CALL TO ORDER The August 1, 1990 meeting of the Apple Valley Planning Commission was called to order by Chairman Robert Erickson at 7:50 p.m, in the City Council Chambers of the City of Apple Valley City Hall. Members Present: Chairman Erickson, Members Carlson, Gowling, and Kitzman. Members Absent: Weldon, Sterling, and Felkner. Staff Present: Richard Kelley, Meg McMonigal, Scott Hickok, Dennis Welsch, and Lon Anne. Others Present: See the sign -in sheet. 2. APPROVAL OF THE AGENDA The proposed agenda of the August 1, 1990 meeting was amended to add Item 6A - Parking Lot Expansion at Greenleaf and Westview Schools. MOTION: With the above amendment, Member Carlson moved, seconded by Member Gowling, to adopt the agenda. The motion carried unanimously. 3. APPROVAL OF THE MINUTES OF JULY 18, 1990 MOTION: A motion was made by Member Carlson, seconded by Member Gowling, to approve the minutes of the July 18, 1990 meeting as submitted. Site Plan for Apple Valley Executive Golf Course Clubhouse Expansion for Storage Space LOCATION: 8661 - 140th Street West PETITIONER: City of Apple Valley (PC90- 043 -B) Planning Commission Minutes August 1, 1990 Page 2 MOTION: A motion was made by Member Carlson, seconded by Member Kitzman, to recommend approval of 4A - Zoning Ordinance Amendment Permitted Setback Encroachments and 4B - Site Plan for Apple Valley Executive Golf Course Clubhouse Expansion for Storage Space. The Planning Commission motion included all staff recommendations. The motion carried unanimously. 5. PUBLIC HEARINGS A. Carrollton Commercial Addition Preliminary Plat and Bachman's Conditional Use Permit for Outdoor Sales LOCATION: Corner of County Road #42 and 147th Street West PETITIONER: R.W.W., Inc. and Bachman's (PC90 -040 -S and PC90- 041 -BC) STAFF REPORT: August 1, 1990 by City Planner Richard Kelley Chairman Erickson opened the public hearing on the preliminary plat and the conditional use permit for outdoor sales. City Planner Richard Kelley provided a background report based upon a written staff report of August 1, 1990. He noted that the comprehensive plan for the area has designated the area for shopping center and retail business, while the zoning in the area designates the site as planned unit development 341, subdivision 4A and is primarily to be used for retail uses. Kelley explained the surrounding uses and noted that 147th Street and Pennock Avenue are neighborhood collector streets. Pennock Avenue is also a portion of the Ring Route System. He explained that 147th Street, from Pennock to County Road 42, will eventually have street lights, trees, and sidewalks along it. Kelley reviewed the overall preliminary plat, noting that a loop road would connect from 147th to Pennock at 149th Street. There would be a right turn only lane on County Road 42 into the site and allowing for exists in a right hand manner. Kelley noted that it is unclear at this time whether the subdivider (Winkler) will utilize public streets or a private road construction system. No further information was available at this time. The staff will be working with Winkler on this project during the upcoming two weeks. Kelly also described the Bachman's site plan, noting that the building will be an L- shaped building and will have only one driveway from 147th Street, but will have internal access from the shopping center roads at the northwest and northeast corners of the site, as well as southeast corner. The intersection of the shopping center streets at the northeast corner of the Bachman's site have been reworked to create a "T" intersec- Planning Commission Minutes August 1, 1990 Page 3 tion. The west loading area adjacent to the shopping center road shares both car and truck traffic and is not screened adequately. Kelley noted that the landscaping on the site meets or exceeds the requirement that 2 1/2% of the construction value be placed in live land- scaping on the site. Bachman's had requested that the City reduce its' requirement for street tree plantings, but Kelley reported that the City Forester has required that the standard City tree placements along the boulevard be utilized. This means that trees will be planted every 27 feet. Parking setback reductions were discussed in detail. Since Bachman's will only construct three rows of parking in front of their building and will depress the parking lot and create a berm of one to two feet, it may be unnecessary to require a three to four foot high berm as was stipu- lated in the planned unit development for this area. Kelley also noted that the side and back areas, where outdoor displays will take place, will be screened and fenced with a wrought iron fence. The architecture of the building will be combination of brown brick, glass, and a major architectural atrium entrance. Kelley stated this architecture is compatible with other downtown designs. Brian Clots, architect representing Bachman's, plans and outdoor display areas are designed to meet unit development requirements. He explained the connections to the existing pedestrian walkways. elevations and a nighttime elevation of the site. Kelley explained that the notification has gone out to all property owners of record within 350 feet. The record was submitted to the City by Dakota Abstract. Ms. Clark asked for additional information regarding the amount of parking on the site, noting that three rows of parking may not be enough in terms of high sales, particularly in the spring. She asked if 147th Street would be available for overflow parking and expressed concern about the speed control on 147th Street. Chairman Erickson responded that the parking on the site has been reviewed by the staff and by Bachman's in which Bachman's noted "full utilization will occur only a few weekends in May ". Chairman Erickson encouraged Ms. Clark to speak with Council Members regarding police and speed controls on 147th Street. Planning Commission Minutes August 1, 1990 Page 4 Ms. Clark asked for further information regarding the trucks making delivery on the site and from which direction these trucks would be entering or leaving. A general discussion of the truck delivery process ensued. City Planner Kelley noted that 147th Street is constructed to a nine ton size, thus allowing trucks to utilize the street without damage to it. He also noted that there appears to be more than enough parking on the site and that the developers will be requested to have cross easements