PLANNING COMMISSION MINUTES
April 6, 1988
Minutes of the meeting of the Apple Valley Planning Commission held Wednesday,
April 6, 1988, at 7:30 p.m. at the Apple Valley City Hall.
PRESENT: Chairperson Robert Erickson; Commission Members Richard Carlson, Alan
Felkner, Marcia Gowling, Frank Kleckner, Virginia Sterling;
Staff Members
Dennis. Welsch, Rick Kelley, Meg McMonigal, Keith Gordon, Dick

Chairperson Erickson called the meeting to order at 7:35 p.m.
2.
Approval of Agenda.
Mr. Kelley indicated that Item 6 should be withdrawn from the
AGENDA
agenda at the request of the Petitioner.

Public Hearing for Amendment to Shoreland Zoning Standards.
PH AMENDMEt
Chair Erickson opened the Public Hearing with the standard SHORELAND
opening remarks. Ms. McMonigal presented the changes included ZONING
in the Amendment to Shoreland Zoning Standards. The Department STANDARDS
of Natural Resources has indicated these changes are acceptable.
Discussion centered around the "zone on zone" district, lot provisions,
and the high water points of the three lakes involved -- Alimagnet, Moeller,
and Farquhar Lakes.
Speaking from the Public:
1. Mr. Ed Holmes, 8921 138th St. Ct., AV: asked if the changes would be
retroactive and was told the changes would be in effect when the
revisions were officially passed. (If the Apple Valley apartment project
is approve, it would have to be in compliance with the revised standards.
2. Mr. Albert Hoff, 12969 Diamond Path, AV: was told that a one -acre lot
(43,000 ,sq. ft.) would be in compliance with the requirement regarding a
substandard lot.
Chair Erickson closed the Public Hearing with the standard closing remarks.

revisions to Apple Valley's "SH" Shoreland Zoning District.

5. Public Hearing for Rezoning and Preliminary Plat for Huntington

Preliminary Plat of Huntington 2nd Addition - -a mixed residential development
containing 111 single - family lots, 61 townhouse units, and 156 condominium
apartment units (328 total units).
Mr. Gordon indicated that sanitary sewer would be extended from Pilot Knob Road
through the property which appears as an exception in the southeast corner of thf
plat (requiring an easement); water would be extended from Pilot Knob Road;
storm sewer would drain into the pond (in the southeast corner exception area
owned by the Petter family) which connects to Farquhar Lake via a 27" culbert.
Mr. Gordon indicated the need to replace the old culvert connecting this pond
to Farquhar.
Reagarding park dedication - -Mr.. Kelley indicated that the Park Committee just
met on April 5 and their recommendation is to receive "cash in lieu of land"
since the majority of the land recommended for a park site is under water.
Also, there is .existing park development on the east side of Pilot Knob Road.
The developer indicated this decision by the Park Committee would add about
six lots to their proposed development. The City will accept the pond on this
site as ana.outlot. The major access would be along the north, CR 1138. The
road in Huntington is designed to line up with the ultimate elevation of CR 1138
and would probably become a signalized intersection.
The petitioner, Mr. Wayne Tauer of Pioneer Engineering, explained the types of
units planned for this project. He indicated that some of the elements from
Huntington lst Addition are being brought "into "this project. The condo units
will be slightly larger than the townhouse units, and some of the amenities
found in single family houses /yards are included. Mr. Kleckner complimented
Mr. Tauer on his project in Brooklyn Park which is along the same line as the
proposed AV project. Ms. Cowling complimented him on the landscape plan and
liked the transition between the high density dwellings and the single family
units.
Speaking from the Public:
1. Mr. Gene Tousignant, 12669 Pilot Knob Rd., AV: indicated that he owns a
portion of the exception area and asked if he could be included in the
road going through the project and the ability to 'hook up' to utilities.
He questioned the level the pond would be maintained and was told that the
current level is a 7' bounce during a severe storm. Mr. Tousignant said
that there is a "wetland" on the back of his property that has never been
wet in the 20 years he has been at that location, and requested that no wat
be backed up to it - -this was.farmed at one time.
2. Mr. Albert Hoff, 12969 Diamond Path Rd., AV; was told that all water was
going to drain to Farquhar Lake. Mr -. Gordon explained that the new pumping
system for the Lake was been bid and will probably be installed in October.
Mr. Hoff expressed concern in the Speed Limit - -50 mph on one side of Diamon
Path and on other side 30 mph - -he requested that the speed limited be
reduced at least one -half mile along Diamond Path Rd. just before intersect
with Pilot Knob Rd. He cited examples of animals killed and expressed
concern that next time it could be a human killed because of speed and the
lack of sidewalks. Mr. Hoff indicated that he suffered severe damage when
the rains of 1987 (summer) caused extenseive damage to his yard - -he indicat
he has had to take legal action against Pioneer Engineering and the Rotlunc
Company because of the lack of response to his concerns over resolving the
damage caused by the washing of soils from Huntington 1 Addition.
Mr. Tauer explained that Pioneer Engineering is presently in litigation
regarding this matter which was turned over to their insurance company whi<
has "free rein" to settle. Discussion ensued as to the errosion controls
which were in place, the severity of the storm, etc.

