total density and the number of units would actually be somewhat reduced from the maximums allowed under the comprehensive plan and the zoning designation. A general discussion ensued among Planning Commission Members regarding the past history of this site, and the need to again change zoning, if this project were to proceed. Member Felkner noted that in order to change the zoning on this site, there must be something very special about this 4 -plex design. The Planning Commission cautioned the Staff and the Developer to reduce the amount of changes to a minimum and yet allow for accommodation of the project. City Planner Kelley will communicate with Good Value Homes Developers to refine the design. 8. OTHER BUSINESS None 9.