allowing for additional parking in the shopping center site when an overflow situation occurs. He noted there will be no parking allowed on 147th Street since it is a four -lane road with no parking lanes. Ms. Clark asked if the stoplight will be installed at County Road 42 and 147th Street. Chairman Erickson responded that the petitioner has requested a stoplight, but the cost of such a stoplight is $100,000 and that the site will have to meet traffic warrants. It may be installed in the future. Ivan Adams, 863 Haralson Drive, asked for further information regarding the berms along County Road 42. He requested that berms and landscaping assist in reducing lights and car impacts parked across the street from the Bachman's site. City Planner Kelley responded that the combination of landscaping berms and a depressed parking area will reduce the impact of the headlights. Sheila Hisdahl, 815 Fireside Drive, asked for clarification regarding the types of street lights to be utilized on the site. Dick Neumeg, 14741 Guthrie Avenue, asked what would be the additional uses on the site. Staff responded that the specific additional retail uses have not been determined at this time by the developer, Winkler. Jane Angove, 14719 Guthrie Avenue, asked the Planning Commission for clarification regarding the uses that would occur on the north side of 147th, between Pennock Avenue and Guthrie Avenue. The Planning Commission and Staff responded that this is a general retail area and would allow for most types of retail use including gas stations and fast foods. However, a buffer of berming and landscaping will be required along Guthrie Avenue and no driveway access will be allowed onto Guthrie Avenue. An unidentified citizen asked the Commission to consider whether there would be pollution coming from the site either from vehicles or fertilizers. Mr. Todd Bachman of Bachman's, Inc. stated that he was un- aware of any chemicals or fertilizers that would hurt the environment. He stated that only one truck would deliver on a normal day and two to three trucks would deliver on busier days. The trucks would be on the site from 9:00 to 5:00 p.m. and would not be parked on the site over night. Planning Commission Minutes August 1, 1990 Page 5 Susan Trish, 15454 Drexel Way, stated that Minnehaha Nursery has been in the community for many years and has had no problems with either trucks, fertilizer, or other environmental problems. Chairman Erickson asked the staff to respond more definitively on the stoplight situation at 147th Street and County Road 42. He also requested a definitive answer on the screening of rooftop mechanicals. Brian Cluts noted that the current design has a 5 foot parapet wall around the entire building, thus screening all mechanical equipment. Member Kitzman asked the staff and developers to work out more details regarding the screening of the loading dock area. There were no further public comments. Chairman Erickson closed the public hearing. The Planning Commission will review further details of this project on August 15, 1990. 6. LAND USE /ACTION ITEMS A. Parking Lot Expansion For Greenleaf and Westview Schools LOCATION: City of Apple Valley PETITIONER: City of Apple Valley STAFF REPORT: August 1, 1990 by City Planner Richard Kelley City Planner Richard Kelley provided a handout to Planning Commission Members which illustrated proposals by School District 196 to add 19 to 20 parking spaces each to the street side of Westview and Greenleaf Schools. He noted that the parking and the parking setbacks meet or exceed the zoning code requirements and that there are existing driveways in both situations to allow for surfacing this new parking area. Member Carlson stated that he was concerned with the site planning at Greenleaf School. While the parking does meet the setbacks for the zoning codes, it is a major loss of green space in front of the building. Carlson asked if there would be another alternative site on the school property for such parking, perhaps in the service area to the north and west. A general discussion ensued regarding the parking sites and the esthetics and landscaping at the schools. Member Carlson recommended that the City and School District work to modify these parking areas by providing more landscaping or finding alternate sites for the parking lots. MOTION: A motion was made by Member Carlson, seconded by Member Kitzman, to recommend denial of the site plan for parking at Westview and Planning Commission Minutes August 1, 1990 Page 6 Greenleaf Schools as presented, because there are no other alternative sites shown nor is a landscaping plan provided for screening of the parking areas (from the street) that were actually proposed. The motion carried with two members approving the motion, one member opposed to the motion, and one member abstaining from the motion. 7. DISCUSSION ITEMS A. ZonCon 003 - Palomino Woods Exception (McMonigal) B. ZonCon Oil - North Star Industrial (Welsch) C. ZonCon 037 - Rodeo Hills (Kelley) MOTION: A motion was made by Member Carlson, seconded by Member Gowling, to set public hearings for zoning consistency case 003 - Palomino Woods Exception, zoning consistency case 011 - North Star Industrial Park, and zoning consistency case 037 - Rodeo Hills for the first meeting in September of 1990. The motion carried unanimously. In zoning consistency case 003, the staff was instructed to provide notification of rezoning to "R -5 ", "M -1 ", "M -2 ", or "M -3" and to illustrate that the comprehensive plan would change to LD - low density. In zoning consistency case 011, the staff was instructed to advertise in the public hearing that the zoning would be changed from heavy industrial to light industrial. In zoning consistency case 037, the commission recommended that the legal notification advise the site as being rezoned from "M -4C" to "M -3C ". 8. OTHER BUSINESS Member Carlson asked for the staff update on the Environmental Impact Statement /Gravel Planning Report. Dennis Welsch reported that there has been no new activity other than meeting with the consultants to establish time lines for completion of the revisions to the Environmental Impact Statement and to begin the studies and uses for the land north of County Road 42. He noted that it is unlikely that the revisions to the Environ- mental Impact Statement will be done until November or December of 1990. 9. ADJOURNMENT The meeting adjourned at 9:18 p.m. kg
