Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held September 24, 2020, at 7:00 o'clock p.m., at Apple Valley Municipal Center.
PRESENT: Mayor Hamann-Roland; Councilmembers Bergman, Goodwin, Grendahl, and
, Hooppaw.
ABSENT: None.
City staff inembers present were: City Administrator Lawell, City Clerk Gackstetter, City
Attorney Dougherty, City Engineer Anderson, IT Manager Bang, Police Captain Dahlstrom,
Police Captain Francis,Assistant City Administrator Grawe, Finance Director Hedberg,
Community Development Director Nordquist, Police Chief Rechtzigel, Fire Chief Russell, and
Public Works Director Saam.
Mayor Hamann-Roland called the meeting to order at 7:00 p.m. Everyone took part in the
Pledge of,Allegiance to the flag.
APPROVAL OF AGENDA
MOTION: of Hooppaw, seconded by Bergman, adding item S.0 -Authorize Payment to
Apple Valley Chamber of Commerce for COVID-19 Relief,to the regular
agenda, and approving the agenda for tonight's meeting, as amended. Ayes - 5 -
Nays - 0.
AUDIENCE
Mayor Hamann-Roland asked if anyone was present to address the Council, at this time, on any
item not on this meeting's agenda.
Mr. Mike Lueck, 927 Garden View Drive, presented the Council with a petition containing 107
signatures requesting permanent stop signs on Garden View Drive at Baldwin Drive.
Discussion followed.
NIr. Anderson said he does not recommend stop signs and strobe lights at the same intersection.
The Council agreed to leave the temporary stop sigris in place until the traffic study is complete.
CONSENT AGENDA
Mayor Hamann-Roland asked if the Council or anyone in the audience wished to pull any item
from the consent agenda. There were no requests.
MOTION: of Bergman, seconcled by Goodwin, approving all items on the consent agenda
with no exceptions. Ayes - 5 -Nays - 0.

Valley Amer-ican Legion, Post 1776, in connection with the On-Sale 3.2 Percent
Malt Liquor and Wine Licenses at 14521 Granada Drive, naming LeeAnn

MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2020-111
establishing tlie precinct boundaries and polling places for the 2020 General .

appointing individuals listed in the resolution to serve as election judges and/or
election officials for the General Election to be held on November 3, 2020, in the

MOTION: of Bergman, seconded by Goodwin, approving the release of fmancial guarantees
for Nuvelo—Bigos Kelley Park Block 1 and Nuvelo—Bigos Kelley Park Block 2,
and the reduction of financial guarantees for Menards at Hanson Concrete (2019-
� 109) from$2,929,613.00 to $2,067,575.00 and Menards at Hanson Concrete
(2019-107) from$2,576,250.00 to $1,084,576.00, as listed in the Community
Development Department Assistant's memo. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, tabling consideration of item 4.F -
Applewood Pointe of Apple Valley to October 8, 2020. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, adopting Resolution No.2020-113 accepting
easements for Project 2020-101, 2020 Street and Utility Improvements. Ayes - 5
-Nays - 0.
MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2020-114
approving the amendment to Orchard Place Addition preliminary subdivision,
with conditions as recommended by the Planning Commission. Ayes - 5 -Nays -
0. .
MOTION: of Bergman, seconded by Goodwin, approving the�VV�aiver of Objection to Special
Assessments, with Rockport, LLC, for construction of public infrastructure
relating to Project 2020-136, Orchard Place Utility Improvements, and
authorizing the 1Vlayor and City Clerk to sign the same. Ayes - 5 -Nays - 0.

easements for Project 2020-136; Orchard Place Utility Improvements. Ayes - 5 -

MOTION: of Bergman, seconded by Goodwin, adopting Resolution No. 2020-116 awarding
the agreement for Project 2020-136, Orchard Place Utility Improvements,to
� McNamara Contracting, Inc.,the lowest responsible bidder, in the amount of
$663,544.00. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, approving first Amendment to Joint Powers
Agreement with Black Dog Watershed Management Organization, extending the
agreement through January 1, 2030, effective upon approval of each member
, City, as attached to the Water Resource Specialist's memo, and authorizing the
Mayor and City Clerk to sign the same. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, approving Change Order No. 1 to the
agreement with McNamara Contracting, Inc., for Project 2019-108, County Road
42 Johnny Cake Ridge Road Improv.ements, in the amount of an additional
$41,616.21. Ayes - 5 -Nays - 0. �
MOTION: of Bergman, seconded by Goodwin, approving Change Order No. 1 to the
�. agreement with Building Restoration Corporation, with a deduction of
$18,800.00; and accepting Project 2019-164, Apple Valley Community Center
Masonry Restoration and Grade Repair, as complete and authorizing final
payment in the amount of$54,354.00. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, approving Change Order No. 1 to the
agreement with Budget Sandblasting and Painting, Inc., in the amount of an
additional $1,984.00; and accepting Project 2020-124, 2020 Fence & Light Pole
Reconditioning Services, as complete and authorizing final payment in the
amount of$32,067.98. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, accepting Project 2019-163, Well Pumps 6,
11, 20, and Low Zone Pump 4, as complete and authorizing final payment on�the
agreement with Keys Well Drilling Company, in the amount of$7,366.75. Ayes -

