SUMMARY: The minutes of the regular Economic Development Authority meeting are attached for your review and approval. BACKGROUND: State statute requires the creation and preservation of meeting minutes which document the official actions and proceedings of public governing bodies. BUDGET IMPACT: N/A ATTACHMENTS: Minutes ECONOMIC DEVELOPMENT AUTHORITY City of Apple Valley Dakota County, Minnesota September 26, 2019 Minutes of the special meeting of the Economic Development Authority of Apple Valley, Dakota County, Minnesota, held September 26, 2019, at 6:15 p.m., at Apple Valley Municipal Center. PRESENT: Commissioners Bergman, Goodwin, Grendahl, Hamann -Roland, Hooppaw and Johnson. ABSENT: Melander City staff members present were: Executive Director Tom Lawell, Community Development Director Bruce Nordquist, Finance Director Ron Hedberg and Department Assistant Joan Murphy. Meeting was called to order at 6:15 p.m. by President Hooppaw. APPROVAL OF AGENDA MOTION: of Goodwin, seconded by Grendahl, approving the agenda. Ayes - 5 - Nays - 0. CONSENT AGENDA MOTION: of Hamann -Roland, seconded by Grendahl, approving the minutes of the meeting of July 25, 2019, as written. Ayes - 5 - Nays - 0. Commissioner Bergman arrived at 6:17 p.m. PRELIMINARY 2020 EDA BUDGET Finance Director Ron Hedberg stated the proposed 2020 budget, approved by the City Council in their annual budget, includes the Economic Development Operations Fund. The proposed budget includes the anticipated activities in 2020. If the need arises to address development opportunities, such as Business Retention, Expansion and Attraction (BREA) activities, future action would be requested to address the need. He reviewed the budget documents that relate to this fund and its use by the EDA. Discussion followed. No action on this item was taken. CLOSE MEETING - ATTORNEY-CLIENT PRIVILEGE MOTION: of Hamann -Roland, seconded by Grendahl, to enter into a closed meeting and convene in closed session to discuss the interest in acquiring property at 5751 — 150th Street W. Ayes - 6 - Nays - 0. The closed meeting took place in the Regent Conference Room at 6:33 p.m. In attendance were President Hooppaw, Commissioners Bergman, Goodwin, Grendahl, Hamann -Roland and Johnson; City Administrator Lawell, City Attorney Dougherty, Community Development Director Nordquist, Finance Director Ron Hedberg and Department Assistant Murphy. The meeting was tape recorded as required by law. December 26, 2019 Regular Agenda Description: Zvago Update Staff Contact: Bruce Nordquist, Community Development Director, Al CP Department / Division: Community Development Department ACTION REQUESTED: Discussion only. SUMMARY: During the last 5 years, the EDA and City have partnered with Village Pointe Plaza at the "triangle" site. By being awarded a $1.1 million Livable Communities grant from the Metropolitan Council, the City successfully responded to a tax forfeiture by a prior owner/developer and proceeded with a private/public partnership for a mixed use development at the strategic center of the Central Village. Dakota County sold the land to the City in lieu of foreclosure for the stated amount which allowed the EDA to establish a development strategy with Village Pointe Plaza (Tim Nichols), OneTwoOne (Tim Nichols and Ecumen) and Zvago, the recently completed active living senior cooperative. Site planning included the 58 -unit cooperative, to be followed by the addition of approximately 30,000 sq. ft. of commercial property along Galaxie Avenue. Zvago was completed this year and only one unit remains to be sold. There have been multiple conversations to date with brokers, businesses and developers to proceed on the commercial portion of the triangle. Staff and the development partners recognize that in the absence of completing the commercial portion, there is a performance default. Legal Counsel has notified the parties, Village Pointe Plaza, OneTwoOne Development and Zvago Cooperative as final cost certifications related to Zvago are now being completed. The notice recognizes obligations that direct resources back to the EDA and the City if the default is not promptly addressed. Staff has taken the approach to continue working with the development partners while making sure resources due to the EDA and City are withheld and remain secure. In turn, new marketing efforts are planned by Village Pointe Plaza to identify commercial users for the remainder commercial parcel. BACKGROUND: N/A BUDGET IMPACT: N/A ... .... .....
