As discussed at an earlier Informal meeting this past summer, a site tour of the C ity’s C entral
Maintenance Facility (C MF) property will be provided at the O ctober 10th Informal meeting.
T he site tour is meant to show first hand some of the issues/concerns addressed in the Space
Needs/Facility Assessment Report of the C MF property. Please join staff along with the
report’s author from Oertel Architects, T homas Stromsodt, for the site tour which will begin
at 5:30 p.m.
Please drive directly to the C MF which is located at 6442 140th Street West. Park in the
parking lot adjacent to 140th Street and enter the main door where we will convene and begin
the tour.

Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held September 26, 2019, at 7:00 o’clock p.m., at Apple Valley Municipal Center.
PRESENT: Mayor Hamann-Roland; Councilmembers Bergman, Goodwin, Grendahl, and
Hooppaw.
ABSENT: None.
City staff members present were: City Administrator Lawell, City Clerk Gackstetter, City
Attorney Dougherty, City Engineer Anderson, Police Captain Dahlstrom, Police Captain Francis,
Assistant City Administrator Grawe, Human Resources Manager Haas, Finance Director

Mayor Hamann-Roland called the meeting to order at 7:00 p.m. Everyone took part in the

INTRODUCTION OF NEW POLICE OFFICER DEMO
Police Chief Rechtzigel introduced newly hired Police Officer Miranda Demo to the Council.
The City Clerk administered the oath of office to Officer Demo. The Police Chief then presented
Officer Demo with her badge. The Council congratulated Officer Demo and welcomed her to her
new position.
PROCLAIM MINNESOTA ZOO A BUSINESS LEADER
Mr. Nordquist provided background on this item and introduced Mr. John Frawley, Director of
the Minnesota Zoo. Mr. Nordquist read the proclamation recognizing the Minnesota Zoo as a
business leader. He then presented the proclamation to Mr. Frawley.
MOTION: of Grendahl, seconded by Hooppaw, proclaiming the Minnesota Zoo a business
leader in connection with Apple Valley’s 50 Golden Year celebration. Ayes - 5 -
Nays - 0.
Mr. Frawley thanked the Council for this honor and the great relationship that the Minnesota Zoo
has with the City. He then gave a brief presentation regarding the Zoo’s 2020 bonding request.

supporting financial assistance for the Minnesota Zoo. Ayes - 5 - Nays - 0.

PROCLAIM “FIRE PREVENTION WEEK”
Fire Chief Russell commented on Fire Prevention Week. The theme for 2019 is “Not every hero
wears a cape. Plan and Practice your Escape!”. Public open houses will be held, from 6:00 to
9:00 p.m., at Fire Station No. 1 on October 8, at Fire Station No. 2 on October 9, and at Fire
Station No. 3 on October 10, and everyone is invited. He then reviewed activities planned at the
fire stations.
MOTION: of Grendahl, seconded by Bergman, proclaiming October 6 - 12, 2019, as "Fire
Prevention Week" in support of the Fire Department's public safety efforts and
urging all citizens to install smoke alarms and to plan and practice fire drills; and
authorizing activities planned at the fire stations. Ayes - 5 - Nays - 0.
APPLE VALLEY GOLF COURSE PROPERTY - COMPREHENSIVE PLAN AMENDMENT
Mr. Lovelace reviewed the request by Joel Watrud, owner of the Apple Valley Golf Course
located at 8661 140th Street W. for amendments to the Comprehensive Land Use Map, re-
designating .5 acres from “PR” (Private Recreation) to “LD” (Low Density Residential/3-6 units
per acre), re-designating 14.5 acres from “PR” to “MD” (Medium Density Residential/6-12 units
per acre), and the re-designation of 8 acres from “PR” to “HD” (High Density Residential/12+
units per acre). He also reviewed staff’s recommendation to the Planning Commission and the
Planning Commission’s recommendation to the City Council. He noted the Planning
Commission held a public hearing on the request for Comprehensive Plan Land Use Map
amendments on June 19, 2019.
Mr. Dougherty commented on the three resolutions included in the agenda packet. If the City
Council agrees with the Planning Commission’s recommended denial of the applicant’s request,
the City Attorney believes it is in the best interest of the City to have the property designated as
something other than private recreation. He noted the applicant has agreed to amend their
application to remove the request for high density. The third resolution was revised to reflect the
amended application and consent to send it to the Planning Commission. It is his opinion this
matter should be referred to the Planning Commission. The Planning Commission should hold a
public hearing on the revised application and provide a recommendation on the designation of
the property.
Discussion followed.
Councilmember Grendahl said she does not appreciate receiving new information the night of
the Council meeting.
Discussion continued.
Mayor Hamann-Roland clarified that if the matter is sent back to the Planning Commission,
there would be a public hearing for additional input and testimony.

Councilmember Goodwin noted the Planning Commission usually gives the City Council its
recommendation, but there was none in this case.
Mr. Peter Coyle, of Larkin Hoffman, representing Apple Valley Golf Course and Mr. Watrud,
briefly shared the thought process that went into the application. He stated they support the
comments and recommendation made by the City Attorney and think it is a practical approach.
He noted it is a difficult site to redevelop because there is not a lot of usable real estate for a
viable economic use. They will endeavor to cooperate with staff and the Planning Commission,
remove the request for high density, and try to bring back an application that meets the approval
of all parties that are interested.
Ms. Carol Elfstrom, 8580 136th Court, echoed the comments of disappointment at seeing a
change at the last minute. They have been watching this item very closely and are very
disappointed in how it was handled. She read an excerpt from the August 7, 2019, Planning
Commission minutes of comments made by the Planning Commission Chair.
Mr. Dougherty explained that the applicant did not see the materials in the packet until Monday.
It was upon receipt of the resolutions that conversations started with the applicant’s legal counsel
regarding the best way for them to proceed.
Ms. Kathy Lundin, 13531 Hollins Court, said she feels they have been left out of the loop and
some materials have been misrepresented. She felt a decision was made by the Planning
Commission and that there is much more attention given to the applicant than to the people who
have lived in the neighborhood for 35 years.
The Council continued discussion.
Councilmember Bergman pointed out low density does not mean single-family homes, it could
include townhomes.
Mayor Hamann-Roland complimented the Planning Commission for doing a terrific job and for
reviewing all the details necessary to make good decisions regarding land use planning.
MOTION: of Goodwin, seconded by Hooppaw, adopting Resolution No. 2019-113 directing
the Planning Commission to review and recommend an amendment to the Apple
Valley Comprehensive Plan for property located at 8661 140th Street W.,
including a public hearing by the Planning Commission and notification of the
public hearing to property owners within 350 feet. Ayes - 4 - Nays - 0 - Abstain -
1 (Grendahl).
MASSAGE THERAPY BUSINESS AND MASSAGE THERAPIST FINDINGS & DECISION
Ms. Gackstetter introduced this item and provided a brief summary regarding the revocation
hearing held on July 10, 2019, for the Massage Therapy Business license held by Impression

Spa, LLC, and the Massage Therapist license held by Yuanling Lan. Ms. Lan was the sole
owner of Impression Spa.

regarding the Hearing Officer’s recommended Findings and Decision relative to
Impression Spa, LLC, and Yuanling Lan. Ayes - 5 - Nays - 0.
COMMUNICATIONS
Mr. Grawe reminded everyone Fall Clean-up Day will be September 28, 2019, from 8:00 a.m. to
1:00 p.m. at the Aquatic Center parking lot.
Mr. Lawell congratulated Police Detective Sean McKnight on his retirement. The Council
thanked Detective McKnight for his service.