Regarding the issue of speed, it would be appropriate for the City to
request that a speed study on the portion of the road be done by Dakota
County. Mr. Carlson indicated that it would be appropriate for Mr. Hoff
to appear before the City Council to indicate the need for a speed study.
3. Mr. Byron Huseby, 4805 Dominica Way, AV: asked about the proposal to
control sedimentation because of a 7' loss in the lake and was told
of the plan to install new pipe which along with the pumps would help to
control this problem. No water from the proposed development will go
directly into Farquhar Lake.
4. Mr. James R. Lohmann, 12959 Diamond Path. W., AV: indicated that he is
mainly concerned about the flow of water into Farquhar Lake so that the
same mistake is not made again by not having adequate storm sewer in
place with the land being completely stripped. Mr. Gordon indicated there
would be a considerable amount of storm sewer in place. Mr. Lohmann asked
about the grading plan, the storm sewer plan, whether the streets would be
paved by the City or private contractor, etc.- Mr. Gordon indicated that
the water in Long Lake would be raised 2 to 22' and that this is probably
not the last planned development for this watershed. Mr. Lohmann said that
the level of Farquhar Lake is rising - -he is losing land according to a marke
that he placed 15' from the corner of his property. He is also distressed
over the number of dead fish. Mr. Ling indicated that the level of the
lake is the point that they try to keep it all summer so that it will not
become too low. This 12" rainfall in 3 days was definitely unusual Mr. Ling
pointed out to Mr. Lohmann.
5. Mr. Doug Williams, 12886 Essex Way, AV: indicated that the residents in his
area are in the process of forming a homeowners association because of this
development. They are basically concerned about property values, and the
elevation of the eastern most side lots. He indicated they have beautiful
view of Farquhar Lake at this time and is concerned that this development
will "break down": their view. The added population in this area is also
a major concern.. He indicated their desire to talk with the developer so
that an understanding of the proposal could be determined. Ms. Cowling
indicated that she felt the project seems to be a low profile two -story
group of units and that there are no 3 -4 story apartment buildings proposed.
Mr. Carlson asked if home owners in that area had checked with the City
to find out what was planned in that area before purchasing their homes.
6. Mr. Bill Jackson, 12892 Essex Way, AV: expressed concern over the numbers
of school children coming from Essex Way to Diamond Path for the school bus.
The AV Police are there with radar; there is a high concentration of people
there already.
Mr. Kelley indicated that he could provide estimated traffic counts and
how the anticipated increase in traffic compares with the design of the roar
When Pilot Knob Road is widened, this will provide some relief.
Ms. Sterling expressed concern over the children in this area and their
need for a park - -she wondered if eventually there would be a sidewalk to
at least aid them in reaching the park in Huntington 1- -there should be
a provision for getting these children safely across Pilot Knob Rd.
7. Ms. Linda Merick expressed concern over the schools and was told how studies
are done.
8. Ms. Kim Dally, 12840 Essex Way, AV.: indicated that the proposed townhomes
will cut off their view of the lake, the increased density, and the need
for a park.

9. Mr. Mark R. Gilligan, 12834 Essex Way, AV: indicated they would be
overlooking a tar paper and asphalt jungle.
10. Mr. Greg Brown, 13826 Eveleth Ct., AV: requested that Apple Valley
not become a part of the Eagan syndrome of building expensive homes next
to townhomes. He feels there is not a need for the high density in this
area; it does not seem desirable.
Mr. Kelley explained the overall need in the City to provide for a variety of
housing .needs at various locations.
Mr. Felkner indicated that it is in the developer's best interest to not build
large homes at the intersection of major roads especially in view of the fact the
30 +7 of a home is the value of the land.
Ms. Sterling indicated that she would like to see the final plat with the new
cul de sacs, etc.

The neighbors should be made aware of the /pgans w ich the petitioner has for thie
area and meet with them to .discuss concerns.
Letter received from David and Patricia Evans indicating their views is noted.

7. Continuation of Public Hearing for Capital Improvements Plan.

Mr. Kelley requested that this hearing be continued until IMPROVEMENTE
the April 20, 1988 meeting. PLAN- -CONT.

the Public Hearing for Capital Improvements Plan until the
April 20, 1988 meeting.

8. Discuss Comprehensive Plan Update.
Mr. Dennis Welsch indicated that there will be efforts made to COMP PLAN
assess strengths. /weaknesses.. of the City by way of Comprehensive
UPDATE
Plan Review and Updates Procedures. For example, a concise message regarding
land use should be included in the City's newsletter to begin an education
process of the citizens. (Mr. Welsh will provide a draft of the newsletter
at the April 20 meeting.) The April 13 work meeting will focus on sand and
gravel operations.
9. Other Items.
None were reported.
