CITY OF APPLE VALLEY
SEPTEMBER 20, 1989
1. CALL TO ORDER
The September 20, 1989 meeting of the Apple Valley Planning
Commission was called to order by Chairman Robert Erickson at 7:32 p.m. in
the City Council Chambers of the City of Apple Valley City Hall.
Members Present: Chairman Erickson, Members Carlson,
Felkner, Weldon, Kleckner, Sterling and
Gowling.
Members Absent: None.
Staff Present: Richard Kelley, Meg McMonigal, Kurt Chatfield,
Dennis Welsch, and Dennis Miranowski.
Others Present: See the sign -in sheet.
2. APPROVAL OF THE AGENDA
The agenda was approved as submitted.
3. APPROVAL OF THE MINUTES OF SEPTEMBER 6, 1989
The minutes of September 6, 1989 meeting were approved with the
following corrections: page 3, paragraph 2, a new paragraph should be
inserted prior to the motion and should read "It was pointed out that the
proposed zoning would be in conflict with the proposed comprehensive plan
designation, thus perpetuating the situation the City is attempting to
correct." The second correction is on page 2, paragraph 3, which should
read, "Member Kleckner stated that the Coady North site is a tough piece
to gain access to and noted that he owns the adjacent residential lot. He
suggested that access to this site might be easier from the east."
With the two corrections mentioned above, the minutes were approved
6 - 0 with Member Gowling abstaining.
4. CONSENT AGENDA (One motion sends items needing no discussion on to
the City Council with the staff recommendations.
A. Size Variance for Accessory Building in a R -1A Zone
LOCATION: 12199 Galaxie Avenue
PETITIONER: John Grimm (PC89- 063 -V)
MOTION: Member Felkner moved, seconded by Member Carlson, to
approve a size variance for an accessory building in an "R1 -A" zone
located at 12199 Galaxie Avenue for John Grimm (PC89- 063 -V1, with staff
recommended conditions attached. The motion carried unanimously.

B. Sign Variance
LOCATION: 140th & Pilot
PETITIONER: Keith Carlson
for Brooks Food Market
Knob Road
(PC89- 061 -V)
MOTION: Member Felkner moved, seconded by Member Carlson, to
recommend approval of a sign variance for the Brooks Food Market located
at 140th and Pilot Knob Road as requested by Keith Carlson (PC89- 061 -V),
as per the City Planning Staff report and recommendations. The motion
carried unanimously.
5. PUBLIC HEARINGS
None.
LAND USE /ACTION ITEMS
A. Residential Parking Revisions to Zoning Code
PETITIONER: City of Apple Valley (PC89- 044 -Z)
STAFF REPORT: September 12, 1989 by Associate Planner Scott Hickok
Community Development Director Dennis Welsch presented a background
report and illustrations of three different versions of the revisions to
residential parking requirements. The first illustration was the present
ordinance, the second represented a recommendation from the Urban Affairs
Committee dated September 1, 1989, and the third was a recommendation
submitted by the Planning and Building Staff dated September 12, 1989.
The staff recommendations were made in response to the Urban Affairs
Committee recommendations and requested the Planning Commission to adopt
an ordinance which reduce administrative problems. The staff would
recommend the deletion of portions of the proposed code which would
require a paving permit and require parking pavement to be set back a
least 5 feet from any property line. The staff recommended this
alternative because of the number of preexisting parking slabs in the
community and because of the cost of inspecting each new slab. The staff
suggested that such a permit process may be counter - productive with
homeowners simply avoiding the permit, or claiming the surface had been
installed prior to the code amendment.
A general discussion among the Planning Commission members ensued
regarding the need to define the specifications for a gravel parking area.
MOTION: Member Carlson moved, seconded by Member Weldon, to
recommend approval of amendments to the parking requirements to the zoning
code as per the staff recommendation of September 12, 1989 with the
condition that crushed rock of a minimum I inch in diameter size be
utilized in parking spaces where an impervious surface was not required.