Personal information forms have been filed on these individuals and the Police Department

Adopt resolution amending 2019 Operating Budget for Specific Items.
S UM M ARY:
T he City Council is requested to consider a resolution amending the 2019 operating budget
for items that are proposed to be funded by anticipated savings within the 2019 budget or by
realigning other sources. T he items were included as budget addition requests during the
2020 budget review process and were not included in the preliminary 2020 budget. By
utilizing current year budget savings the pressure on the 2020/21 budget was reduced. It is
expected that these items will be completed during 2019.

T he General Fund expenditure budget will increase $33,500 with the use of Committed Fund
Balance, the Internal Service VERF Fund is budget neutral with increases in revenues and
expenditures each by $31,400 and the Enterprise Fund is also budget neutral.

BACKGROUND
Streets Maintenance - Purchase of Mobile Field Devices (1600-6211) Amount
The Public Works Department is requesting $1,600 of the amounts remaining of the
budgeted supplies in the streets budget be directed to the purchase of I-pads/Surface
Pros for streets department staff to use in the Cartegraph Asset Management System
while out in the field.
The funding for this project would come from unspent 2019 budgeted amounts in
other supplies in the Streets Maintenance Department.

Streets Maintenance - Purchase of Hands-free Devices (1600-6211) Amount
The Public Works Department is requesting $1,000 of the amounts remaining of the
budgeted supplies in the streets budget be directed to the purchase of hand-free devices,
headsets or push button transmitters for 2 way radios, to be used by plow drivers to
communicate with supervisors and other drivers in a safe manner while plowing.
The funding for this project would come from unspent 2019 budgeted amounts in
other supplies in the Streets Maintenance Department.

CMF & Fleet – Training Room Projector Replacement (1530-6735) Amount
The Public Works Department is requesting that a savings in Fleet Maintenance be
directed to the replacement of the projector in the training room at CMF.
The funding for this project would come from salary savings experienced in the delay
in hiring of the mechanic position in 2019.

CMF/Fleets – Assetworks (1530-6735) Amount
Public works previously amended the budget to provide for the replacement of a fleet
management system for tracking fuel and vehicle repairs. This system was not replaced
in the prior year and funds were included in committed fund balance at the end of 2018.
This action appropriates funds for the replacement of the existing system.
The funding for this would come from committed fund balance from the prior year.

Park Maintenance – Roof Replacement at JCRP East (1730-6735) Amount
The Parks Maintenance Department is requesting that $5,000 in savings in the repairs
expense budget be directed to the shingle replacement of building D at Johnny Cake
Ridge Park East.
The funding for this project would come from unspent 2019 budgeted amounts in
repairs expense in the Park Maintenance Department.

Police – Police Range Well Repairs (1200-6266) Amount
Emergency repairs to the well at the police range in Eagan were needed to restore water
and sewer service at the range. This cost is the City of Apple Valley’s share of the
repairs.
The funding for this would come from savings in the Police Departments 2019 budget
in Other Charges (6399) and Out of Town Training (6276).

Police – Evidence Management System (1200-6265) Amount
The police Department is requesting to reallocate savings for the purchase of an
Evidence Management System. The existing system has reached the end of its useful
life and is no longer supported.
The funding for this would come from savings in wages and salaries from position
vacancies.

Fleet VERF– New Electric Utility Vehicle for Scissor Lift (7435-6730) Amount
Public Works is proposing to purchase utility vehicle with a scissor lift attachment to
be used in multiple departments in place of a bucket truck or ladders while doing
maintenance.
The funding for this would come from 2019 budget savings in multiple departments.

Fleet VERF– Scissor Lift to Mount on Utility Vehicle (7435-6730) Amount
Public Works is proposing to purchase a scissor lift that can be attached to a utility
vehicle that will be used in multiple departments in place of a bucket truck or ladders
while doing maintenance. This scissor lift will also be able to attach to the existing
Police Departments UUTV.
The funding for this would come from 2019 budget savings in multiple departments.

1.The Assistant Finance Director has calculated the amount proper and necessary to
be specially assessed for improvements in the areas described, as set forth in Exhibit A,
against every assessable lot, piece or parcel of land affected thereby upon the basis of
benefits without regard to cash valuation in accordance with the provisions of Minnesota
Statutes Annotated, Section 429.
2.This Council, finds each of the lots, pieces and parcels of land enumerated in the
proposed assessment rolls, in the aggregate amount of $272,986.10, was and is specially
benefited by an increase in the market value of the properties by the construction of said
improvement is not less than the amount of assessment set opposite the description of each

lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied
against each of the respective lots, pieces and parcels of land described in Exhibit B.
3. The proposed assessment rolls are hereby adopted and confirmed as the proper
special assessments for each of said lots. Each assessment, together with interest at the rates
set forth in Exhibit A, accruing on the full amount thereof, from time to time unpaid, shall
be a lien concurrent with one (1) year’s interest on that and other unpaid installments to be
payable with the general taxes for each consecutive year thereafter until the entire
assessment is paid.
4. The Assistant Finance Director shall, as soon as may be, prepare and transmit to the
County Auditor, a Special Assessment Input form as may be prescribed by the County