MOTION: of Bergman, seconded by Goodwin, approving the personnel actions as listed in
� the Personnel Report dated September 24, 2020. Ayes - 5 -Nays - 0.
MOTION: of Bergman, seconded by Goodwin, approving the claims and bills, check
registers dated September 2, 2020, in the amount of$3,085,353.64, and
September 9, 2020, in the amount of$955,869.32. Ayes - 5 -Nays - 0.

PROCLAIM"FIRE PREVENTION WEEK"
Fire Chief Russell said every year the Natiorial Fire Protection Association and Fire Departments
' nationwide recognize Fire Prevention Week. The educational theme for 2020 is "Serve Up Fire
Safety in the Kitchen!". He then read the proclamation.
MOTION: of Grendahl, seconded by Hooppaw,proclaiming October 4-10, 2020, as "Fire
, Prevention Week" in support of the Fire Department's public safety efforts and
urging all citizeris to install smoke alarms and to plan and practice fire drills.
Ayes - 5 -Nays - 0.
, Fire Chief Russell said the Fire Department is creating videos that will be posted on the website 1
and given to the schools for Fire Prevention Week.
PROCLAIM"GARY EMBRETSON DAY"
Mr. Lawell introduced this item and shared photos honoring Gary Embretson, former Apple
Valley High School Principal, who recently passed away.
Mayor Hamann-Roland then read the proclamation proclaiming September 24, 2020, as"Gary
Embretson Day in the City.of Apple Valley".
MOTION: of Goodwin, seconded by Grendahl,proclaiming September 24, 2020, as "Gary
Embretson Day in the City of Apple Valley" in recognition of his achievements at
Apple Valley High School. Ayes - 5 -Nays - 0. �
Councilmember Gooclwin and Mayor Hamann-Roland recalled special memories they have of
Mr. Embretson and commented on the impact he has had and will continue to have on the
cominunity.
Mr. Embretson's daughter, Sigrid, and wife, Jan, shared stories and said they were deeply moved
and thanked the Council for honoring their loved one with the proclamation.
CONVENTION &VISITORS BUREAU
Mr.Nordquist said at the Economic Development Authority earlier this�evening, members ,
adopted a motion recommending the City Council allocate additional resources to the Chamber
of Commerce due to COVID-19. �

MOTION: of Hamann-Roland, seconded by Hooppaw, authorizing payment of$10,000.00
from the City of Apple Valley Lodging Tax Special Revenue Fund to the Apple
Valley Chamber of Commerce for COVID-19 relief. Ayes - 5 -Nays - 0.
COMMUNICATIONS ,
Mayor Hamann-Roland thanked the Election staff for all the work they are doing. �-

Mr. Lawell said an electric vehicle charging station is now available for City and public use at
the Municipal Center. Mayor Hamann-Roland noted Apple Valley was the first green Municipal
Center in the State of Minnesota.
Councilmember Grendahl asked if there is a policy regarding use of cable equipment and staff.
� Mr. Lawell distributed the Guidelines and Policies for Programming on the Apple Valley,
Farmington, and Rosemount Cable Commission dated February 21, 2007.
Discussion followed.
The Council directed staff to add this topic on an informal agenda in the future for further
discussion.
Mr. Lawell said the letter the Council requested addressed to the Metropolitan Council regarding
the Cedar Avenue Red Line Bus Rapid Transitway has been prepared.
MOTION: of Grendahl, seconded by Goodwin, approving the letter to the Metropolitan
Council and authorizing the Council to sign the same. Ayes - 5 -Nays - 0.
Mr. Lawell also recognized the Election staff for their work over the past several weeks.
Mr. Saam said Public Works staff touched up the medians on Cedar Avenue with new plantings
and mulch.
CALENDAR OF UPCOMING EVENTS
MOTION: of Bergman, seconded by Grendahl, approving the calendar of upcoming events
as included in the Deputy City Clerk's memo, and noting that each event listed is
hereby deemed a Special Meeting of the City Council. Ayes - 5 -Nays - 0.
MOTION: of Grendahl, seconded by Goodwin, to adjourn. Ayes - 5 -Nays - 0.