In addition, the staff was to prepare specifications for the depth,
containment, and weed retardant, or mulch, as well as requiring a maximum
grade for such crushed rock areas of ten percent. The motion carried
unanimously.
B. Neighborhood Center - Zoning
PETITIONER: City of Apple Valley (PC89- 058 -Z)
STAFF REPORT: September 20, 1989 by Community Development
Director Dennis Welsch
Community Development Director Dennis Welsch presented information
which explained additional requirements requested by the Planning
Commission at their September 6th meeting. Those requirements included a
more clear and concise definition of Class 1 and Class 2 restaurants and
the insertion of a conditional use permit process for businesses, which
would operate in hours beyond those established in the ordinance. In
addition, the staff pointed out that, as per the Planning Commission
direction, no Class 2 fast -food restaurant will be aloud in a NC zone.
A general discussion ensued. The staff recommended that the Class 1
restaurant definition be amended to read "Traditional Restaurant: an
eating facility where full waitress /waiter table service is provided
whereupon a customer orders food from printed menus, and the main food
course is served and consumed while seated at a single location. In
addition, a Class 1 restaurant shall not be prohibited by law or private
restricted covenant or otherwise, from obtaining a full liquor license.
Such restaurants also have dining areas with formal or semi - formal decor
and appointments utilizing traditional or reusable food utensils, plates,
cups, and glasses. A traditional restaurant may provide additional
incidental services, such as food delivery and retail over - the - counter
prepared food sales."
In addition, the Planning Commission requested that within the
definition of a Class 2 restaurant one of the criteria defining a Class 2
restaurant should read "drive -in or drive -thru window service in which the
majority of the customers consume their food in an automobile or off -
premises."
MOTION: Member Gowling moved, seconded by Member Carlson, to
recommend approval of the corrected definition of Class 1 and Class 2
Restaurants and the Neighborhood Center Performance criteria amendments to
the zoning code. The motion carried unanimously.

7. DISCUSSION ITEMS (Verbal Reports)
A. 017 - Domestic /Calistro - Zoning
LOCATION: North of 140th Street and West of Cedar Avenue
PETITIONER: City of Apple Valley (PC89- 051 -Z)
STAFF REPORT: September 20, 1989 by Community Development
Director Dennis Welsch
Community Development Director Dennis Welsch explained the progress
in meeting with representatives from Domestic Realty regarding their
parcel, and the need to clarify the issues which have been objectionable
to adjoining neighbors west of the Domestic site. Those issues include
creating a buffer between the single- family homes and any higher density
uses, as well as creating a north /south roadway system which will reduce
or eliminate the need for residents of the Domestic project to utilize
Pennock Avenue between 140th and 138th Streets to the greatest degree
possible. A general discussion ensued regarding the need to rezone this
parcel after the Planning Commission and Council have adopted a new multi-
family and residential zoning district definitions. No action was taken
on this item.
OTHER BUSINESS
A. Southport Centre (Ryan Construction Site Plan Review)
City Planner Richard Kelley provided an update of the Ryan Southport
Centre project illustrating new building elevations and layouts for the
proposed Target store. No action was taken.
B. Joint Meeting Tentatively Scheduled for October 19, 1989
October 19th had tentatively been set for a joint meeting between the
Planning Commission, Park Committee, and City Council. It appears that a
meeting in early November would allow more members of the Park Committee
and Planning Commission to attend. No action was taken.
C. Distributions of Citizen's Guide
Associate Planner Meg McMonigal distributed copies of the revised and
reprinted Apple Valley Citizen's Guide (June 1989).

Two members of the Planning Commission had asked for any direction
the Planning Commission might have on how to make these guides available
to citizens throughout the community. The Planning Commission asked the
staff to provide copies of the Citizen's Guide to the Comprehensive Plan
at the door when a Planning Commission meeting is to be held.
In addition, the staff is to prepare a press release for the two
local papers explaining what a Comprehensive Plan is and noting that the
Citizen's Guide to the Comprehensive Plan is available at City Hall. The
staff will see that a short article is placed in the upcoming City
newsletter sent to all property owners. The staff will distribute copies
of the Citizen's Guide to the Comprehensive Plan to each of the locations
where real estate subdivision sales boards are currently available within
the community. In addition, the staff will work with members of the
banking community to distribute copies of the Citizen's Guide with a note
that citizens may pick up their individual copies at City Hall. No action
was taken.
D. Other
Chairman Erickson noted for the record that he had received a letter
from Merlin Anderson, 307 Cimarron Road, expressing his concern regarding
the Galles Subdivision. Chairman Erickson asked that the letter be placed
on file and that members of the staff utilize the letter in their review
of the project.
The meeting adjourned at 8:27 p.m.

meeting which included the following items:

I. Status of Zoning Consistency Program
The informal meeting adjourned at 9:50 p.m.