S UM M ARY:
For your consideration is a request by Menard, Inc. for approval of the final plat and
development agreement and planned development agreement for the Menards at Hanson
Concrete addition, and a Waiver of Objection to Special Assessments for C S A H (C ounty
State Aid Highway) 42 and J ohnny C ake Ridge Road for public infrastructure
improvements.
T he 50-acre final plat is located at the northwest corner of C SA H 42 (150th Street West) and
J ohnny C ake Ridge Road and is the part of the former Hanson Pipe concrete pipe
manufacturing facility. T he final plat represents the platting of a portion of an unplatted
parcel into two (2) lots and two (2) outlots. Lot 1 will be 22.6 acres and will be the location
of the new Menards store and storm water ponding area. No development proposal has been
submitted at this time for the 3.8-acre Lot 2. O utlot A and the northwest corner of Outlot B
will also be used for storm water ponding. T he portion of the 12.6-acre Outlot B not used
for ponding purposes will be reserved for future subdivision and development. Public right-
of way for C SA H 42, 147th and 149th Streets West, J ohnny Cake Ridge Road and Fernando
Avenue will be dedicated with this final plat, as well as all the necessary drainage and utility
easements to serve the plat
Also for consideration is a planned development agreement. T his agreement calls out the
type of uses, consistent with the Planned Development Ordinance No. 1053, that will be
allowed on Lot 1, Block 1 of the final plat. It also states that the use and development of the
lot will be in conformance with the C ity approved site, building elevation, landscape, and
signage plans.
And finally, staff is requesting approval of a Waiver of O bjection to Special Assessments for
Projects 2019-108 and 2019-111, C SA H 42 and J ohnny Cake Ridge Road public
infrastructure improvements. T hese improvements will consist of:
1. Installation of a new traffic signal at the C SA H 42/J ohnny C ake Ridge Road
intersection.
2. Additional channelization and turn lanes in three (3) of the four (4) legs of C SA H 42
/J ohnny C ake Ridge Road intersection (excludes any improvements to the east leg.
T his will result in a longer eastbound C SA H 42 left-turn lane onto J ohnny Cake Ridge
Road and double left-turn lanes for southbound J ohnny C ake Ridge Road onto
eastbound C S A H 42.
3. A dedicated southbound right-turn lane on J ohnny C ake Ridge Road at C S A H 42.
4. A new westbound right-turn lane on C S A H 42 into Menard's property.
5. Construction of a four-lane divided roadway. T his will create right in/right out
conditions at the Holiday gas station and other driveways.
6. A new two-lane roundabout at 149th Street West and J ohnny C ake Ridge Road, which
will replace an existing three-legged T intersection.
B AC K G RO UND :
A public hearing on the comprehensive plan amendment, rezoning, and subdivision of the
land by preliminary plat was held by the Planning C ommission on J uly 15, 2018, and was
recommended for approval by the C ommission at its August 15, 2018, meeting. O n
November 15, 2018, the City C ouncil approved the re-designation of Lot 1 Block 1 from
“IN D” (Industrial) to “C ” (C ommercial) on the Comprehensive Plan’s 2030 Land Use Map,
a rezoning from “I-2" (Industrial) to "PD " (Planned D evelopment), a planned development
ordinance for the property, preliminary plat, and site plan/building permit authorization for the
Menards store and warehouse on Lot 1, Block 1 of the preliminary plat.
T he draft development agreement that has been prepared refers to the installation of the
municipal improvements consisting of municipal streets and utilities and required financial
guarantees for all of the developer-installed items. T he agreement also calls out the
immediate installation of all subdivision monuments and the documentation of the following:
1. An access restriction easement that will restrict direct driveway access to and from
Upper 147th and 149th Streets West, Fernando Avenue, and J ohnny C ake Ridge Road;
except at C ity approved locations.
2. A shared cross-access easement over and across Lots 1 and 2 that will provide access
from Lots 1 and 2 to a public street.
Menard, Inc. has also granted an access restriction easement to D akota C ounty, which will
restrict direct driveway access to C S A H 42 except at the location as shown on the
development plans for Lot 1. No direct access from Lot 2 to C SA H 42 will be allowed.
Also for consideration is a planned development agreement. T his agreement calls out the
type of uses, consistent with the Planned Development Ordinance No. 1053, that will be
allowed on Lot 1, Block 1 of the final plat. It also states that the use and development of the
lot will be in conformance with the city approved site, building elevation, landscape, and
signage plans.
On J uly 25, 2019, the C ity C ouncil approved the Feasibility Report for Project 2019-108,
2019-109, 2019-111. T his report identified the public infrastructure improvements related to
the Menards at Hanson Concrete development project. Menard, Inc. has
signed the necessary waivers for Project 2019-109, which the C ity C ouncil has approved.

T he C ity will incur some roadway oversizing costs associated with the public infrastructure
improvement projects, which was identified in the feasibility report approved by the C ity

WHEREAS, pursuant to Minnesota Statutes 462.358, the City of Apple Valley adopted, as
Appendix B of the City Code, regulations to control the subdivision of land within its borders; and
WHEREAS, pursuant to Appendix B of the City Code, the City Planning Commission held
a public hearing on an application for subdivision of land by plat on July 18, 2018; and
WHEREAS, the City Planning Commission found the preliminary plat to be in conformance
with the standards of Appendix B of the City Code and made a recommendation as to its approval
on August 15, 2018, which was subsequently approved by the City Council on November 15,
2018; and
WHEREAS, pursuant to Appendix B of the City Code, a development agreement between
the applicant and the City detailing the installation of the required improvements in the subdivision
and the method of payment therefore has been prepared.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Apple Valley,
Dakota County, Minnesota, that the development agreement and final plat for the following
described plat of land are hereby approved and the Mayor and City Clerk are authorized to sign the

AGREEMENT
WHEREAS, the City of Apple Valley, Dakota County, Minnesota, (the "City"), has
been requested by Menard, Inc., a Wisconsin corporation (the "Developer") to approve for
recording the following described plat:
The plat of Menards at Hanson Concrete; and
WIIEREAS, Developer intends to develop the real property legally described on the
plat (the "Properf¡/") as two (2) lots and two (2) outlots; and
WHEREAS, pursuant to City Ordinances, the Planning Commission held a public
hearing with reference to the application for approval of the plat on July 18, 2018; and
WHEREAS, the Planning Commission recommended its approval on August 15,
2018; and
WHEREAS, the City Council approved the prelimi nary platon November I 5, 20 18 ;
NOW, TIIEREFORE, in consideration of the mutual agreements of the parties, it is
hereby agreed by and between the parties as follows:
1. Subject to the terms and conditions of this Agreement, the City hereby
approves for recording the plat known as Menards at Hanson Concrete (the "Plat',), as
shown and noted on Exhibit ',.L,, attached hereto.
2. This Plat is governed by the terms and conditions of the Cþ's Zoning
Ordinance (the "Ordinance"). Any use or development of the Plat shall be in accordance
with the provisions of the Ordinance
3. The Developer shall comply with the conditions of preliminary platapproval
set forth in City of Apple Valley Resolution No. 2018-1 69, a copy of which is attached
hereto as Exhibit "8" and incorporated herein.
4. The Developer shall comply with the conditions of Preliminary Planned
Development Agreement, a copy of which is attached hereto as Exhibit ,,C" and
incorporated herein.
5. The Developer shall comply with the conditions of building permit
authorization set forth in City of Apple Valley Resolution No. 2018-170, acopy of which
is attached hereto as Exhibit "D" and incorporated herein.
6. The Developer,requested, and the City designed the necessary: (i) sanitary
sewer and service stubs; (ii) water main and service stubs; (iii) storm sewer; (iv) streets
with concrete curb; and (v) concrete sidewalks to be constructed and installed on the
Property. The improvements are as identified in the plans and specifications for Apple
Valley Project Nos. 2019-107 and20l9-Il0 (Menards Street and Utility Improvements)
(the "Improvements") and are being installed by the Developer under a separate contract
by and between the Developer and City entitled "Agreement for Private Installation of
Improvements" dated August 22, 2019.
The Improvements shall be maintained as follows:
Ð The City shall only be responsible for maintenance of sanitary sewer
lines located upon the Property having a pipe equal to or greater than eight
inches in diameter and located within public right-oÊway or utility
easements. Maintenance of service and lateral lines shall be in accordance

iÐ The City shall only be responsible for the maintenance of water lines
on the Property that have a pipe equal to or greater than six inches in diameter
and located within public right-oÊway or utility easements. Maintenance of
service and lateral lines shall be in accordance with City Policy 2.03 Water
and Sanitary Sewer Service Maintenance and Repair Policy Adopted July 8,
2010, per resolut ion 2010 -l 44.
iiÐ The storm sewer improvements to be owned and maintained by the
City shall be located entirely within public right-oÊway or dedicated public
easements.
7. Developer requested and the City designed and contracted to install road
improvements (including traffic signalization) at the intersection of l47th Street West and
Johnny Cake Ridge Road, which are necessary to service the Property, as identified in the
plans and specifications for Apple Valley Project No. 2019-109 (Public Infrastructure
Relating to the Proposed Menards at Hanson Concrete Development). A portion of the
cost of Project 2019-109 is Developer's responsibility and shall be assessed against the
Property. Developer has waived its right to contest the assessment for Project 2019-109, a
copy of the waiver is attached hereto as Exhibit "8" and incorporated herein.
8. Developer requests and the City agrees to design and conhact for: (i) road
improvements (including replacement traffic signalization) at the intersection of CSAH 42
and Johnny Cake Ridge Road, and (ii) a right turn lane improvement on CSAH 42,which
are necessary to service the Property, as identified in the approved Feasibility Report for
Apple Valley Project Nos. 2019-108 and 2019-11l (Public Infrastructure Relating to the
Proposed Menards at Hanson Concrete Development.) A portion of the cost of,Project No.
2019-108 and all the cost of Project No. 2019-111 is Developer's responsibility and shall
be assessed against the Property. Developer shall waive its right to contest the assessments
forProject Nos.2019-108 and 2019-l1l by executing a waiver, the form of which is
attached hereto as Exhibit *F" and incorporated herein. The actual assessments shall be
determined upon completion of the Projects based upon the actual cost of construction,
including standard and uniformly applied City overhead charges. The waivers herein apply
to the final total assessments as determined by the City and shall be assessed to Lot 1,
Block 1, of the Plat.
9. Subject to the provisions hereunder, the Developer shall grade the Property
and install improvements within the Property, in accordance with and under the following
conditions:
A. To complete the installation of the Improvements pursuant to the Agreement
for Private Installation of Improvements.
B. To complete all improvements in conformance with the plans and
specifications submitted by the Developer and approved by the City, including but
not limited to the following plans prepared by wenck, dated August 16,2019, and
any subsequent revisions as required by the City Engineer:

C. To construct sidewalk(s) and driveways with concrete or bituminous material
in accordance with City construction standards.
D. To seal or cause to be sealed all existing wells on the Property in accordance
with State, County and local laws.
E. To install a protective box and cover over each sewer cleanout and water
shutoff, to City specifications.
F. To install all lot monuments upon or before August 31,2020.
G. To install and maintain all materials (trees, shrubs and sod) identified in the
City approved landscape plan.
H. The Developer agrees to comply with all requirements of the Natural
Resources management regulations as set forth in Chapter 152 of the Apple Valley
City Code prior to, during and after the development of the Property. The Developer
has submitted, and the City has approved, a Natural Resources Management plan in
connection with the development of the Property. The Developer shall implement
and comply with all terms and conditions of the approved Plan prior to and during
any construction or land-disturbing activity, including, but not limited to,
maintaining the perfonnance security required in Chapter 152 of the Apple Valley
City Code.
I. To install and maintain erosion control measures in accordance with the
approved Erosion Control Plan.
J. To install each item noted in this Section 9 at the Developer's sole cost and
expense, in accordance with all plans reviewed and approved by the city.
K. To attend a preconstruction meeting with representatives of the City and to
require the attendance of all contractors and subcontractors, prior to commencement
of construction.
L. Developer will not bury any pipe nor install bituminous surface nor pour
concrete pursuant to implementing the Plans, without the specific approval of the
City Inspector, prior to the work being performed.
M. All "on-site" inspections by the City will be done at the sole cost and expense
of Developer, by persons supplied by the City.
N. The Developer shall repair any and all damage to City streets, curbs, gutters,
utilities and other municipal improvements caused by or resulting from the
development of the Property, at the Developer's sole cost and expense.
O. To pay the City's reasonable costs related to the Property and this Agreement,
including but not limited to administration, engineering, legal fees, inspection and
enforcement. The City shall submit invoices to the Developer with detailed
descriptions of the services rendered by the City in accordance with this Agreement.
The Developer shall deposit the sum of $10,000.00 with the City toward payment
of the City's reasonable costs. If the City's reasonable costs exceed the deposit,
Developer agrees to reimburse the City within thirty (30) days of billing. Should the
costs be less than the amount of the deposit, upon completion of the improvements,
the amount remaining on deposit shall be ieturned to the Developer.
P. If Developer causes any material violation of the terms of this Agreement
and this section, City shall give written notice to Developer of such violation and
Developer shall have l0 days, or a different period of not less than 10 days, as may
be set forth in the notice, to cure such violation. Failure of Developer to complete
such cure shall allow the City to stop and enjoin all construction in the Property
until authorizationto proceed is given by the City. The Developer agrees to hold the
City harmless from any damages, causes of action, or claims related to the
construction being stopped by the City.
a. The Developer shall provide the City Engineer as-built plans that demonstrate
that all constructed storm water conveyance structures and management facilities
(ponds and sub-surface infiltration practice) conform to design and/or construction
plans, as approved by the City. As-built volumes (for detention and retention) shall
be provided for the ponds and subsurface infiltration practice. The Developer shall
submit to the City Engineer certification that the storm water management facilities
' have been installed in accord with the approved plans and specifications. This
certification shall be provided by a Professional Engineer licensed in the State of
Minnesota.
10. The Plat shall not be released by the City for recording until Developer has
deposited with the City a Financial Security in the total amount of Two Million Nine Hundred
Twenty-Nine Thousand Six Hundred Thirteen and No/100 Dolla¡s ($2,929,613.00)
(Financial Security) securing the full performance of this Development Agreement. The bank
or financial institution issuing a Financial Security is subject to the approval of the City
Attorney. The form of the Financial Security shall be a cash deposit with the City. The
amount of the Financial Security was calculated as follows:

(Ð Financial Security. In the event of a default by Developer which is not
cured within ten (10) days after written notice from the City or within a
different period as may be set forth in the notice, the City may draw down the
Financial Security to pay for all costs and expenses incurred by the City to
enforce this Agreement including the costs incurred by the City in connection
with the collection of the Financial Security. The Cþ's cost may include any
remediation or completion of Developer's obligations under this Agreement.
The City may draw on the Financial Security, without notice, after a default has
occurred under this Agreement, which has not been remedied within any
applicable cure period.
(iÐ. Claims to Financial Security. In the event that the City receives claims
from subcontractors or materialmen for work performed in or intended for
easements dedicated to the public as required by this Agreement and money
due has not been paid, City shall give notice to Developer of such claim and
Developer shall have 90 days to make payment or provide City with
documentation showing such claim to be unwaranted and its intent to take
legal action to remove such claim. If Developer fails to provide such written
notice to City Developer hereby authorizes the City, at the City's discretion, to
c,oÍtmence an Interpleader action pursuant to Rule 22 of the Minnesota Rules
of Civil Procedure for the District Courts at the expense of Developer, to
include court costs and attorney fees. Developer further authorizes the City to
draw upon the Financial Security in the amount of one hundred twenty-five
percent (I25%) of the claim together with attomeys'fees and court costs, and
to deposit the funds in compliance with the Rule.
(iiÐ Release of Financial Security. Periodically upon Developer's
written request and upon completion and verification of satisfactory
compliance of any installed Improvements, a like percentage of that portion
of the Financial Security covering those specific completed Improvements
(Section 9), or the payment of special assessments levied in connection with
the Public Improvement Projects (Sections 7 & 8), a like percentage of that
portion of the Financial Security covering those specific Improvements or
Public Improvement Projects may be released; except however the final
twenty percent (20o/o) of the Financial Security shall be held until a final
acceptance by the City of all Improvements to be maintained by the City and
the receipt by the City of all as-builts required under this Agreement. At the
time of final inspection of all Improvements, if it is determined by the City
that the plans and specifications for the Improvements were not strictly
adhered to or that work was done without City inspection, the City may
require that the Developer post a cash escrow equal to one hundred twenty-
five percent (125%) of the estimated amount necessary to correct the
deficiency or to protect against deficiencies arising therefrom. Such
additional cash escrow shall remain in force for such time as the City deems
necessary, not to exceed five (5) years.
11. Developer shall pay the special assessments, when due, for all amounts
associated with Projects 2019-108, 2019-109 and 20l9-ll I as set forth on the exhibits to
this contract.
12. The Developer agrees to install all utilities underground in the Property,
specifically including electrical, telephone, cable television and gas services. The
Developer hereby represents that all utility services will be available for a building prior to
occupancy of any dwelling in that respective building.
13. No occupancy of any building in the Property shall occur until water, sanitary
sewer, and a paved driving surface are available for use to that building.
14. Prior to the release of the Plat for recording, the Developer shall:
A. Deliver to the City the Financial Security (Section (10).
B. Deposit the funds to the City (Section 9O).
C. Pay the following trunk charges in the total amount of $2951769.32 for
Lot 1, Block I of the Plat:

15. In addition to the trunk charges noted herein, upon submission of a building
permit application, the Developer agrees to pay the City for the public services furnished
to the Property, in an amount as determined below upon the basis of units þer building) as
determined by the City Engineer, which amount shall be paid in the following manner:
A. Sewer Availability Charge - The rate per unit is based on the year in which
the building permit is issued þresently $2,838.00 per unit - $2,485.00 Metro and
5353.00 City). The person who applies for a building permit shall pay, at the time
of the issuance of the permit, an amount equal to the rate times the number of units.
This fee is subject to change if the obligation of the City to the Metropolitan Waste
Control Commission changes.
B. W'ater System, Supply and Storage Charge - The rate per unit is based on the
year in which the building permit is issued þresently $961.00 per unit). The person
who applies for a building permit shall pay, at the time of the issuance of the permit,
an amount equal to the rate times the number of units.
16. The parties mutually recognize and agree that park dedication requirements
for Lot 1, as provided in Chapter 153 of the City Code, shall be satisfied by a cash payment
of $318'000.00. The calculation of the park dedication payment is set forth in City of Apple
Valley Resolution No. 2018-169. Payment shall be made to the City prior to the release of
the Plat for recording.
[Addiitonal park dedication shall be due and payable to the City in connection with the
development of Lot 2, Block I and Outlots A and B of the Plat; the dedication shatl be paid
prior to the issuance of building permit(s).J
17. The parties mutually recognize and agree that storm water pond dedication
requirements, as provided in Chapter 153 of the City Code, shall be satisfied by dedication
of drainage and utility easements on the Plat, and grading the property and installing the
utilities pursuant to approved plans.
l8' The Developer agrees to install and pay for a public (or private) street
lighting system for the Property, in accordance with the standards of the City and the
entities supplying electrical power to the Property.
19. The Developer agrees to provide the City with as-built surveys, in a format
that is acceptable to the City Engineer, to include electronic documents, for the location of
any building perimeter and the utilities, curbs, and/or pavement constructed upon,a lot in
the Plat.
20. The Developer agrees to reimburse the City for all engineering,
administrative and legal costs and expenses incurred by the City in connection with this
Agreement or the enforcement thereof.
21. The Developer agrees to execute and record with the Plat an Access
Restriction Easement to restrict vehicular access to l47th Street and Johnny Cake Ridge
Road except at City approved locations, in the form attached hereto as Exhibit ,,G".
22. The Developer shall prepare and deliver to the City's Afforney, for approval,
a shared cross-access easement (Declarations) over, across and upon Lots I and2,Block
1, of the Plat for access from the lots to a public street, which cross-access cannot be
terminated without approval by the City. "No ParkingÆire lane" signage shall be installed
along the private accesses within the development to ensure they be kept open for
emergency vehicle access. The Developer shall provide a plan to be approved by the Fire
Department that includes o'No ParkingÆire Lane" areas and any possible fire department
pull offs. Developer is responsible to record the access easement with the filing of the plat.
23. The Developer shall deliver to the City copies of the recorded documents to
evidence that the Developer has complied with its recording obligations under this
Agreement.
24. The Developer hereby specifically holds the City and the City's offrcers,
employees, and agents harmless from claims made by Developer and third parties for
damages sustained or costs incurred resulting from the Developer's obligations under this
Agreement. Developer releases the City and the City's officers, employees, and agents
from any liability in connection with this Agreement, the Plat and the development of the
Property.
25. This Agreement shall terminate upon issuance of the completion of
Developer's obligations under this Agreement. Upon written request from Developer, the
City will release, by means of a recordable document, one or more lots from all or specific
obligations of the Developer under this Agreement, provided the obligation from which
Developer seeks to be released has been fully completed in conformance with the terms of
this Agreement.
26. Theparties mutuallyrecognize and agree that all terms and conditions ofthis
Agreement shall run with the Property and shall be binding upon the respective heirs,
administrators, successors and assigns of the Developer.

MENARDS AT HANSON CONCRETE
WHEREAS, pursuant to Minnesota Statutes 462.357, the City of Apple Valley has adopted,
as Title XV of the City Code of Ordinances, to control land uses throughout the City; and
WHEREAS, pursuant to Chapter 155 of the City Code, the City Planning Commission held
a public hearing for a rezoning of property located at the northwest corner of 150th Street West
(CSAH 42) and Johnny Cake Ridge Road on July 18, 2018; and
WHEREAS, the City Planning Commission recommended its approval of a rezoning of the
subject property from “I-2” (General Industrial) to “PD” (Planned Development) that would allow
for a mix of retail, office, office/warehouse and limited industrial uses at a public meeting held on
August 15, 2018; and
WHEREAS, the City Council approved the rezoning subject property from “I-2” (General
Industrial) to “PD” (Planned Development) and Planned Development Ordinance No. 1053 on
November 15, 2018; and
WHEREAS, pursuant to Chapter 155 of the City Code and the Planned Development
agreement between the applicant and the City detailing the conditions of approval of the Menards
retail store on Lot 1, Block 1, Menards at Hanson Concrete therefore has been prepared; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Apple Valley,
Dakota County, Minnesota, the Planned Development agreement for the following described

This Final Planned Development Agreement ("hereinafter "Agreement") is made
effectiveasofthedayof-20|9,byandbetweentheCityofAppleValley
(the "City"), a Minnesota municipal corporation; and Menard, Irc., a Wisconsin corporation (the
'oowner"). The "City" and "Owner" are hereinafter collectively known as the "Parties."
WHEREAS, the City Council of the City of Apple Valley is the official governi¡g body
of the City; and
WHEREAS, the Owner is the fee owner of Lot 1, Block 1, Menard at Hanson Concrete
(the "Property"); and
WHEREAS, the Property is subject to a Preliminary Planned Development Agreement
dated November 15,2018 (the "Development Agreement") attached hereto as Exhibit A; and
WHEREAS, the Owner applied to the City for building permit authorization to construct
a 206,210 SF retail building and 48,970 SF warehouse on the Property (the "Development
Proposal"); and
WHEREAS, the City did review the Development Proposal in its entirety on November
15,2018, and did authorize the issuance of a building permit subject to conditions; and
\MHEREAS, the plans attached hereto (Exhibits A - E) are found to be in conformance
with the Development Proposal, and the Parties hereby acknowledge that this Agreement and the
attached exhibits constitute the Final Planned Development for the Property.
NOW, TIIEREFORE, it is hereby agreed to and between the Parties hereto as follows:
1. This Agreement applies only to the use of the Property.
This Agreement includes specific conditions to the Property as set forth in Exhibit
A attached hereto.
2.
The Owner shall use and develop the Property in conformance with the following
plans attached hereto as Exhibits B-8. (A full-size copy of these exhibits and any
modifications thereto shall be on file with the City's Community Development
Deparûnent.)

WAIVER OF OBJECTION TO SPECIAL ASSESSMENTS
FOR THE CITY OF APPLE VALLEY
TIDS AGREEMENT, in waiver of assessment appeal (the "Agreement") is entered by
and between the City of Apple Valley (the "City"), a Minnesota Municipal Corporation, and
Menard, Inc., a Wisconsin Corporation (the "Owner"), as of the date of its complete execution.
RECITALS
WHEREAS, the Owner is the fee owner of certain property located at 6055 - 150th
Street West, in the City of Apple Valley, PID No. 0l-02605-10-020, legally described on Exhibit
"A", attached hereto (the "Property");
WHEREAS, the City has been asked by the Owner to undertake various public
improvements that benefit the Property, (including replacement traffic signalization) at the
intersection of County State Aid Highway 42 and Johnny Cake Ridge Road, and a right turn lane
improvement on County State Aid Highway 42, as identified in City Public Improvement
Projects 2019-108 and 2019-111 (the "Projects");
WHEREAS, the City proposes to levy a special assessment on the Property, associated
with the Projects, in the estimated principal amount of $4,053,290 ("Special Assessment
Amount") payable over 5 years together with interest at the rate of 5% per year with the first
installments due and payable in 2021;
WHEREAS, the City shall procure bids for the completion of the Projects;
WHEREAS, the Special Assessment Amount is an estimate, and the actual amount shall
be determined by the City upon the completion of the Projects;
WHEREAS, the Owner agrees to accept the levy of the Special Assessment Amount;
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency
of which is hereby acknowledged, the City and the Owner hereby covenant, and agree as
follows:
1.UP FRONT PAYMENT FOR WORK. City agrees to front the costs and to publicly bid
and install the Projects that the Owner agrees benefits the Property. Owner agrees that the
benefits to the Property will be equal to or exceed the Special Assessment AIµount.
2.REPAYMENT AND ASSESSMENT. The Owner shall repay the Special Assessment
Amount through a special assessment to be levied by the Apple Valley City Council over a
period of five (5) years together with five percent (5%) interest per year on the unpaid principal
balance. The first installments shall be due and payable lr-2}2l. Owner will have the option to
pay the Special Assessment, without interest, for a period of thirty (30) days following the City's
Council levying the assessment and certiffing the assessment to Dakota County for collection.
3. Lrvv Auor¡¡¡r. The Parties agree that the Special Assessment Amount is a good

unpaid Special Assessment Amount ¡e¡¡¿ining due and payable at the time of subdivision shall
be allocated to the lot in the subdivision upon which the Menards store will be located (Lot 1 of
the proposed plat of Menards at Hanson Concrete.)

accepts the Special Assessment Amount for the Projects to be levied against the property in
repayment to the City. The Owner hereby waives the right to object or to appeal the assessment

this Agreement or if the Owner breaches this Agreement, the Owner shall reimburse the City for
all attorney's fees and costs associated with any such breach.

with the laws of the State of Minnesota.

rest of the Agreement shall be effective and remain a binding agreement.

or shall constitute a waiver of any other provision, whether or not similar, nor shall any waiver

S UM M ARY:
Attached please find the public hearing documents for the 2019 Special Assessment Roll
No. 661 for delinquent utility account charges for those properties served by utilities. T he
public hearing notices have been mailed to the affected property owners and the affidavits of
publication of the hearing notices have been received.
B AC K G RO UND :
T he process followed is to complete a certification process of delinquent accounts twice per
yea r. T his twice per year process is unusual for metro area cities, but protects the city by
accelerating the process of establishing the unpaid amounts as a lien on the property and
avoiding issues that may arise by property owners filing bankruptcy. T he certification
process also serves as the city’s “collection agency” and collection process.
T he Fall 2019 certification process started with 1,049 letters being sent A ugust 05, 2019 to
all customers who had a delinquent balance, notifying them that if the account was not paid
by August 22, 2019, the delinquent amounts would be certified for collection. Once this
payment deadline passed, a list of remaining delinquent accounts was prepared and is
included for the certification process. Following the City C ouncil calling for a public hearing,
a certification letter was sent to the delinquent account holder notifying them of the public
hearing and the proposed certification amount, which includes a $50 certification fee.
Following the public hearing on October 10, 2019 and Council adoption of the assessment
roll, property owners will have 30 days to pay at C ity offices prior to the list being certified
to the county for collection.
T he total amount of the assessment was originally $173,042.87 and represented 523
accounts. T his amount is up from the Spring 2019 certification total of $162,902.71, which
included 505 accounts. It is also higher than the Fall 2018 amount of $167,021.21 which
included 553 accounts. We have received $30,004.62 payments to date, which brings the
current balance to $143,038.25.

Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of
Apple Valley, Dakota County, Minnesota, was held at the Municipal Center in said municipality on
the 10th day of October, 2019, at 7:00 o'clock p.m.

The Finance Director presented an affidavit of publication showing publication of the
Notice of Hearing on proposed assessment roll 661 for improvements as described in said notice.
Said affidavit showed publication in the official newspaper in accordance with a resolution
heretofore adopted by the City Council, which affidavit was examined, found satisfactory and
ordered placed on file.
The Mayor announced that the meeting was open for consideration of objections, if any, to
said proposed assessment and the Mayor proceeded to conduct the hearing related to the assessment
roll. All persons were given an opportunity to present all objections and all written objections
theretofore filed with the Clerk were presented and considered and all objections were tabulated and
are attached hereto as Exhibit A.
The Mayor then declared the hearing closed.

RESOLUTION NO. 2019-
RESOLUTION APPROVING AND LEVYING SPECIAL ASSESSMENTS
WHEREAS, public hearings have been duly held this 10th day of October, 2019,
concerning the proposed assessment roll as set forth in Council Resolution No. 2019-101 with all
objections to any of said assessment having been duly noted and considered, if any.
BE IT THEREFORE RESOLVED by the City Council of the City of Apple Valley, Dakota
County, Minnesota, as follows:
1. The Assistant Finance Director has calculated the amount proper and
necessary to be specially assessed for improvements in the areas described in the legal
notice of public hearing, as set forth in Exhibit A of Resolution No. 2019-101, against every
assessable lot, piece or parcel of land affected thereby upon the basis of benefits without
regard to cash valuation in accordance with the provisions of Minnesota Statutes Annotated,
Section 429; and notice has been duly published and mailed as required by law that this
Council would meet and pass upon all objections, if any, and to amend said proposed
assessment as might be necessary; and said proposed assessment roll has at all times since
their filing been open for public inspection and an opportunity has been given to all
interested parties to present their objections, if any, to such proposed assessment.
2. This Council, having heard and considered all objections so presented and
being fully advised in the premises, finds each of the lots, pieces and parcels of land
enumerated in the proposed assessment roll, dated September 12, 2019, in the aggregate
amount of $173,042.87 subject to prepayments and adjustments during the hearing process
of $30,004.62, which changes result in a revised aggregate amount of $143,038.25, is
subject to such charges and that such amount is hereby levied against each of the respective
lots, pieces and parcels of land therein described. The Clerk is hereby directed to amend all
necessary parts of the then containing 5 pages of Assessment Roll 661, adopted for hearing
purposes by Resolution No. 2019-101 and to attach the amended assessment roll in the
amount of $143,038.25, to this Resolution as Exhibit B, now containing 5 pages.
3. The proposed assessment roll is hereby adopted and confirmed as the proper
special assessment for each of said lots. Each assessment, together with interest at the rates
set forth in Exhibit A of Resolution No. 2019-101 accruing on the full amount thereof, from
time to time unpaid, shall be a lien concurrent with one (1) year's interest on that and other
unpaid installments to be payable with the general taxes for each consecutive year thereafter
until the entire assessment is paid.
4. Prior to certification of the assessment roll to the County Auditor, the owner
of any lot, piece or parcel of land assessed hereby may, at any time, pay the whole of such
assessment with interest accrued to day of payment, to the Treasurer of the municipality
except that the entire amount may be paid within thirty (30) days hereof without interest.
5. The Assistant Finance Director shall, as soon as may be, prepare and trans-
mit to the County Auditor, a Special Assessment Input form as may be prescribed by the
County Auditor, to be extended upon the proper tax lists of the County and the County
Auditor shall thereafter collect said assessments in the manner provided by law.

Attached please find the public hearing documents for the 2019 Special Assessment Roll
No. 662 for delinquent false alarm charges. T he public hearing notices have been mailed to
the affected property owners and the affidavits of publication of the hearing notices have
been received.
B AC K G RO UND :
T he total amount of the assessment is $1,784.00 and represents false alarm charges billed by
the C ity, which includes a $50.00 administrative fee. We have not received any payments to
date. T he number of properties involved and the amounts of the charges are not consistent
from year to year. T he amount is up from the Spring 2019 assessment of $1,388.00. It is also
higher than the Fall 2018 assessment of $1,124.00.

EXTRACT OF MINUTES OF MEETING
OF THE CITY COUNCIL OF THE
CITY OF APPLE VALLEY, DAKOTA COUNTY
MINNESOTA, HELD ON OCTOBER 10, 2019
Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Apple
Valley, Dakota County, Minnesota, was held at the Municipal Center in said municipality on the 10th day
of October, 2019, at 7:00 o'clock p.m.

The Finance Director presented an affidavit of publication showing publication of the Notice of
Hearing on proposed assessment roll 662 for delinquent false alarms as described in said notice. Said
affidavit showed publication in the official newspaper in accordance with a resolution heretofore adopted
by the City Council, which affidavit was examined, found satisfactory and ordered placed on file.
The Mayor announced that the meeting was open for consideration of objections, if any, to said
proposed assessment and the Mayor proceeded to conduct the hearing related to the assessment roll. All
persons were given an opportunity to present all objections and all written objections theretofore filed with
the Clerk were presented and considered and all objections were tabulated and are attached hereto as
Exhibit A.
The Mayor then declared the hearing closed.

CITY OF APPLE VALLEY
RESOLUTION NO. 2019-
RESOLUTION APPROVING AND LEVYING SPECIAL ASSESSMENTS
WHEREAS, public hearings have been duly held this 10th day of October, 2019, concerning the
proposed assessment roll as set forth in Council Resolution No. 2019-102 with all objections to any of
said assessment having been duly noted and considered, if any.
BE IT THEREFORE RESOLVED by the City Council of the City of Apple Valley, Dakota
County, Minnesota, as follows:
1. The Assistant Finance Director has calculated the amount proper and necessary to
be specially assessed for improvements in the areas described in the legal notice of public hearing,
as set forth in Exhibit A of Resolution No. 2019-102, against every assessable lot, piece or parcel
of land affected thereby upon the basis of benefits without regard to cash valuation in accordance
with the provisions of Minnesota Statutes Annotated, Section 429; and notice has been duly
published and mailed as required by law that this Council would meet and pass upon all
objections, if any, and to amend said proposed assessment as might be necessary; and said
proposed assessment roll has at all times since their filing been open for public inspection and an
opportunity has been given to all interested parties to present their objections, if any, to such
proposed assessment.
2. This Council, having heard and considered all objections so presented and being
fully advised in the premises, finds each of the lots, pieces and parcels of land enumerated in the
proposed assessment roll, dated September 12th, 2019, in the aggregate amount of $1,784.00
subject to adjustments/prepayments during the hearing process of which there were none, is
subject to such charges and that such amount is hereby levied against each of the respective lots,
pieces and parcels of land therein described. The Clerk is hereby directed to amend all necessary
parts of the one page of Assessment Roll 662, adopted for hearing purposes by Resolution No.
2019-102 and to attach the assessment roll in the amount of $1,784.00 to this Resolution as
Exhibit B, then containing one page.
3. The proposed assessment roll is hereby adopted and confirmed as the proper
special assessment for each of said lots. Each assessment, together with interest at the rates set
forth in Exhibit A of Resolution No. 2019-102 accruing on the full amount thereof, from time to
time unpaid, shall be a lien concurrent with one (1) year's interest on that and other unpaid
installments to be payable with the general taxes for each consecutive year thereafter until the
entire assessment is paid.
4. Prior to certification of the assessment roll to the County Auditor, the owner of any
lot, piece or parcel of land assessed hereby may, at any time, pay the whole of such assessment
with interest accrued to day of payment, to the Treasurer of the municipality except that the entire
amount may be paid within thirty (30) days hereof without interest.

5. The Assistant Finance Director shall, as soon as may be, prepare and transmit to
the County Auditor, a Special Assessment Input form as may be prescribed by the County
Auditor, to be extended upon the proper tax lists of the County and the County Auditor shall
thereafter collect said assessments in the manner provided by law.

removal charges, in the amount of $3,075.74, minus any prepayments.
S UM M ARY:
Attached please find the public hearing documents for the 2019 Special Assessment Roll
No. 663 for delinquent tree removal charges. T he public hearing notices have been mailed to
the affected property owners and the affidavits of publication of the hearing notices have
been received.
B AC K G RO UND :
T he total amount of the assessment is $3,075.74 and represents tree removal charges
incurred by the City, which includes a $50.00 administrative fee. T he number of properties
involved and the amounts of charges are not consistent from year to year.

EXTRACT OF MINUTES OF MEETING
OF THE CITY COUNCIL OF THE
CITY OF APPLE VALLEY, DAKOTA COUNTY
MINNESOTA, HELD ON OCTOBER 10, 2019
Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Apple
Valley, Dakota County, Minnesota, was held at the Municipal Center in said municipality on the 10th day
of October, 2019, at 7:00 o'clock p.m.

The Finance Director presented an affidavit of publication showing publication of the Notice of
Hearing on proposed assessment roll 663 for delinquent tree removal charges as described in said notice.
Said affidavit showed publication in the official newspaper in accordance with a resolution heretofore
adopted by the City Council, which affidavit was examined, found satisfactory and ordered placed on file.
The Mayor announced that the meeting was open for consideration of objections, if any, to said
proposed assessment and the Mayor proceeded to conduct the hearing related to the assessment roll. All
persons were given an opportunity to present all objections and all written objections theretofore filed with
the Clerk were presented and considered and all objections were tabulated and are attached hereto as
Exhibit A.
The Mayor then declared the hearing closed.

RESOLUTION NO. 2019-
RESOLUTION APPROVING AND LEVYING SPECIAL ASSESSMENTS
WHEREAS, public hearings have been duly held this 10th day of October, 2019, concerning the
proposed assessment roll as set forth in Council Resolution No. 2019-103 with all objections to any of
said assessment having been duly noted and considered, if any.
BE IT THEREFORE RESOLVED by the City Council of the City of Apple Valley, Dakota
County, Minnesota, as follows:
1. The Assistant Finance Director has calculated the amount proper and necessary to
be specially assessed for improvements in the areas described in the legal notice of public hearing,
as set forth in Exhibit A of Resolution No. 2019-103 against every assessable lot, piece or parcel
of land affected thereby upon the basis of benefits without regard to cash valuation in accordance
with the provisions of Minnesota Statutes Annotated, Section 429; and notice has been duly
published and mailed as required by law that this Council would meet and pass upon all
objections, if any, and to amend said proposed assessment as might be necessary; and said
proposed assessment roll has at all times since their filing been open for public inspection and an
opportunity has been given to all interested parties to present their objections, if any, to such
proposed assessment.
2. This Council, having heard and considered all objections so presented and being
fully advised in the premises, finds each of the lots, pieces and parcels of land enumerated in the
proposed assessment roll, dated September 12th, 2019, in the aggregate amount of $3,075.74
subject to prepayments during the hearing process of $0.00, which results in an unchanged
aggregate amount of $3,075.74, is subject to such charges and that such amount is hereby levied
against each of the respective lots, pieces and parcels of land therein described. The Clerk is
hereby directed to amend all necessary parts of the one page of Assessment Roll 663, adopted for
hearing purposes by Resolution No. 2019-103 and to attach the assessment roll in the amount of
$3,075.74 to this Resolution as Exhibit B, then containing one page.
3. The proposed assessment roll is hereby adopted and confirmed as the proper
special assessment for each of said lots. Each assessment, together with interest at the rates set
forth in Exhibit A of Resolution No. 2019-103 accruing on the full amount thereof, from time to
time unpaid, shall be a lien concurrent with one (1) year's interest on that and other unpaid
installments to be payable with the general taxes for each consecutive year thereafter until the
entire assessment is paid.
4. Prior to certification of the assessment roll to the County Auditor, the owner of any
lot, piece or parcel of land assessed hereby may, at any time, pay the whole of such assessment
with interest accrued to day of payment, to the Treasurer of the municipality except that the entire
amount may be paid within thirty (30) days hereof without interest.

5. The Finance Director shall, as soon as may be, prepare and transmit to the County
Auditor, a Special Assessment Input form as may be prescribed by the County Auditor, to be
extended upon the proper tax lists of the County and the County Auditor shall thereafter collect
said assessments in the manner provided by law.
